I 7777 I RESOLUTION NO. CJ WHEREAS, the Common Council of the City of Rochester by enactment of Resolution 143-80 on March 24, 1980, duly adopted a "LAND USE PLAN" as part of the comprehensive municipal plan for the City of Rochester, Minnesota, and environs; and WHEREAS, RTL, Inc., initiated an amendment to the Rochester Urban Service Area Od Use Plan to change the designation of 9.69 acres of land located along the west side of rion Road and north of 29 Street S.E., from the "Low Density Residential" to the "Light Industrial/Business Park" land use designation; and, WHEREAS, the Planning and Zoning Commission of the City of Rochester, after published notice and hearing, recommended the approval of the proposed amendment to the 1 p p p City's "LAND USE PLAN;" and WHEREAS the Common Council, after published notice, held a public hearing in the Council/Board Room of the Government Center on September 3, 2008, on the matter of the proposed amendment to said "LAND USE PLAN;" and WHEREAS, the Council determined that the application did satisfy all of the criteria applicable to amendments of Land Use Plans. f NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester that the "LAND USE PLAN" as adopted on March 24, 1980 and as thereafter amended, is hereby further amended by changing the designation on the following-described property from the "Low Density Residential" designation to the "Light Industrial/Business Park" p Y designation: M-3 • That part of the North half of the Southeast Quarter of Section 17, Township 106 North, Range 13 West, Olmsted County, Minnesota, described as follows: 4 Y Commencing at the southeast corner of said North Half of the Southeast 4 f Quarter; thence on an assumed bearing of North 89025'00" West along the south line of said North Half of the Southeast Quarter 359.04 feet to the centerline of S i County Road #36 and the point of beginning; thence North 33001'00" West along said centerline 474.50 feet; thence South 56059'00" West 353.60 feet; thence South 26°17'00" East 223.69 feet to the south line of said North Half of the Southeast Quarter; thence South 89°25'00" East along said south line 456.02 feet to the point of beginning. The above described parcel contains 2.97 acres, is subject to a right of way easement for County Road #36 along the northeasterly line thereof, and is subject to any other easements of record. ALSO That part of the South Half of the Southeast Quarter of Section 17, Township 106 North, Range 13 West, Olmsted County, Minnesota, described as follows: Commencing at the southwest corner of said South Half of the Southeast Quarter; thence on an assumed bearing of South 89034'49" East 2624.79 feet to the southeast corner of said South Half of the Southeast Quarter; thence North 00°04'08" East along the east line of said South Half of the Southeast Quarter 690.35 feet to the point of beginning; thence North 89029'55" West 431.44 feet; thence North 31°20'15" West 736.13 feet to the north line of said�South Half of the Southeast Quarter; thence South 89°25'00" East along said North line 456.02 feet to the centerline of County Road #36; thence South 33001'00" East along said centerline 13.85 feet; thence Southeasterly along said centerline a • distance of 630.58 feet along a tangential curve concave to the Northeast having a radius of 22918.62 feet and a central angle of 01°34'35", the chord of said curve bears South 33048'18" East to the east line of said South Half of the Southeast Quarter; thence South 00°04'08" West, not tangent to said curve, 92.28 feet along said east line to the point of beginning. The above described parcel contains 6.72 acres, is subject to a right of way easement for County Road #36 along the east line thereof, and is subject to any other easements of record. Said tract contains 9.69 acres, more or less. BE IT FURTHER RESOLVED that a certified copy of this resolution shall be maintained in the office of the Director of the Rochester-Olmsted Department of Planning and Housing; the office of the Director of Public Works of the City of Rochester; and the office of the Director of Building and Safety of the City of Rochester and shall be available for public inspection. • 2 • BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to file a certified copy of this resolution in the office of the County Recorder in and for Olmsted County, Minnesota.
