I1711inutes of a special meeting of the Common Council of the City of Rochester.,
+Minnesota, held in the Council Chambers, in the City Hall, on September 16th,1940,
President Lemmon'called the meeting to order at 7:30 o'clock P.M., the
following members -being present: Lemmon,'Amundsen, Anderson, Bowers, Moody,
jMrachek, Williams: Absent: None. 4
The call for the Special meeting was -read, and President Lemmon ordered that
the aane be placed on file; said teeting having been celled for the purpose ,of
staking action on improvements for which hearings have been set for this date,,
and any other btsihess'the said Common Council might deem proper.
Upon motion by,Amtzndsen second by Anderson,- the minutes of the meetings of
1August 27th'and September 3rd,1940, were each approved.
President Lemmon stated this as being'the time and•place, set for a hearing
on the construction of a sanitary sewer and water main in 32 Street Southeast.
from' Fifteenth Avenue Southeast to West of Thirteenth Avenue Southeast as far -
as necessary and bn Fifteenth Avenue Southeast from Fourth Street Southeast to
32 Street Southeast, and asked if any one present wished,to•be heard concerning
this improvement. No one present wished to be heard.
President Lemmon stated this as being the time ands place set for a hearing
on the' construction' of curb and gutter on Fifteenth Avenue Southeast from
Center Street East to Second Street Southeast, , and asked if any one present
wished to'be heard concerning this improvement. No one present wished to •
be heard. ' '
A communication from the State Department of Health, Division_ of Sanitation,
was read and President Zem'mon ordered that the,same be placed on file.
A circular' letter from H.G.Sti`llwell, Cign,rette license Supervisor of the-
Stat'e of Minnesota Department of Taxation, to all members of - Town Boards, and
members of Village and City Councils, was read and President Lemmon referred the
same to the Police D'epa'rtment and the Mayor,.
The emergency order given by the Mayor to the Cdtr Clerk for the purchase
of one 'car load of gasoline, eras read, and upon, motion by Moody s(ecoud by
Bowers the sarre vgs approved -and ordered filed.
'The recommendation by then Zoning Board that the petition, of- property
owners asking thiat -Mr. *and Mrs. Clifford Hurd ocf a23 Second Avenue Northwest -be
permitted to change their dwelling from a multiple dwelling tint-o a commercial
dwelling,'�e denied,--was-read and upon motion by Mrach6k second by Amundsen
the said recommendation was approved.
A communication received by F.R.Finch,City Clerk, from Frances L.Underleak,

responsibility in the administration of a Selective Training and Service Act
now pending in Congress,.if and when it shall be enacted into a law, and that
• the Hon. Harold T.Stassen, Governor, had requested her cooperation in mobilizing
the so-called election machinery for the registration of man power within
the certain age group, and asking the City Clerk to assume the responsibility
of Chief registrar of the City of Rochester, was read.
A motion by Alderman Williams, that the City Clerk �§e given full authority
to appoint the necessary officers to assitt in the above mentioned registration
was seconded by Mrachek and upon roll call, Aldermen Amundsen, Mrachek,tlmlliams,
and Lemmon voted "Aye", and Aldermen Anderson, Bowers and Moody voted "No".
Communications received by the City Clerk from the Western Surety Company
regarding license bonds of John Kelly, and Gus Anton, were each read, and
upon motion by Moody second by Mrachek the City Clerk was instructed to,
• answer these communications.
A communication from Bemel Bros. Auto Parts, asking for a permit to
add 5 feet on the south side of five of the cabins they own located at Ninth
Street Northeast and Second Avenue Northeast, was read, and Upon motion by
Moody second by Bowers the matter was referred to the Building Inspector.
The City Engineer submitted estimate of costforthe construction of curb
and gutter in Fifteenth Avenue Southeast from Center Street to Second Street
Southeast, and President Lemmon ordered that the same,be placed on file,
A .copy of a resolution passed by the Public Utility, requesting authority
to enter into a contract with the McWane Cast Iron Pipe Company, was read, and
President Lemmon ordered that the same be placed on file.
• A communication from the Board of Public Health and Welfare requesting
authority to enter into a contract with C.F.Walde *as read, and President Lemmon
ordered that the same be placed on file.
A petition from the Mayo Properties Association and the Kahler Corporation
requesting permission to build and maintain extensions to the present systems
of tunnels, was read and President Lemmon ordered that the same be placed on
file.
A communication from the Firemen's Relief Association requesting approval
of a loan to Mrs. Sarah Ginther, was read and President Lemmon referred the
same to the Finance Committee.
The report of the Clerk of the Municipal Court for the week ending September
7th,1940,showing criminal fines and costs collected $271.40, civil fees received
$16.05, and conciliation court fees received $4..25, and for the week ending
September 14th,1940, showing criminal fines and costs collected $290.$0, civil
fees received $15.95, and conciliation court fees received $8.75, were each read,
and having been previously approved by the City Attorney, President Lemmon ordered
that the same be placed on file.

