President Lemmon called the meeting to.order at 7:30 o'clock P.M.,.the ,following members beilig present: Lemmon, Amundsen,.Anderson, Bowers, Moody, '!villiams. Absent: Mrachek. il Upon motion by Moody second by Anderson, the minutes of the meeting of , ,May 13th, 1940, . were approved. , President Lemmon stated this as being the -time and place set for a hearing ,on the widening of the pavement on and the construction of curb and gutter on Fourth Street Southeast from Third Avenue Southeast_ to Sixth Avenue Southeast, :and, on; Third Avenue Southeast from Fourth Street Southeast to Fifth Street Southeast,_and.asked if any one present wished to be heard concerning the said ,improvements. Frank Stopple spoke in opposition to the,said improvements. President,Lemmon stated this as being the time_and place set for a hearing ion the wideming of the pavement on Center Street 1,7est from Broadway to Seventh i Avenue tritest, and on Second Avenue Northwest from Center Street Viest to the ':'Chicago Great Western Railroad Company. tracks,_ and asked if any one present ,;wished to be heard concerning these improvements. _George Mepcier spoke in ;;opposition to the widening of Second Avenue Northwest. President Lemmon stated this as being the time and place set for receiving 'land opening bids for the widening of the pavement and construction of curb and i -!gutter on Fourth Street Southeast from Third Avenue_ Southeast_ to Sixth Avenue ! Southeast, and on Third Avenue Southeast- from Fourth Street Southeast to Fifth Street Southeast. Upon motion_ by moody second by Bowers it was ordered that the bids on the above improvement of Fourth Street Southeast and Third Avenue Southeast, be returned unopened to the bidders and that further action in said matter be abandoned. President Lemmon stated this as being the time and place set for receiving !,and opening; bids for the resurfacing of the north and south alleys in Blocks 9, '9, 10, 11, 19, 19, 22, 23, 32, 33, 37 and 46 of the Original Plat and Block 20, i ��Moe and Olds Addition, and Mill Reservation, the east and west alley in Block �16, Original Plat, and Third Street Southwest from Broadway to Third Avenue i .Southwest; The following bids were received and opened at this time: i'. Roxanda Mines, Inc.: Top dressing $10.60, Leveling course $6.20, total for I. I,alleys $7,149.20, for street $4,392.00; Ashworth -Hawkinson Company: Top dressing $10.55, leveling course $6.35, .total for. alleys $7,319.14, for street $4,495.13. The City Engineer submitted an estimate of the cost of widening the east side of Third Avenue Southwest from Center Street to First Street Southwest and on First Street Southwest from Sixth Avenue Southwest to Seventh Avenue Southwest, and President Lemmon ordered that the same be placed on file. The recommendation of the Street and Alley Committee and the City Engineer that the bid and proposal of the Rovanda Mines, Inc., for the resurfacing of � the alleys and Third Street Southwest, be accepted, was read, and upon, motion by Amundsen second by Anderson the said recommendation was accepted and ardered placed on file. The application of the Yellow cab Company for transfer of taxicab license N`o= 6 to cover a five pass•eriger LaSalle Sedan bearing state license no. 8774, was read, and upon motion by Amundsen second by Anderson, transfer was granted. The application of the Town Taxi for transfer of taxicab license No.21 It o cover a 7 passenger Buick Sedan bearing state license No.100, was read. and upon motion by Williams second by Amundsen transfer was granted. Applications signed by C.R..Bowen to move four hpuses from the Mayo farm, one to Sady Oaks tourist'camp, one to Douglas, one to a point near Mayowood, and one to 309 Fifteenth Avenue Northeast, were each read, and uponemotion by Bowers second by Amundsen permits were granted, all voting in favor thereof except Aldermen Moody and Williams who voted "No." 0 The surety bond of Martin Paulson in the sum of $3,500.00 with the Fidelity I& Casualty Company of New York as surety, was read and upon motion by Moody second by Amundsen, the said bond was approved the surety thereon accepted and it was ordered that the same be placed on file.. n A petition asking that a sidewalk be constructed on'the north and south sides of Eighth Street Northwest,, from Fourth Avenue to Sixth Avenue Northwest, was read, and upon motion by Moody second •by A- undsen said petition was referred to the Street and Alley Committee and