HomeMy WebLinkAboutResolution No. 067-26 - Resolution - CD2026-003PLAT - Pebble Creek Sixth Final Plat RESOLUTION Approving Final Plat No. CD2026-003PLAT, To Be Known As Pebble Creek Sixth, A Project Consisting Of 108 Single-Family Residential Lots On 56.19 Acres, Located On The West Side Of 60th Ave NW, South of 51st St NW And Approximately 1,200 Feet North Of The Intersection Of Behrens Ln. NW With 60th Ave. NW. WHEREAS, Lennar has requested from the City of Rochester Final Plat approval for a subdivision to be known as Pebble Creek Sixth. WHEREAS, the Final Plat proposes 108 Single-Family Residential Lots, on 56.19 acres of land located on the west side of 60th Ave NW, south of 51st St NW and approximately 1,200 feet north of the intersection of Behrens Ln. NW with 60th Ave. NW. WHEREAS, the Council adopts the findings as described within Community Development memo dated April 6, 2026, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. H) Final Plat. WHEREAS, on December 8, the City of Rochester Common Council held a public hearing to consider a Final Plat application for the development, adopted the findings of fact, and approved the Final Plat subject to three conditions. NOW, THEREFORE IT BE RESOLVED, by the Common Council of the City of Rochester, at a public hearing duly noticed and held on April 6, 2026, the following plat of lands in Olmsted County, Minnesota is to be known and designated as follows: That part of the East One-Half of Section 13, Township 107 North, Range 15 West, Olmsted County, Minnesota, described as follows: Commencing at the northeast corner of the Northeast Quarter of said Section 13; thence South 00 degrees 08 minutes 24 seconds West (NOTE: All Bearings are in relationship with the Olmsted County Coordinate System NAD '83, Adjusted 1996), along the east line of said Northeast Quarter, 1620.10 feet to the southeast corner of PEBBLE CREEK, according to the plat thereof and to the POINT OF BEGINNING; thence North 89 degrees 51 minutes 36 seconds West, along the south line of said PEBBLE CREEK, 100.00 feet to the west right-of-way line of 60th Avenue NW (C.S.A.H. Containing 56.19 acres, more or less. TO BE KNOWN as “Pebble Creek Sixth”, by Lennar. Applicant, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the follow conditions: 1. Prior to submission and recording of Final Plat mylars, the applicant shall update the Final Plat document by addressing the following items: a. Provide 3.5 acres of land adjacent to “Outlot D” to be a dedicated parkland easement to be subsequently transferred to the City; or, dedicate the 3.5 acres of land to the City of Rochester as part of this final plat b. A 30-foot-wide pedestrian facilities easement is required on Outlot A over the location of the proposed midblock crossing from the north line of Pebble Creek Court NW to the north line of Outlot A. c. Coordinate with Olmsted County Public Works GIS Division to revise street names in accordance with the GIS referral letter dated March 23, 2026, and update the final plat street names on the mylar copies. 2. Prior to the recordation of the Final Plat mylars: a. Grading, Civil, and Stormwater Management Plans shall be approved by the City Engineer. b. Full execution of the Development Agreement by Owner and City and recording of the agreement by the City shall be required. c. The midblock crossing from the north line of Pebble Creek Court NW to the north line of “Outlot A” shall be dedicated by separate document so the easement can be shown on the Final Plat mylars with applicable document number notated. d. A City prepared Maintenance Declaration is required for Outlot B, C & E is required. Recording shall occur immediately after recording Pebble Creek Sixth Final Plat mylars. e. The applicant shall make payment to the Rochester Park and Recreation Department for the City planting of required boulevard trees or execute a Boulevard Tree Green Facilities agreement to be recorded by the City. 3. After recordation of the final plat, “Outlot F” shall be transferred to the City of Rochester and an area in the southwest comer of Outlot F shall be designated for the RPU Booster Station.
