RESOLUTION
Authorizing Acquisition Agreement with University of Minnesota for the 6th Street
Bridge, Roadway Safety 7 Riverfront Improvements Project J7919
WHEREAS, by Resolution 187-25, the Common Council of the City of Rochester authorized
the acquisition of real property interests (“Acquisitions”) needed to construct, operate, and
maintain the 6th Street Bridge, Road Safety, and Riverfront Improvements Project, Project
J7919 (“Project”); and
WHEREAS, the Acquisitions include certain permanent and temporary easements across
lands owned by the University of Minnesota (“University”), identified as Parcels 44, 45, and
46; and
WHEREAS, the City had the Parcel 44-46 easements appraised by an independent
appraiser, shared the appraisals with the University, and entered into good faith negotiations
with the University for the City to purchase the Parcel 44-46 easements; and
WHEREAS, the University has agreed to convey the permanent easements and a
temporary construction agreement for Parcels 44, 45, and 46, in substantially the forms
attached hereto as Exhibit 1 (“UMR Agreements”), in exchange for the sum of $372,500;
and
WHEREAS, the Common Council finds that it is reasonably prudent and in the interest of
the general welfare that the City accept and enter into the UMR Agreements to acquire the
Parcel 44-46 easements for the Project for the total sum of $372,500.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Rochester,
MN that:
1. The agreement to pay the University the sum of $372,500 in exchange for the UMR
Agreements is hereby approved.
2. The proper City officers and agents are authorized and directed to execute and
accept the UMR Agreements and to pay the University the sum of $372,500 in
exchange for the UMR Agreements.
