C.ouncil.Chambers, in the City Hall, in said City, on March. 31,.19390 President Lemmon. call-ed- the meeting. to order at 7:30 o'clock P.M., the following members being pr.e:se.nt.: Le-mmon.,.Amundsen, Green, Moody, Richman,, Willaims, Absent: Fryer, Alderman Fryerbeing absent on account of the illness of himself. Upon motion by Williams,. second by Richman, the minutes of the meeting of y March 15th, and 20th, 1939, were approved. A communication.from the City_Engineer requesti.ng a change in the amount of'Cutback asphalt from-40,000.9a1lon.s..to 20,000 gallons, and that 20,000. gallons tar be purchased, and recommending that the.Council advertise for bids -far Ithe purchase of roadoil and bituminous materials for the 1939 season, was read and President Lemmon ordered that the.same be placed on file. A communication from•.the Tourist Club regarding sale of beer in Soldier Field,, was. read and President. Lemmon referred the same to the Park Board; said communication being.quoted as follows: "Rochester, Minnesota Mar. 25 - 1939. City Councilmen Rochester, Minn Dear" Sirs: At a meeting. Monday. afternoon, the Tourist Club a group of twenty Rochester. women voted to go on record'as endorsing the appeal of the Womens"Temperance Union against the sale of, beer on Soldiers Field. Respectfully, The Tourist 'Club ,Per E.D.Adams, Secy." A communication from Earle R.Warns, Public Relations man of the Public Utility Departments., to the Custodian of the City Hall, regarding his findings in an i-nve-stigation of- the elect.-ric..-wiring_ of the City Hall building, was read, and upon motion by Green. second by Williams, the said - report was referred to the- P-ublic Grounds Committee and the. Custodian of the City Hall, for further investigation -and report. - A commun.icat-ion- from Joseph T.Langlais, State Comptroller, stating that as soon as the State Comptroller's.Depar.tment have a man available they will commence the audit- of the bo.oks.. and, recordsof the City of Rochester. An emergency authorization by the Mayor for the purchase of approximately 9000 gallons gasoline for use in the City bulk station, was read and upon motion by. Green second by Richman said action was approved. 180 Record of Official Proceedings of the -Common Council of the. City of Rochester, Minn., March 31,1939• A recommendation from the Street and Alley Committee and the City Engineer on the widening of.Second Street Southwest from Eleventh Avenue Southwest to Twelfth Avenue Southwest, and the construction of a sidewalk on the north side of.the said part of Second Street Southwest, was read, and Upon motion by Green second by Amundsen, said recommendation was approved. The City Engineer submitted estimate of cost and specifications and plans for the construction of a sanitary sewer in 91 Avenue Southeast from Eleventh Street to Twelfth Street Southeast. The report of the Clerk of the.?Municipal Court f-or the week ending March 27th,1939, showing criminal fines and costs collected $69.40, Civil fees received $12.00, conciliation court fees received $4-75, was read, and having been previously approved by the City Attorney, President Lemmon ordered that -the same be placed on file. The official bonds of Fred R.Witzke as Constable of the First Ward, and Orville L.Rowland as Patrolman, each in the sum of $500.00 with the Fidelity & 'Casualty Company of New Yark as surety, were read, and upon motion by Moody second by Amundsen, said bonds were accepted, the sureties thereon approved and ,it was ordered that the same be placed on file. A petition signed by twelve persons and quoted as follows, was read and Acting - !Upon motion by Moody second by Green it was referred to the/Chief of Police and the City At.tor.ney: i "We, the undersigned, living in the neighborhood of the 1200 and 1300 block on Fourth Street N.E. in the City of Rochester do hereby. respectfully petition the City of Rochester to have the City Dog Catcher dispose of the Chow dog, known as "Butch", owned by Norman 17yatt residing at 1244 Fouth St.N.E., the sai.d dog being a public nuisance due to the fact that he is vicious,. he knocks down little children and he is not kept confined to his owner's premises." The annual report of the Rochester Bus Line, Inc., was read and President 