HomeMy WebLinkAbout09-08-1942RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., S e-pt e m b e r S. 1942 Minutes of a regular meeting of.the Common Council of the City of lRochester, Minnesota, held in the Council Chambers, in the City Hall, in said Cite, Ion September 8, 1942. President Lemmon called the meeting to order at 2:00 o'clock P.M., the following members being preserLt: Lemmon,, Fryer, Hanson, Mrachek, Nass, and Yaegerl. (Absent: none. Upon motion by Hanson, second by Fryer, the minutes of the Special meet - ling of August 26th, 1942 were approved. The report of the Public Examiner on the Financial affairs of the Roch- ester Fire Department Relief Association covering the year ended March 31, 1942, was presented and same was referred to the Fire Committee, the Chief of the Fire Department, and the City Attorney to determine the correct amount of tax which could be levied for the Fire Department Relief Association. The City Engineer's estimate of cost of constructing a storm sewer in ,Tenth Street Southeast from Fifth Avenue to Sixth Avenue Southeast, and a storm sewer on Eleventh Street Southeast from Fourth Avenue Southeast west to the Reid (Murdoch Company storm sewer, was read, and upon motion by Fryer, second by Mrache same was ordered placed on file for future reference. A communication addressed to the Board of Education calling attention to the danger of school children crossing Highway No. 52, was presented to the Common Council by Alderman Nass at the request of the Board of Education. Chief. Bf Police, H.N.Tompkins, stated that school crossing signs had been purchased and were now on hand, and that he preferred that the Board of Education designate the streets or avenues upon which they desired to have the signs placed. Upon motion by Fryer, second by Hanson, the City Clerk was instructed - to communicate with the Board of Education asking them to notify the Chief of 'Police as to the location of the school crossing signs where they thought would I be most effective. A letter from the League of Minnesota Municipalities regarding the hold ing of regular meetings as had been done in previous years, was read, and upon 'motion by Mrachek, second by Hanson, the City Clerk was instructed to notify the League that the Common Council was in favor of meetings being held as before. The City Engineer's request that $5000.00 be appropriated from the Street and Alley Fund and $3000.00 from the Sewer -Fund for use of the Street and +Alley Committee was read, and President Lemmon ordered that same be placed on fil A letter from Clarence R. A petition that that part of Fourth Street Northwe'st lying directly East of the East line of Eleventh Avenue Northwest be vacated for a distance of 266.9 feet East on the North line of said Fourth Street Northwest, and 261.5 feet on the South line of said Fourth'Street Northwest, was read, and President Lemmon referred same to the Street and Alley Committee for a report at the next Council meeting. A petition in regards to the widening of the channel of Cascade Creek from the Chicago & North Western Railroad bridge to Fourt1henth Street Northwest, was read, and same was left with the Street and Alley Committee, the City Engineer and the City Attorney. A petition signed by twenty eight residents on Eleventh Aven.e Northwesti and Southwest, that steps be taken to eliminate the excessive noise caused by trucks traveling on Eleventh Avenue West, was read. Mayor Grassle recommended that the Chief of Police be given authority to handle truck traffic within the City limits of the City of Rochester. Chief of Police Tompkcins recommended that an Ordinance be set up govern- ing truck traffic within the City limits, and upon motion by Fryer, second by Hanson, the matter was referred to the Mayor, the City Attorney, the Police Commit tee, a-nd the Chief of Police, to make a study of the situation and draft an Ord- nance for the regulation of truck traffic within the corporate limits of the City. The recommendation of the Police Civil Service Commission that the services of Chester R. Fellows with the Rochester Police Department be terminated' because of disability, was read, and upon motion byr-Fryer, second by Yaeger, the action of the Police Civil Service Commission was approved. The recommendation of the Board of Zoning that the petition requesting that Block 43 Original Plat of the City of Rochester, be changed to Commercial Zone, be not granted, was read, and upon motion by Mrachek, second by Fryer, the action of the Zoning Board was approved. The report of the Public Grounds Committee andthe Custodian of the City lHall that all repairs to the City Hall building, as authorized by the Common Council, had been completed, was read, and upon motion by Mrachek, second by Fryer, the report was accepted. The City Engineer's trial balance sheets for the months of July and August 1942, were read, and President Lemmon ordered same placed on file. The report of expenditures for the City Engineer's Payroll for the month of August was read and President Lemmon ordered that same bplaced g n • • a. a. a e • n 11file. 660 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF ROCHESTER, MINN., September 8, 1942 The reports -of the Building and Plumbing Inspector for the month of August, 1942, showing fees for building permits issued $34.00, and plumbing per- Imits $104.00; and of the Electrical Inspector for the month of August, 1942, sho ing fees for electrical permits issued $4.00, were each read, and President Lemmo referred same to the Finance Committee. The statement of receipts,and expenditures from the Park Improvement ' Fu for the month of August, 1942, was read and President Lemmon ordered that same be j1 placed on file. The reports of the City Weighmaster for the month of July, 1942, showir. 