I Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota held in the Council Chambers, in the City Hall in
!said City, on April 9, 1945.

President Jemmon called the meeting to order at 7:30 o'clock P.M., the �.
following members being present: President Lemmon, Alderman Fryer, Kennedy,

!Kjerner, Mcquillan, Farveson and Yaeger. Absent: None.

Upon motion by Yaeger, second by Kjerner, the minutes of the meeting
I
of April 2, 1945 were.approved. •
i
President Lemmon stated this as being the time and place set for
!receiving and opening bids for the purchase of one Diesel Motor Grader. The
following bids were received and read at this time: The George T. Ryan Co., one
Galion 4101 Diesel Motor Grader at $7,101i.69; A & W Company Inc. of Minnesota, i

lone Diesel Power Pa.trol"Grader at $7,759.00; Rosholt Equipment Company, one Modeli,
1412 Adams Motor Grader at $6,791.00 and 1 Model 511-12 Adams Motor Grader at

The recommendation of the Street and Alley Committee and the City
Engineer that the bid. of George T. Ryan Co. in thy, amount of $7,104.69 be accepted,
was read and upon motion by Yaeger, second by Kjerner, the same was accepted.
Upon motion by Fryer, second by Kennedy, the City Clerk was instructed
to return the certified checks of the unsuccessful bidders on the Diesel Patrol
Grader. 1'
P, communication addressed to Mayor Grassle from H. 0. Halvorson,

Professor of Bacteriology at the University of Minnesota., transmitting his
comments on the report submitted by Toltz, King & Day, Inc. on the prouosed

;sewage treatment plant at Rochester, was read together with the comments on the
I •!;method of treatment, capacity of the plant, plan basis, sludge handling equipment',
I i.
(land incineration. Upon motion by'Fryer, second by Kjerner, the report by Dr.
INalvorson was accepted and ordered placed on file. Alderman Kennedy stated that II

!Mr. Duval of Toltz, King & Day, Inc. wished to meet with the Common Council and
;,upon motion by Fryer, second by Kennedy, a meeting was set for 7:30 o'clock P,.M.
on April 19, 1945 at the City Hall.
An invitation from the County Auditor to the members of the Board of
';Review to attend a meeting called by the Commissioner of Taxation, the said
meeting to be held at the Court House on Friday, April 13th, at 2:00 o'clock P.'M.
was read and the same was referred to the City Assessor to notify the members of

The recommendation of the Board of Zoning that the petition to have the'

West 267 feet of Lot 38, Auditors Plat "A" changed from residential zoning to
commercial zoning, be not granted, was read. A motion was made by Alderman
McQuillan, that the Council override the recommendation of the Board of Zoning
and that the.Zoning Ordinance be amended so as to place the West 267 ft. of Lot
39, of Auditor's Plat °A" in commercial zoning. No second to the motion being
received it was declared.out of order.
The City Engineer's appointment of Kenneth L. Hansen, as Assistant
• City Engineer; Soren Olsen,. Foreman; George Eayres, Sub -Foreman; Anna M. Drews,
Secretary; and R. N. Wentworth as -Mechanic; also John J. Cook, Chief - Operator of
the Sewage Disposal Plant and Edward Ranfranz and H. 14. Persons as Assistant

Operators of the Sewage Disposal Plant, was read and upon motion by Fryer, second
by Kennedy, the same were approved.
Th.e appointment by the City Clerk of Miss Elfreda Reiter as
first
stenographer and clerk of registration in the office of the City Clerk
was read
and upon motion by IT'cQuilla.n, second by Fryer, the same was approved.
A copy of a resolution adopted by the Public Utility Board setting
forth the amounts of salaries- for the various positions in the Public
Utility
Department for the period beginning April 1, 1945 and ending April 1,
1946 was
read. Mr. W. H. Foard, Busines..s Agent;= r f or Local Union No. 8-949 of
the
American Federation of Labor, Electricians Union, appeased before the
Council
and requested that the schedule as set forth in the resolution for certain
employees be increased and also stated that he desired to meet with the Public
Utility Board before final settlement of the salary schedule. Upon motion by
McQuillan, second by Fryer, the salary schedule was referred back to the Public
Utility Board.
A communication from the Public Health & Welfare Board submitting the
salary schedule recommended by them for;the positions in the Public Health &
• Welfare Department and at the City Farm for the ensuing fi§ca.l year was read and
the same was ordered placed on file.
A communication from the Board of Park Commissioners setting forth the
recommended salaries for the various positions in the Park Department was read
and upon motion by Fryer, second by Kjerner, the City Clerk was instructed to
request the said Park Board to furnish a schedule which would show a comparison
of the salaries paid last year and those recommended for the ensuing year, and
also a similar schedule was requested from the Public Utility Board.
The request of the City Engineer -that $5000.00 be ap-propriated fror-n the
General Fund for use of the Street and Alley Committee was read and ordered place
on file.

