Minutes of an adjourned regular meeting of the Common Council of the City i lof Rochester, Minnesota, held in the Council Chambers, in the City Hall, in i n ,,said City, on November 20th,1939. ' President Lemmon called the meeting to order at 7:30 o'clock P.M., the ;i 'following members being present: Lemmon, Amundsen, Fryer, Green, Moody, 1;14rachek, Williams. Absent: None. !I President Lemmon stated this as being the time and place set for a hearing ' on the levying of special assessments for, the grading to an established grade !;line of Fourteenth Avenue Northeast from Fourth Street Northeast to Fifth !'Street Northeast, and asked if any one present wished to be heard concerning l�the said improvement. No one present wished to be heard. �i President Lemmon stated this as being the time and place set for a hearing on the levying of special assessments for the construction of a sanitary sewer in Ninth Avenue Southeast from Seventh Street Southeast to Eighth Street South— east, and asked if any one present wished to be heard concerning the said .�improveient. No one present wished to be hearth President Lemmon stated this as being the time and place set for a hearing on the levying of special assessments for the construction of curb and gutter on Twelfth Avenue Southeast from Center Street East to Second Street Southeast, and ,asked if any one present wished to be heard concerning the said improvement. ,One lady inquired regarding payments being made in installments. The report of the Sewer Committee on the construction of a sanitary sewer in 92 Street Southeast from Ninth Avenue Southeast to 429 feet east, wherein the 'I said Committee does not recommend the construction of a sanitary sever and water ;'main in this location unless the property owners give the City two more rods of land for street purposes, was read and President Lemmon ordered that the said report be placed on file. The report of the Street and Alley Committee and the City Engineer recommend-6 ing that Second Avenue Northeast between Silver Lake and Fourteenth Street ''Northeast be vacated as petitioned, was read and President Lemmon ordered that the same be placed on file. A communication from the Western Surety Company withdrawing their notice I, • ,of cancellation of the license bond of John Kelly, was read and President Lemmon ordered. that the same be placed on file._ A communication from the Central Labor Union recommending Mike Maloney, �, John Bray , and M.F.Benjamin for appointment as Labor Inspector, was read. A motion was made by Alderman Green seconded by Alderman�,to appoint John Bray as a Resident Identification Card Inspector, and after a discussion as to the duties and powers of said Inspector, Alderman Green -withdrew his motion and i ;;Alderman Moody withdrew his second. .,Near the close of the meeting Mr. Coon i! !;requested that said communication be returned to him. A communication from the City Engineer requesting an appropriation of 1 $3, 000.00 from the Street 'and Alley Fund for use of the Street and Alley (Committee was read, and President Lemmon ordered that the same be placed on file. A report from the Zoning Board recommending that the petition of•W.E.Hocking, ,regarding Lot 1,Block 1,D.P.Nadden's Addition, be rejected, was read, and President Lemmon ordered that the same be placed on file. The recommendation of the Finance Committee that $1500.00 be appropriated from the General.Fund to the Library Fund for purchase of new lighting fixtures, was read and President Lemmon ordered that the same be placed on file. Upon motion by Williams second by Amundsen seid recommendation was accepted. The application of the Economy Electric Shop for an electrician's license was reconsidered at this time, and upon motion by Mrachek second by(Amundsen, license was granted. The report of the Clerk of the Municipal Court for the week ending November 13th,1939,showing criminal fines and costs collected $231.90, civil fees received $11.05, and conciliation court fees $3.7.5; and for the week ending November 20th,1939, showing criminal fines and costs collected $370.60, civil fees received $1.35, and conciliation court fees received $11.25, were each read and having been previously approved by the City Attorney, President Lemmon ordered that the same be placed on file., A motion by Moody second by Amundsen carried that Lot 1,Block 1, D.P. Madden's Addition be added to the Commercial District in the proposed new Zoning Ordinance . A petit.ion•:.signed by 13 property owners in Block 4 Kutzky's Addition, Block 2, Flathers Addition, and Block 1 Hammer & Hannings Addition, asking that all of said lands be continued in the residential district zone and not placed in the Commercial zone as proposed in the new ordinance,�was read and President Lemmon ordered that the same be placed on file. Alderman Williams introduced a resolution appropriating $1592.95 from the Park' Improvement Fund and ordering payment made to the Mayo Trust Fund, for which payrolls for labor during the half month ending November 15th,1939,fwa,s read Upon motion by Williams second by Amundsen that the said resolution,be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Mrachek introduced a resolution appropriating $272.64 from the Park Improvement Fund and ordering payment made to Leitzen Concrete. Products for black dirt.purchased during August, September and October,1939, which was read. 0 43® -. T. Earle for cement steps at St.Maryls Park, which was read. Upon motion by Mrachek second by Moody that the said resolution be adopted as read, and all voting �n favor -thereof, President Lemmon declared the said I , ;;resolution -duly passed and adopted. ! Alderman Moody introduced a resolution appropriating $696.75 from the Sewer j1 3?u=d and $10.20 from -the Lighting Fund and ordering payment.made to -the City of IlRochester, Light and Cater Departments, for electricity and water furnished at the Isewage Disposal Plant and Sewage Lift Stations, in accordance with billings of November 15th,1939, Rich was read. , Upon motion by Fryer second by Freen that the said resolution be adopted !I as read, and all voting .in, favor thereof, President Lemmon declared the said i resolution duly passed and adopted. �V Alderman Moody introduced a resolution appropriating $662.49 from the Park Improvement Fund and ordering payment made to the Rochester E & Poultr Company ji P g P ym Egg y ;for grass seed and vigoro, which was read. Alderman Amundsen introduced a resolution appropriating $1500000 from the General Fund and ordering payment made to the Library Fund, for transfer of funds for purchase of light fixtures, whichvas read. Upon motion by Amundsen second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Williams introduced a resolution ordering a hearing on the vacation of Second Avenue Northeast, from Fourteenth Street Northeast to the north shore of Silver Lake, said hearing to be held at 2:00 o'clock P.M., on January 2nd, t 1939,which was read. Upon motion by Amundsen second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared .the said resolution duly passed and adopted. Alderman Williams introduced an ordinance entitled, "An ordinance for the purpose of promoting health, safety, order, convenience and general welfare by regulating the use of land, the location, size, use and height of buildings and the arrangement of building on lots and the density of population*.with the City of Rochester, Minnesota, all in accordance with a comprehensive plan" which was tiven its first reading. the following claims were read, and upon motion by Mrachek second by Williams the same were allowed and the Mayor and City Clerk were authottized and directed to draw warrants upon the City Treasurer and make payments accordingly: From the General Fund: Mark Blanchard $39.60, Walter Trapp $3.00, Graybar Electric Company $10 .50, Miller -Davis Co. $40.00, F.R.Finch $65.09, Wm. Upon motion by Amundsen second by Fryer the non -intoxicating malt liquor licenses of the Checker Board were revoked, effective immediately. !,. Upon motion by Moody second by Green the law suit of R.V.Williams vs. the City of Rochester, was referred to the Finance Committee and the City Attorney. Upon motion by Moody second'by'Williams, the Common Council adjourned until 7:30 o'clock P.M., on November 27th,i939. ` ' City Clerk. El