1216 private loads weighed and receipts of $21.60, and for the month of August„ 1942, showing 367 private loads weighed.and receipts of $36.70, were each read, and President Lemmon referred same to the Finance Committee. The Health Officer's Lockup inspection report, dated September 1, 1942, was read, and President Lemmon ordered that same be placed on file. A report of the receipts and expenditures of the Rochester Public Schools for the fiscal year ended July 31, 1942, was read and ordered placed on file, and the City Clerk was requested to mail a copy of same to each membHr of the Common Council. The reports of the Clerk of the Municipal Court for the week ending (August 1, 1942, showing criminal fines and costs collected $253.75, civil fees received $12.55, and conciliation court fees $4.00; for the week ending August S, 1942, showing criminal fines and costs collected $349.60, civil fees received 1$13.15, and conciliation court fees $4.00; for the week ending August 15, 1942, showing criminal fines and costs collected $414.00, civil fees received $3.35, anc conciliation court fees $3.00; for the week ending August 22, 1942, showing crim- inal fines and costs collected $153.40, civil fees received $13.75, and concilia- tion court fees $5.25; and for the week ending August 29, 1942, showing criminal fines and costs collected $366.05, civil fees received $10.30, and conciliation court fees $5.50, were each read, and having been previously approved by the City Attorney, President Lemmon ordered that same be placed on file. The application of R.S.Plzak and Edward Overkamp for transfer of "Off Sale" 3.2 Beer license +764 was read, and upon motion'by Mrachek, second by Nass, the transfer was approved. The application of Claude G. Darst and Lucasr Kuglitsch for transfer of "Off Sale" 3.2 Beer License +720 and "On Sale" 3.2 Beer license #419, was read, and upon motion by Yaeger, second by Fryer, the transfer was approved. The application of the Whitlock -Sonnenberg Post 41215, V. Alderman Hanson introduced a resolution appropriating $954.02 from the General Fund and -ordering payment made to the Public Health & Welfare Fund for transfer of garbage assessmentsi which was read. Alderman Mrachek intro-duced'a resolution appropriating $211.90 from thel I.Street & Alley Fund and ordering payment made to H-. T. Earle for repairing curbs at Weber & Judd, Massey corners and Old Library corner, which was read. Upon motion by Hanson, second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said "resolution duly passed and adopted. Alderman Nass introduced a resolution appropriating $490.00 from the Street and Alley Fund and ordering pat men"t made to Kris Nielson for excavation" of l Cascade Creek, wh'i ch' was read. Upon motion by Yaeger, second by Nass that the said resolution be ladopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and -adopted. Alderman Nass introduced a resolution appropriating $1209.62 from the Permanent Improvement Revolving Fund and ordering payment made to H.T.Earle for curb and gutter in Seventh Street and -Sixth Avenue Southwest, which was read. Upon motion by Nass, second by Yaeger that the said resolution.be ladopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. - Alderman Yaeger introduced a resolution granting a public dance permit to the Whitlock -Sonnenberg Post, V. F. W. , which was rea.d. Upon motion by Yaeger, second by Fryer that the said resolution be J adopted as- read, and all voting, in favor thereof, President Lemmon declared" the said resolu-tion duly passed and adopted. Alderman Yaeger introduced a resolution -appropriating $5200.00 from thel Fire Protection Fund and ordering payment made to City of Rochester, Public Utilit Department for hydrant rental for six months, which was read.. Upon motion by Fryer, second by Hanson that the said resolution be ladopted as read, and all voting in favor thereof, President Lemmon dedlared the isaid resolution duly passed -and adopted. Alderman Fryer introduced•a resolution -ordering a hearing on the vaca- tio'hof the 15 ft alley running North and South on the East side of Block 3, from Lot 12 through Lot 31, in Flather's Addition, said hearing to be held at 7:30 o1clock P.M. Alderman Fryer introduced a resolution appropriating $1000.00 from the General Fund.and ordering payment made to.the Rochester Civilian Defense Council, Control Fund, which was read. Upon motion by Fryer, second by Mrachek that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Mayor Grassle explained to the Common Council that in order to follow lout the Civilian Defense Program, it would now be necessary to install a Control Center in the City Hall Building, and the City Clerk was requested to prepare the above resolution appropriating the said sum. A communication from the Chief of the Fire Department at Plainview, (Minnesota, requesting that the new pumper and hose car purchased by the City of (Rochester recently, be displayed.at a meeting,of the Southea.stern.Minnesota Fire- men's Association on September 20, 1942, was read. Upon motion by Hanson, second by Fryer, Chief C.E.Ginther was given permission to.take the fire rig to Plainview as requested, and to take such mem- bers of the Department along as would be necessary to properly display and demon- strate the equipment. Mayor Grassle stated that he had received a request that the Common Council appropriate funds to pay the telephone bill of the Rationing Board at their new location, and upon.motion by, Mrachek, second by Hanson, the payment of telephone bills for the Rationing Board, not, to exceed $10.00 per month, was approved. _ Upon motion by Fryer, second by Mrachek, the sum of $199.00 was approp- riated to the Mayor's Contingent Fund. Upon moti.on by Hanson, second by Yaeger, Mr. Austin A. Kennedy was appointed by the Common Council as successor to the late Alderman D. Leon William of the Second Ward of the City of Rochester, he to serve until the first Monday in April, 1943. President Lemmon announced the appointment of Mr. Austin A. Kennedy as Chairman of the Purchasing Committee and 41so to take the place of Mr. D. Leon Williams on all other Committees. Alderman S. Smith Fryer was appointed Chairman of the Street and Alley Committee. Upon motion by Yaeger, second by Hanson, the meeting was adjourned until 7: 30 o'clock P.M. September 21, 1942. City Clerk
