I; Minutes of an adjourned regular meeting of the Common Council of the City
of Rochester, Minnesota., held in the Council Chambers, in the City Hall in said
City, on October 16th,1939.
Presid-en.t Lemmon called the meeting to order at 7:30 o'clock P.Ph., the
'following members being present: Lemmon, Amundsen, Fryer, Green, Moody, Mrachek,
Williams. Absent: None.
President Lemmon stated this as being the time set for a hearing on the
„grading of Fourth Avenue Southeast from Fourth Street Southeast to Sixth Street
,Southeast, and asked if any one present wished to be heard concerning the said
improvement.

Southeast to Sixth Street Southeast, and asked if any one present wished to be
.heard concerning the said improvement.
Three7�men appeared before the Council and spoke in favor of each of the .

above improvements in Fourth Avenue Southeast.
President Lemmon stated this as being the time and place set --for a hearing
on the vacation of Seventh Street Southeast between Ninth Avenue Southeast and
Tenth Avenue Southeast, and asked if any one present wished to be heard concern-
ing the said vacation. No one present wished to be heard.
President Lemmon stated this.as being the time and place set for a hearing

on the levying of special assessments for the construction of a sanitary -sewer
and water main in Sixteenth Avenue Southwest from Second Street Southwest to
Fifth Street Southwest, and in Second Street Southwest from the west line of
Riege's Addition to Sixteenth Avenue Southwest, south of Second Street Southwest,
and asked if any one present wished to be heard concerning the levying os said

';assessments. No one present wished to be heard.
Communications from the Federal Works Agency regarding Epplications for
,grants for street improvements and -a sewage disposal plant, being nu0bers 1726
.and 1590 respectively, were read and President Lemmon ordered that the same be
:,placed on file.
A communication from the Secretary of the Firemen's Relief Association,
'requesting the approval of the Council of an investment of $3075.29 in State
of Minnesota Highway bonds, was read, and upon motion by Fryer second by
!Williams, the said investment by the Firemen's Relief Association was approved.
Mr. C.E.Patterson appeared before the Council and requested that the
members of the Council sign a communication which he was sending to the Governor '

of the State of Minnesota, requesting that the State make a re -assessment of
taxable property in the City of Rochester, Minnesota., A motion by Fryer seconded
by Amundsen carried that the Council not sign the said letter.

A copy of the annual report of the Weed Inspector was read, and President
Lemmon ordered that the same be placed on file.
Remonstrances against proposed changes in the zoning ordinance covering
Block B. on First Avenue Northeast between Fifth and Sixth Streets Northeast,
Lot 1, Block 1, D.P.Madden t s Addition, and Lots 1 to 6 in Block .41., Morse &
Sargent's Addition, were each read, and President Lemmon ordered that the same -
be placed on file.
A petition asking that a sanitary sewer be constructed on Eleventh Street
Southeast from Fifth Avenue to Sixth Avenue Southeast, was read and upon motion
by Moody second by Green it was ordered that the same be placed on file.
The report of the City Weighmaster for the month of September,1939, showing
222 private loads weighed, and total receipts in the sum of $19.60, was read,
and President Lemmon referred the same. to the Finance Committee.
The reports of the Clerk of the Municipal Court for the week ending
October 2nd,1939, showing criminal fines and costs collected $440.20, civil fees
received $6.40, and conciliation court fees received $3.50; for the week ending
October 9th,1939, showing criminal fines and costs collected $323.00, civil fees
received $4.30, and conciniation court fees -$3.25; and for the week ending
October 16th,1939, showing criminal fines and costs collected $659.00, civil
fees received $4.55, conciliation dourt fees received $2.00, were each read, and
having been previously approved by the City Attorney, President Lemmon ordered
that the same be placed on file.
The contractors bonds of Wm.C.Fraser & Son, in the sums of $403'.60, and
$2749.55, each with the United States Guarantee Company as surety thereon,
covering his contracts for construction of a sanitary serer in Ninth Avenue
Southeast from Seventh Street to Eighth Street Southeast., and the construction
of a sanitary sewer in Twelfth Avenue Northeast from Ninth Street to Tenth Street
and in Thirteenth Avenue from Ninth Street to Tenth Street, and in Ninth Street
Northeast from Eleventh Avenue to Thirteenth Avenue Northeast; Wane each read
and upon motion by Green second by Amundsen, the bonds were approved, the
sureties thereon accepted and it was ordered that the same be placed on file.
The surety bonds of Martin Paulson, with the Fidelity & Casualty Company
As surety thereon in sum of $3114.14, covering his contract for the construction
of a water main in parts of 2*elfth Avenue Northeast, Thirteenth Avenue Northeast
and Ninth Street Northeast, and in the sum of $3227.00, covering his contract
for the construction of a sanitary sewer in Fourth Street Southeast, fribm
Lot 14,Auditor's Plat "A", to Lot 29,Banderson's Second Addition, were each read,
and upon motion by Green second by Amundsen, the said bonds were approved, the
sureties thereon accepted and it was ordered that the same.be placed on file.

