Minutes of a regular meeting of the Common Council of the City.'of Rochester,
'Minnesota, held in the .Council Chambers, in the City Hall, in said City, on
JjJune 3rd, 1940.
President Lemmon called the meeting to order at 2:00 o'clock-P.I.I., the
following members being present: Lemmon, Amundsen, Anderson, Bowers, Moody,
fjMrachek, Williams. Absent: None.
Upon motion by Mrachek second by Moody the minutes of the meetingsof May 20tt
land May 29th,1940, were each approved.
President Lemmon stated this as being the time and place set for a hearing
Ion the widening of the pavement and construction of curb and gutter on Fourth
Street Southeast from Third Avenue Southeast to Sixth Avenue Southeast, and
asked if any one present wished to be heard concerning,this improvement.
Lawrence Rudlong appeared before the Council and stated that he did not oppose
the improvement but did not think that the costs thereof should be assumed.by
the property owners. Lawrence Rudlong also presented a petition asking that -
the costs of this improvement be char#ed to general taxes,and President Lemmon
ordered said petition placed on file.
President Lemmon stated this as being the time and place set for a hearing
Ion the widening of the pavement on Center Street West from Broadway to Seventh
(Avenue West, and asked if any one present wished to be heard concerning the
said improvement. No one present wished to be herad.
President Lemmon stated this as being the time and place set for a hearing
on the construction of a sanitary sewer and water main in Second Street Southwest,
from Sixteenth Avenue Southwest to the west line of Lot 3,Block 2, Westlawn
Addition, and asked if any°one present pished to be heard concerning the said
improvement. No one present wished to be heard.
President Lemmon stated this as being the time and place set for receiving
bids for the widening of the pavement on Center Street West from Broadway to
Seventh Avenue West. The following bids were received and opened at this time:
L-M.Feller Co. $10,136.00 for widening; J. H. Ganley Co., Widening $9960-50,
resurfacing $6929.11; H.T.Earle widening $9946.75, Roxanda Mines, Inc.
resurfacing $6,731.00. President Lemmon referred the said bids to the Street &
Alley Committee and the City Engineer for tabulation and recommendation.
President Lemmon stated this as being the time and place set for receiving
and opening bids for the construction of a sanitary sewer and water main in
Second Street Southwest from Sixteenth Avenue Southwest to the west line of Lot
3, Block 2, Westlawn Addition. The following bids were opened at this time:
Martin Paulson $670.38, Wm. C. Fraser & Son $771.90. President Lemmon referred
the said bids to the Sewer Committee and the City Engineer for tabulation and

President Lemmon stated this as being the'time and place set for receiving
bids for the cleaning and painting of the East Center Street bridge. The
one year guarantee,
following bids were opened at this time: E. J. Puterbaugh/$753.00, E.A.Danewick
$934.00, ten year guarrantee;:',;Marcus H. Mattison $1196.00, no guarantee.
After considering-the_:above' bid&; a'..inotion was made -by Alderman Moody
second by Williams, and .carried that all bids be rejected, the certified checks
returned to the bidders, and the City Engineer to prepare new specification
with readvertisement for bids to be opened June 14th,1940.
President Lemmon stated this as being the time and place set for receiving
and opening bids for furnishing 750 feet of fire hose for use of the Fire
Department. The following bids were apened at this time:

Fold White Cotton D.J. $.90, Relianoe White Cotton D.J. $.75, and Elkshead

Eureka Fire Hose Division: White Oak $1.05, Special Double Jacket $.92,
Eureka Underwriters $.655;
President Lemmon referred the said bids to the Fire Department Committee
and the Chief of th4 Fire Department for recommendation.
Glenn Devlin appeared before the Council and requested that the Council
cooperate with the Fair Board to the extent that carnivals and other shows
be not licensed from July 1st until after the close of the Olmsted County Fair,
and upon motion by Moody second by Anderson the Council went on record as
favoring Mr. Devlin's request.
Mrs. Manion inquired as to when the sidewalk would be constructed in front
of her property and the matter was referred to the Street and Alley Committee
and the City Engineer and they were requested to look the situation over and
report at the meeting of June 14th,1940.
Arthur Reiter, President of the Park Board appeared before the Council
and requested that approximately the same amount of money be transferred to
the Park Improvement Fund for maintenance of the parks during the coming year
as had been transferred last year, $5,000.00 of that having already been
transferred.

