RESOLUTION
Awarding Contract for Project No. J4407- 2026 Sanitary Sewer Repair from MH 10/0104
to MH 10/0108 (Rochester City Lines Property)
WHEREAS, pursuant to an advertisement for bids for the following improvement(s): Project
No. Project No. J4407-2026 Sanitary Sewer Repair from MH 104 to MH 0108 the following
bids were received complying with the advertisement:
Bid Name Total
KATS Excavating, LLC $167,427
S.L. Contracting $299,970
Elcor Construction, Inc. $301,815.50; and
WHEREAS, it appears that KATS Excavating, LLC is the lowest responsive and
responsible bidder.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester,
Minnesota, that the bid of $167,427, is hereby accepted and execution of the standard City
contract for construction with KATS Excavating, LLC, is authorized for the following
approved local improvements: Project No. J4407-2026 Sanitary Sewer Repair from MH
10/0104 to MH 10/0108 (Rochester City Lines Property); and
BE IT FURTHER RESOLVED that the City Clerk is directed to return to all bidders the
deposits made with their bids, except the deposits of the successful bidder and the next
lowest bidder, which shall be retained until the contract has been executed; and
BE IT FURTHER RESOLVED that the bidder shall execute all contracts within ten days
after the contract is ready for their signature, and if not executed by them in said time, they
shall be deemed to have abandoned the same.
