President John Hunziker called the meeting to order at 3:45 P.M. with the
following members present: Councilmembers Mack Evans, Ed Hruska, David
Senjem and Walter Stobaugh. Absent: Councilmembers Marcia Marcoux and
Jean McConnell.
Councilmembers expressed concerns that mining operations in residential areas
of the City have caused extraction of land in an unsightly manner; particularly
hilly areas,within a neighborhood.
Councilmember Marcoux was present.
Phil Wheeler, Planning Department Director, called attention to definitions of site
preparation and excavation that might be established.
Wishing to be heard was Ken Moen, representing SJC Properties, John Arnold,
read a letter from Mr. Arnold noting his concerns with the passage of a
moratorium which might impact mining activities currently underway. Mr. Moen
asked that the ordinance not be given a second reading at this meeting but
rather information given to concerned citizens to respond to the proposed
moratorium.
Wishing to be heard was Lisa Weisner of the Planning and Zoning Commission.
Ms. Weisner noted that the commission put a limit on the amount of cubic yards
and grading height that could occur. She felt that the site preparation should be
protected.
Wishing to be heard was Bill Tointon, McGhie & Betts. cautioning the Council to
be careful of the language because several developments, such as Western
Digital, will require more than 5,000 cubic yards of material moved. He also
noted that the map was provided showed areas of the city where mining
operations have been completed.
Wishing to be heard was Lee Ganske, 4220 Eastwood Road S.E., a member of
the Committee on Urban Design and Development. He cautioned to proceed
carefully on making the residential/commercial distinction and on the aesthetic
and environmental issues as well.
It was suggested that a limit on the duration of time that mining equipment could
be in an area might be 18-24 months. Bob DeWitz stated that he did not feel
that 24 months would hamper any commercial development. Bill Tointon
suggested that mining could occur in an approved general development, site
planning permit or restricted development plan.
After further discussion, President Hunziker recessed the meeting to 5:15 P.M.
asking that staff and those concerned individuals present bring back wording for
a moratorium ordinance.

E-3 Councilmembers Hruska moved, Stobaugh seconded, to approve the initiation of
the vacation of the South 25 feet of Third Street S.W. lying adjacent to Lot 5,
Block 11 of Original Plat. Ayes (6), Nays (0). Motion carried.
Councilmember Marcoux left the meeting.
E-1 Two separate proposals for wording for the moratorium ordinance were brought
back to the Council. Proposal number two would exempt anything that is applied
for after this time and has come to the Council for approval. Only one project
would be exempted under proposal number two and that would be a mining
operation south of 40th Street S.W. by Keystone.
Both proposal options would: restrict to residential, 24 months rather than 18,
cubic yards increased from 5,000 to 10,000, change in elevation at the surface of
more than 10 feet instead of 5 feet, excluding land area subject to building
footing permit, storm water management facilities approved by the City, projects
for which the Council has granted preliminary approval.
Councilmembers Hruska moved, Stobaugh seconded, to direct the City Attorney
to prepare an interim ordinance similar to what is being proposed with option
number 1 being substituted for item f and direct a study of the existing ordinance
for possible changes. Ayes (4), Nays (1). Councilmember Senjem voted nay.
E-2 Councilmembers Senjem moved, Evans seconded, to adopt Resolution No. 046-
98 setting the order of succession in the event that the Councilmember-at-large
is absent as: the senior most counciimember and then by ward number, the
lower ward number controlling. Ayes (5), Nays (0). Motion carried.
F-2a An Ordinance Creating Section 66.104 of the Rochester code of Ordinances,
Relating to the. Adoption of an Interim Ordinance Regulating the Issuance of
Permits for Mining or Extraction Activities Within the City, was given a first
reading.
H-1 Councilmembers Senjem moved, Evans seconded, to reconsider the
appointment of David Senjem to the Housing and Redevelopment Authority
Board by the Council President. Ayes (5), Nays (0). Motion carried.
Councilmembers Senjem moved, Hruska seconded, to approve the appointment
of Councilmember Hruska to the Housing and Redevelopment Authority Board.
Ayes (5), Nays (0). Motion carried.
Having no further business, Councilmembers Stobaugh moved, Senjem
seconded, to adjourn the meeting. Ayes (5), Nays (0). Motion carried.
