HomeMy WebLinkAbout02-12-1998RECORD OF OFFICIAL PROCEEDINGS OF THE COMMON COUNCIL CITY OF ROCHESTER, MINNESOTA Regular Adjourned Meeting No. 5 - February 18, 1998 5183 Agenda Item A-1 President John Hunziker called the meeting to order at 7:00 P.M. with the following members present: Councilmembers Mack Evans, Ed Hruska, Jean McConnell, David Senjem and Walter Stobaugh. Absent: Councilmember Marcia Marcoux. B-1 A Hearing on Type III, Phase II Restricted Development Preliminary Plan #97-29 by Frank Kottschade to allow the extraction of sand and gravel in the R-1 district and a Type III, Phase III Conditional Use Permit to allow extraction within the Floodway of Willow Creek for property located south of 40th Street S.W. and west of TH 63. Councilmembers McConnell moved, Stobaugh seconded, to continue ,the hearing on Restricted Development Preliminary Plan #97-29 and Development Preliminary Plan #97-29 by Frank Kottschade to the March 2, 1998 meeting as requested by the developer. Ayes (6), Nays (0). Motion carried. B-2 A Hearing on General Development Plan #97-127 by South Broadway Partners LLC located east and northeast of St. Bridgets Road and directly north of 45th Street S. E. Wishing to be heard was Lloyd Johnson, 1431 20th Street S.W., available for questions that the Councilmembers may have. Having no one further wishing to be heard, President Hunziker closed the hearing. Councilmembers Senjem moved, Stobaugh seconded, to approve General Development Plan #97-127 by South Broadway Partners LLC with five conditions and direct the City Attorney to prepare Findings of Fact, Conclusions of Law, and Order. Ayes (6), Nays (0). Motion carried. B-3 A Hearing on Vacation Petition #98-2 by the City of Rochester to vacate the South 25 feet of 3rd Street S.W. lying adjacent to Lot 5, Block 11 Original Plat, between 1st Avenue S.W. and 2nd Avenue S.W. and an area approximately 40 feet by 5 feet along the west side of 1st Avenue S.W., in conjunction with the planned parking ramp at 1st Avenue S.W. and 3rd Street S.W. Having no one wishing to be heard, President Hunziker closed the hearing. Councilmembers Stobaugh moved, Hruska seconded, to adopt Resolution No. 091-98 approving Vacation Petition #98-2 by the City of Rochester. Ayes (6), Nays (0). Motion carried. B-4 A Hearing on Type III, Phase III, Restricted Development Final Plan #97-23 by Keystone Management, Inc. to allow the extraction of sand and gravel in the R-1 district and a Type III, Phase III Conditional Use Permit to allow extraction within the Floodway of Willow Creek for property located on the south side of 40th Street S.W., also north and westerly of Willow Creek and lying west of U.S. 63.
