A-1 President Selby called the meeting to order at 2:00 P.M., the follow-
ing members being present: President Selby,Aldermen Canfield,
Crawford, Hunziker, McConnell, Petersson and Solinger. Absent:None.
Fred Wagner presented a Safety Award which depicted the 1991
Outstanding Safety for the City of Rochester. The City of Rochester
was one of three cities given this award. The Council thanked Mr.
Wagner for the efforts his department has made on behalf of the City.
C-1 Crawford moved, McConnell second to approve the follow.ing appointments
by the Mayor.
Citizens Adv. of Transit - Charles Rainy of 708 15th Ave. S. W. and
Martha Miner of 2225 Telemark Lane-N. W. they replace Ernest
Kleckner and David Jensen - terms run' .to 12-31-95. Also considered
in the motion was'Jeff Allman of 2510 Hillside Lane-S.W. for a -three
year term expiring 12-31-95. Ayes (6), Nays (1). Alderman Solinger
voted nay. because one of.-the.appointees did not live in the City.

C-2 Petersson moved, Crawford second to approve the following appointments
by the Mayor to the Music Board:

end Ciresi for the waiver of conflict of interest in the firms

Canfield moved, Solinger second to adopt Resolution No. 250-92
authorizing the issuance and sale of $90,000,000. in Health Care
Facility Revenue Bonds for the Mayo Medical Foundation/Mayo Medical
Center and authorization of the execution and delivery of documents
and certain actions be taken with respect to such issuance and sale.
Alderman McConnell stated that for the Record that he would like to
have the words added that there•is no liability for the City on any
of these bonds. Ayes (7), Nays (0).Motion carried.
Crawford moved, McConnell second to adopt Resolution No. 251-92
awarding the low bid for the Reconstruction, grinding and grooving
and marking on Runway.13/31 J 6929/69,04 to Diamond Surface, Inc
of Maple Grove Mn. The amount is $836,902.73.

Resolution No. 252-92 approving the low bid of upgrading of security
systems FAA 107 to Nietz Electric for the amount of $66,300.00.
These bids met the MBE standards and are subject to the approval of
the Federal Aviation Adm. and Mn. Dept. of Transportation.

was an incomplete bid.. Also included in the motion was to readvertis(

the condition that the applicants should be required to dedicate
to the City the ROW for 20th St. S. E. which lies on their property.

A Hearing on the Consideration of the proposed Ordinance -Regulating
C.abaret Erotic Dancing.. Terry Adkins, City Attorney explained the
law and how it pertained to this matter. The Constitution of the
United States protects this type of business and the First Amendment
protects it. Local jurisdictions can regulate certain activities.
This hearing is trying to establish the adverse secondary effects
by the testimony of people during this hearing..
Secondary effects of prostitution rape and criminal assault are just
some of the reasons which could be adverse secondary effects.
Wishing to be heard was Ron Livingston of the Consolidated Planning
Dept. and he went over the Land Use for Adult Entertainment and the
history of like zoning.
Wishing to be heard was Rory Lenton of Rochester and is President of
Rochester/ Olmsted Co. Social Services. He presented a petition to
the Council containing 2,488 signatures on it opposing this type of
activity. He stated that he only worked on getting them for a short
time and that more signatures could be secured in a couple of days.
He cited the following as some of the main reasons they oppose this
business. 1. Safety - Traffic would be increased and the highway
would have to be crossed without the benifit of a traffic signal.
2. If alcohol beverages are served, then it would present danger to
the area of drunk drivers, etc. 3. With such an activity, patrons
may become sexually aroused and thus.relieve themselves of this
frustration in the parking lot or pose a danger to the residents.
4. This would definitely decrease their property values because
"who wants to live next to such an activity"?
5. The sexual exploitation that would be presented by women. He does
not want his five daughters exposed to such demeanor nor would he
want the area to be exposed to diseases. He gave various names of
cities and states that have dealt with this type of activity and
they have indicated that crime does go up significantly where this
type of business is allowed. The City Attorney questioned Mr. Lenton
for the Record on tipping, covering of parts of the body, etc.
and he stated that if clothing was required, and if a glass/plastic
shield was to be used, this would help the situation, but they still
do not want it in Rochester.
Heather Lenton of 3951 Willow Park S. W. is a -student of Willow
Creek Jr. High School. She is opposed and is concerned about the
safety factor. She states that kids her own age walk in the area to
go babysitting and also to Fleet Farm and she would be denied those
privileges if this business was to be allowed. She feels that her
rights have been taken away.

