RESOLUTION
WHEREAS, the City of Rochester has prepared the Environmental Assessment (EA)
for the 20th Street SE Connection Project (Project) in accordance with state and federal rules;
and,
WHEREAS, as part of.the EA, the City completed a noise analysis and assessment of
the potential need for noise walls; and,
WHEREAS, the NW, SW and SE quadrants of the 11th Avenue SE/20th Street SE
intersection met the feasible, cost-effectiveness, and mitigation standards for noise walls; and,
WHEREAS, the noise wall impacts were discussed with affected property owners at a
public meeting on January 6, 2009 and at a Public Hearing on the EA on January 7, 2009,
followed by the transmittal of clarifying information; and,
WHEREAS, the City received comments from 38 sources about noise and noise walls
indicating that there was majority support for noise walls in only the SE quadrant; and,
WHEREAS, the City Council discussed at its March 2, 2009, Committee of the Whole
eneeting the 2030 noise levels with and without the Project and, where noise mitigation was
feasible and cost-effective, considered public opinion, cost and reasonableness factors to
make a determination regarding noise walls for the 11th Avenue SE/20th Street SE intersection.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Rochester, Minnesota, that in consideration of all the noted discussion items noted above, the
Common Council of the City of Rochester does not support the construction of the noise walls
at the NW and SW quadrants of the 20th Street SE and 11th Avenue SE intersection based on
the unreasonableness of constructing noise walls to mitigate noise levels that will be present
with or without the project.
BE IT FURTHER RESOLVED that in consideration of all the noted discussion items
noted above, the Common Council of the City of Rochester supports the construction of a
noise wall at the SE quadrant, excluding the 11th Avenue SE frontage, based on the opinions
of the affected property owners and the reasonableness of mitigating noise increases that will
occur as a result of the project.
