NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Rochester, Minnesota, that the bid of $52,613.50, is hereby accepted and execution of the standard City contract for construction with KATS Excavating, LLC, is authorized for the following approved local improvements: Project No. J7866 2026 Sanitary Sewer Maintenance Project from MH 08_0292 to MH 08_0303 19 Ave NW; and BE IT FURTHER RESOLVED that the City Clerk is directed to return to all bidders the deposits made with their bids, except the deposits of the successful bidder and the next lowest bidder, which shall be retained until the contract has been executed; and BE IT FURTHER RESOLVED that the bidder shall execute all contracts within ten days after the contract is ready for their signature, and if not executed by them in said time, they shall be deemed to have abandoned the same.
