Minutes of an adjourned regular meeting of the Common Council of the
City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in
said City on April 8, 1946.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
(following members being present: President Lemmon, Aldermen Fryer, Kennedy,
Kjerner, Mcquillan, Narveson, and Yaeger. Absent:. None..
Upon motion by Yaeg-er, second by Kjerner, the minutes of the meeting of
April 1,.1946 were approved.
President Lemmon stated.this as being the time and place set for the
receiving and opening of bids for furnishing of approximately 100,000 gallons
MC-3 Cutback Asphalt and 35,000 gallons TC3Tar. The following bids were received
and read at this _time:. Northwestern Refining Company, MC 3 Cutback Asphalt at
$.OS per gallon; Rock Is -land Refining Company, MC 3 Cutback Asphalt at $.0736 per
gallon;. Standard Oil Company, MC 3 Cutback Asphalt at $.0642 per gallon; Macmills
(Petroleum Corporation, MC 3 Cutback Asphalt at $.0711 per gallon.
The recommendation of the Street and Alley Committee that the contract
for the purchase of 100,000 gallons MC 3 Cutback Asphalt be awarded to Standard
Oil Company at $.0642 per gallon was read and the same was ordered placed on file.
No bids were --received for furnishing tar and upon motion by Fryer, second by
Kjerner, the. City Engineer was authorized to purchase tar as needed and the City
Clerk was authorized to return the certified checks of the unsuccessful bidders
for cutback asphalt.
President Lemmon stated this as being the time and place set, for the
receiving and opening bids for the furnishing of a power shovel for use of the
Street and Alley Department. The bids of A & W Company in the amount of $9795.00
and Ken S. Gold Company in the amount of $19,991.00 were each read and upon motion
by Fryer, second by Kjerner, action on the same was deferred until the meeting on
April 23, _ 1946.
Mr. Russell L. Sanders, representing the Junior Chamber of Commerce,
appeared before the Common Council and requested an appropriation by the Common
Council for furnishing music at the Gypsy Frolic to be held at the Mayo Civic
Auditorium. Upon motion by Fryer, second by Kennedy, $199.00 was appropraited
from the Band Fund for the purpose of furnishing music at the 4H Club Gypsy Frolic
A communication from the State of Minnesota Water Polution Control
Commission with an application form to be used in making application for a .permit
to construct a Sewage Disposal Plant was read and upon motion by'Kennedy,'second
by K jerner,. the same was referred to Mr. S. P. Kingston, Engineer for the Public
Health and Welfare Department.

A communication from Mr. H. S. Patterson stating that there was a high
'lbank at each end of the sidewalk in front of his property at 606 Eleventh Street
iSoutheast which has never been graded was read and the matter was referred to thei
!'Street. and Alley Committee and the City Engineer.
j The following receipt given by Mr. E. A. Zuehlke,City Treasurer to
�Mr. F. R. Finch, City Clerk, was read and the same was ordered placed on file:

I hereby acknowledge receipt of bonds in all Rochester
funds except the Police Relief Fund in the amount of
$2,042,000.00 face value. I also acknowledge receipt of
bonds registered in the name of Rochester Police Relief
Association in the amount of $20,000.0.0.

read: Soren Olsen, Foreman; Frank Eaton, Senior Draftsman; Anna Drews, Private
(Secretary; Louis McGarry, Surveyor; R. N. Wentworth, Mechanic; Donald J. Valsvik,'
(,Junior Draftsman; Clarence Hanson, Rodman in the City Engineer's Department and
John J. Cook, Chief Operator; Edward Ranfranz, Floyd Wussow, and William Haugen,
iAssistant Operators at the Sewage Disposal Plant. Upon motion by Fryer, second by,

The appointment of Miss Elfreda Reiter as First Assistant and Clerk of

�.Registratlon in the City Clerk's office was read and upon motion by Kennedy,
second by Narveson, the same were approved.
The appointment of Mr. Neil D. Adams and Mr. Ruger Keehn as members of
,the investigating committee for heating licenses by John A. Marsh, Heating