The official bond of Plat E.Walz, Electrical Inspector, in the sum of
$1,000.00 with the Fidelity & Casualty Company.as surety thereon, was read and

(thereon approved and it was ordered that the same be placed on file.
The application of Paul R.Lietz for an.auctionear's license, together with
�a surety bond in the sum of $500.00 with the Fidelity & Casualty Company as
,,surety, was read , and upon motion by Green second by Moody the'license was
granted, the bond approved, the surety thereon accepted and it was ordered that

The application of J.M.Carey, for an Auction Sale license on October 14th,
1939, together with a surety bondin the sum of $1,000.00, with the Fidelity &
''Casualty Company as surety, were each read, and upon motion by Amundsen second
,by Moody, the license was granted, the bond approved, the surety thereon
.',accepted and it was ordered that the same be placed on file.
Applications signed by the State Farm Insurance Company, Baker Motor

The application of M.L.Priebe'for two pin ball machine owners licenses,
,was read and upon motion by Green second by Amundsen, licenses were granted.
The application of Sam DeFosse for a pin ball machine operators license
,�at 3o4 Twelfth Street Southeast, was read and upon motion by Amundsen second
';by Williams, license was granted.
The application of Wm.Green fora plumberls'license was read, together with
the Recommendation of the Building and Plumbing Inspector that said license'be
not granted until such time as the applicant gives a business address in the
',Commercial zone, were each read, add upon motion by Fryer second by Moody said
,license was not granted.
The application of Edwin Brown, for an electrician's license, together with
a surety bond in the sum of $1,000.00 with the Fidelity & Casualty Company as
,surety thereon, were each read, and upon motion by Green second by Amundsen,
,;the license was granted, the bond approved, the surety thereon accepted and it
,was ordered that the same be placed on file.
The application of Ray Kerns for a drivers'license was read, and upon motion
by Moody second by Amundsen license was granted.
The application of James'Sullivan fox a roller skating rink license at
the corner of Fourth Street and First Place Southeast, was read, and upon motion
by Fryer.second by Mrachek, tLhe license was granted for one month commencing
';October 21,1939, at a fee of $5.00.