The recommendation of the Finance Committee that the loan by the Firemen's
lRelief Association to Sarah Ginther,be approved, was read, and upon motion by
Moody second by Williams, the said Committee recommendation was accepted and
the loan approved.
The application of-T.J.Daly for a plumbers license, was read and upon
(motion by Moody second by Amundsen the license was granted.
The application of H arry's Conoco Station fora permit to place -and maintain
a sign was read and upon -motion by Moody seco-nd by Bowers the permit was granted.
The applicationsof Alvin Drake for on sale and off sale licenses to sell
non -intoxicating malt liquors at 20 Third Street Southwest, were each read
and upon motion -by -Williams second by Amundsen the licenses were -granted- sugject
to the approval of the Chief -of -Police after making an investigation.
- The application of -Alvin Drake for a license to,sell soft drinks was
read and upon motion by P,!rachek second by Amundsen the license was granted.
The application of the Town Taxi for transfer of taxicab license No.20
to cover a 7 passenger -Buick sedan bearing state license No.496, was read and
upon motion by Amuhdsen second by Mrachek the transfer was granted.
The application of the Rochester Plumbing and Heating Company for a
plumbers license was read, and upon motion by 11rach ek second by Williams
license was granted.
The license bond of Christ Margellos and -Don Emerson, in the sum of
$1,000:OO..with the Western Casualty Company as surety, covering -their license
to sell intoxicating liquors, was read and upon motion -by Moody second by
Anderson, the said bond -was approved, the surety thereon accepted and it was
ordered that the same be placed on file. - .
The license bond of Lloyd Bennett in the sum of $1,000.00 with the New
,Amsterdam Casualty Company as surety, and of -Tim flay in the sum of $1,000.00 witl
the Western Surety Company as surety, were each read, and upon motion by Moody
second by Anderson the said bonds were approved the sureties thereon accepted
and it was ordered that the same be placed on file. -
The contract bonds of H.T.Earle-in the sum of $4122.45 and $1353.90,-with
the Standard Surety & Casualty Company of New York as surety, were each read
and upon motion by -Moody second by Anderson the said.,bonds were approved, th e
sureties thereon accepted m d it was ordered that the same be placed on file.
The following claims were read, and upon motion by Williams -second by
Amundsen, .the same were allowed ah d the Mayor and City Clerk were authorized.