Inspector were read and upon motion by Yaeger, second by Narveson, the same were

The appointment of Mr. Reidar Pederson and Mr. T. H. Johanson as

(members of the Plumber's Examining Board by John A. Marsh, Plumbing Inspector
;were read and upon motion by Kjerner, second by Yaeger, the same were approved.
A petition to have the East 82 ft. of Lots 10 and 11, Block 15, in
(East Rochester Addition changed to a multiple dwelling zone was read and President

Lemmon referred the same to the Board of Zoning.
A communication from the Board of Public Health and Welfare recommendin
salaries in the Public Health and Welfare Department and at the City Farm was
read. Mr. Walter Halley was pres.entc d.t :.t.he;'.!m:eeting and objected to the salary as
recommended for the foreman at the city farm, and also protested the retirement
of Mr. T. J. Costello at this time. Mayor Grassle recommended that Mr. T. J.
Costello be allowed a hearing before the Public Health and Welfare Board and that
the .Common Council be present during the hearing. After hearing Mr. Hasley
further on the recommended salary for the foreman at the city farm, a motion was
made by Fryer, second by Kennedy, recommending that the matter be referred back
to the Public Health and Welfare Board for their consideration. Upon roll call
all voted: -in favor thereof.
A petition for the construction of a sanitary sewer and watermain in
Blocks 1 and 2, Indian Heights was read and the same was.referred to the Street
and Alley Committee, the Sewer Committee and the Water Committee.
The following request by th.e Mayo Properties -Association was read and
the same was referred to the Street and Alley Committee, the Sewer Committee and
the Water Committee.,
"The Honorable Mayor and Common Council
City of Rochester
Rochester, Minnesota
We request that the following improvements be made in the
Homestead Addition:
Sewer and water in lhth Ave. S.E. extending South
from Fourth Street S.E. to end of Avenue, a distance
of approximately 350 feet.
Street grading and gravel on 14th Ave. S.E. as
described above; and on 15th Ave. S.E. from Durand
Court S. E. to Graham Court S.E. and on Berkman,
Damond, Durand, and -Graham Courts, S. E. west of
15th Ave. S.E.
We will pay the cost of these improvements with the
understanding that the usual rebates for water mains
will be made as the individual services are connected.

and upon motion by Fryer, second by Yaeger, the -same were accepted and the City
Clerk and City Engineer were authorized to prepare resolutions fixing hearings
on same.
The recommendation of the Water Committee that the City Engineer be
directed to make field surveys and.prepare preliminary estimates for the
installation of a watermain in 15 Avenue Northeast from East Center Street,to the
Chicago Northwestern Railroad Tracks was read.and upon ;motion by Fryer, second by
Yaeger, the same was accepted and the City Clerk and City Engineer were authorizes
to. prepare a resolution fixing a hearing on the same.
The recommendation of the Finance Committee that the Rochester Post
Bulletin Company be appointed to do the official printing and publications for
the City of Rochester during the fiscal year beginning April 1, 1946 and ending
April 8. 1947 was read and upon motion motion by Fryer, second by faeger, the
same„was accepted and ordered placed on file.
The following recommendation by. the Sewer Committee was read:
"TO THE COMMON COUNCIL
The matter of a minimum of amendments to our present charter
to take care of our needs until a new charter might be
presented to the voters, was referred to the Sewer Committee
which suggests the following:
1. An amendment to permit an increase of the tax levy
from 5% to 15%.
2. An amendment to provide for a Primary Election in
May and a Charter Election in June. All elected
officers to take office July let. The Fiscal Year
ofthe City shall commence on July let on each and
every year. All appointed officers to be named
December 1 and take office Januarylst. All Council
meetings to be held in the evening.
3. An amendment for the Police Protection Fund so much
as may be necessary to maintain Police Protection
for the City.
4. An amendment to -issue Revenue Bonds against any
Public Utility after b-eing -recommended-by the Board
in charge of Utilities and approved by 5/7 vote of
the Common Council, then submitted to the voters
for final approval.

