RESOLUTION
Awarding Contract for 2026 Sidewalk and Pedestrian Ramp Improvements NC
District 2-1 - Project No. J4731, establishing Sidewalk Improvement District NC-2,
and establishing rates to be collected from 2027 to 2031.
WHEREAS, The City Council adopted the Sidewalk Improvement District Program for the
annual repair and replacement of City sidewalks on November 14, 2022; and
WHEREAS, pursuant to an advertisement for bids for the following improvement(s): 2026
Sidewalk and Pedestrian Ramp Improvements NC District 2-1 - Project No. J4731,
the following bids were received complying with the advertisement:
Ti-Zack Concrete, LLC $3,886,587.18;
Pember Companies, Inc $5,933,881.90; and
WHEREAS, it appears that Ti-Zack Concrete, Inc. is the lowest responsive and
responsible bidder; and
WHEREAS, implementation of the program requires establishment of the Districts
contributing to annual repair and replacement of City sidewalks; and
WHEREAS, implementation of the program also requires establishment of the Project
Areas within Districts where annual repair and replacement of City sidewalks will be
focused; and
WHEREAS, implementation of the program also requires establishment of the rates
assessed to parcels within each District.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester
that the bid of $3,886,587.18 is hereby accepted and execution of the standard City contract
for construction with Ti-Zack Concrete, LLC., is authorized for the following approved local
improvements: 2026 Sidewalk and Pedestrian Ramp Improvements NC District 2-1 -
Project No. J4731; and
BE IT FURTHER RESOLVED that the City Clerk is directed to return to all bidders the
deposits made with their bids, except the deposits of the successful bidder and the next
lowest bidder, which shall be retained until the contract has been executed; and
BE IT FURTHER RESOLVED that the bidder shall execute all contracts within ten days
after the contract is ready for their signature, and if not executed by them in said time, they
shall be deemed to have abandoned the same; and
BE IT FURTHER RESOLVED that Sidewalk Improvement District NC-2, shown in the
attached figure and generally described as:
Parcels within City limits starting at 7 Ave SW & 1 ST SW, going west on 1 ST
SW to the centerline of Hwy 52, then following Hwy 52 north to 65 ST NW, then
following the City Limits boundary north and east to 18 Ave NW, following 18 Ave
NW south to 55 ST NW, east to the City Limits boundary, following that to the
west side of Foster Arend Park, south to 37 ST NW, west to the Zumbro River,
following the Zumbro River to Broadway Ave N, then south to W Silver Lake Dr
NE, east of W Silver Lake Dr NE to 7 ST NE, east 800’, then following Silver
Lake southwest to the railroad tracks, then following the DMC Boundary back to
7 Ave NW & 1 ST NW.
is established for sidewalk replacements and repairs to be completed in 2026 and
assessed to participating parcels in the District from 2027 to 2031.
BE IT FURTHER RESOLVED that Project Area NC 2-1, shown in the attached figure and
generally described as:
Parcels within City limits starting where Hwy 52 NW passes 14 ST NW, following
14 ST NW east to W Silver Lake Dr NE, running east of W Silver Lake Dr NE to 7
ST NE, east 800’ then following Silver Lake southwest to the railroad tracks, then
following the DMC Boundary to Hwy 52 and then north to where Hwy 52 NW
passes 14 ST NW.
is established as the project area for sidewalk replacements and repairs for the 2026
construction season.
BE IT FURTHER RESOLVED that participating parcels in District NC-2 will be assessed at
the following annual rates from 2027 to 2031:
Residential (without sidewalk) $42.80
Local Public (without sidewalk) $42.80
Residential $83.60
Local Public $83.60
Non-Residential (without sidewalk) $246.80
Non-Residential $491.60
Non-Participating $0.00