on the North side of Third Street Southwest to the intersection of Third -Avenue
Southwest, thence diagonally under the intersection of Third Street Southwest
and Third Avenue Southwest to the Northeast corner of -Block No.Thirteen (13) -of
the Original Plat of the Town, now City of Rochester; and an Ext-ension t-o the
present tunnel in the alley running East and West through Block No. Seve-nte-en
(17) of -the Original- Plat of -the Town now City, of Rochester, fro-m the end of -
said tunnel in•a weste'rly direction•to a point not more than 45 feet west of -the
Northeast -corner of Lot -No. Eleven (11) in said Block No. Seventeen (17), which
was -read. -
Upon motion by Williams second by Anderson that the said resolution be -
adopted as read-, • and all voting- in. favor thereof, P-resident Lemmon declared the
said resolution duly -passed and- adopted-.
- Alderman Amundsen introduced a resolution ordering plans for curb and gutter
on -Fifteenth Avenue Southeast from Center -Street East to Second -Street Southeast,
which was read.
Upon motion -by-Amundsen -second by Bowers that the -said resolution be - -
adopted as read; and all voting in favor thereof, P-res-iddnt Lemmon declared the
said resolution duly passed and adopted. - - -
- Alderman Amundsen introducedea reeDl.ution adopting sthe plans, for the -construc-
tion of curb and gutter -in Fifteenth Avenue -Southeast, from Center Street east to',
Second Street Southeast, ordering a hearing on the said improvement,said hearing
to' be -held at 7:30 o'clock- P-h", on September 23,1940, and -ordering bids for -
the construction of said curb and gutter, said bids to -be opened at 7:30 O'clock
P.'M.,• on September 23, 1940, which was -read. -
Upon motion -by Mrachek second by Moody that- the said resolution be adopted
as read, and all voting in favor thereof, President �emmon declared the said
resolution duly passed and adopted.
Alderman Amundsen introduced a resolution granting public dance permit to
the- Central Labor Union for the Woodman -Hal-1 on S-eptember 7th and -14t-h, 1940, and
fixing the fee at $6.0O,which was read. -
Upon -motion-by Moody second by Amundsen that the said resolution b•e
,ad6pte'd as -read, and all voting -in favor thereof, •Presi•dent Lemmoh declared th-e
said resolution duly passed --and adopted.- - •-
Alderman Amundsen -int-ro duced a resolution autho-ri ring the Public• Utility
IlBoard to enter into contract with the McWane Cast Iron Pipe Company for the
furnishing of pipe and -fittings for the sum -of '$3, 627.95, which was read.
Upon moticn-by Amundsen second by Williams that- the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Amundsen introduced a resolution authorizing the Board of Public Health
and Welfare to enter into a cop -tract with C.F.Walde, which was read.
Upon motion by Williams second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Amundsen introduced a resolution appropriating $397.55 from the
General Fund and ordering payment made to the Rochester Post -Bulletin for
official printing and publications for August,1940, which was read.
Upon motion by Moody second by Anderson that the sai d resolution b7e adopted
as read, and all voting in favor thereof,. Presid§nt Lemmon declared the said
resolution duly passed and adopted. _
Alderman Mrachek introduced a resolution appropriating $350.10 from -the
General Fund and ordering payment made to.J..T..Collin for insurance premium on
policies covering the Williams Business. -Property, which was read.
Upon motion by,Mrachek second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon,declared the
said_resolut.ion duly passed dnd adopted.
Alderman Mr*achek introduced a resolution appropriating $1176.30 from the
General Fund and ordering payment made to.the Street and Alley Fund, for use
of equipment during August, 1940, which was read..
Upon motion by Bowers second by Arib rson that the said resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $15,000.00 from the
General Fund and ordering payment made.to the Street and Alley Fund, for transfer
of funds to make same available for the use of the street and Alley Department,
which was read._
Upon motion by Mrachek second by Amundsen.that the said resolution be adopted
as read, and all voting in favor thereof , President Lemmon declared the said
resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $311.94 from the
General Fund and ord.ering.payment made to the State of Minnesota, Oil Inspection
Division for state gasoline tax and inspection fee on tank car 29673 of gasoline II
which was read.
Upon motion by Amundsen second by Bowers that the said.'resolution be adopted
as read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.,
Alderman Mrachek introduced a:resolution appropriating $170.41l from the
General Fund and $3g.gl from the Park Improvement Fund, and ordering -payment made

to the Street and Alley Fund, for resurfacing drives in Soldier Field, which
was read.