The following recommendation of the Finance Committee was read:

. After careful consideration of t.he finances on hand and
the income to be received for code 19, this committee wishes
to report that we would recommend that $5000.000 be paid to the
Park Board on this date and that $1000 be paid such Board
on the regular monthly meeting of the Common Council, this
amount to be the total amount to be transferred to that
Board up to April 1,194 1, first monthly pa3nmbnt to be made
on July 1,1940.

On motion by Mrachek second by Moody a transfer of 45,000-00 •to the Park -
Improvement Fund was approved and -the date of June 7th,.1940 was set for the
ICounci.l.to meet with the Park Board to discuss further the appropriation of
I funds for maintenance of the Parks.
A communication signed by Mrs. Boyd Skyhawk asking to withdraw the petition
for vacating the alley in Block 3, Cascade Manor, and upon motion -by Mrachek
second by Moody her request was granted.
A circular letter from the Executive Secretary of the .League of Minnesota
1,1unicipalities regarding Constitutional Amendment No.l to be voted on in
Minnesota in November of .this year, was read and President Lemmon ordered that
Ithe same be placed on file.
The appointment by the President of the Common Council of Bernard Amundsen
Thomas A.9oody and Harold J.Mrachek, as members of the Equalization Board
was read and upon motion by Mrachek second by Williams it was ordered that the
same be placed on file.
The emergency authorization given by the Mayor to the City Clerk for the
purchase of an 9,000 gallon car of gasoline for the city bulk station, was
read and upon motion by Mrachek second by Anderson the Council approved the
action of the Mayor.
A communication from Burns & McDonnell Engineering Company, employed by
the City to make a report on the Peoples Natural Gas Company, was read and
President Lemmon ordered that the same be placed on file.
A communication received by the Mayor from the Peoples Natural Gas
Company at Omaha, Nebraska, stating that representatives of the Burns & McDonnell
Engineering Company arrived in Omaha on May 29th,194o, was read and President
Lemmon ordered that the same be placed on file.

The requisition by the Deputy Health Officer upon St.14ary's Hospital for
the isolatnon of Earl Holmberg, diagnosed to be suffering from erysipelas,
was read and President Lemmon ordered that the same be placed on file.
Upon motion by Amundsen second by Bowers the necessary changes made to
date by the City Engineer on the storm sewer being constructed in Third Avenue
Southwest, Center Street West, Second Avenue Northwest and Fifth Street
Northwest and Northeast, were approved.
L. M. Feller Company submitted an estimate of the changes on the trunk
Iline sewer and President Lemmon ordered that the same be placed on file.
The first and final estimate by the City Engineer on the contract for
the construction of curb and gutter on Second Street Southeast, was read and
(President Lemmon ordered that the same be placed on file.

A petition asking that Fifth Avenue Southeast from Twelfth Street Southeast
to Thirteenth Street Southeast be oiled, was read, and the City Clerk was
instructed to prepare a resolution ordering a hearing on the same to be held

A petition asking that curb and gutter on Second Street Southeast from`
IThirteenth-Avenue to -Fifteenth Avenue Southeast be constructed, was read and
President Lemmon ordered that the same be placed on file.
A remonstrance against the construction of a sidewalk on the north side of
Eighth Street Northwest, was read, and upon motion by Amundsen second by Moody
the same was re£@rred to the Street and Alley Committee for report on June 14th,
1194o .
The application of M.P..ihaloney for a transfer of his various licenses from
1115 Broadway Street North to 119 Broadway Street North, was read, and upon
emotion by Bowers sedb nd by rrachek transfers were granted.
The applications of Leonard Drake, Wm. Helmkay, Don Arenz, and J.K.Williams
I for licenses to sell soft drinks, were each read, and- upon motion by Amundsen_
(second by Bofvors licenses mere"granted.
The application of Clinton E.Wilson for a journeman Electrician's license
was read, and upon motion by Williams second by Mrachek said application was
I referred to the License Committee.
The application of R.L.Harrell for a journeyman electrician's license
Ilwas read, and upon motion by Bowers second by Williams said application was
(rejected.
The application of Donald W.Cain for a drivers license was read, and upon
jmotion by Mrachek second by Amundsen license was granted.
The application of John M.Shank for a permit to place and maintain a sign
jwas read, and upon motion by Amundsen second by Bowers permit was granted.

