COUNCIL ..901 22, 1978 Agenda Item A-1 President Postier called the special meeting to order at 4:45 P.M. in the Public Library AudJorium:- The followi-ng members being present: President Postier, Aldermen Allen, Gray, Larson, Powers, Solinger and Strain. Absent: None. The call of the special meeting was read by President Postier, the same being called for the purpose of instructing the City Clerk to advertise for bids on Runway 2-20 at the Rochester Municipal Airport Phase II and any other business the Council may deem proper. E-1 Allen moved, Larson second to instruct the City Clerk to.advertise for bids to be opened at 11:00 A.M. on June 16, 1978 for Runway 2-20 Phase II at the Rochester Municipal Airport. Ayes (7), Nays (0). Motion carried. F-1 Powers moved, Allen second to adopt the prepared Resolution No. 359-78 approving the cost estimate and financing plan -for the Pine -Landmark project. The Common Council hereby finds that the public costs assoc- iated with the project as proposed are financially feasible and the Ci hereby commits itself to implementation of these public improvements subject to the successful negotiation and execution of a Phase II agreement between the City and the developers of the Pine -Landmark project. Ayes (7), Nays (0). Motion carried. F-1 An Ordinance correcting the legal description of property rezoned by Ordinance No. 1907 ( Gooding High Point Condominiums ) was given its first reading. Gray moved, Larson second to suspend the rules and give this ordinance a second reading. Upon Roll Call vote, Aldermen Allen, Gray, Larson, Powers, Solinger, and Strain and President Postier voted aye. Ayes (7), Nays (0). Motion carried and the Ordinance was given its second reading. Powers moved, Gray second to adopt the Or- dinance as read. Ayes (7), Nays (0). Motion carried. F-1 Larson moved, Strain second to adopt the prepared Resolution No. 360-7� orrecting the error in. -.the legal description contained in Resolution o. 400-77 Lots 5,6, and 7 of Block 17 Head and McMahon's Addition ( Gooding High Point Condominiums ). Ayes (7), Nays (0). Motion arried. H-1 layor Alex Smekta presented a letter to the Common Council at this time regarding a citizen complaint on the residence of Dr. Joseph uffy, duly elected Second Ward Alderman at the May 16., 1978 election. he letter is as follows: he Honorable Alex P. Smekta May 19, 1978 ayor of Rochester ity Hall Rochester, Minnesota Pear Mayor Smekta: a citizen of second ward, I would like to express a concern 902 RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA Special Meeting of the Common Council No. 45 - May 22, 1978 Agenda Item -1 over the recent election for alderman in my ward. From reading the "Post Bulletin ", I must assume there could be a question of residence legality of the new alderman -elect, Dr. Joseph Duffy. Also.through the "Post Bulletin", Alderman Gray has stated that he would not support any charge to this effect. I do not think this is a decision Alderman Gray can make. I wish to make no allegation or charge towards Dr. Duffy's good intentions, integrity, or honesty. However , if there is the slightest doubt of the required residence legality, I feel it should be investigated I would therefore, ask that you i.ni.tiate whatever action is needed to determine if Dr. Duffy was or was not a legal resident, for the position of the alderman of the second ward, at the time of the recent election. Further, that these results, either way be published in the"Post Bulletin". Ayes. (6), Nays (0). Alderman Gray abstained. Motion carried. Gerald Swanson, City Attorney stated that we have a legal requirement to start action seven days after the canvass has been completed. This is started with this special'meeting. He also stated that the legal question was whether the Charter provision is superceded,by the State Statutes. Having no further &sne�s, Strain moved, Larson second to adjourn the meeting. Ayes (7), Nays (0) - Motion carried. City Clerk
