Minutes of a Special Meeting of the Common CQuncil- of the City of Roch-
ester, Minnesota, held in the Council Chambers, in the City Hall in said City on
January 23, 1942.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
follerwing members -being present. President Lemmon, Aldermen Anderson, Bo.wers, Han
son, Mrachek, Williams and Yaeger. Absent: none.
The call of the Special Meeting was read, and President Lemmon ordered
that same be placed on file; said meeting having been called for the purpose of
considering bids for the purchase of a truck.for use in the City Engineer's Depart
m.ent, and any other.busines.s the said Common Council may deem -proper.
Mr. Erwin Briese, Secretary of the Chamber of Commerce, again appeared
before the Council in regard to an appropriation.for the printing of a Rochester
booklet. Mr. Briese introduced Mr. Charles R. MacDonald, Chairman.of the Publicit
Committee of the Chamber of Commerce, who requested that the sum of $500.00 be
appropriated for the printing of the said booklets.
Alderman Mrachek introduced a resolution appropriating $500.00 from the
General Fund and ordering payment made to the Chamber of Commerce for the purpose
of printing the said Rochester booklets, which was read.
Upon motion by Mrachek, second by Anderson, the said resolution was
eclared duly passed and adopted, Aldermen Anderson, Mrachek, Yaeger and Lemmon
oting in favor thereof, and Aldermen Bowers, Hanson and Williams voting "No".
A copy of a communication from the Firemen's Civil Service Commission
ranting a one year leave of absence from the Rochester Fire Department, to George
. Kucera, commencing on January.15, 1942, was read, and i3resident Lemmon ordered
that same be placed on file..
A letter from the Public Utility Department requesting that the Common
ouncil approve an action of the said Board and authorize the Mayor and City Clem±
o execute a license with the Chicago and Nort4 western Railroad Company covering,
he construction of an unloading device, was read, and President Lemmon ordered
hat same be placed on file.
A petition that the South one-half of Lots 1, 2, 3, 4 and 5 in Block 13
n McCullough's Addition and the,South one-half of Outlots 5, 6, 7 and S in Cummin,
ddition and Lots'6 and 7 in Elliott's Sub -division of the West one-half of Out-
ots 4 and 5 in said Cumming's Addition to the City of Rochester, be changed from
esidential to Multiple Dwelling Zoning was read, and upon Motion by Williams,
econd by Hanson the said petition was referred to the Board of Zoning.,
Copies of resolutions passed and adopted by the.Commissioners of the

d for purchase of$40,000.00 State of Minnesota, Rural Credit Deficiency Fund
Certificates; appropriating $49,590.00 from the Sinking Fund, Code 23, for the
purchase of thirteen United States Savings Bonds, Defense Series F; the bid of the
Commissioners of the Sinking Fund for all of the 12% Permanent Improvement Revolv-
ing Fund Bonds dated Januaryl, 1942, in the amount -of $10,123.00; and appropriatin
$10,123.00 from the Sinking Fund -for the purchase of $10;000.00 City of Rochester
ermanent Improvement Revolving,Fund Bonds.
Upon motion by Mrachek, second by Bowers, the actions of the Commission
iers of the Sinking Fund were approved.
The -City Engineer presented the following bids for a truck for use of
the Street and Alley Department: Postier & Eggers Company in the amount of $2255.
Carl Test, in the amount of $2459.95; International Harvester Company, in the
amount of $2752.33; and Ellis Motor Company, in -the amount of $2184.12. The same
were referred to the Street and Alley Committee and the City Engineer for tabu-
lation and recommendation.
Alderman Anderson, Chairman of the Street and Alley Committee, recommend
that the Diamond T truck be purchased from Carl West for the sum of $2459.95.
A communication from the Seagrave Corporation acknowledging receipt of
Defense Rating Certificate No. 276307 giving the City of Rochester an A-10 rating
.on the Pumper and Hose Car ordered, was read, and -President Lemmon ordered that
same.be placed on file.
The City Engineer's estimate of quantities and cost of various oils
and asphalts required for dust prevention work during the season of 1942 was read,
and upon motion by Mrachek, second by Williams the same was approved and ordered'
Alaced on file.
The City Engineer's Trial Balance and report of expenditures from the
payroll for the month of December, 1941, were each read and President Lemmon
ordered that same be.-olaced on,file.
The report of the City-Weighmaster for the month of December, 1941,
showing 290 private loads weighed, and receipts of $29:00 was read, and President
Lemmon referred same to the Finance Committee.
A statement of receipts and expenditures of the Park Improvement Fund
for the month of December, 1941, was read and President Lemmon ordered that same
be placed on file.
The reports of'the Clerk of the Municipal Court for the week ending
January 10,.194 2, showing criminal fines and costs collected'$320.90, civil fees
received $3.70, and conciliation court fees $1.50; and for the week ending Jan-
aary 17, 1942, showing.criminal fines and costs collected $301.92, civil fees

