Rochester, Minn.; `' May• 1;:1939 Minutes of a regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said City, on May lst,1939• President Lemmon called the meeting to order at 2:00 o'clock P.M., the following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Richman, Williams. Upon motion by Amundsen second by Richman, the minutes of the meeting of April 24th;1939, were approved. The application of Hugo A.Brumm for a position'at the City Dumping Grounds gat such time as Mr. Mitchell retires, was read, and President Lemmon ordered that the same be`placed on file. The report of the Clerk of the Municipal Court for the week ending April 24th,1939, showing.criminal fines and costs collected $237.95, civil fees received $3.70, conciliation court,fees $4.25, was read, and having been previously ,approved by the City Attorney, President Lemmon ordered that the same be.placed on file. The report of the Building,Electrical and plumbing Inspector for the month of April,1939, showing building permits issued $229.00, Electrical permits $27.75, and plumbing permits $49.75, was read and President Lemmon referred the same to .the Finance Committee. __0 The official bond of Edward Zuehlke as Building,Electrical and Plumbing Inspector, with the American Bonding Company of Baltimore as surety in the sum of $1,000.00, was read, and upon motion by.Amundsen, second by Moody, the �a - bond was approved, the surety thereon accepted and it was ordered that the same be placed on file. A petition asking that a water main be constructed in 92 Avenue Southeast from Eleventh Street to Twelfth Street Southeast, signed by Emil Krolow as owner of all the property abutting the improvement, was read, and President Lemmon referred the same to the seder committee, and City Engineer. A petition asking that the alley south of Second Street Southwest between Fourteenth and Fifteenth Avenue Southwest between blocks 1 and 2 Hammer and Fannings' Addition be graded and treated with bituminous surfacing, and to extend alley from Fourth Street Southwest west to Fifteenth Avenue Southwest, and a petition asking that these improtements be not made, were each read, and President Lemmon referred the same to the City Engineer and the Street and Alley Committee,for investigation and report at the next meeting of this Council. A petition asking that the west one acre of the North 2 acres of the East 10 acres. of the west 33 acres of the northwest one quarter of the Northeast gauarter, of Section 3,township 106,north of Range 14 west,except the east 2 rods thereof, be annex6d to the City of Rochester, was read and President Lemmon ordered that 238 Record of Official Proceedings. of the Common Council May .1,1939. of .the_ City__ of Rochester,_ Minn., the same be placed on file. The application of John P. Kelly for a license to connect with sewers and , drains, together with a surety bond in the sum of $1,000.00 with the Western Surety Company an surety thereon, was read, and upon motion by Fryer second by Williams, the license was granted, the bond approved the surety thereon accepted and it was ordered that the same be placed on file. The application of Magaw & Kjerner for an off sale license to sell non - intoxicating malt liquor, was read and upon motion by Richman second by Williams, license was granted. Applications signed by Walter Cords and Walter 0-Thompson for drivers licenses, were each read, and upon motion by Green second by Amundsen, licenses were granted. Applications signed by Walter H.Bear and Ross Phill for soft drink dealers licenses, were each'read, and upon motion by Fryer second by Richman, licenses were granted. ` Applications signed by the Rochester Amusement'Company for four licenses to operate motion picture theatres were read, and upon motion by Green second by Fryer, licenses were granted. ` A communication from the Rochester Amusement Company requestint permission to erect a canopy at 222 south Broadway to be used in connection with a new theatre to be erected at this location,was read, and upon motion by Fryer second by Richman permission was granted to erect said canopy. An application signed by the New Palace Cafe for a permit to place and maintain a sign, was read, and upon motion by Amundsen second by Fryer, -permit was granted. The applications of L.A'.Kuhl and M.J.Donahue for transfer of on sale liquor license No.80 to M.J.Donah ue were each read, together with the surety bond of M.J Donahue covering said license, in the sum of $3,000.00 with the Seaboard Surety Company as surety, were each read, and on motion by Richman second by Amundsen, the transfer was granted, the bond approved, the surety thereon accepted and it was ordered that the same be placed on file. The report of the Finance Committee stating that they had checked the report of the Building,Electrical and Plumbing Inspector for the month of April, 1939,and found the same to be correct, was read, and President Lemmon ordered that the same be placed on file. The report of the Sewer Committee and City Engineer,recommending that a sanitary sewer be constructed on Eleventh Street Southeast from Fourth Avenue Southeast to a point 115 feet east, was read, and upon motion by Fryer second by Amundsen, said report was accepted. Record; of Official Proceedings of the Common Council of..the- ,City .of -Rochester, Minn:, May 1,1939. 239 Y The report of -the City Engineer, showing expenditures from the General and for labor during the month of April,1939, in the sum of $250.35, from the (Street and -Alley Fund, $237,9.99„ from the Sewer Fund, $265.16, was read, ,and President Lemmo2i ordered that the same be placed on file. The report of the Public Grounds Committee on quotations received by,them - Ifor repairs at the residence on the dumping grounds, and recommending the acceptance of the -bid of the Hayes Lucah Lumber, was read, and upon motion by Fry-e-r second by Green the said report was accepted. The report -of the Purchasing Committee on quotations received by them for he printing of 250 government booklets, was read, and upon motion by Green sec by Richman said report was -accepted. A report from the Public Grounds Committee on cleaning and painting done lin the Mayor's office in the City Hall was read and upon motion by Fryer second by Green said report was accepted. Alderman Williams introduced a resolution appropriating $201.15 from the General Fund and ordering payment made to the Public Utility Departments for.ste heat furnished at the City Hall during.April,1939• - Upon motion by Fryer second by Moody that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said ,resolu- t ion duly passed and adopted. Alderman Williams introduced a resolution appropriating$549.50 from Code 5 of the Sewer Fund and orderinf payment made to the Permanent Improvement Revolvi Fund, -as a temporary transfer to make funds available for the construction of a sanitary sever in Seventh Avenue Northwest and Tenth Street Northwest, which was read. Upon motion by Richman second by Amundsenithat the said resolution be adopted s read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating$949.