'Lemmon ordered that the same be placed on file. The annual report of the City Engineer was presented and upon motion by Green second by goody it was ordered that the same be placed on file. Applications which had been approved by the Building Inspector, for permits to place and maintain signs, were read, and upon motion by Richman second by !Amundsen, permits were granted. Alderman Williams introduced a resolution authorizing certain setbacks, building lines, etc., for lots in Plummer's Replat "A", and Belmont Slope, which 'was read. Upon motion by Richman second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution authorizing the Public Utility Board to make a $29,000.00 advance of Gross Income tax payment to the General Record. of Official Proceedings- -of the.. Common Council of -the.-..City., of Rochester, Mimi.; Mar.eh 31;1939 I V l Fund, which. was. read. Upon motion by Green second by Williams, that the said resolution be adopted as read, and all voting. in..favo.r. thereof, President Lemmon declared the Isaid.resolution duly passed an.d.adopted.. Alderman Richman intr.o.duced_a re.so.lut.ion ordering a hearing onthe widening of Second Str-eet Southwest from Eleventh Avenue. to Twelfth Avenue, and the con.s-truction. of a new sidewalk...on the.. said part of Second Stree-t Southwest, said hearing to be held at 7:30 o'clock P.M., on April 10th,1939, which was read. Upon motion.by Moody se.cond..by Amundsen, that the -said resolution be adopted as read, and all 'voting.in' favor thereof,, President Lemmon declared the said resolution duly passed.. and..a.dopted.. Alderman Richman introduced the following resolution, which was read: "WHERAS, It hath pleased Almight God to call from our midst and these earthly duties our Beloved Friend and co. -worker, Louis J.Claude., and WHEREAS., During his residence in the City of Rochester he, was, looked on as a leader in the community, alway.s..showing- consideration toward- his fellocr citizens, and s WHEREAS, During a period. of fifteen years of service for the City of._, - Rochester, seven years o.fwhich. were spent in .the p-osit ion, of Chief of.. Police,'.: he gave willingly and freely of his time and talents, and faithfully- carried . out the duties of trust which. he- held,. NOW THEREFORE, Be. it resolved by the Common Council of the City of,Rochest-er, Minnesota that in the death. of Louis J. Claude the City of _Rochester has- lost' a-• citizen and Public Official whose -kindness and services.wi-11 be deeply missed. BE IT FURTHER RESOLVED, That the. said resolution be entered upon the records - of the City of Roche.st.er and: --that a certified copy thereof be- delivered to Mrs. Claude his surviving wife and to Betty and Beverg:k., his surviving.daughters; and the sympathy of the Mayor, Common. Council and all Departments, of our City is hereby expressed to them,and to the othe-r relatives in this hour of sadness. 1i Upon motion by Amundsen second by Green that the said resolution be adopted as read, and all. voting in-favo-r thereof, Pre-sident Lemmon declared the said resolution duly passed and adopted. Alderman Moody introduced a resolution appropriating $1534._70 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for payrolls for labor during the half -month ending March 31st,1939 , which was read. Upon motion by Green second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and..adopte-do 182 Record of Official Proceedings of the Common Council of -.the City of Rochester, Minn., March 31,1939 Alderman.. Moody introduced a re.s.olut-io.n. appropriating $27, 70g..56 from the General Fund and ordering payment made to the State of Minnesota, Highway Department, for the City's share of costs of repaving Broadway Street North and South from the Chicago Northwesterntracks to Fourth St,.re'et Southeast and Southwest., in accordance with th.e. State of Minnesota, verified invoice No.241, dated February 20th,1939, and in accordance with resolutions heretofore passed and adopted by the Common Council May 4th,1939, which was read. Upon motion by Amundsen second by -Williams, that the said resolution be adopted as read,,and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution granting,publ.ic dance permit to iPaul Schroeder for the A.O.U.W.Hall, April1 lst,1939, and fixing the fee at $3.00, which was read. Upon motion by Williams second by Richman -that the said resolution be adopted as .read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution adopting the plans, specifications and estimate of cost for the construction of a sanitary sewer. in 9 Avenue .