RESOLUTION
Approving Major Land Subdivision No. CD2026-009PLAT, to Be Known As Century
Valley Fifth, a Project Consisting of 16 Single-Family Residential on 16.72 Acres,
Located Between Silver Creek Rd NE on the South and the Terminus of Bella Vista
Lane on the North, Immediately South of the Century Valley Fourth Subdivision.
WHEREAS, Roger Payne requested from the City of Rochester approval of a Major Land
Subdivision to be known as Century Valley Fifth.
WHEREAS, the Major Land Subdivision proposes 16 Single-Family Residential Lots on
16.72 acres of land between Silver Creek Rd NE on the south and the terminus of Bella
Vista Lane on the north, immediately south of the Century Valley Fourth subdivision.
WHEREAS, the Council adopts the Planning Commission findings as described in the
attached Community Development memo dated June 24, 2026, and finds the proposal
meets the criteria in R.C.O § 60.500.040 (subd. G) Major Land Subdivision Permit.
WHEREAS, on June 24, 2026, the City of Rochester Planning Commission reviewed the
application and recommended approval subject to four conditions.
WHEREAS, on July 20, 2026, the City of Rochester Common Council held a public
hearing to consider this application and adopted the findings of fact and approved the
application subject to four conditions.
NOW, THEREFORE IT BE RESOLVED by the Common Council of the City of Rochester
that, based upon the above-stated findings of fact, the Applicant has shown by a
preponderance of the evidence submitted at the public hearing that it has satisfied the above
criteria subject to the imposition of the below-stated four conditions of approval.
BE IT FURTHER RESOLVED, that the City approve Major Land Subdivision No.
CD2026-009PLAT, requested by Roger Payne, subject to the four conditions of approval
shown below:
CONDITIONS
1. Civil Plans & Stormwater Management Plan approval shall be approved prior to
approval of the final plat.
2. Prior to submittal of the final plat, the applicant shall address the wetland
replacement order prior issued in March of 2026.
3. The applicant shall provide an updated Major Land Subdivision Plat to
Community Development that identifies the floodway and flood fringe within the
plat boundaries.
4. The Final Plat submission shall provide the additional public utility easement
required for RPU Electric facillties, parallel to water and sewer easement off the
cul-de-sac, subject to review and approval of RPU Electric.
