Minutes of an adjourned regular meeting of the. Common..,C•ouncil of the City
of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said
City, on October 10th,1939-
President L&Amon called the meeting to order at 7:30 o'clock P.M., the
following members being present: Lemmon, Amundsen; Fryer, Green. -Moody,
Richman, Williams. Absent: None.
Upon motion by Richman second by Amundsen, the minutes of the meeting of
October 3zd',1938, were approved.
The Committee to whom the proposals for the f,urni'shing and installation of
the public address system for the Counci-1 Chambers -were referred to, submitted
-the following committee report, and on motion by Amundsen second by Richman,
said report was accepted and ordered placed on file:

Gentlemen,
We-, the committee appointed by the Common Council to study the bids
of the Loud Speaker System in the City Hall, recommend that the
lowest bid, being the bid of the United Sound Equipment Company, be
accepted.

Alderman Amundsen introduced a resolution accepting.t.he bid and proposal
.of the United Sound Engineering Company for the furnishing and installing of a
-.public address system in the Council Chambers in accordance with specifications
on file in the office of the City Clerk, for the sum of $915.00, which was read.
Upon motion by Richman second by Green to adopt said resolution as read,
and upon roll call all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Upon motion by Green second by Richman the proposal of R.S.Pitkin,Jr., for
the furnishing of a public address system for the Council Chambers for the sum
of $990.00 was rejected and the City Clerk was authorized to return the certi-
fied check which accompanied the rejected bid.
The following Committee report regarding the parking on Third Avenue North-
west was TeAd., and on motion by Richman second by Amundsen'said report was
accepted and ordered placed on file:

We, the Committee appointed. by the Common Council in regard to the
parking on Third Avenue Northwest, recommend that this parking be
not, changed, and we' also recommend th8.t y'the rest of Third Avenue
Southwest be brought in to comply with the ordinance.

r The report of the Clerk of the Muuicipal Court for the week ending October
3rd,1939, showing criminal fines and costs collected $2g4.34, civil fees
received $11.95 and conciliation court fees $3.50, and for the week ending

received $9.35, and conciliation court fees $5.50, were each separately read,
and having been previously approved by;- the City Attorney, President Lemmon

ordered that the same be placed on file.
The surety bond of Glen Peterson in the sum of $1,000.00 with the Fidelity
ii& Casualty Company of New York as surety covering plumber's license issued to
said Glen Peterson, was read, and on motion by Green second by Richman, the bond
was approved, the surety thereon accepted, and it was ordered that the bond be

;i placed on file.
A communication from W.A.Moore, Mayor, announcing the appointment of_

Willard Hutchins, , as a special policeman for the City of Rochester, for the
week from October 5th to October llth, was read, and President Lemmon ordered
that the same be placed on file.
The City Clerk reported the receipt of the following telegram, which was
read, and President Lemmon ordered that the same be placed on file:

Applications for permits to place and maintain signs, signed by Charles
Wilkep. at 1009 Second Avenue Northwest and Arthur A.Hirman at 1131 South
Broadway, were each separately read, and on motion by Moody second by Amundsen

I' of the City -of Rochester for an undivided five eighths (5/9) interest in the

Alderman Williams introduced a resolution ordering a' hearing on the con-
struction of a sanitary sewer in First Avenue Southwest' from Fifth Street South-
west to Sixth Street Southwest, said hearing'to be held at 7:30 o'clock P.M. on
October 17th,1938,' which was read.
Upon motion by Green second by William§,that the said resolution be bLdopted
as read, and all voting in favor thereof,' President Lemmon declared the said
resolution duly passed and adopted.

Alderman Williams'introauced a resolution ordering a hearing on the
construction of curb and' gutter on Sixth Street Southwest from Broadway Street
South to Second' Avenue Southwest' and on First Avenue Southwest from Fifth' Street
Southwest to Sixth 'Street Southwest, said' hearing to be held at 7:30 0' clbck
P.M., on October' 17th,1939, which was read.
Upon motion by Fryer second by Green,that the said resolution be adopted
as read, and. all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution ordering a hearing on the
construction of paving on Sixth Street Southwest from Broadway Street South to
Second Avenue Southwest and on First Avenue Southwest from Fifth Street South-

Upon motion by Green second by Amundsen,that the said resolution be adopted
as read, and all voting in favor thereof, President 'Lemmon declared the said
resolution duly passed and adopted.
Alderman William& introduced a resolution ordering a. hearing on thelevying
of special assessments for the bituminous treatment of Seventh Avenue Southwest
from. Sixth Street to. Eleventh 'Street Southwest; Sixth Avenue Southwest from
Center Street West to Second Street Southwest; Third Avenue Southwsst from
Second Street to Third.' Street Southwest, Fourth Place Southwest from First
Street Southwest to Second Street Southwest; Sixth Street Southeast from Thira Av
Avenue Southeast to Fourth Avenue Southeast ;and Fourth Avenue Northwest and South-
west from Second Street Southwest to First Street Northwest; said hearing to be
held at' T!30 o'clock P.M., on October; 24th,1938, which was read.
Upon motion by Richman second by Green, that the said resolution be.adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Richman introduced a resolution appropriating $245006 from the.
Street and Alley Fund and ordering payment made to Harry Earle for replacing
and patching old curb and gutter, constricting cross walks, alley crossings, and,
repairs to manhole and catch basins, which was.read.
Upon motion by Amunds-en 'second by Williams, that the said resolution be
.adopted as -read, and all voting in favor thereof, -President Lemmon declared the
said resolution duly passed and adopted.
Alderman Richman` Iniroduced a resolution appropriating 4255.51- from the
Permanent hmprovementRevolving Fund and ordering payment made to, the Street &
Alley Fund, for use of equipment during September, 1938, which was read.
Upon motion by Green second by Amundsen,that the said resolution be°adopted
as read, and all voting in favor thereof, President Lemmon-declared the said
resolution duly passed and adopted. <
Alderman Rich"man introduced a resolution appropriating $282.79'from the
General Fund and ordering payment made tp the Standard Oil Company, for tank
car of road oil, which was read.
Upon motion by X&lliams 'second by Moody,that the said resolution be adopted
as- read,. and all. voting in favor ,thereof, President Lemmon declared the said
resolution duly passed and al,opted.
Alderman Mooay introduced a resolution appropriating $431.99 from the
Permanent Improvement Revolving Fund an,d ordering payment made to the Socony
Vacuum Oil Company, for one tank car of asphalt for bituminous treatment of
various streets, which was read.