the City Engineer for report on I.June 3 xd, 1940. A petition to vacate the east and west alley in Block 3, Cascade Manor, was read. Mark B.Fuller, Ole Dison, and Mr. Wallace, voiced objections to the closing of this alley, at which President Lemmon ordered that the petition be placed on file for future reference. A petition requesting that the Common Council do not widen the -pavement on Third Avenue Southeast in Block 95 Moe and Old's Addition and Block 1 East East'Rochester Addition, was read and President Lemmon ordered that the same be placed on file. The report of the Clerk of the Municipal Court for the week ending May 20.th,1940, showing criminal fines -and costs collected $254.60, civil fees received $9.40, conciliation court fees $4.50, was read, and having been previously approved by the City Attorney, President Lemmon ordered that the same The placed on file. The recommendation of the Zoning Board that the petition of H.W.Harrison Ito have his.property zoned as commercial<instead of residential be granted, was read, and upon motion by Moody second by Anderson said recommendation besgranted approved. n The recommendation by the Zoning board that the request -of Earnest Heid.tke for permission to build his garage two feet wider. and four feet longer, beta granted, was read and upon motion,.by Moody second by Anderson said recommenda- tion was approved. The recommendation b;7 the Zoning Board that the request of Mrs. Minnie �;Boethke for permission to build a P,arage within two feet or eighteen inches of, !the property line; be granted, was read, and upon motion by Moody second by,. Bowers the said Zoning Board recommendation eras accepted and the permission. ,Igrant e d. Alderman,Plilliams introduced a resolution accepting the -bid and proposal ;of the Roxanda Mines, Inc. for resurfacing the alleys, and Third Street South- 'west,,and fixing the amount of the surety bond to be given by the.said contractor J ,,at the sum of $11, 541.20, which was read. Upon motion by, Moody '.second by Williams that the said resolution be adopted 'as read, and all voting in favor ,thereof, President Lemmon declared the said ;resolution duly passed and adopted. Alderman Williams introduced a resolution appropriating $2,000.00 from the I ';General Fund, and $5,000.00 from the Street and A11ey•Fund; for use of the Street li& Alley Committee, which was read.. Upon motion by Amundsen second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the I' said resolution duly passed and adopted. Alderman Williams introduced a resolution granting public dance permit to :;Dale Hess for the A.O.U.PI.Hall, May lgth, 1940, and fixing the fee at $3.00, ,which was read. , i Upon motion by Moody second by BQwers that the said,resolution be adopted ,as read, and all voting in favor thereof, President Lemmon declared the said ;resolution duly passed and adopted. Alderman Moody introduced a resolution granting public•dance permit to the ;'Central Labor Union, for the Woodman Hall, May 18th,1940, and fixing the fee at $3. 00, which was read. !' Upon motion by YIilliams second by Anderson that the said resolution be If ijadopted as read, and all voting in favor thereof, President Lemmon declared ;the said resolutiona duly passed and adopted. a ` , Alderman Moody introduced a resolution ordering plans for the. widening of Center Street Pest from Broadway to Seventh Avenue Priest, which was 'read. Upon motion by Moody second by Bowers that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said ;resolution duly passed and adopted. The City Engineer submitted pland,specifications and estimate of coat for ,,the widening of the pavement on Center Street W&st from Broadway to Seventh !Avenue Priest, ;i May 20,1940. Alderman Moody.introdueed a resolution adopting the plans, specifications, land estimate of cost for the widening of the pavement on Center Street West, r from Broadway to Seventh Avenue West, ordering that the same be placed on file, ordering a hearing on the said improvement to be held at 2:00 o'clock P.M ., on Mune 3rd,1940, and ordering advertisement for bids to be received and opened at 2 :00. o' clock P.M.,' on June 3rd, 1940, which was read. Upon motion by Moody second by Amundsen that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman.Bowers introduced a resolution appropriating $209.40 from the General Fund and ordering payment made to Mrs. J.M.Hall, for insurance premium on city property,.which was read. Upon motion by Moody_ second