A report of expenditures from the Park Improvement Fund from April lst,1939
to September 30th,1939, filed by the Secretary of the Park Board, was read and
ordered placed on file.
A recommendation from the Street and Alley Committee and the City Engineer
that the grading of the north and south alley in Block 1 Flathers Addition, and
Fourth Street Southwest, be completed next spring and lowered as much as
possible, was read, and upon motion by Fryer second by Amundsen said report
was accepted and ordered filed.
The report of the Finance Committee on the Weighmaiter and Building,
Electrical, & Plumbing Inspector reports for September, was read and President
Lemmon ordered that the same be placed on file.
The report of the Finance Committee recommending the transfer of $4600.00
to the Park Improvement Fund, was read and upon motion by Green second by
Amundsen said report was accepted and ordered placed on file.
A report from the special committee investigating the finances of the
Park Department, and recommending the transfer of $4600.00 to the Park Improvement
Fund, was read, and upon motion by Mrachek second by Fryer said report was accepte
A communication from Alderman Fryer and City Attorney Eckholdt regarding
an order given by the Electrical Inspector for re-giring a houke for Mr. Harrison,
was read and ordered placed on file.
A copy of a resolution passed by the Board of Education of School District
No.B, levying taxes for school purposes for 1937, in the sum of $332,946.00,
together with a communication dated October 10th,1939, and a communication
dated October 12th, requesting the addition of a $1,000.00 emergency item to
said tax budget for assisting the Park Board in maintenance of the Athletic Field,
were each read and President Lemmon ordered that the same be placed on file.
A communication from the Library Board requesting the sum of $22,950.00
in the tax budget for the Library Fund in the 1939 tax levy, and also requesting
that $1500.00,not included in the above amount, be levied for the purchase of
and installation of lights in the reading and reference rooms, was read and
President Lennon ordered that the same be placed on file.
Upon motion by Fryer second by Williams the City Clerk was instructed to
request the various other City Department heads and boards to submit their
1939 tax budgets on or before October 23rcd,1939-
Alderman Williams introduced a resolution ordering plans, specifications and
estimate of cost for the construction of a, sanitary sewer in Fourth Avenue South-
east from Fourth Street Southeast to Sixth Street Southeast, which was read.
Upon motion by Moody second by Williams that the said resolution be adopted
as read,and and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Williams introduced a resolution ordering plans, specifications,
and estimate of cost for the grading of Fourth Avenue Southeast from Fourth
Street Southeast to Sixth Street Southeast, which was read.
Upon motion by 1-loody second by Amundsen that the said resolution be adopted
as read., -and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution vacating Seventh Street Southeast
I'from Ninth Avenue Southeast to Tenth Avenue Southeast, which was read.
Upon motion by Green second by Amundsen that the said resolution be adopted
I as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced d resolution levying special assessments for
the construction of a sanitary sewer and water main in Sixteenth Avenue Southwest
from Second Street Southwest to Fifth Street Southwest, and in Second Street
Southwest from the w6st line of Riege's Addition to Sixteenth Avenue Southwest
south of Second Street Southwest, which was read.
Upon motion by Fryer'second by Green that the said resolution be adopted
as read, and all voting in favor thereof, President .Lemmon declared the said
;resolution duly passed and adopted.
Alderman Williams introduced a resolution ordering a hearing on the con-
struction of a sanitary sewer in Eleventh Street Southeast from Fifth Avenue
,Southeast to Sixth Avenue Southeast, said hearing to be held at 7:30 o'clock P.M.,
.on Octob6r 23rd,1939, which was read.
Upon motion by Moody second by Williams, that the said resolution be adopted
E as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $10.50 from the
General 'Fund, $441.39 from the Street and Alley Fund, and $26.70 from the Perma-
nent Improvement Revolving Fund, and ordering payment made to horse Brothers,
for sand and gravel furnished during the period September 13th to 30th,'1939,

Upon motion by Amundsen second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
'said resolution duly passed and adopted.
Alderman Amundsen introduced'a resolution appropriating $235.20 from the
General Fund, $3.00 from the Street and Alley Fund, $2712.21 from the Lighting
,!Fund and $21.12 from the F.E.Williams Estate Fuud, and ordering payment made to
the City of Rochester, Light and Water Departments, for electricity and water
'furnished in accordance with billings dated September 25th,1939, which was read.

Upon motion by Williams second by Moody that the said resolution be adopted
as read, and all voting in favor there of, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $4600.00 from the
General Fund and ordering payment made to the Park Improvement Fund, for transfer
of funds to make the same available for maintenance of the Mayo Civic Auditoriuip,
which was read.
Upon motion by Mrachek second by Amundsen that the said resolution be adoptei
as ,read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution_ appropriating $446.74, from the
General Fund and ordering payment made to George C.Peterson Company, for 9090 gall
gasoline furnished in tank car No.HTCX 1000, which was read.
Upon motion by Green second by Amundsen that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $1065.00 from the
General Fund and ordering payment made to the Street and Alley Fund, for use of
equipment during September,1939,which c'as read.
Upon motion by Amundsen .second by Fryer that the.said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $312.24 from the
General Fund and ordering payment made to the State of Minnesota, Oil Inspection
Division for inspection fee and tax on $090 gal.gasoline furnished in car #HTCXIOC
which was read.
Upon motion by Moody second by Williams, that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Williams introduced a resolution appropriating $965.40 from the Street
& Alley Fund and ordering payment made to Arthur Dornack, for disability
received while in the employee of the Street and Alley Department, which was read.
Upon motion by Williams second by Amundsen that the said resolution be Gdopt(
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $752.65 from the
Street and Alley Fund and ordering payment made to the Street and Alley Fund, for
use of equipment during September,1939,which was read.
Upon motion by Green second by Amundsen that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Williams introduced a- resolution appropriating $44514.95 from the
Street and Alley Fund, and $5491.14 from the Permanent Improvement Revolving
Fund, for payment .to L.M.Feller,.for estimate No.2, on contract for widening
of Second Street Northwest from Broadway to Eleventh Avenue Northwest, which
was read.
Upon motion by Fryer second by 14rachek that the said resolution be adopted'
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman -Amundsen introduced a resolution -appropriating $212.95 from the'
Sewer Fund and ordering payment made to the Street and Alley Fund, for materials
used from stock during September,1939, which was read.
Upon motion by Green second by Amundsen that the -said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $212.62, from the
Park Improvement Fund, and ordering payment made to the Street -and Alley Fund,
for materials used, labor and equipment used for work done in parks, which was
read.
Upon motion by Mrachek second by Williams that the said resolution be
,adopted as read, and all voting in favor thereof, President Lemmon declared the
said- resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $2216.92 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for
payrolls for labor during the half month ending September 30th,1939,which was

