HomeMy WebLinkAboutResolution No. 242-25 - Resolution - CD2025-032PLAT - Badger Heights Final Plat RESOLUTION Approving Final Plat No. CD2025-032PLAT, To Be Known as Badger Heights, for the Subdivision of 33.56 Acres Into 55 Residential Lots and 2 Outlots, Located th Northeast of the Intersection of 50 Ave NW and Valleyhigh Rd NW. WHEREAS, West 34 Partners LLC. has requested from the City of Rochester Final Plat approval for a subdivision to be known as Badger Heights. WHEREAS, the Final Plat proposes 55 residential lots on 33.56 acres of land located th northeast of the intersection of 50 Ave NW and Valleyhigh Rd NW. WHEREAS, the Council adopts the findings as described attached to the Community Development memo dated October 6, 2025, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. H) Final Plat. WHEREAS, on October 6, the City of Rochester Common Council held a public hearing to consider a Final Plat application for the development, adopted the findings of fact, and approved the Final Plat subject to two conditions. NOW, THEREFORE IT BE RESOLVED, by the Common Council of the City of Rochester, at a public hearing duly noticed and held on October 6, 2025, the following plat of lands in Olmsted County, Minnesota is to be known and designated as follows: The Southwest Quarter of the Northwest Quarter of Section 20, Township 107 North, Range 14 West, Olmsted County, Minnesota, EXCEPT the following two parcels: Part of the Southwest Quarter of the Northwest Quarter and the Northwest Quarter of the Southwest Quarter, Section 20, Township 107, Range 14, Olmsted County, Minnesota, lying westerly of the following described line: Beginning at the intersection of the south line of said Southwest Quarter of the Northwest Quarter and a line parallel with and 39.96 feet east of the west line of said Southwest Quarter of the Northwest Quarter; thence northerly parallel to said west line 177.41 feet; thence northerly 327.40 feet along a tangential curve concave to the west having a radius of 7,699.00 feet and a central angle of 2 degrees 26 minutes 11 seconds to the intersection with a line parallel with and 33.00 feet east of the west line of said Southwest Quarter of the Northwest Quarter and said line there terminating. AND That part of the South 454.00 feet of the West 598.00 feet of the Southwest Quarter of the Northwest Quarter of Section 20, Township 107 North, Range 14 West, Olmsted County, Minnesota, lying easterly of the following described line: Beginning at the intersection of the south line of said Southwest Quarter of the Northwest Quarter and a line parallel with and 39.96 feet east of the west line of said Southwest Quarter of the Northwest Quarter; thence northerly parallel to said west line 177.41 feet; thence northerly 327.40 feet along a tangential curve concave to the west having a radius of 7,699.00 feet and a central angle of 2 degrees 26 minutes 11 seconds to the intersection with a line parallel with and 33.00 feet east of the west line of said Southwest Quarter of the Northwest Quarter and said line there terminating. Containing 33.56 acres, more or less. TO BE KNOWN as “Badger Heights”, by West 34 Partners LLC. Applicant, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the follow conditions: 1. Prior to recording of Final Plat mylars, full execution of a City-Prepared Development Agreement, executed by both Owner and City, shall be recorded. 2. Prior to recording of Final Plat mylars, the required Parkland Dedication fee shall be paid to the Rochester Parks & Recreation Department.
