HomeMy WebLinkAbout09-16-19461 • • 1 1 • C� 1 Minutes of an.adjourned regular meeting of the Common Council of the Ci Df Rochester, Minnesota, held in the Council Chambers in the City Hall, in said i ty on September 16, 1946. President pro tem Fryer called the meeting to order at 7:30 o'clock P.M, the following members being present: Aldermen Fryer, Kennedy, Kjerner, McQuillan,1 Narveson, and Yaeger. Absent: President Lemmon. Upon motion by Kennedy, second by Kjerner, the minutes of the meeting of September 3, 1946 were approved. President pro tem Fryer stated this as being the time and place set for the second hearing on the construction of a curb and gutter on 8th Avenue Southeas from 6th Street to 9th Street Southeast. Three owners of abutting property appear11 jed nd again protested the construction of the said curb and gutter. President pro em Fryer advised that no further action would be taken on the project at this ime. President pro.tem Fryer stated this as being the time and place ,set for he second hearing on the construction of a watermain in llth Street Northwest rom 5th Avenue Northwest to 6th Avenue Northwest and in 5th Avenue Northwest from lth Street to 135 feet North of the center line of llth Street Northwest.There as no one present wishing to be heard. President pro tem Fryer stated this as being the time and place set for eceiving and opening bids for the construction of a sanitary sewer and watermain n 13th Avenue Southeast from 7th to 8th Street Southeast. The bid of Carlisle G. raser in the amount of $1610.50 for sanitary sewer and $1905.50 for! watermain as received and opened. Mr. Sam Crawford appeared at the meeting and inquired as to the progress f the project for the construction of a curb and gutter on 9th Avenue Northwest. e was informed that no action would be taken on the matter at this meeting. Mr. and Mrs. Emil Reiter and others appeared at the meeting in regard to the change of zoning of the Satoris property on East Center Street. After searing their protests, President pro tem Fryer stated that the final reading of the amendment to the Zoning Ordinance would be held on October 7th at 2:00 o'clock ?.M. Mayor Grassle asked if a commercial business at -that location would be a traffic hazard being so near to the East Center Street Bridge and upon motion by ,�arveson, second by Kjerner, the matter was referred to the Police Committee and the Chief .of Police for report at the meeting of October 7, 1946. The following petition for annexation of property was read and upon otion by Narveson, second by Yaeger, the same was referred to the Street & Alley Committee for report on October 7, 1946: " The undersigned owners of the following described real estate, to -wit: That part of the East One Half (E2) of Section No. Thirty Four (34), Township No. One hundred Seven (107) North, Range No. Fourteen (14) West, described September 16, 1946 I as follows: Beginning at a point on the east line of section No. thirty four (34) which is 313.5 feet south of the south right of way line of the Chicago and Great Western Railway, running thence west at right angles to said section line 220 feet, thence South parallel with the East line of said Section 100 feet, thence East to a point on the East line of said Section line which is 100 feet south of beginning, thence North along said section line 100 feet to place of beginning, in the County of Olmsted and State of Minnesota, hereby respectfully petition the Honorable Common Council of the City of Rochester, Minnesota that the above described premises be annexed to the said City of Rochester, such • property abutting the city limits of the City of Rochester, Minnesota. Brogan Mrs. Nellie Brogann The recommendation of the Sewer Committee that the contract for the construction of a: sanitary sewer in 13th Avenue Southeast from 7th Street Southeast to Sth Street Southeast be awarded to Carlisle G. Fraser for the sum of $1610.50 was read and upon motion by Narveson, second by taeger, the same was approved. The recommendation of the Water Committee that the contract for the construction of a watermain in 13th Avenue Southeast from 7th Street Southeast to 8th Street Southeast be awarded to Carlisle G. Fraser for the sum of $1905.00 was read and upon motion by Rjerner, second by McQuillan, the same was approved. A proposal in the amount of $1000.00 from the George Leiferman Insurance and Realty Company to purchase for a client the Fast 95 feet of Lot 