received $3.95, and conciliation court fees $5.50, were each read and having been
reviously approved by the City Attorney,. President Lemmon ordered that the same
e placed on file.
A notice of claim for damage in the sum of $175.00 to an automobile
owned by Sam Larson of 524 Second Street Northeest, Rochester, Minnesota, filed by
Hanson & Wilcox, Attorneys, was read and upon motion by Williams, second by Ander-
son the same was referred to the City Attorney and the Police Committee.
A communication from the League of Minnesota Municipalities notifying
the Council and interested City Officials of a Defense Cooperation Meeting to be
held in St. Paul on January 30, 1942, was read and upon motion by Mrachek, second
by Williams, -those urishing to attend were authorized to do so at City expense.
Applications for license to sell cigarettes at retail o£'Huey's Cigar
Store, Fred Schuster, Hollywood Bar, Mrs. John C. Eppard, Elmer W* Judd, Rochester
Eat Shop, Joseph K. Williams, Louis Schilling, Mrs. Geo. Williams, Mrs. Joe Settirr
i1m. ' R. Moriarty, Drips Grocer Co., E.F. Hughes, Charles F. Wilkens, Mrs. Sam De
Fosse'and Magaw & Kjerner were each read, acid upon motion by Hanson, second by

The applications of the Rochester Plumbing & Heating Company for Plumb-

.'The application of Max Shapiro for permit to Place and Maintain a sign
was read, and upon motion by Mrachek, second by Yaeger the permit was granted.

The application of Bemel Bros. for a Junk Ddalers License was read, and
upon motion by Williams, second by Yaeger the license was granted.
The application of 4flmer W. Judd for License to sell soft drinks was
read and upon motion by Bowers, second by Hanson the license was granted.
The application of Town Taxi Company for transfer of a license was read,
and upon motion by Williams, second by Mrachek the transfer was approved.

The license bonds of Elmer C. Johnson in the sum of $1000.00 and Vincent
Huyber in the sum of $1000.00, both with the Aetna Casualty and Surety Co. , as

Western Surety Company as surety, were each read, and upon motion by Williams,
second by Bowers, the -said bonds were approved, the surety thereon accepted and it
was ordered that same be placed on file.
Alderman Anderson introduced a resolution appropriating $1120.39 from
the General Fund and ordering payment made to the State Treasurer for services
rendered in examining financial affairs and records for year ended March 31, 1941,

Upon motion by Williams, second by Hanson that the said resolution be
adopted as read, and'all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $0.50 from the
General Fund, $630.1.0 from the Street & Alley Fund, $29.75 from the Permanent Im-
provement Revolving Fund and $77.50 from the Sewer Fund, and ordering payment made
to the Street & Alley Fund for use of equipment during December, 1941, which was

Upon motion by Bowers, second by Mrachek, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $1291.39 from
the Park Improvement Fund and ordering payment made to the Mayo Trust Fund for
ayroll for first half of January, 1942; which was read.
Upon motion by Mrachek, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Anderson introduced a resolution appropriating $200.00 from the