Upon motion by Anderson second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced:a resolution appropriating $363.97 from the
Street and Alley Fund and ordering payment made to Dodge Lumber & Fuel Company
for 132 bbls of cement, which was read.
Upon motion by Mrachek second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
Alderman Williams introduced a resolution. appropriating $943.65 from the
Street and Alley Fund and ordering payment made to the Street and Alley Fund.,
for use of equipment during Aug ust,1940, which was read.
Upon motion by Anderson second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared
the said resolution duly passed and adopted.
,Alderman Williams introduced a resolution appropriating $12,703.12 from the
Street and Alley Fund and ordering payment made to Roxanda Mines, Inc., for
!estimate No.l on contract for resurfacing Second -Street Southwest from Broadway
Street South to Eleventh Avenue Southwest, which was read.
Upon motion by Williams second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution -duly passed and adopted.
Alderman Williams introduced a resolution appropriating $999.52 from the
!Street and Alley Fund and ordering payment made to Roxanda Mines, Inc., for
Estimate No.2 on contract for resurfacing Qf West Center Street from Seventh
jAvenue to Eleventh Avenue West, which was read.
Upon motion by Mrachek second by Anderson that the said resolution be
adopted as read, and all voting in -favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $1363.58 from the
Street and Alley Fund and ordering payment made to the International Harvester
Company, for an international truck, which was read.
Upon motion by Moody second by Anderson that the said resolution be adopted
las read, and all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.
Alderman Moody introduced a resolution appropriating $293.75 from the
IStreet,an d Alley Fund and ordering payment made to Quarry Products Company
Ifor crushed rock furnished during August,1940, which was read.
Upon motion by Mrachek second by Moody that.,the said resolution be adopted
as read, and.all voting in favor thereof, President Lemmon declared the said
resolution duly passed and adopted.

Alderman Moody introduced a resolution appropriating $119.55 from the
General Fund, $1100.94 from the Street and Alley Fund, and $206.26 from the
Permanent Improvement Revolving Fund and ordering payment made to Morse Brothers,
for sand and gravel furnished during August,1940, which was read.
Upon 'motion by Williams second by Amundsen that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Alderman Anderson introduced a resolution appropriating $492.99 from the
Sewer Fund and ordering payment made to the Permanent Improvement Revolving
Fund, for correcting charge for slab in the construction of new storm sewer
originally charged to Second Avenue Northwest widening, which was read.
Upon motion by Anderson second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $797.20 from the
Sewer Fund and.ordering payment made to Martin Paulson for first and final
estimate on contract for construction of a storm sewer in Fourteenth Street
Northeast, which was read.

Alderman_ Anderson introduced a resolution appropriating $1822.27 from

Southeast, which was read.

The matter of dust on. Thirteenth Street Southeast between Ninth Avenue
and Eleventh Avenue Southeast, was referred to the Street and Alley Committee
and the City Engineer.
Alderman Williams made a motion to recall work done so far on the new
building code and turn the worx over to others but deceived no second to the
said motion.
Upon motion by Anderson second by Bowers the Electrical Inspector was
granted permission to attend the Northwestern Electrical Inspectors Association
Eonvention at Kansas City, Missouri, on September 23rd, 24th, and 25th,1940.
Judge Eaton requested that Miss Eliringer be employed full time in his
office, and President Lemmon referred the matter to the Finance Committee and the
City Attorney.
Mr. Pen`del submitted his bid for insurance on trucks in the
Fire `Department and the City Eneineer''s Department`, at a saving to the City.
The Chairman of the Insurance Committee rrecomLlended that- the insurance be divided
among various agents and if not', that bids be taken from other agents.
Upon motion by Williams' second by.Amumdden the matter was left in the hands
of the InsurAn.ce Committee.
