RESOLUTION
Approving Final Plat No. CD2026-014PLAT, To Be Known as Westbury First
Subdivision, For the Subdivision of 34 Acres 105 Residential Lots, Located
th
Southeast of the Intersection of 60Ave NW and Kingsbury Dr NW.
WHEREAS, Bigelow Homes has requested from the City of Rochester Final Plat approval
for a subdivision to be Westbury First Subdivision.
WHEREAS, the Final Plat proposes 105 lots on 34 acres of land located southeast of the

intersection of 60Ave NW and Kingsbury Dr NW.
WHEREAS, the Council adopts the findings as described in the Community Development
memo dated July 20, 2026, and finds the proposal meets the criteria in R.C.O §
60.500.040 (subd. H) Final Plat.
WHEREAS, on July 20, 2026, the City of Rochester Common Council held a public
hearing to consider a Final Plat application for the development, adopted the findings of
fact, and approved the Final Plat subject to five conditions.
NOW, THEREFORE IT BE RESOLVED, by the Common Council of the City of Rochester,
at a public hearing duly noticed and held on July 20, 2026, the following plat of lands in
Olmsted County, Minnesota is to be known and designated as follows:
The Northeast Quarter of the Southwest Quarter, Section 18, Township 107 North,
Range 14 West, Olmsted County, Minnesota.
AND
That part of the Northwest Quarter of the Southwest Quarter of Section 18, Township
107 North, Range 14 West, Olmsted County, Minnesota, which lies easterly of the
following described line:
Commencing at the northwest corner of said Northwest Quarter of the Southwest
Quarter; thence South 89 degrees 44 minutes 26 seconds East, assumed bearing,
along the north line thereof, 501.62 feet to the most northerly corner of Lot 18, Block 1,
KINGSBURY HILLS EIGHTH for the point of beginning of the line to be described (the
next two courses are along the east line of said KINGSBURY HILLS EIGHTH); thence
South 13 degrees 10 minutes 36 seconds West, 316.59 feet; thence South 00 degrees
06 minutes 08 seconds West, 541.27 feet to the southeast corner thereof; thence
continue South 00 degrees 06 minutes 08 seconds West, 120.00 feet; thence South 89
degrees 53 minutes 52 seconds East, 330.48 feet; thence South 00 degrees 06 minutes
08 seconds West, along the east line of LIFE LUTHERAN CHURCH, 343.73 feet to the
south line of said Northwest Quarter of the Southwest Quarter and there terminating.
AND
The Northwest Quarter of Section 18, Township 107 North, Range 14 West, Olmsted
County, Minnesota less:
KINGSBURY HILLS, KINGSBURY HILLS SECOND, KINGSBURY HILLS THIRD,
KINGSBURY HILLS FOURTH, KINGSBURY HILLS FIFTH, KINGSBURY HILLS SIXTH,
and KINGSBURY HILLS SEVENTH Subdivisions.
Containing 60.90 acres, more or less.
TO BE KNOWN as “Westbury First Subdivision”, by Bigelow Homes, Applicant, is hereby
approved, and all dedications of land or interests in land for public purposes as shown on
said plat are hereby accepted, subject to the following conditions:
1. Prior to recording of the Final Plat, the Development Agreement shall be fully
executed by Owner and City, and shall be recorded;
2. Prior to recording of the Final Plat, the applicant shall relabel the lot currently
labelled as “Park” to “Outlot D”, to the satisfaction of City Public Works;
3. Prior to recording of the Final Plat, the applicant shall easements across Outlots
A, B and C shall be removed from the plat and be replaced with temporary public
drainage and utility easements and dedicated to the City via a City-prepared
easement and recorded, to the satisfaction of City Public Works;
4. Prior to recording of the Final Plat, the applicant shall dedicate the 8.16 acre park
(now Outlot D) to the City;
5. Prior to recording of the Final Plat, the applicant shall submit all GIS Impact and
E911 Addressing Fees to the satisfaction of Olmsted County Public Works
Department.