Park Improvement Fund and ordering payment made to Bemel Bros. Auto Parts for one
motor pump, which was read.
Upon motion by Hanson, second by Bowers that the said resolution be
adopted as -read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $1155.46 from the
Park Improvement Fund and -ordering paStment made to Hayes, Lucas Lumber Co., for
materials for Shelter House project, which was read.
Upon motion by Yaeger, second by Williams that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $427.50 from the
ark Improvement Fund and ordering payment made to City of Rochester, Public Util-
ities, for steam heat at Mayo Civic Auditorium, which was read.
Upon motion by Hanson, second by Anderson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Yaeger introduced a resolution appropriating $345.60 from the .
ark Improvement Fund, and $173.49 from the Lighting Fund and ordering payment mac
to City of Rochester, Public Utilities for electricity and water used, which was
read.
Upon motion by Yaeger, second -by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Williams introduced a resolution appropriating $752.00 from the
ermanent Improvement Revolving Fund and ordering payment made to the Street and-
lley Fund, which was read.
Upon motion by Williams, second by Hanson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Williams introduced a. resolution appropriating $696.97 from the
Permanent Improvement Revolving Fund and ordering payment made to Martin Paulson
laying mf watermain in Eighth Avenue Northwest, which was read.
Upon motion by Mrachek, second by Yaeger that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Bowers.introduced a resolution ordering a hearing on the levy-
ing of special assessments for the cost and expense of laying a watermain in
Eighth Avenue Northwest from Tenth Street to Eleventh Street Northwest,, said.hear-
ing to be held at 7:30 o'clock P.M. February 9, 1942, which was read.
Upon motion by Williams, second by Mrachek that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Bowers introduced a resolution authorizing the Mayor and City
Clerk to execute a license with the Chicago & North Western Railroad Company as
requested by the Public Utility Board, which was read.
Upon motion by-Mrachek, second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution appropriating $602.75 from the,
General Fund and ordering payment made to the Rochester Post Bulletin for Offic-
lial publications, which was read.
Upon motion by.,Hanson,,second by Bowers that the said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the
(said resolution duly passed and adopted.
Alderman Mrachek introduced a resolution fixing the distribution of the
10%i Utility Gross Income payments for the year of. 1942, which was read.
Upon motion by Williams, second by Yaeger thatthe said resolution be
ladopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution ordering bids for road oil for
the 1942 season, said bids to be.received and opened at 7:30 o'clock P.M. February
9, .19,42, which was read.
Upon motion by Yaeger, second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Mrachek introduced -a resolution accepting the bid of Carl West

for the purchase of a truck for use in the. City Engineer's Department, which was
read.
Upon motion by Anderson, second by Williams that the said resolution be
adopted as read, Aldermen Anderson,. Hanson, Mrachek and Williams voting in favor
thereof and Aldermen Bowers and Yaeger voting "No", President Lemmon declared the
said resolution duly passed and adopted.
Upon motion by Anderson, second.by Hanson, and all voting in favor ther(
of, the Mayor's action in issuing an emergency order to the City Engineer for the,
purchase of one, two .to three and a half ton truck for. use in the City Engineer's
Department, was approved.
An .invoice from the Mayo . Clinic for professional service in the case of
Chester R. Fellows was presented to the Council, and upon motion by Yaeger, seco
by Bowers, the City Attorney was instructed to take up the matter of a settle-
ment.in the case of Chester R. Fellows with the Industrial Commission olf the Stat(
of Minnesota.
Mayor Grasslefread a letter from Mayor Floyd Simon of Winona inviting
the Common Council of the City of Rochester to meet in a joint session with the
Winona Council who would also be hosts to the Rochester Council at a dinner.
The matter of setting up a record in the City Clerk's Office of the
parcels of land in the City of Rochester,.and the purchase of equipment for hand-
ling this record and possibly other records in the Clerk's Office, was brought upl
by Mayor Grassle. Upon motion by Williams, second by Anderson, the proposed
matter was referred to the Mayor, the Survey Committee and the City Clerk.
The matter of qualifications required -for one to'fill the office of an
Electrical Inspector was discussed, and upon motion by Williams, second by Yaeger,
the same was referred to the City Attorneys for a ruling to be submitted in writinj
Alderman Bowers introduced a resolution authorizing the Mayor and the
City Clerk.to execute an -agreement with the Minnesota State Highway Department,
which was read.
Upon motion by Williams, second by Hanson, that,the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Hanson introduced a resolution ordering a hearing on improve-
ments on Twelfth Street Southeast, said hearing to be held at 2:00 o'clock P.M.
February 2, 1942, which was read.
Upon motion by Williams, second by Anderson that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.

Mayor Grassle stated that it had been recommended to him by the Minnes-1
ota Tax Commission that an up-to-date master.map be prepared of the City of Roch-1
ester, and upon motion by Williams, second by Ander.'son, the matter of preparing I'I
said map was referred to the City Engineer and the Street and Alley Committee with
power to act.
Upon motion by Williaes, second by Bolters, the City Engineer was in-
structed to set up a complete file for each street, avenue and alley, showing all
underground installations and other street improvements.
Alderman Bowers introduced a resolution requesting the Public Examiner
to make an examination of the records of the City of Rochester, Minnesota for the
fiscal year ending March 31, 1942,•which was read.
Upon motion by Williams, second by Bowers that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted,
A motion was made by Williams, second by Bowers, that in the future
all rulings from the City Attorney pertaining to 6ity matters be submitted to the
Common Council in writing.
Upon motion'by Mrachek, second by Anderson, the meeting was adjourned.
