ORDINANCE NO.
AN ORDINANCE AMENDING SUBSECTION 3 OF SUBPARAGRAPH (a) OF
PARAGRAPH 3 OF CLAUSE E OF SECTION 60.200.040 OF THE UNIFIED
DEVELOPMENT CODE.
THE COMMON COUNCIL OF THE CITY OF ROCHESTER DO ORDAIN:
Section 1. Subsection 3 of Subparagraph (a) of Paragraph 3 of Clause E of Section
60.200.040 relating to Floodplain Overlay Districts of the Unified Development Code is
amended as follows:
3. Designation
a. General Requirements
1) Each individual flood subdistrict represents a set of regulations
superimposed upon the existing zoning districts, superseding existing
underlying regulations only to the extent that developments must meet the
additional standards of the FPO district as well as those of the underlying
district in order to be in compliance with this UDC.
2) The Floodway (FW), Flood Fringe (FF), and Flood Prone (FP) subdistricts
are identified upon the zoning map, and reference to the status of any
property located in one of the flood related districts is made by the district
symbol (FW, FF, or FP) being post fixed to a use district symbol (examples
R-l/FF, B- 4/FW, M-2/FP). Section 60.500.040E.2.d addresses zoning
designation of property in the FW or FF annexed to the city.
3) The following maps together with all attached materials are hereby
adopted by reference and declared to be a part of the official zoning map
and this UDC. To aid in the identification and designation of properties in
the flood related districts, certain materials are attached and hereby adopted
by reference and declared to be part of this UDC. These materials includeing
the Flood Insurance Study for Olmsted County, Minnesota, and Incorporated
Areas, dated June 10, 2026, September 21, 2023 and prepared by the
Federal Emergency Management Agency, including and the following Flood
Insurance Rate Map Panels: 27109C0135D 27109C0141F, 27109C0142F,
27109C0143E, 27109C0144F, 27109C0153F, 27109C0154F,
27109C0155E, 27109C0158E, 27109C0161F, 27109C0162F,
27109C0163F, 27109C0164F, 27109C0166F, 27109C0168F,
27109C0169E, 27109C0284D, 27109C0301F, 27109C0302F,
27109C0303E, 27109C0304E, 27109C0306F, 27109C0307E,

27109C0308E, 27109C0313E, 27109C0315D, dated April 19, 2017; as well
as panels 27109C0130E, 27109C0282G, and 27109C0295E, dated
September 21, 2023; and panels 27109C0164G and 27109C0302G, dated
June 10, 2026. These panels have been revised by the following letter of
map revisions incorporated by reference (Case No): 18-05-0869P dated
October 18, 2018; 19-05-0734P dated October 31, 2019; 19-05-2402P dated
June 18, 2020; 22-05-1237P dated June 03, 2022; and 23-05-269P dated
August 14, 2024. These materials were prepared by the Federal Emergency
Management Agency and are on file at the City of Rochester Development
Services and Infrastructure Center (4001 W River Pkwy NW STE 100,
Rochester, MN 55901).
Section 2. This ordinance shall become effective from and after its publication.