by Bowers that the said resolution :be adopt ed as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Bowers,,introduced a resolution appropriating $419.90 from the General Fund and ordering payment made to Herbert G. Knopp, for insurance premium on city property, which was read. Upon motion by Anderson second by Amundsen that the said resolution be < < adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. t Alderman Bowers introduced a resolution appropriating $209.40 from the General Fund, ap.d ordering payment made to Francis V.McGovern Agency, for insurance premium,' on city property, which was read. .Upon motion by Amundsen second by Anderson that th.e said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson -introduced a resolution appropriating $522.52 from the Street and Alley Fund and ordering payment made to the General Fund, for gasoline furnished thru the City Filling station,which was read. Upon motion by Boyers second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declaredthe said resolution duly passed and adopted. - Alderman Anderson introduced a resolution appropriating $239.95 from the Park, Improvement Fund, and ordering payment made to the City of Rochester, Steam Department, for st.eam furnished for heating Mayo Civic Auditorium,which was read. Upon motion by Williams second by Amundsen that the said resolution be adopted as read, and all voting in favor. thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Anderson introduced a resolution appropriating $2, 129.05 from the Park Improvement Fund and ordering payment made to the Mayo Trust Fund, .;for payrolls for labor during the half month ending May 15th, 1940, which was read. Upon motion by`'Amundsen second by:,Moody that the said resolution be tLdp1bted as read, and all voting in favor thereof, President Lemmon deblarred the said :resolution duly passed and adopted. Alderman Amundsen introduced a resolution appropriating $296.76 from the ;,Park Improvement Fund and ordering payment made'to A.D.Reynolds, Collector of 'Internal Revenue, for Government tax* collected at Mayo Civic Auditorium during ,April,l940,which was read. 'I Alderman' Amundsen introduced a resolution appropriating $479.40 from the :Street and Alley Fund, and ordering payment matte to Morse Brothers, for ',sand and gravel furnished April 26th to May 14th,1940, which was read. i Upon motion by Moody second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said .,resolution duly passed and adopted. Alderman Bowers inquired if something could be done about parking large ,:trucks on Broadwa= and other business streets, and upon motion by Williams second by Amundsen, the matter was referred to the City Attorney,the Chief of Police and Street and Alley Committee to draft an ordinance. ' Alderman Moody introduced a resolution ordering that Fourth Street Southeast :from Third Avenue Southeast to Sixth Avenue Southeast be widened and a new curb ,and gutter constructed thereon, and ordering a hearing on the said improvement it'o be held at 2:00 o'clock P.M., on June 3,1940., which was read. ' Upon motion by Moody second by Anderson, that the said resolution be adopted as read, and all voting ih favor thereof, President Lemmon declared' the said resolution duly passed and adopted. i May 20,1940. b3 The Mayor stated that he had sent letters to all employes and officials of the -; ':_City of Rochester, asking for expressions of their opinions regarding, affiliation with labor unions, but that sufficient time had not passed in which Ito receive the replies. The Mayor suggested that at the close of thi's Council Meeting the officials go to the Elk's Club to congratulate Mr. and Mrs. Eugene Schwarz, -who are celeLarating their 50th wedding mniversary. Alderman Williams introduced a resolution accepting the proposal of Burns & McDonnell to make a survey of the local gas company, and authorizing the Mayor and City Clerk to execute a contract accordingly, which was read. Upon motion by Amundsen second by Anderson that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the (said resolution duly passed and adopted. Upon motion by Anderson second by Amundsen, the sum of $199000 was appro- priated from the General Fund and ordered paid to Paul Grassle, Mayor, for use lin his Mayor's Contingent Fund, which was read. Upon motion by Williams second by Amundsen the City Clerk ivas instructed to make reservations for eight delegates to the League of Minnesota Municipalities convention.