-50 from the Permanent Improvement Revolving Fund and ordering payment made to:Wm.C•Fraser &: Son, for estimate No.l on contract for construction of a sanitary sewer in ;parts of Seventh Avenue and Tenth St.reet Northwest, which was read. Upon motion by Williams second by Richman that the said resolution be `adopted as read, and all voting in favor thereof, President Lemmon declared the ,!said resolution duly passed and adopted. Alderman Richman introduced a resolution appropriating $2793.55 from the Lighting Fund and ordering payment made to the City.of Rochester, Light Department for lighting public streets and grounds, which was read. Upon mot -ion by Fryer second by Amundsen, that the said resolution be,adopted' as read, and all voting in favor thereof, President Lemmon declared the said reso- i Aution duly passed and adopted. 240 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., May Ist ,1939 • -Alderman Moody introduced a resolution appropriating $2438.71 from the Park - Improvement Fund and ordering payment made to -the Mayo Trust Fund, for payrolls for labor .during thq .half month ending April 30th„1939, -whi ch was read. Upon•motion by Green second by Richman that the said resolution be adopted ems. as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Green introduced a resolution appropriating $1195-13 from -the- ! Park Improvement Fund and ordering payment made to the -Toro Manufacturing Company for one Toro tractor, universal hitch, 5 3011 Trojan mowers, which - was -read. Upon motion by Amundsen second by Green that the -said resolution be s adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman F4yer-introduced a resolution appropriating $400.00 from the Construction Account, P.W.A•Docket #1516-F, and ordering payment made to contract for Wm. C.Frase r & Son, for payment of final estimate on/construct ion of sewers under P.W.A.Docket #1516-F, -which was read. Upon motion by Williams second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said, resolution duly passed and adopted. Alderman Amundsen introduced a resolution granting public dance permit to Dale Hess for the Woodman Hall April 29th, 1939, and fixing the fee at $3.00, which was read.- • Upon motion by Green second by Richman that the said resolution be adopted as read, and all -voting in favor thereof, President Lemmon declared the said, resolution duly passed and adopted., Alderman Green introduced a resolution ordering a hearing on the construction of a sanitary sewer in Eleventh Street Southeast from Fourth Avenue Southeast to a point 115 feet east of Fourth Avenue Southeast, said hearing to be held -at 7:30 0 'clock P.M., on May 15th,1939, which was read. Upon motion by Moody second by Amundsen,that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution_ ordering a hearing on the cons truction of a water main in 91 Avenue Southeast between E14venth Street and Twelfth Street Southeast, said hearing to be held at 7:30 o'clock P.M., on May 15th,1939, which was read. Upon motion by Moody.second by Richman that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. , Record of Official Proceedings of the Common Council of__the. Upon motion byMobd.y second by Williams, and all voting_in favor thereof, the rules were suspended and the said ordinance' given its bbeoxicd,.reading. Upon motion'by Green second by Amundsen, and all voting in favor thereof, . the rules were suspended and the said ordinance given its third and final reading. Upon motion by Green second by Moody; that the said ordinance be adopted -as read, and all voting in favor 'thereof, President Lemmon declared the said ordin- ance duly passed and adopted. I Alderman Fryer introduced an ordinance entitled, "An ordinance providing for the formation'l anti government of the Police Depart -went, of the City of Rochester, Minnesota." which was given its first reading. - Upon motion by Fryer second by Williams,- and all voting- inv favor thereof, -- the rules were suspended and the "said ordinance was given its second reading. Upoh motion by Fryer second by Richman, and all, voting' in favor thereof, the rules were suspended and the /said ordinance was given"."its third and final reading. Desmond Hunt, attorney, appeared before the Council and suggested that a study -be made of the possibilities of eliminating a $5..00 cost fee in connection with appeals from the small debtors court, and upon motion bar Fryer second by Moody the matter, was referred to the City Attorney, Mr. Hund and Judge Eaton for investigation and report. Alderman Moody brought before. the Council the necessity of making arrangement,s to relieve the sanitary sewers of the vast amount of cooling waters being emptied into the sanitary sewers on Broadway, and suggested that steps- be taken to have all cooling systems on Broadway connected to the old trunk line sanitary sewer ` I in Fourth Street Northeast (now abandoned) in said Broadway Street, and making a connection/from the old t Broadway sewer to a storm sewer in First Avenue Northeast, and .upon motion by Fryer second by. Williams the Sewer Committee were authorized to make, the Record of Official Proceedings of the. Common on Council of ..the. -City -of -Rochester, Minn., may 1, 19 39 • 243 necessary improvements to make possible the connecting of the cooling systems on Broadway to the old sanitary sewer.