The application of 'M. J. Donahue for transfer of on sale liquor license
No.91 from 20 Third Street Southwest to 307 Broadway Street South, was read,
and upon notion by Mrachek second by Williams said application was referred
to the License Committee.
The application of Fellows & Hilmer for an auctioneers license was read,
and upon motion by Moody second by Williams license was granted.
The report of the Clerk of the Municipal Court for the week ending
May 27th,1940, showing criminal fines and costs collected $202.75, civil fees
received $11.15, conciliation court fees $9.50, was read, and having been
previously approved by the City Attorney,President Lemmon ord4red that the same
be placed on file.
The official bondsol James Starkey in the sum of $5,000.00 with the
Commercial Casualty Insurance Company as surety, of Ralph B. Compton in the
sum of $3;000.00 with the Great American Indemnity Company as surety, and of
Donald Dwight Murray, in the sum of $5,000.00 vrith.the Great American
Indemnity Company as surety, were each read, and upon motion by Doody second
by Bowers the said bonds were approved, the sureties thereon accepted and it
was ordered tha t the same be placed on file.
The license bonds of F.F.Hilmer and Leonard A.Fellows, in the sum of
$1,000.00 each and with the National Surety Corporation as surety thereon, were
each read, and upon motion by Moody second by Bowers, the sai'd.bonds were
approved,the sureties thereon accepted and it was ordered that the same be
placed on file.
The liability insurance policy of J.C.Adams,' doing business as the Town
Taxi Company, issued by the Anchor Casualty Company, was read and upon motion by
Williams second by Mrachek the said policy was approved and ordered placed on
file.
The report of the City Engineer for the month of June,1940, showing
expenditures from the General Fund, for labor, $563.14, Street and Alley Fund
$1801.77, Sewer Fund $616.19, Bridge Fund $7.61,'w as read and President Lemmon
ordered that the same be placed on file.
The statement of receipts and expenditures'by the Park Board from the
Park Improvement Fund, as at lAay 31,1940, was read anA President Lemmon ordered
tgat the same be placed on file.
A recommendation by the Lighting Committee that street lights be in6talled
on Fifth Avenue Southeast between Tenth Street and Eleventh Street Southeast,
on Seventh Avenue Southeast between Tenth Street and Eleventh Street Southeast,
at the intersection of Twelfth Street and Eleventh Avenue Southeast, at the

intersection of Thirteenth Street and Eleventh Avenue Southeast, and at the
intersection.of Fourth Avenue and Eleventh Street Northwest, -was read, and
upon motion by Moody second by Williams the said resommendation was accepted
and the City Clerk instructed to request that the Public_Utility Board make
installations accordingly.
Alderman Williams introduced a resolution accepting the bids of Harry T. Earl
and the Roxanda Mines, Inc. for the furnishing of all labor, materials, equip-
ment, etc., necessary for the widening of the pavement on Center Street West,
from Broadway.to Seventh Avenue West, and fixing the amount of the surety bonds
to be given by the said contractors at the sum of $6,731.04 for the Roxanda
Alines, Inc., and $9,946.75 for Harry T. Earle, which was read.
Upon motion by Williams second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and. adopted.
Alderman Williams introduced a resolution accepting the bid of Martin
Paulson in the sum of $670. 39 for the construction of a sanitary sewer and
water main in Second Street Southwest from Sixteenth Avenue Southwest to the
west line of Lot 3,Block 2,.Westlawn Addition, which was read.

Upon motion by Amundsen second'by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared.the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution purchasing 250 feet of fire hose
;from W.S.Nott Company at $1.00 per foot, 250 feet from the Manhattan Rubber
Company at $.61 per ft., and 250 feet from the Hewitt Rubber Company at $.61
l per foot, which was read.
Upon motion by Mrachek second by Anderson that the said resolution be
.adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution ordering plans for the widening
of the pavement and construction- of curb and gutter on Fourth Street Southeast,
from Third Avenue Southeast to Sixth Avenue Southeast, which was read.
Upon motion by Moody second by Bowers that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
The City Engineer submitted plans, specifications and estimate of cost.
for the widening,,and construction of curb and gutter on Fourth Street Southeast,
as above described.
Alderman Mrachek introduced a resolution adopting the plans, for the
widening of Fourth Street Southeast.as above described, ordering a hearing on

