Special meeting of the Common Council of the .City of Rochester, Minnesota, held in
the Council Chambers in the City Hall, in said City, on October 22, 1964.
President DeVreis called the meeting to order at 4:30 o'clock P. M., the following
members being present:. President DeVries, Aldermen Day, Eichten, McCaleb, Perry, Wilson.
Absent: Alderman Hanlon.
Upon motion by Perry, second by McCaleb, and all present voting in favor thereof,
the meeting was moved to the Mayor`s office, due to court being held in the Council Chambers.
The call of the special meeting was read and President DeVries ordered the same
placed on file, the said meeting having been called for the purpose of hearing Van Cuyk and
Leach on the South Broadway Project and any other business the said Common Council may deem
proper.
Mayor Smekta stated that Mr. Uan Cuyk and Mr. Leach had approached him about their
problem considering real estate tax reduction on their property on South Broadway and he felt
this was a problem the Council should discuss and that is why he had called this special
meeting. Mr. John Van Cuyk and Mr. William Leach were both present, also Mr. Austin Dunagan,
County Assessor, Mr. Alfred Nelsen, City Assessor and Mr. R. V. Ehric}c,City Attorney.
The following letter was then read:
"TO: The Common Council,City of.Rochester, Minnesota
SUBJECT: Consideration of Real Estate Taxreduction and freeze for real
property described as: South 44_ feet of Lot 9 and all of sots
10-11-12, Block 20, Iloe & Olds Addition, City of Rochester,
Minnesota.
This bequest is necessary for the continuance and consummation of the development
of the above described property.
An exhaustive study,has been made to determine the economic feasibility of the
above described property by Apache Realty,Minneapolis, Minnesota; Horwath &
Horwath, a Minneapolis accounting firm; Ralph Meyers, an AIA Registered Architect
with Kivett & Meyers, Architects and Engineers, Kansas City, Missouri. The
results of their findings definitely state that a Real Estate Tax reduction
and freeze for a period of five (5) years is mandatory so that the project now
under consideration can.be economically feasible.
Letters from the above mentioned parties are in our possession and confirmation
can be read to you if so requested.
We sincerely trust that the Common Council will join us in..the attempt to
further the betterment of Downtown Rochester by -granting this request.

Both Mr. Van Cuyl and Mr.-I"6h spoke, stating that they were paying high taxes on this
property but were receiving a very small income from it,most of the buildings in this block are
bacant because when their leases ran out they moved to different locations, they felt that the
fact that the buildings were not producing revenue should be recognized in the tax rate; they
said the taxes were their big bottle neck and they would appreciate anything that could be done.
R. V. Ehrickp City Attorney, informed the Council that there is no authority under the
Minnesota law for this; -he said some states do provide some measure of tax relief to properties
that are in the process of development, but Minnesota laws made no such provision and therefore
the Council had no authority to grant such a request. A lenghty discussion was held on the

matter and the possibility of seeking help from the State Legislature was discussed. Mr. Ehrick
was to research further the matter of the tax freeze and Mr. Dunagan and Mr. Nelson were instructed
to reappriase the properties in the next few days and determine whether or not the current
assessments are too high.
A.motion was then made by Wilson, second by McCaleb, that the,Council consider business
other than the call and upon roll call all present voted in favor thereof.
A letter signed by Mr. and Mrs. D. N. Munger stating that the water on the property they
own at 1808 - 2nd Street S. W. has become contaminated and they are unable to use it,he would
like to hook pp with the city water and sewer and he was willing to have -his property annexed
to the City, was read. This property is presently in the process of being annexed. A motion
was then made by Wilson, second by Eichten, that the City Engineer be instructed to issue a
permit allowing Mr. Munger to connect.to the city sewer and water; all present voted in favor
thereof.
Alderman Perry introduced a resolution amending the Comprehensive Resolution adopted by
the Common Council on July,21,1958, establishing parking an4 parking meter regulations,and pro-
visions pursuant to Ordinance No. 871,aas amended, by. further amending it as follows:
(1) Subsection (c) ZONE C of Section (8) LIMITED PARKING ZONES is hereby
amended.by adding thereto subparagrpahs 16, 16, 18 and 19 to read in their
entirety as follows:
1116. On North Broadway on both sides of the street between Fifth Street and
Seventh Street between the hours of 8:00 a.m. and 6:00 p.m. -on -Monday through
Saturday.
"17. On Fifth Street Northwest on both sides of the street between Broadway
and First Avenue Northwest between the hours of 8:00 a.m. and 6:00 p.m. on Monday
through Saturday.
"18. On Sixth Street Northwest on both sides of the street between Broadway
and First Avenue Northwest between the hours of 8:00 a.m. and 6:00 p.m. on Monday
through Saturday.
"19. On Sixth Street Northeast on both sides of the street between Broadway
and First Avenue Northeast between the hours of 8:00 a.m. and 6:00 p.m. on Monday
through Saturday.
A motion was then made by Wilson,,second by Eichten, that,the said resolution be adopted as
read and all present voting in favor thereof, President DeVries declared the said resolution
duly passed and adopted.
Upon motion by McCaleb, second by Wilson,and all present voting in favor thereof, the
meeting was ad§urned.