Alderman Moody i-ntroduced a resolution appropriating $451950 from the

of Rochester, Light and dater department's for electricity and water furbished
` public buildings in accordance with billings of September 25th,1939, which was
read.
Upon motion by Moody second by Green that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Street and Alley Fund and ordering payment made to the Street and, Alley Fund,
.for use of equipment during September,1938,which was read.

Alderman Green introduced a resolution appropriating $1083.55 from the
General Fund and ordering payment made to the Street and Alley Fund, for
use of equipment during September,1938,which was read.

Alderman Amundsen introduced a resolution appropriating $260.•22 from the
Park Improvement, Fund and ordering payment made to the City of Rochester, Light
and Water Departments for electricity and water furnished in accordance with
billings of September 25th,,19389which was read.
Upon motion by Doody second by Amundsen,that the said resolution be adopted
as read, and all voting in favor thereof,, President Lemmon declaredi. the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $497.57 from the
F.E.Williams Estate Fuud and ordering payment made to C.C.Pagenhart for labor
and material for new coping on Williams business building,which was read..
Upon motion by Richman second by Williams that the .said resolution -be adopts(
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed, and adopted.
The City Engineer submitted a plat signed by Emil grolow s$. a .resubdi vi si on
of Lot 105 Auditor's Plat "A", and on motion by Williams, second by Fryer, the
said plat was approved and the. City Clerk authorized to execute the certificate
accordingly.
Mr. E.M.Raetz-, representing the Board of Education of the City of Rochester
was before the Council :regarding a stop and- go- signal at •Center Street East and
Eleventh Avenue, requesting that street crossings be more plainly marked on
Center Street, East,' and that a sidewalk be built on the south side. `of Sixth
Street Southwest from Tenth Avenue Southwest to Fourteenth Avenue Southwest.
Upon motion by Fryer second by Moody.,the matter of the stop & go signal
and street crossings was referred to the Chief of Police -and Police ,Committee
of the 'Common Council and the matter of - the sidewalk on Sixth Street Southwest
was referred -to' -the Street and Alley Committee and the City Engineer, giving each
committee power to act.
A group of citizens _residing in North Rochester were before the Council
and a general discussion followed regarding the Sewage Disposal Plant.
On motion by Amundsen second by -Fryer the President of the Council was
directed to% 'appoint a Committee consisting of eight, memb-ers,;
-.... ,, said Committee to make
an investigation of various sewage disposal plants of different cities and make
report.t6 the Common Council, the- necessary traveling expenses of said Committee
to be paid by the City of Rochester.
President Lemmon withheld the appointment of the -Committee until a later
dat e.

Upon motion by Fryer second by Green, the President of the Council was
requested to appoint -a committee of four for'the purpose of contacting the
P.W.A. officials regarding an extension of time for the applicatian for a grant

for the construction of a sewage disposal plant for the City of Rochester,
the said Committee being authorized to go to Omaha personally if necessary.
President Lemmon accordingly appointed Mayor Moore, City Attorney I.L.
Eckholdt, Alderman Tom Moody, and Dr. T.B.Magath, City Health'Officer, as
members of such committee,. '
Amiel L.Glabe, City Clerk submitted the following resignation as City
Clerk, which was read and President Lemmon ordered that the same be placed on
file:

Gentlemen:
I wish to hereby tender my resignation as City Clerk
j, of the City of Rochester effective as of November lst,1938.
In tendering my resignation as a city official of the.
City of Rochester, I cannot help but feel a deep regret for the
severance of the friendly relationship which has existed between
the governing officials of the City and myself, and I wish at this
time to express my sincere thanks to the Mayor, President of the
k Council, the Common Council, and all other appointees and employees
r of the City of Rochester for the splendid cooperation and consider-
ation which I have received during my time as City Clerk.

AldermanGreen moved that the foregoing resignation be accepted as of
November 10th,1938. The motion was seconded by Alderman Fryer and all -present
voting in favor thereof.
Alderman Amundsen introduced an ordinance entitled, "An ordinance pro-
viding for'the formation and government of the Fire Department of the City of
Rochester, Minnesota" which was given its first reading.
On motion by Fryer second by Richman, and upon roll call all voting in
favor thereof, the rules were suspended and the said ordinance was given its
i second reading.
Alderman Moody reported a request for a sidewalk at 1014 Fifteenth -Avenue
Southeast, and President Lemmon referred the •matter 'to the Street and Alley
' Committee and the City Engineer.

7:30 o'clock P.M. on October 17th,1938.
