HomeMy WebLinkAbout03-01-1939148 Record of Official Proceedings of the Common Council of the City of Rochester, Minn.,°� 1939 Minutes of an adjourned regular meeting of the Common Council of the:City of Rochester, Minnesota, held•in the Council Chambers, in the City Hall, in sal d City, on March lst,1939. -President Lemmon called the meeting to order.at 7:30 o'clock P.M., the following members, being present: Lemmon, Amundsen, Fryer, Green, Moody,. Richman, Williams. Absent: None. Copies of requisitions by the Health Officer upon St.Mary's Hospital for the isolation of Florence Miller diagnosed to be suff-ering from measles, and James Gillies diagnosed to be suffering from erysipelas, were each read, and Rpenident Lemmon ordered that -the same be placed on file. A copy of a notice of claim for damages by Mrs. John Dooley in the sum of $3,000.00 for injuries resulting from a fall on the sidewalk at the corner of, Fourth Street and Sixth Avenue Southeast,, was read and President Lemmon referred the same to the City Attorney. Notice of claim for damages in the sum of. $750.00 by Franeis G. Sheets resulting from his automobile colliding with a parked automobile on South Broadway apnroximately.in front of the Clements Chevrolet Company parking lot between Fifth Street and Sixth Street Southwest, was read and President Lemmon referred the same to the City Attorney. The report of the City Engineer for the month of February,1939, showing expenditures from the General Fund for_ labor_ in the sum of $17.91, from the Street and Alley Fund, $2199.93, and from the Sewer Fund $729.44, was read and President Lemmon ordered that the same be placed on file. The report of the Building,Electrical and Plumbing Inspector for the month of February,19399 showing lbuilding permits issued $21.00, Electrical permits $20.75, and plumbing permits $29.75, was read and President Lemmon referred the same to the Finance Committee. The surety bond of the International Harvester Company, in the sum of $1300.00, with the Fidelity & Casualty Company as surety, covering their contract ,for furnishing a one and one half ton truck with cab and three yard dump box, was read, and upon motion by Moody second by Amundsen, the said bona was approved; the sureties thereon accepted and it was ordered that'the same be placed on file. The report of the Clerk of the Municipal Court for the week ending February 20th,1939, showing criminal fines and costs collected $300-SO, civil fees received $7.40, and conciliation court fees received $7.50, and for the week ending February 27th,-1939, showing criminal fines and costs collected $219.90, i civil fees received $2o4o, .and conciliation court fees received $1.00, were each read, and having been previously approved_ by the City Attorney, President Lemmon /ordered that the same be placed on. file. The application of Victor Cook for a drivers license was read, and upon motion by Richman second by Amundsen license was granted. The application of Leo A.Huey for an Off Sale Retailers Liquor license at 237) South Broadway, together with a surety bond in the sum of $1,000,00 with the Western Surety Company as surety, were each read, and upon motion by Fryer, second by Amundsen, the license was granted, the bond approved, the surety thereon accepted and ordered placed on file. The application of R.M.Graen, for an off sale retailers -liquor license at 14 First Street Southwest, together with a surety bond in the sum of $1;000.00 (with the Western Surety Company as surety, were each read, and upon motion by Amundsen, second by Richman, the license was granted, the bond approved, the surety thereon accepted. and ordered placed on file. The application of Emgnuel Kostakes for an off sale retailers liquor license ,Iat 116-A South Broadway, together with a surety bond in the sum of $1,000.00 with It he Seaboard Surety Company as surety thereon, were each read, and upon motion by Fryer, second by.Moody, the license was.granted, the bond approved, the surety !thereon accepted and ordered placed on file. The application of Joe Wallace for an off sale retailers liquor license it 16 First Avenue Northwest, together with a surety bond in the sum of $1,000.00 with the.Western Surety Company as surety thereon, were each read, and upon motion by Richman second by Green, the license was granted, the bond approved, the surety thereon accepted. and ordered placed on file. The application of Robert P.Kennedy for an off sale retailers liquor license at 12 Fourth Street Southwest, together with a surety bond in the sum of $1,000.00 with the Western Surety Company as surety thereon, were each read, and upon motion by Richman second by Amundsen, the license was granted, the bond approved, the surety thereon accepted and ordered placed on file. The application of Christ Margellos for an off sale retailers liquor license at 20 South Broadway, together with a surety bond in the sum of $1,000.00 with the Seaboard Surety Company as surety thereon, were each read, and upon motion by Green second by Amundsen the license was granted, the bond