Wishing to be heard was Howard Winholz of 1928 26th Avenue N.W. and
has been a resident of 27 years and he is concerned about the future
of Rochester. He was helping gather opposing signatures and is
amazed at the unified response in opposition to this business.
He stated that he understood the Supreme Courts decision and how
it relates to the Constitution, but he thinks the Council should do
the right thing and not allow this business in the City of Rochester.
Wishing to be heard was Gary Melin of 1211 1st St. N. W. and just
had a heart transplant and does not want sexually transmitted
diseases to happen in Rochester. He stated that from his own life,
health is -concern. Terry Adkins, City Attorney also questioned Mr.
VIelin and Mr. Melin stated that a shield and clothes on requirement
for the dancers etc. would help a little.
Wishing to be heard was Dorothy Combs of 1103 7th St. S.W.
She is opposed and brought information about other cities in the
country that had to deal with this situation in their cities.
She is opposed. Terry Adkins, City Attorney also questioned her about
the fact that tipping , use of clothing and shields would help.
She stated that it definitely would help.
Wishing to be heard was Sandy Smith of 1723 Terrace Lane N. E.
He is concerned: about the traffic generated in the area: He stated
that one of the most dangerous intersections in the area is the
one at the Fleet Farm and that is where this would be established.
Alderman Canfield reminded the citizens that the Council is to decide
whether or not to regulate the strip bars.
Wishing to be heard was Thomas Rexler of 1138 5th'Avenue S. E.

St. S.W. were concerned about the situation.They donot want this
type of entertainment in their neighborhood.
Also opposed were Steve Herper, Tom Brandy of 2848, Fox ValleyDr. SW.
and a resident of 3715 llth Avenue S. W. who stated that the mess
they had in California, where he came from was not good for anything.
Mr. Adkins questioned this person and he, too , agreed that the
allowance of more clothing and putting up a shield and no tipping
would help - however, the traffic situation and safety would still
be prominent for the area citizens.
Wishing to be heard was Gary Podulfin of Stewartville, Mn. and is
opposed and urged the Countil to do what they can to regulate this
business. He asked the City Attorney what can be done to stop this.
Mr. Adkins stated that regulatory measures can be used. You simply
cannot pass a State law to stop this sort of thing - Also you can
change the Constitution of the United States.
Wishing to be heard was Chris Mullin of 3916 Willow Heights S. W. He
is the manager of Fleet Farm and would be a neighbor. He is opposed.
Traffic would overflow into his parking lot and he would have constan
parking problems. He does not want his property value lowered -and he
is opposed to his rights being violated.

Wishing to be heard was Sandra Mullin of 3916 Willow Heights S. W.
and stated that this city is known for its leadership, integrity,
culture and the fine people it represents. The 2,488 opposing
signatures alone should guide the Council on their decision.
She would like to take this all the way to the Supreme Court - it
would be money well spent. This is not a good place to have this
sort of business.
Wishing to be heard was Jim Miller of the Rochester Police Dept.
his title is Assistant Chief. He brought information on definitions
of "Exotic Dancing". Mr. Miller also stated that some regulatory
measures that can be used would be - raised platform for the dancers
and glass plated shield. Also requiring them to wear clothing of
some sort. Mr. Miller gave statistics on raise of crime, rape,
etc. involved with this sort of business. Under questioning by
City Attorney, Terry Adkins, Mr. Miller substantiated that crime,
rape, drunk driving, etc. does indeed rise when affiliated with
this sort of business. Also questioning Mr. Miller was Assistant
City Attorney Tom Canan. The questions were aimed on the types
of crimes committed and statistics. This is on Record with the
City Clerk. The Council also questioned Mr: Miller and those
questions are also on Record with the City Clerk. .
Wishing to be heard was Tracy Ostergard of 1705 4th Avenue S. W.
and lived in Nebraska where they had this sort of business. He
stated that a glass shield would be good as many times smells have
an arousal that tend to excite people. Also if businesses of these
types are allowed, then the "good" business moves elsewhere and
one thing breeds on another. He urged the Council to regulate this
with as stiff regulations as can --be allowed.
They also had many police calls in the area of Nebraska that he was
from. Mr.Adkins, City Attorney questioned "Would glass shields
help? " He stated that they definitely would - in his estimation.
Wishing to be heard was Cindy Bertschinger of 3900 Willow Court S.W.
and is also concerned about the various types of crime that could
occur. She has little girls and is worried about their safety when
men come out of this establishment aroused and drunk or both.
Alderman McConnell agreed with her as he has four daughters of his
own and can understand her concern.
Alderman Crawford questioned where she had lived before - Ms.
Bertschinger stated Phoenix. She grew up a block away and knows
first hand of all the problems affiliated with this sort of business.
Speaking in opposition was Tony Knauer of 1606 15th St. N.E.
and urged the Council to regulate this as strong as they can.
Wishing to be heard in opposition was Dan Holter of 1934 3rd
Avenue N. E.; Robert Miller of 714 36th St. N. W. , Lyle Gardner
of 532 5th Avenue N. W., Mary Hedstrom of Dover , Mn. ; John
Jacobson of 719 7th Avenue S. W. Sherry Rentzen of 3951 Willow
Heights S.W.; Elmer Eik of 2206 1st Avenue S. W.; Tom Miller of
Rural Route Rochester; Bill Bertschinger of 3900 Willow Court S.W.
Having no one else present that wished to be heard, President Selby
closed the hearing.

regulations and what they could do. This is on Record with the
City Clerk.
Having no further discussion, Petersson moved, McConnell second
to proceed with the adoption of the Ordinance Regulatin Cabaret
Erotic Dancing as proposed by the City Attorney. Ayes �7), Nays

An Ordinance Creating Section 85.021 of the Rochester Code of

liquor premises or an adult cabaret, and providing a penalty. This