accepted and the City Clerk was instructed to notify the Charter Commission of thi
proposed amendments.
The report of the City Weighmaster for the month of March, 1946 showing
465 loads weighed and receipts of $46.50 was read and President Lemmon referred
the same to the Finance Committee.
The report of the Clerk of the Municipal Court for the week ended
April 6, 1946 showing total criminal fines and costs collected $949.00, civil feet
received $20.00 and conciliation court fees $1.75 was read and having been

previously approved by the City Attorney, President Lemmon ordered that the same

during the months of February and March, 1946 and the annual report of the Board

Alderman Kennedy introduced a: resolution appropriating $226.87 from
the Sewer Fund and ordering payment made to Hayes Lucas Lumber Company for coal
for sewage disposal plant, which -was read.
Upon motion by Yaeger, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution - ordering a hearing on vacating
the alley running East and West in Block 41, Northern Addition, which was read.
Upon motion by Kennedy, second by Narveson, that the said resolution b
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced aresolution ordering a hearing on vacating
the alley in Block 5, Cummings Addition, starting a.t.the North line of the Chica
Northwestern Railroad and running North to the North property line of Block 5,
Cummings Addition, which was read.
Upon motion by Narveson, second by Yaeger, that the said resolution be

"Be it resolved, by the Common Council of the City of Rochester,
Minnesota;
That the Public Utility Board of the City of Rochester, Minnesota, be
and -the said Board is hereby authorized, effective April 1st, 1946 to pay the
following sums as yearly salaries and compensations to its employees; the said
salaries to be payable in equal monthly installments, one half of the said
salaries to be paid on the 16th day of each month and one half thereof to be due
and payable on the last day of each calendar month, to -wit:

"Be it resolved. by the Common Council of the City of Rochester,
Minnesota:
. That. the salary and compensation of ,the following members of the °Police
Department of the City of Rochester, Minnesota, hereinafter named be and the same
are hereby fixed, set and allowed as follows during the ensuing official year:
1 Chief of Police $3,900.00 per year
1 Asst. Chief of Police 3,000.00 per year-
1 Capt. of Detectives 2,920.00 per year
2 Detectives, each 2,700.00 per year
1 Supt. of Juvenile Division 2,820.00 per year
1 Asst. Juvenile Officer(man) 2,590.00 per year
1 Asst. Juvenile Officer(woman)2,400.00 per year
1 Record Clerk 2,820.00 per year
3 Captains, each 2,820.00 per year
3 Desk Sargeants, each 2,590.00 per year
20 Patrolmen, with former

Provided that all policemen appointed who have not had previous
experience as policemen shall receive a salary and compensation in the amount of
$170.00 for the first six months; $185.00 for the next 12 months; and $200.00
maximum.
Such salaries and compensation shall be paid from the General Fund of
said City in equal monthly installments, one half of the monthly salary and
compensation being payable on the 16th day of each month and the balance thereof
on the last day of each calendar month during the ensuing official year."

The Mayors emergency order for the repair and construction of the sell —

and estimate of cost and ordea ng bids for the construction of a watermain from
3rd Avenue Southeast into the fair grounds and a sanitary sewer from Graham
Addition into the fair grounds, which was read.

Alderman Kennedy introduced a resolution appropriating $499.00 from the

The request of The Kruse Company that a curb be installed extending thel
full length of their property on 7th Street Northeast was read and upon motion by
Fryer, second by Itennedy, the matter was referred to the City Engineer to give
the proper grades and prepare plans and specifications for the installation of the
said curb.
The claim of Carlisle G. Fraser in the amount of $199.00 for the
construction of a sanitary sewer.in 4th Street Southeast from 3rd to 4th Avenue
Southeast was read and upon motion by Fryer, second by Yaeger, the same was
approved and the Mayor and City Clerk wer.e .authorized and directed to draw a
warrant on the City Treasurer and make payment accordingly.