Upon motion by Moody second by Mrachek that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said

Alderman'M.rachek introduced a resolution appropriating $10",06G.06 from the
General Fund and ordering payment made to the Sewer F unfl, for a temporary
transfer of funds to make same available for construction of a storm sewer in
Third Avenue Southwest,Center Street Nest, Second Avenue Northwest and Fifth
Street Northwest and Northeast, which was read.
Upon motion by Williams second by Anderson that the said resolution be
adopted as read, and all' voting in favor thereof, President Lemmon declared the
said resolution dull passed and -adopted.
Alderman Moody introduced a resolution appropriating $16,066.06 from the
Sewer Fund and ordering payment made to Fraser & Feller for payment of the
first estimate on the contract for construction of -=a trunk line sanitary sewer
in Third Avenue Southwest, Center Street West, etc., $12,952.34 and for
changes and additions in accordance with sworn billing'of June 3,1940,03;31'3.72,
which was read.
Upon motion by'Amundsen second -by Boyers that the!said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $800.47 from the
Permanent Improvement Revolving Fund and ordering payment made to Harry T.Earle
for first and final estimate on contract for construction of curb and gutter
on Second Street Southeast from Eleventh Avenue to Thirteenth Avenue'Southeast,
which was read.
Upon motion by Moody second by L4rachek that the said resolution be adopted
as read, and all voting in favor -thereof, President Lemmon declared the said
resolution duly passed and adopted. '
Alderman Moody introduced a resolution appropriating $5,000.00 from the
General Fund and ordering payment made to the Park Improvement Fund, for
transfer of'funds to make same available for maintenance of parks, which was
read.
Upon motion by Mrachek second by Amundsen that the said resolution be
adopted as read, and all voting in favor therebf, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Bowers introduced a resolution appropriating $302.88 from the
Park Impr.ovement Fund and ordering payment made to the Toro •Manufacturing
Company for 1 Park special 30" power mower, which was read.

Alderman Anderson introduced a resolution appropriating $349.39 from
the General Fund and ordering payment made to the Standard Oil Company for
tank car ,+'UTLX 52405 of road oil, which was read.
Upon motion by Bowers second by Anderson that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Boners introduced a resolution granting public dance permit to
(Dale Hess .for the A.O.U.W.Hall, May',25th and June 1st,1940, and fixing the fee
l at $6.00, which was read.
Upon motion by Moody second by Boners that the said -resolution be adopted
as read, and all voting -in favor thereof, President Lemmon declared the said
(resolution duly passed and adopted.
Alderman Bowers introduced a resolution granting public dance permit to the
10entral Labor Union for the Woodman Hall, May 25th and June lst,1940, and
fixing the fee at $6.00, which was read.
Upon motion by Anderson second by Amundsen that the said resolutionbe
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted. -
Alderman Anderson introduced a resolution •appropriating $224.58 from the
General Fund, $2.00 from the Street and Alley Fund, and $2, 924.99 froi4 the
(Lighting Fund and ordering payment made -to the City of Rochester, Light and
Water Departments, for- electricity and water furnished for public grounds and builjdings
l in accordance with billings -of May 25th, 194o', which was read.
Upon motion by Williams second by Anderson that the said resolution be
adopted as read, and all -voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution -ordering a hearing on the
construction of curb and gutter on Second Street Southeast from Thirteenth
�jAvenue Southeast to Fifteenth Avenue Southeast, said hearing to be held at
17:30 o'clock P.M., on June•14th,1940, which was read.
Upon motion by Moody second by Williams that the said resolution -be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution accepting the plat of Rummers
First Subdivision, which was read.
Upon motion by Mtachek second by Bowers that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Amundsen introduced the following resolution, which was read:
"WHEREAS, The City of Rochester, Minnesota, has entered into a contract
with Wm..C..Fraser & Son and L.M.Feller & Company for the construction of a
surface drainage (storm)•sewer cgmmencing at Fourth Street and Third Avenue
Southwest, running thence north on Third Avenue to Center Street West, thence
east on Center Street West to Second Avenue Northwest, thence north on Second
Avenue Northwest to Fifth Street.Northw"t, and thence east on Fifth Street
Northwest and Northeast to the Zumbro River, and
WHEREAS There are not sufficient funds in the City Treasury of the City of
Rochester, Minnesota, for the payment of the cgst and expense of the construction
of the above described surface drainage sewer, and it is consequently necessary
to issue sixty-two thousand dollars ($62,000.00) City of Rochester, Minnesota,
21% Surface Drainage Sewer Bonds, and '
WHEREAS, Chapter 168 of the Laws of Minnesota, for 1927, provides authority
for the issuance of surface drainage sewer bonds to realize funds for the pqy-
ment of the cost and expense of constructing surface drainage sewers, and
WHEREAS, It is deemed necessary and expedient that the form of the said
sixty-two thousand dollars ($62,000.00) surface drainage sewer bonds be pre-
scribed and adopted by this Common Council, and it is necessary to sell and
issue,at this time sixty-two thousand dollars ($62,000.00) par value of said
surface drainage sewer bonds under and by authority of the said Chapter 168
of the Laws of Minnesota for 1927;
SO THEREFORE,. Be it resolved by the Common Council of the City of Rochester,
Minnesota:
That said bonds shall be dated June 1st,194o, shall be payable at the office
of the City Treasurer in the City of Rochester, Minnesota, shall be sixty-two
(62) in number and numbered one (1) to sixty-two (62), both inclusive, in the
denomination of One Thousand,Dol]ars ($1,000.-00) each, shall bear.interest at
the rate of two and one half'per cent (2-%) per annum, payable semi-annually, on
the first days of June and December, and ghall mature Twelve Thousand Dollars
($12,000.00) on June lst,13-4`1, Twelve Thousand Dollars ($12,000.00) on June lst,
1942, Twelve Thousand Dollars ($12,000.00) on June lst, 1943, Twelve Thousand
Dollars ($12,000.00) on June 1st, 1944, and Foi4rteen Thousand Dollars ($14,000.00;
on June 1st, 1945..
Be it further resolved by the said Common Council:

