HomeMy WebLinkAboutResolution No. 089-26 - Resolution - CD2026-006PLAT Savannah Rochester Final Plat RESOLUTION Approving Final Plat No. CD2026-006PLAT, To Be Known as Savannah Rochester, For the Subdivision of 30.17 Acres Into 2 Blocks, With Each Block Encompassing One Lot, Located at the Southeast Corner of the Intersection of Badger Hills Dr. NW and 50th Ave. NW. WHEREAS, SCS Rochester LLC., has requested from the City of Rochester Final Plat approval for a subdivision to be known as Savannah Rochester. WHEREAS, the Final Plat proposes two lots on 30.17 acres of land located at the Southeast corner of the intersection of Badger Hils Dr. NW and 50th Ave. NW. WHEREAS, the Council adopts the findings as described in the Community Development memo dated May 4, 2026, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. H) Final Plat. WHEREAS, on May 4, 2026, the City of Rochester Common Council held a public hearing to consider a Final Plat application for the development, adopted the findings of fact, and approved the Final Plat subject to five conditions. NOW, THEREFORE IT BE RESOLVED, by the Common Council of the City of Rochester, at a public hearing duly noticed and held on May 4, 2026, the following plat of lands in Olmsted County, Minnesota is to be known and designated as follows: The Northwest Quarter of the Northwest Quarter of Section 20, all in Township 107, Range 14, Olmsted County, Minnesota, less the following described parcel: That part of the Northwest Quarter of the Northwest Quarter of Section 20, Township 107, Range 14, Olmsted County, Minnesota lying Westerly (should read: northerly) of the following described line: Commencing at the intersection of the north line of said Northwest Quarter of the Northwest Quarter of Section 20 and a line parallel with and 33 feet east of the west line of said Northwest Quarter of the Northwest Quarter; thence Southerly parallel to said west line 114.31 feet to the point of beginning of the line to be described: thence northeasterly deflecting to the left 150 degrees 00 minutes 00 seconds 11.19 feet; thence northerly and northeasterly a distance of 39.36 feet along a non tangential curve concave to the southeast, having a radius of 76.00 feet, a central angle of 29 degrees 40 minutes 22 seconds, and a chord of said curve deflects 28 degrees 07 minutes 29 seconds to the right from the last-described line; thence easterly not tangent to the last described curve deflecting to the right 31 degrees 52 minutes 31 seconds from the chord of the last described curve a distance of 22.27 feet; thence northerly deflecting to the left 90 degrees 00 minutes 00 seconds 85.50 feet to the north line of said Northwest Quarter of the Northwest Quarter of Section 20 and said line there terminating. TO BE KNOWN as “Savannah Rochester”, by SCS Rochester, Applicant, is hereby approved, and all dedications of land or interests in land for public purposes as shown on said plat are hereby accepted, subject to the following conditions: 1. Prior to recordation of the Final Plat, the applicant shall pay the Parkland Dedication fee for 4.34 acres of parkland to the Parks and Recreation Department. 2. Prior to recordation of the Final Plat, the applicant shall make payment to the Rochester Park and Recreation Department for the City planting of required boulevard trees for Alpha Parkway NW and Worrall Ct. NW.; or, execute a Boulevard Tree Green Facilities agreement to be recorded by the City. 3. Prior to recordation of Final Plat, execution and recording of the City prepared Development Agreement is required. 4. Prior to Final Plat Recordation, Easement “A” & Easement “B” for public drainage and utilities, and Easement “C” for “Pedestrian Facilities Easement” shall be dedicated by separate recorded document in accordance with the Public Works Memo dated April 22, 2026: 5. Prior to recordation of the Final Plat, the applicant shall make the following updates to the Final Plat mylars in accordance with the Public Works Memo dated April 22, 2026: a. Existing recorded easement (Document No. A1631890) for road, utilities and pedestrian facilities shall be depicted on the plat with reference document number. b. Outlot A shall be removed. The area shown as Outlet A shall be platted as public right-of-way. c. The purpose of Easement “C” shall be updated and depicted as a “Pedestrian Facilities Easement”. Said easement will be executed and recorded prior to recording of final plat. The document number of the recorded easement shall be identified on the plat. d. The document number of the recorded easements for easement “A” and easement “B” shall be identified on the plat upon recording.