` Southeast from -Eleventh Street Southeast to Twelfth Street Southeast, and ordering a hearing on the said improvement for 7 :30 0' clock P:ii. , April .loth, 1939, and ordering advertisement. for bids for the construction of said sar_it.ary sewer, said sealed bids to be received and opened at 7.:3.O o'clock P.N., on' April loth; 1939, whichwas: read. Upon motion by Richman second by Amundsen, that the said resolution be adopted as read, and all voting in favor thereof, Presiden-t Lemmon declared' the said resoiuti.on duly passed and adopted. Alderman Amundsen introduced'a resolution ordering hearing on the levying of special assessments for the construction of a sanitary sewer in part of Fifth Avenue -and Eighth Street Southwest, said hearing to be held at 7:30 o'clock P.M., on April 24th,1939, which ;+as read. 'Upon motion by Moody second by Williams, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Amundsen introduced a resolution ordering bids for the furnishing of road oil and bituminous materials- for treating streets during the 1939 season, said bids to be received and opened at 7:30 o'clock P.M., on April loth, 1939, which was read. Upon motion.by Green second by Williams, that the said resolution be adopted las read, and all voting in favor thereof President Lemmon declared the said resolution duly passed and adopted. Record of Official Proceedings of the .Common Council of. the City of Rochester, Minn., March 31, 19 3 9 The following claims .were read.,.. andupon notion. by Williams second by Moody, and all votingin favor thereof, the same were allowed and the Mayor and City Clerk.were authorized and dir-ect.e.d to draw warrants upon the City Treasurer and make payments accordingly: From the General Fund: F.R.Finch_$15.03, H.H.Walclron $9.00, Geo.Wood $39.50, George Wood $30.00, Tri-State Telephone. Company $5b.65; From the Park Improvement Fund: Hotel Kahler $46.w ; From the Fire.Protection Fund: C.E.Ginther $5.00, -Frank Adair $13.50. The matter of purchasing a lltunicipal Year Book was referred to the Purchasing Committee. Mr. Richard. Manahan,_ at.to-rney. f.o-r Firs. Kathleen Fitzgerald, appeared before the Common, Council inregard.to th.e. title of certain lots South -of Sixth Street Southwest and east of Sol.die.r Field, and upon motion by Williams second by Moody the matter was referred to the City Attorney, and action -deferred until April 10th,.1939 - Upon motion by Amundsen .second by Richman it was agreed that the fee for pin ball machines b.e_.fixed.in..a new ordinance at the sum of $100.00 per machine. Alderman Williams introduced an ordinance entitled "An ordinance providing for the licensing and regulation of card, board, box, table, stand, cabinet or similar device used in games of amusement where a ffharge is made for the use thereof and subscribing penalty for violation thereof" which was given its first reading. and all voting in favor thereof, Upon motion by Green_.second.by Amundsen/the rule-s were suspended and the said ordinance was given.' it s '' reading. Alderman Amundsen introduced an ordinance amending an ordinance regulating the sale of intoxicating liquor within the City of Rochester, providing for such by licensed persons estab.lishing..regulations for the operation of places where sui intoxicating liquor issold, providing regulations for the granting of such licenses, setting license fees, providing penalties for the violation thereof and repealing all inconsistent orclinanc.es,.being an emergency ordinance rendered necessary for the prever.Vkbion of -.the public peace, health and safety, and repealing ordinance No.514, which was given its first reading. Upon motion by Moody second.by Williams, and all voting in favor thereof, the rules were suspended and thesaidordinance was, given its hecond reading. Upon motion -by Amundsen second by Green the matter of trading the Ford car in the Police Department for a new one was referred to the Police Committee.
