HomeMy WebLinkAboutResolution No. 110-25 - Resolution - CD2025-007PLAT Badger Heights RESOLUTION Approving Major Land Subdivision No. CD2025-007PLAT, To Be Known As Badger Heights, A Project Consisting Of 84 Residential Lots And Two Outlots On 33.56 th Acres, Located Northeast Of The Intersection Of 50 Ave NW And Valleyhigh Rd NW. WHEREAS, North Rock Real Estate, requested from the City of Rochester approval of a Major Land Subdivision to be known as Badger Heights. WHEREAS, the Major Land Subdivision proposes 84 Residential Lots and two outlots, th on 33.56 acres of land located northeast of the intersection of 50 Ave NW and Valleyhigh Rd NW. WHEREAS, the Council adopts the Planning Commission findings as described in the attached Community Development memo dated April 23, 2025, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on April 23, 2025, the City of Rochester Planning Commission reviewed the application and recommended approval subject to two conditions. WHEREAS, on May 19, 2025, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to two conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated two conditions of approval. BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No. CD2025-007PLAT, requested by North Rock Real Estate, subject to the conditions of approval shown below: CONDITIONS 1. Prior to the Final Plat submittal, Stormwater Management, Civil, and Grading Plans shall be approved. 2. Prior to the Final Plat submittal, a City-prepared Development Agreement must be approved. 3. Prior to the Final Plat submittal, a Traffic Impact Report or waiver must be submitted to Public Works. 4. Prior to the Final Plat submittal, the plat exhibit shall be revised to show the street connection on the north property line in alignment with the proposed roadway in the approved Badger Hills GDP for the adjacent property to the north. 5. Prior to the Final Plat submittal, dedication of a pedestrian facilities easement is th required for the parts of the existing pedestrian path adjacent to 50 Ave NW that are located on private property. 6. Prior to the Final Plat submittal, RPU Electric comments shall be addressed. 7. Prior to the Final Plat submittal, RPU Water comments shall be addressed. 8. Prior to the Final Plat submittal, Rochester Fire Department comments shall be addressed. 9. Prior to the Recordation of the Final Plat, the applicant shall meet their parkland dedication obligation. 10. Prior to the Recordation of the Final Plat, the applicant shall meet their boulevard tree obligation.