Upon motion Moody second by Amundsen that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $1934.32 from the
Park Improvement Fund and ordering payment made to the Mayo Trust Fund, for
payrolls for labor during the half month ending October 15th,1939,which was
read.
Upon motion by 1.4rachek second by Green that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
gresolution duly passed and adopted. -
Alderman Amundsen introduced a resolution graatinka,ptibjic dance permit to
I Dale Hess for the Woodman Hall, October 7th and 14th, 1939, and fixing the fee
at $6.00, which was read.
Upon motion by Williams second by Moody that the said resolution be adopted
gas read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Williams introduced a resolution ordering a hearing on the
levying of special assessments for construction of concrete paving, curb and
gutter, lateral connections to the -curb line, and sidewalks and driveways, in
First Avenue Southwest from Fifth Street to Sixth Street Southwest; and in
Sixth Street Southwest from Broadway Street South to SecondAvenueSouthwest,
said hearing to be held at 7:30 o'clock P.M., on October 30th,1939, which was

Upon motion by Fryer second by Amundsen that the said resolution be adopted
as read, and all voting in favor thereof; President Lemmon declared the said
resolution duly passed.and adopted:
Resolutions levying -special assessments for sprinkling, flushing and oiling
during the 1939 season were introduced, duly adopted, and ordered placed on file,

and made a part hereof, reference to which for more particulars are hereby made.
Alderman Amundsen introduced a resolution ordering a hearing on sprinkling
assessments levied for 1939, said hearing to be held at 7:30 o'clock P.M., on
October 23rd,1939, which was read. -
Upon motion by Green second by Mrachek that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
(resolution duly passed and adopted.
Alderman Williams introduced a resolution adopting plans and specifications,
for Christmas street lighting, also accepting the estimate of the cost for
said lighting, said plans, specifications and estimate of cost having been
submitted by the Electrical Inspector; also ordering advertisement for bids
to be received and opened at 7:30 o'clock P.M., on October 30th,1939, which was.

Upon motion by Williams second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Upon motion by Green second by.Fryer the Chief of Police was authorized to
make improvements to the Stop and Go signals in accordance with quotations in
a letter received by the Mayor. _
Upon motion by Green second by Fryer the City Clerk wa.s instructed t-o bill
H.T.Earle for repairs on a street and alley department truck damaged in,a
collision.
Alderman Moody introduced the following resolution, which was read:
"A RESOLUTION ACCEPTING THE OFFER TO AMEND THE
CONTRACT CREATED BY THE ACCEPTANCE OF THE
ORIGINAL OFFER OF THE UNITED STATES OF AMERICA
TO THE CITY OF ROCHESTER, MINNESOTA, TO AID IN
FINANCING THE CONSTRUCTION OF STREET IMPROVEMENTS,
INCLUDING SIDEWALKS, DRIVES, SEWER AND WATER
CONNECTIONS.
Be it resolved by the Common .Council of the City of Rochester, Minnesota:
Section 1. That the offer to amend the contract created by the acceptance
of the original Offer of the United States to the City of Rochester, Minnesota,
to aid by way of grant in financing the construction of street improvements,
including sidewalks, drives, sewer and water connections, a copy of which Offer
follows, be and the same is hereby in all respects accepted:

Section 2. That said City of Rochester, Minnesota, agrees to abide by all of
the terms and conditions relating to such original Offer, a copy of which terms
and conditions was annexed to the Government's original.Offer and made a part
thereof.
Section 3. That the Mayor is hereby directed to sign, and the City'Clerk
to Countersign and affix the corporate seal of the City of Rochester, Minnesota,
to the executed amendatory Offer made by-- the United States of America to the
City of Rochester, Minnesota, as eviden6e of the acceptance of said offer by the
City of Rochester, Minnesota.

Section 4. That the City Clerk be and he is hereby authorized and

istration."
Upon motion by Pryer second by Williams that the said resolution be adopted