Southeast from 4th Avenue Southeast to 5th Avenue Southeast was read and the
same was referred to the Sewer Committee and the City Engineer for report at
the next meeting.
The report of the City Weighmaster for the month of March, 1945 showing)
293 private loads weighed and receipts of $29.30, Eras read and President Lemmon

referred same to the Finance Committee.
The report of the Clerk of the Municipal Court :or the wepk en6_ed
April 7, 1944, showing criminal fines and costs collected $306.90, civil fees

received $2.00, and conciliation court fees $3.50, was read and having been
previously approved by the City Attorney, President Lemmon ordered that same be
placed on file.
The annual report of the Public Utility Department for the year ended
March 31, 1945 was read and upon motion by Fryer, seco.nd by Kennedy, the same
was accepted and ordered placed on file.

The City Engineer's Trial balance for the month of March, 1945 was read
and President Lemmon ordered that same be placed on file.
The statement of receipts and disbursements in the Park improvement
Fund for the month of March, 1945, was read and the same was accepted and ordered
placed on file.
The annual report of the Board of Park Commissioners was read and upon
motion by Fryer, second by Kjerner, the same was accepted and ordered placed on
file.
A report by the License Committee recommending that Bemel Bros. load
scrap paper and junk at a team track out of the residential section of the City,
that scrap paper in transit over City streets be covered by a canvas or similar
covering, that brakes on trucks used by them in collecting their junk be
regularly inspected by the Police Department,. and also that plates with the
license number, dealer's name and the words "Rochester Junk" be displayed on theii •
truck, as provided by Ordinance. The License Committee further recommended that;
a license be issued to Bemel Bros. with the understanding that they will observe)

the provisions of the ordinance governing junk dealers. The License Committee
also recommended that a junk dealers license be granted to Bernard Lumelsky of
Zumbrota, Minnesota, and upon motion by Fryer, second by Kennedy, the report of
the license Committee was approved and ordered placed on file.

Neumann, Rochester Chamber of Commerce and Harold A. Witzke for license to sell

The application of Earl 1. Judge for Journeyman Electricians License
was read and upon motion by Narveson, second by Kennedy, the license was granted.
The applications of Dornack, J. A. I)a.ly� and Edward T. Connolly
for Master Plumber's Licenses were each rea.d and upon motion by McQuillan, s econ
by Narveson, the licenses were granted.
The applications of Harold Gerths, Elmer C. Kruesel, Edward Connolly
and Donald Connolly for . Journeyman Plumber's License were each , r ea.d and upon
motion by Kjerner, second by Yaeger, the licenses were granted.
The applications for Poll -Hall Licenses of Don Emerson (j tables) and
Sig Aal (5 tables) were each read and upon motion by Fryer, second by Narveson,
the licenses were granted.
The application of Oren M. Sizer for license to operate a. popcorn and
peanut wagon was read and upon motion by Kjerner, second by Kennedy, the license
was granted.

Alderman Kennedy introduced a .resolution appropriating $381.70 from the I
3eneral Fund, $992. S2 from the St. & Alley Fund, and $199.00 from the Sewer Fund

Alderman Kjerner introduced a. resolution appropriating $407.65 from the
P. E. Williams Estate Fund and. ordering payment ir:ade to the Sir:;on Stensrud Estate

Upon motion by Fryer, second by Kennedy, that the said resolution be

said resolution duly passed and adopt ed.
Alderman Na.rveson introduced a resolution appropriating $221.50 from the
Sewer Fund and ordering payment made to Hayes Lucas Lumber Company for coal for
Sewage Disposal Plant, which was read.
Upon motion by Na.rveson, second by Kjerner, that the cair'.. resolution
b•e adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