28, Block 7 of Sunnyside Addition was read and upon motion by Kjerner, second by Narveson, the matter was referred to the Sewer Committee. The resignation of Ralph F. Books from the Rochester: Police Department effective September 16, 194 6 was read and upon motion by Yaeger, second by Rjerner, the same was accepted. A protest against the construction of a curb and gutter at this time on 9 th Avenue Northeast was read and the same was ordered placed on file. the congregation of A protest signed by 113 persons..r.epresemthg/ the Church of Peace against the granting of an Off or On Sale Liquor license for the location now known as • the Rochester Table Supply on North Broadway and also a protest signed by 33 residents in that location were each read and President pro tem Fryer ordered that the same be placed an file. A communication addressed to Mayor Grassle from the Sisters of Saint • Francis protesting the granting of an intoxicating liquor license in the vicinity of St. Marys Hospital was.read and President pro tem Fryer ordered that the same be placed on f Ile. The request of .B. A. Rosenthal for one years leave of absence from the Rochester Fire Department was read and upon motion by Kennedy, second by Yaeger, the same was approved. A.proposal by Mr. Tom Tracy in the amount of $300.00 to purchase a ff ILWAIVU 1 • • 1 1 Sep tember 16. 1946: piece of land belonging to the City of Rochester on 3rd Avenue Northwest was presented by Alderman McQuillan and upon motion by Yaeger, second by Kjerner, the matter was referred to the Public Grounds Committee. A petition signed by Tom Andrew, Rochester Bus Line, Inc., Mrs. Phillips Cassidy and Brum & White to have the property located at 15-5th Street Northwest described as the East 50 feet of -Lots 11 and 12, Block 74, Original Plat changed from a residential to a commercial zone was read and upon motion by Yaeger, second by Kjerner, the same was referred to the Board of Zoning. The report of the City Weighmaster for the month of August, 1946 showinE receipts for loads weighed $45.40 was read and President pro tem Fryer referred the same to the Finance Committee. The City Engineers Trial balance for the month of August, 1946 was read and the same was ordered placed on file. The statement of receipts and disbursements in the Park Improvement Fu for the month of August, 1946 was read and the same was ordered placed on,file. The City Treasurer's report for the month of August, 1946 was read and the same wa-s ordered placed on file. The reports of the Clerk of the Municipal Court for the week ended September 7, 1946 showing total criminal fines and costs collected $695.00, civil fees received $3.70 and conciliation court fees $1.25 and for the week ended September 14. 1946 showing total criminal fines and costs collected $643.00, civil fees received $1.05 and conciliation court fees $4.00, were each read and having been previously approved by the City Attorney, President pro tem Fryer ordered that the same be placed on file. The application of Angeline Kyle for a cigarette license was read and upon motion by Kennedy, second by "arveson, the license was granted. The. application of Frank Adair for a Journeyman Electricians License was read and upon motion by Yaeger, second by aarveson, the license was granted. The application of Angeline Kyle for license to., sell soft drinks was read and upon motion by Kjerner, second by Kennedy, the license was granted. The applications of Robert H. Bahr and Louis W. Haase for "Off Sale" Intoxicating Liquor Licenses were each -read and President pro tem Fryer ordered that the same be placed on f ile. The application of Sam Larson for a permit to place and maintain a sign) was read and upon motion by Kjerner, second by Kennedy, the permit was granted. The bonds of Carlisle G. Fraser in the sum of $1452.60 and $933.60 each with the United States Guarantee .Company as surety., were each read and upon motion by Kennedy, tecond by Kjerner, the bonds were approved, the surety thereon Fryer accepted and President pro tem/ordered that the same be placed on file. Upon motion by Kennedy, second by 13arveson, the City Clerk was instructe'i 70 Sep tember 16 1946 to request the various Boards and Department Heads to submit their budgets for ,the fiscal year beginning April 1, 1947 and ending March 31, 1949. Alderman Kennedy introduced a resolution appropriating $237.21 from the • General Fund and ordering payment made to Lyle Signs, Inc. which was