RESOLUTION
Approving Special District Final Development Plan No. CD2020-001SD, for a 7360
square foot Anytime Fitness development with 26 parking spaces, located at 4181
31st Avenue NW.
WHEREAS, the project is being proposed through the Arboretum Special District process
identified in Ord. 2247; and,
WHEREAS, the Council adopts staff findings as described in the staff report dated August
13, 2020, and finds the proposal meets the regulations in R.C.O. § 62.708 (subd. 3)
Conditional Use Permit Restricted Development Final Plan.
WHEREAS, on August 12, 2020, the City of Rochester Planning Commission held a public
hearing to consider this application, and adopted the findings of fact and recommended
approval subject to conditions one through six proposed by the Planning Department.
WHEREAS, on August 31st, 2020, the City of Rochester Common Council held a public
hearing to consider this application and adopted the findings of fact and recommended
approval subject to conditions one through six.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester
that, based upon the above-stated findings of fact, the Applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria subject to the imposition of the below-stated six conditions of approval.
BE IT FURTHER RESOLVED that the City approve Special District Final Plan No. CD2020-
001SD, requested by Joe Jewison, subject to the conditions of approval shown below.
CONDITIONS
1. Prior to issuance of building permits, a revised Final Site Plan shall incorporate the
following revisions:
a. Revisions to the zoning summary table showing a total proposed building area
consistent with the building area shown on the site plan.
b. Revisions to the zoning summary table Proposed Floor Area section to list the total
area dedicated to each use (eg. 6,000SF Personal Service Area).
c. Revisions to the zoning summary table to show six boulevard trees required along
31st Ave NW, instead of 10.
d. Revisions to the zoning summary table to show the total number of proposed parking
spaces, not the number of proposed handicap parking spaces.
e. Revisions to the zoning summary table to include the hours of operation that this use
will be operated by staff, consistent with the approved Special District.
f. Revisions to the zoning summary table and site plan that identify the proposed front
yard, interior side yard, side street side yard, and rear yard setbacks.
g. Incorporation of bike parking consistent with the approved Project Development Plan.
h. Remove proposed vacation area (CD2020-003VAC) on the site plan. Revise the
location of utility and Drainage easements to the satisfaction of Rochester Public
Utilities.
2. Prior to issuance of building permits, applicant must provide the following documents to
Community Development for additional review in compliance with the Special District
Ordinance.
a. Photometric plans in compliance with Lighting Standard “B”.
b. Landscape plan or a revised final site plan incorporating the location and type of
landscaping proposed.
c. Building floor plans showing total area dedicated to each use within the structure.
d. Revised elevations showing cardinal directions per façade.
e. Revised Utility Plans submitted to the satisfaction of RPU-Water.
3. Prior issuance of building permits, the east drainage and utility easement vacation shall
be recorded (Vacation No. CD2020-003VAC).
4. Prior to issuance of building permits, the dedication of a 15-foot utility easement must be
recorded to the satisfaction of Rochester Public Utilities-Operations.
5. Prior to approval of a building permit, a grading and storm water management plan
associated with this project shall be approved.
6. Development of this property is subject to a Plant Investment Fee (PIF) that will be
calculated and collected through the Building Permit review and approval process.
