HomeMy WebLinkAboutResolution No. 110-26 - Resolution - CD2026-007PLAT - Creekview Meadows Fourth Major Land Subdivision RESOLUTION Approving Major Land Subdivision No. CD2026-007PLAT, To Be Known As Creekview Meadows Fourth, A Project Consisting Of 15 Single-Family Residential and 3 Outlots On 12.6 Acres, Located South of 18th St SE, North of 20th St SE & East of 37th Ave SE behind Creekview Meadows 1 & 2 Subdivisions. WHEREAS, Bigelow Homes LLC. requested from the City of Rochester approval of a Major Land Subdivision to be known as Creekview Meadows Fourth. WHEREAS, the Major Land Subdivision proposes 15Single-Family Residential Lots and 3 Outlots, on 12.6 acres of land south of 18th St SE, north of 20th St. SE & east of 37th Ave. SE behind Creekview Meadows 1 & 2 Subdivisions WHEREAS, the Council adopts the Planning Commission findings as described in the attached Community Development memo dated May 13, 2026, and finds the proposal meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit. WHEREAS, on May 13, 2026, the City of Rochester Planning Commission reviewed the application and recommended approval subject to four conditions. WHEREAS, on June 1, 2026, the City of Rochester Common Council held a public hearing to consider this application and adopted the findings of fact and approved the application subject to four conditions. NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester that, based upon the above-stated findings of fact, the Applicant has shown by a preponderance of the evidence submitted at the public hearing that it has satisfied the above criteria subject to the imposition of the below-stated four conditions of approval. BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No. CD2026-007PLAT, requested by Creekview Meadows, LLC., subject to the four conditions of approval shown below: CONDITIONS 1. Prior to the submission of a final plat, the applicant shall submit Civil Plans, Grading Plan, and a Stormwater Management Plan for review and approval of Rochester Public Works and Rochester Public Utilities. Any proposed private facilities will require the execution and recordation of a City prepared Maintenance Declaration. 2. Prior to the submission of a final plat for Creekview Meadows Fourth, the required off-site lane addition on County 143 shall be completed. 3. Prior to the submission of a final plat, the applicant shall provide an updated Major Land Subdivision Exhibit for Creekview Meadows Fourth to Community Development, identifying the 100-year flood plain and Stormwater Impact Zone areas. 4. Civil improvement plans shall show the extent of the Stormwater Impact Zone in accordance with the comment by the Flood Control Administrator.