read. Upon motion by Kjerner, second by Narveson, that the said resolution be adopted as read, and all voting in favor thereof, President pro tem Fryer declared the said resolution duly passed and adopted. • Alderman Kennedy introduced a resolution appropriating $9463.55 from the P.I.H. Fund and ordering payment made to Carlisle G. Fraser for estimate No. 1 for construction of a watermain in Indian Heights Addition, which was read. Upon motion by Kennedy, second by McQuillan, that the said resolution be adopted as read, and all voting in favor thereof, President pro tem Fryer declared ,the said resolution duly passed and adopted. Alderman Kennedy introduced a resolution adopting plans, specifications: and_ ordering bids for the installation of a watermain in llth Street Northwest from 5th to 6th Avenue Northwest and in 5th Avenue Northwest from llth Street to 135 feet North of center line of llth Street Northwest, which was read. Upon motion by Kjerner, second by Kennedy, that the said resolution be adopted. as, read, and all voting in favor thereof, President pro tem Fryer declared the said resolution duly passed, and adopted. Alderman Kjerner introduced a resolution accepting the bid of Carlisle G. Fraser for the construction of a sanitary sewer in 13th Avenue Southeast from 7th , to 8th Street Southeast, which was read. Upon motion by Kennedy, second by Warveson, that the said resolution be .adopted as read, and all voting in favor thereof, President pro tem Fryer declared' -the said resolution duly passed and adopted. Alderman Kjerner introduced a resolution appropriating 356.99 from the General Fund and ordering payment made to Department of Taxation, Petroleum Division, which was read. Upon motion'by Yaeger, second by kennedy, that the said resolution be • adopted as read, and all voting in favor thereof, rresident pro tem Fryer declared the said resolution duly passed and adopted. Alderman McQuillan introduced a resolution appropriating $957.76 from the General Fund and ordering payment made to Leo N. Herrick, which was read. Narveson, • Upon motion by Kennedy, second by that the said resolution be adopted as read, and. all voting in favor thereof, President pro tem Fryer declared the said resolution duly passed and adopted. Alderman McQuillan introduced a resolution appropriating $632•39 from the General, Fund and ordering payment made to `The Standard. Finch, City Clerk, $31. 73; Collector of Internal Revenue, $29.59.- The matter of holding examinations for patrolmen in the Rochester Police Department and firemen in the Rochester Fire Department was discussed and upon motion by Kennedy, second by Narveson, the Police and Fire Civil Service Commissions were requested to hold the said examinations as soon as possible. Alderman Yaeger stated that the Farmers Elevator Company had requested permission to construct a building Ln a commercial zone which would be built of. sheet metal over a •steel framework. He further stated that the building code did not provide. for this type of construction and upon motion by Yaeger, second by McQuillan, and all voting in favor thereof except Alderman Nar-veson, who. voted "no", the City Attorney was instructed t.o draw an amendment to the Building Code providing for- the construction of the said building -on a temporary basis, the time limit to be not over five years. The matter of an agreement between A.W. Wilkens and the Gity of- Roche-ster for the -rental of the Northern• Hotel building was again -brought to the attention • of the Council and upon motion- by Yaeger, second by Kjerner, the City Attorney was instructed to draw an agreement covering the rental of the Northern Hotel as had been verbally stated at a previous meeting. Garnet Spring, Building Inspector, stated that section 606, Paragraph CI, of the Building -Code should be amended to permit the use of 12 inch blocks in building up -to 15 fee-t in •heighth and upon motion by Kennedy, second by 73 McQuillan, the City Attorney was instructed to draw an amendement to the Building Ordinance covering the recommended change. Mr. John Marsh, Heating Inspector, recommended the change in the Heatin Ordinance. which would provide for the licensing of operators who install automati heating`equipment and also provisions regulating the installation of such equipme ,and upon motion by Kennedy, second by 1larveson, the City Attorney was instructed to prepare an amendment adding these provisions to the present Ordinance.