Surface Drainage Sewer Bond
That said bonds shall

KNOW ALL MEN BY THESE PRESENTS THAT The City of Rochester, in the County
of Olmsted, and State of Minnesota, acknowledges itself to be indebted; dnd
for value received, hereby promises to.pay to bearer the sum of ONE THOUSAND
DOLLARS on the -first day of June 1941 (1942, 1943,•.1944, 1945) together with
interest thereon from the date hereof until paid at the rate of two and one
half (2%) per cent per annum payable semi-annually on the first days of June
and December in accordance with and upon presentation and surrender of the
attached interest coupons as,they severally become due. Both principal and
interest of this bond are payable at the office of the City Treasurer in the
City of Rochester, Minnesota, in lawful money of the -United States of America,
and to provide money for the prompt and full payment of the principal and inter-
est as the same become due, the full faith, credit,.and resources of said city
have been and are hereby irrevocably pledged.
This bond is one of a series of bonds of like date and tenor issued by the
City pursuant to Chapter 168 Laws of Minnesota for 1927 and in conformity with
the city charter and the Constitution and laws of the State of Minnesota there -
unto enabling, for the purposes of constructing,of surface drainage (storm)
sewers in the said city.
IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions, and things
required by the Charter of the City of Rochester, Minnesota, and the constitu-
tion and laws of the State of Minnesota to have been done, to have happened,
and to have been performed precedent to and in,the issuance. of this bond, have
been done, have happened, and have been performed in regular and due form,
time, and manner as required by law; that prior to the issuance of this bond a
direct, annual, irrepealable tax has been levied on all of the taxable property
to said city in an amount sufficient to pay the principal and interest of this

bond as the same become due; and this bond, 'together with all other debts of
said city outstanding on -the date hereof, does no:t exceed any charter, statutory,

said City by the Mayor and attested by the City Clerk, and the sea] of said City

printed, engraved, or lithographed facsimile signature of said City Clerk; and
that the full faith credit, and resources of said City shall be, and they are
hereby irrevocably pledged to the ptompt and full payment of the principal and
interest thereon.
Be it further -resolved: That the City Clerk is hereby authorized and
directed to prepare and furnish to the purchasers of said bonds, and their
attorney, certified copies of all proceedings and records relating to said
bonds and the financial affairs of said city, and such other certificates as
may be required to show other facts within his knowledge or as shown by the
books and records under his custody or control relating to the issuance of
;said bonds, and to the right, power, and authority of the municipality to
tissue the same, and said certified copies and certificates shall be deemed the
(representations of the City as to the facts stated therein.
Be it further resolved: That it is deemed to be necessary that there
shall be, at this time, issued and sold sixty-two (62) bonds of one thousand

