HomeMy WebLinkAboutResolution No. 082-25 - Resolution - Major Land Subdivision - CD2025-001PLAT - Creekview Meadows, LLC RESOLUTION Approving Major Land Subdivision No. CD2025-001PLAT, To Be Known As Creekview Meadows Third, A Project Consisting Of 25 Residential Lots On 8.0 Acres, Located 215 Feet East Of The Intersection Of 18th St. SE With 37th Ave. SE WHEREAS,Creekview Meadows, LLC., requested from the City of Rochester approval of a Major Land Subdivision to be known as Creekview Meadows Third. WHEREAS, the Major Land Subdivision proposes 25 residential lots on 8.0 acres of land, located 215 feet east of the intersection of 18th St. SE with 37th Ave. SE. WHEREAS, the Council adopts the Planning Commission findings as described in the attached Community Development memo dated March 12, 2025, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on March 12, 2025, the City of Rochester Planning Commission reviewed the application and recommended approval subject to thee conditions. WHEREAS, on April 7, 2025, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to three conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated three conditions of approval. BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No. CD2025-001PLAT, requested by Creekview Meadows LLC., subject to the conditions of approval shown below: CONDITIONS 1. Prior to the submission of a final plat, the applicant shall submit Civil Plans, Grading Plan, and a Stormwater Management Plan for review and approval of Rochester Public Works and Rochester Public Utilities. Any proposed private facilities will require the execution and recordation of a City prepared Maintenance Declaration. 2. Execution of City prepared temporary easements are required for the turn-around at the end of Bromfield Drive SE and for any area where public sanitary sewer, watermain, or storm sewer extend beyond the proposed public right of way. 3. At the submittal of a Final Plat application, the unlabeled stub roadway intersecting 18 ST SE on the Major Land Subdivision should be labeled as BEAUS DR SE.
