RESOLUTION
Approving Conditional Use Permit No. CD2026-003CUP, a Request by the City of
Rochester, for Changes to the Structural Works with Alterations of the Flood Wall

and Location of Supporting Piers for the Development of the 6 Street Bridge.
WHEREAS, the City of Rochester requested approval for Conditional Use Permit No.
CD2026-003CUP for changes to the structural works with alterations of the flood wall and
th
location of supporting piers for the development of the 6 St bridge; and
WHEREAS, Findings 1-6 in the community development memo dated May 4, 2026, are
adopted; and
WHEREAS, on April 8, 2026, the City of Rochester Planning and Zoning Commission
reviewed the application according to the requirements of Section 60.500.060H.4 of the
Unified Development Code and recommended approval with City teammates’ findings and
conditions; and
WHEREAS, on May 4, 2026, the City of Rochester Common Council held a public hearing
to consider this application and adopted findings of fact and recommended approval subject
to the conditions listed below, based on the community development memo dated May 4,
2026.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester,
that, based on the above-stated findings of fact, the applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria, subject to the imposition of the conditions of approval stated below.
BE IT FURTHER RESOLVED that the Common Council of the City of Rochester approve
Conditional Use Permit No. CD2026-003CUP requested by the City of Rochester, subject
to the following conditions of approval.
1. Prior to final approval, the applicant must submit plans signed by a Professional
Engineer to Rochester Community Development.
2. Prior to construction of the bridge, the Federal Emergency Management Agency
(FEMA) shall approve the submitted Conditional Letter of Map Revisions (CLOMR).