of the Common Council of said City, which is hereby fixed to be held in the

said bonds, in the Rochester Pbst-Bulletin, a local newspaper printed and pub-

dollars ($62,00000) City of Rochester, Minnesota, two and one half per cent
(21%) surface drainage sewer bonds, or such part thereof the bidder desires to
make a bid for, then to be issued and sold, being an issue authorized by Chap -
,ter 169 of the Laws of Minnesota for 1927, for the purpose of securing funds
for the payment of the cost and expense of constructing a surface drainage
(storm) sewer commencing at Fourth Street and Third Avenue Southwest running
(thence north on -Third Avenue to Center Street Vest, thence east on Center Street
;West to Second Avenue Northwest, thence north on Second Avenue Northwest to
Fifth Street Northwest, and thence east on Fifth Street Northwest and Northeast
to the Zumbro River.

All'of-said bonds shall be of the denomination -of one thousand dollars
(.$1, 000.00) _each, dated June 1st, 1940, and to mature $12, 000.00 thereof on
June 1st of each of the years, 1941; .1942, 1943, - 1944, and $14, 000:00 thereof
Ion June 1st,1945, with interest until paid at the rate of two and one half
iper-cent-(21%) per annum, payable -semi-annually on the first days of June and
'December of each year. Both principal and interest on the said bonds will be
payable at the office of the City Treasurer of the City of Rochester, Minnesota.
All bids must be addressed to the undersigned City Clerk of Rochester, MinrEesota,
and -be accompanied by a certified check for two per cent (2%) of the principal
of the bonds bid for, payable, without any condition, to the order of the City
Treasurer of Rochester; Minnesota, -which two per cent (2p) will, if the bid is
accepted, be applied to the purchase price of the bonds, otherwise to be return-
ed to the unsuccessful bidder or bidders, ' and such successful bidder will be
required to accept delivery and pay for the said bonds June 21,1940.
,No bids will be considered for less than par value.
The City Clerk is authorized and directed to prepare and furnish to the
purchaser of said bonds, and their attorneys, -certified copies of all proceed-
ings and records rel ating to said bonds and the financial affairs of said
City, ,and such other, certificates as may -be -required to show other facts -

Alderman Moody introduced a "resolution ordering advertisement -for bids
for the purchase of the Witherstine Property, Lots 10, 11, 'and 12, Block 19,
Original Plat, said bids to be received and opened at 7:30 o'clock P-.n:., on
June 24th, 1940, Which was read.
Upon motion by Moody second by Williams that -the said resolution be adopted
as read, and all voting 'in favor thereof, President Lemmon declared the said
resolution duly passed and adopted. -
Alderman. Williams introduced an or-din-ance amending an ordinance fo-r the
purpose ,of promoting health, safety, order, convenience and general welfare
by' regulating the use of land, the location, size, use and -height of bui-ldi-ngs,
and the arrangement of building on lots and the density of populati-on within
the City of Rochester, Minnesota, all in accordance with a comprehensive plan,
as amended`by ordinarice No.560, which was given its -first reading. ; -
Upon motion by Williams second by Moody and all voting in favor thereof,
the rules were suspended and the said ordinance given its second reading.

Upon motion by Moody second by Anderson the Chief of -the Fire Department and
two or three firemen were authorized to attendthe State Fire Convention -to be
held at VirgiAia,Pviinnesota.
The Mayor stated that National F1a� Week had first been observed throughout
the country in 1 National Flag � ee will be observed .in the-
, � 939 • � ,year 1940
from June 9th to June 14th inclusive. In keeping with this observance the
Mayor recommended that the flags be displayed on the streets during this
period and upon motion by Moody second by Bowers it was left in the hands
I of the -Mayor to make the necessary arrangements for having the flags
displayed.
Upon motion by Moody, second by Anderson, the Common Council adjourned
until 9:30 o'clock P.M., on June 14th, 1940.
