Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall,. in
said City, on February 26, 1958.
President Schroeder called the meeting to order at 3:00 o'clock P. M.,
the following members being present: President Schroeder, Aldermen Briese, LeWitz;
Haas, Kamm, Morris. Absent: Alderman Tingley.
President Schroeder .stated this as being the time and place set for
receiving and opening bids for base, bituminous surfacing and concrete paving
at the Rochester Municipal (New) Airport. The ten following bids were received
and opened and upon motion by Haas, second by Briese, the same were referred to
the Airport Commission and the consulting engineers for tabulation and report,.
The bids of McGarry Bros. of St. Cloud, Minnesota in the amount of $908,175•99;
W. Hodgman & Sons Inc. of Fairmont , Minnesota in the amount of $945, 400.07;
Jay W. Craig Company of Minneapolis, Minnesota in the amount of $956,979.33;
Mathy Construction Company of LaCrosse, Wisconsin in the amount of $1,_047,993.37;
S. J. Groves & Sons Company of Minneapolis, Minnesota. in the amount of $1, 057, 455. 8
Judd Brown Construction Company of Mankato, Minnesota in the amount of $928,g10.16;
Alexander Construction Company, Inc. of..Minneapolis, Minnesota in the amount of
$940,959.71; Ashbach Construction Company of St. Paul, Minnesota in the amount of
$1.005, 361. 53; Ulland Bros. Inc. of Austin, Minnesota, in the amount of $907, 363.90;
and G. H. Lindekugel & Sons of Mitchell, South Dakota in the amount of $914,059.76.
The Council then proceeded to the polling places in the various precincts)
of the City to inspect the register counters of the voting machines and to compare
the number of votes shown by such voting machines with the returns submitted by
the Judges at the Primary Election held on February.25, 1959.
After making the canvass of the voting machines the Council members
returned to the City Hall at 5:00 P. M. and President Schroeder called the meeting
to order, the following members being present: President Schroeder, Aldermen
Briese, DeWitz, Haas, Kamm, Morris. Absent Alderman Tingley.
Alderman Morris then introduced the following resolution which was read:
"Be it resolved by the Common Council of the City of Rochester,
Minnesota:
_That the following is a tabulated statement of the number of votes
cast for each person at the Primary Election held on the 25th day of
February, A. D. 1958, in the City of Rochester, as determined by said
Common Council on the canvass of the returns of the said Primary Election
made this 26th day of February, A. D. 1959, and that the,said tabulated
statement is hereby declared to show the results of the said Primary
Election:

-Be .it further resolved by the said Common Council:-
That Adolph M. Bach and Alex P. Smekta are hereby declared to he
candidates for the Mayor of the City of Rochester, Minnesota,_ at the
Charter Election to be held March llth, 1959.
That David G. Hanlon and Roy H. Nordby are hereby declared to be
candidates for Alderman of the, First Ward, of the City of Rochester,
Minnesota, at the Charter Election to be held March llth, 1959.
That the City Clerk of said City is hereby instructed to cause
.the names of the s aid persons to be printed as candidates for the
respective offices upon the official ballots at the coming Charter
-Election...to be held March llth, 1959.
A motion was mad'e by Alderman Morris, second by Alderman Haas, that the said
resolution be a.dopted as read, and all voting in favor thereof, President Schroeder
declared the said resolution duly passed and adopted.
Alderman Morris stated that the Attorney representing the owners of the
Bottke and Greenwaldt property on 7th Street Northeast had requested that'action
on.the award for the condemnation of the said property be deferred until the
to be held next Monday. Upon motion by Morris, second by DeWitz, the
meeting
matter was tabled until the meeting to be held Monday, Flarch 3, 1959. All voted
favor thereof.
Upon motion by Morris, second by Briese, the meeting was adjourned until

Minutes of an adjourned meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers in the- City -Hal-1, -in said City
on February 26, 1959.
President Schroeder called the meeting to order at 7:30 P. 'M., the
following members being present: President Schroeder, Aldermen Briese, DeWitz,
Haas, Kamm, Morris, Tingley.
The following recommendation of the Rochester Airport Commission was
read:

"To the Common Council of
the City of Rochester, Minnesota
Gentlemen: `
At a meeting of•the Airport Commission of the City of Rochester
held on February 26th, 1959, the Commission was informed that Mr.
Vincent Lilly, whose land, was condemned for airport purposes on
March lgth, 1957 and who appealed the condemnation award to the
District Court of Olmsted County, is willing to settle his claim
and dismiss his appeal upon the payment of the condemnation award
plus interest -as required by law plus the additional sum'of $750.00.
In other words, the -claim can be settled by payment of the sum that
would be legally -due and owing if the appeal were dismissed plus
the sum of $750.00.
The City Attorney recommended that this compromise settlement
be accepted in the best interests of the City of Rochester, having
in mind trial costs and,accumulation of further interest charges.
After due consideration the Airport Commission recommends to
the Common Council•that,the compromise settlement offer be accepted
and the necessary funds be appropriated to. dispose of this claim
f or.thwit.h.

R. V. Ehrick, City Attorney, recommended to the Council that this recommendation
be accepted as he felt Mr. Lilly was willing to enter into a settlement and.
dismiss his.appeal upon payment of the award and interest and plus the $750.00.
Upon motion by Haas, second by Tingley, the recommendation was accepted. All
voted in favor of the motion.
The recommendation of the. Airport Commission recommending to the
Common Council that the bid of Megarry Brothers, a'partnership of St. Cloud,
Minnesota, be accepted in the sum of $909,175.99, for the construction of runways,
taxiways and aprons at the Rochester Municipal -(New) Airport and that W. Hodgman
& Sons, Inc. of Fairmont, Minnesota whose bid was $945, 400.07 .be .declared the 2nd
lowest responsible bidder was read. Upon motion by .Tingley, second by Kamm,- the
recommendation was approved.
A petition protesting the change of zoning of real estate in Belt Line
SUb-Division signed by William K. Manahan, Albert Erath, William J. Laabs, Maurice
Starkson, Theodore Rieple, Otilie Engvaldsen, Stanley J. Oakes, Paul Grotebaer,
Gynith Gratebaer and Elinaveta Manahan was read and upon motion by Tingley, second
by DeWitz, the same was referred to the Board of Zoning. All voted in. favor thereof
The following resolutions were each introduced and read and all voting
in favor thereof, President Schroeder declared the same duly passed and adopted:
Resolution authorizing and directing the City Clerk to advertise for bids
for the construction of control room addition to Fire House No. 1. Upon motion by
Morris, second by Briese, resolution adopted.
Resolution appropriating $26,9-49.00 from the General Fund and ordering
payment made to Vincent S. Lilly and Olmsted County Bank & Trust Company, $25,6

and Vincent S. Lilly and John M. Sharp, his attorney, and Olmsted County Bank &
Trust Company, $1,150.00. Upon motion by Haas, second by Tingley, resolutiona
adopted.

A resolution accepting the low bid on airport site prepara"xon project,
authorizing the execution of contract, directing return of certified checks and

authorizing the ex-ecu-tion of certain state forms was read and upon motion byHaas,
second by Tingley, and all voting in favor thereof, President .Schroeder declared
the said resolution duly passed and adopted.
Upon motion by Haas, second by Kamm, the. meeting was adjourned.