approved, the surety thereon accepted and ordered placed on file. r The application of Hazel V.Kitzman for an off sale retailers liquor license at 221 First Avenue Southwest, together with a surety bond in the sum of $1,000.00 with the Fidelity & Company as surety thereon, were each read, and upon -motion by Fryer second by Moody the license was granted, the bond approved, the surety thereon accepted and ordered placed on file. 100 Record of Official Proceedings of the "Common Council of the City -of Rochester, Minn., March 1,1939 The application of Andrew C.Chafoulias for an off sale retailers liquor license at 6 North Broadviay, together with a communication from Andrew C.Chafou- lias requesting that United? States of America 3 3/01%• Treasury bond, in the sum of $1,000.00, numbered 69 492-B and dated July 16th,192S, and now in the hands of the City Treasurer, be continued in lieu of a surety bond covering off sale liquor license, was`read, and on motion by 1mundsen second by Richman the license was granted, and the said United States Treasury bond accepted in lieu of the surety bond. Upon motion by Amundsen second by Richman that the said resolution be adopted as read, and all voting in favor therderf, President Lemmon declared the said resolution duly passed and adopt'ed._ Alderman Williams introduced a resolution granting public dance permit to Dale Hess for the Woodman Hall Rebruary ;25th, 1939, and fixing the fee at $3.00, which was read. Ripon motion by Williams second by Moody that the said resolution be adopted as read -,.and all voting in favor thereof, President. Lemmon declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution granting public dance permit to Leslie Bumgarner for the Armory, -March 17th,1939, whd fixing the fee at $3.00 which was read. Upon motion by Fryer second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Wi•lliAmsintroduced a resolution appropriating $210.00 from the Interest Fund and ordering payment made to the First !National Bank of Rochester, Minnesota, for the March 1st, 1939,maturity of interest on' City of Rochester, Repaving Bonds Nos922 to 35,inclusive, which was read. Upon motion by Moody second by Williams that the said resolution be adopted as read, an,d all voting in favor thereof,' President Lemmon declared the said resolution duly` passed and adopted. Alderman Fryer, introduced a resolution appropriating $365.79 from the Lighting fund and ordering payment made to the City of Rochester, Light Depart - rent for electricity furnished at public buildings, in accordance with the Record of Official Proceedings of the Common, Council of the City'of Rochester, Minn., March 1,1939: February 25th,1939,billings, which was read. 4 Upon motion by Moody second by Fryer that the said resolution be adopted as read, and all.voting in favor thereof, .President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $3,�44-75 from the „ Lighting Fund and ordering payment made to the;City of Rochester, Light Depart- 'went for lighting public streets and grounds in accordance with the February 25th,1939,billings, which was read. Upon motion by Moody second. by Fryer that the -said resolution be adopted as read, and all voting in favor thereof, President Lemmo-n declared the said !-resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $320.95 from the General Fund and ordering payment made to the City of Rochester, Steam Depart-, ment for.steam heat furnished at the City Hall,in accordance with the February 29th,1939,billing,which was read. Upon motion by Fryer second by Moody, that the said resolution by adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. J. L. Plemling, Attorney, representing the Mayo Properties Association presented and read a communication from the Mayo Properties Association regarding the,extension of .Tenth Street Southwest. Af6er consideration by the Council and residents in the vicinity of Tenth Street Southwest, i.e. Morrison, Whiting, Paulson, gjerner and. Leisch, of the said communication and the plat of the proposed extension of Tenth Street Southwest, J. L. Plemling withdrew the said communication and the plat of the proposed extension of Tenth Street Southwest for further consideration by the Mayo Properties Association and the said residents in the vicinity of Tenth Street Southwest. J. L. Plemling, Attorney for the Mayo Properties Association, presented a petition to the Common Council to establish certain setbacks, building lines, and yards for each and all of certain lots in Plummer's Re -Plat "All and in t ,Belmont Slope, which was read, and upon motion by Williams second by Green the 'said petition was referred to the Zoning Board for recommendation. Upon motion by Fryer second by Richman the License Committee, the Chief of Police and City Attorney were requested t.o make a report on the application of ,Same DeFosse for transfer of his non -intoxicating malt liquor license from 302 to 30.(2:�Twelfth Street Southeast; said report to be made at the meeting of this ,'Common Council, which is to be held at 2:00 o'clock P.M., on March 6th,1939.
