Minutes of an adjourned regular meeting of the Common Council of the
"City of Rochester, Minnesota, held- in the Council Chambers in the City Hall in
I
said Pity, on December 16, 1946.
President Lemmon called the meeting to order at 7:30 o'clock P.M., the
Iifollowing members being present: President Lemmon, Aldermen Fryer, Kennedy,
,Kjerner, McQuillan, Narveson, and Yaeger. Absent: None.
Upon motion by Kjerner, second by Yaeger, the minutes of the meeting ofl'
:December 2, 1946 were approved.
President Lemmon stated this as being the time and place set for the
!receiving and opening of bids for furnishing a four door sedan for use in the
,City Engineer. -Is Department. The bids of Ellis Motor Company in the amount of !
$1795.00 and Universal Motors, Inc. in the amount of $1677.57, were each received,,
and opened.
The recommendation of the Street & Alley Committee that the contract for
the furnishing of one four -door Sedan for the City Engineer's Department be
awarded to the Ellis Motor Company for the sum of $1, 785. 00 was read and upon
'motion by McQuillan, second by Yaeger, the same was approved.
Upon motion by Fryer, second by Kennedy, the City Clerk was authorized
'to return the certified check of the unsuccessful bidder.
The request of the Board of Park Commissioners that the Common Council
instruct the Public Grounds Committee to start action to eleviate a condition on
,the north side of Silver Lake which now appears to be a hazard, by procuring the
;plot of land on which there is now an abandoned sand pit, was read and President

Lemmon referred the same to the Public Grounds Committee and the City Engineer for
;report. !
The recommendation of the Board of Park Commissioners that when 10% of
i
any section of a proposed addition to the City is suitable for a park or playground
. I
in the opinion of the said Board, the area be designated as such or if10% of the
'value be accepted in place of the land, the revenue be used for the improvement
i
',of park or playground areas in the vicinity of the new addition was read and
r
President Lemmon referred the same to the Public Grounds Committee.
The Mayor's emergency order given to the City Clerk for the purchase
;of approximately 9000 gallons of gasoline was read and upon motion by Ljerner,
second by Fryer, the same was approved.
A letter of appreciation from the Rochester Ministerial Association for,

;making the Mayo Civic Auditorium available for the Community Thanbsgiving Service,!
;,was read and the same was ordered placed on file.

A notice of postponement of the public hearing in the matter of the
application of Virginia C. Wilson d/b/a Wilson Trucking Company for a certificate,
..of public convenience and necessity was read and the same was ordered placed on

The Mayor'semergency order given to the Public Utility Board for the
purchase of additional fuel oil was read and'upon motion by Kennedy,second by
Narveson, the same was approved.
The recommendations. of the State Board of Registration for Architects,
Engineers and Land Surveyors as follows were read:
1. If reference is not made in your building code to the
provisions of the registration law, it is suggested
that provision as to compliance with.this and other
pertinent State laws be added to the existing building
code ordinance.
2. If you do not have a building code, it is suggested that
every effort be made to aid the League of Minnesota
Municipalities in its work in drafting such a uniform code
for the State of Minnesota which may be either adopted by or used
as a pattern for your City.
3. In the interest of proper construction and to safeguard life,
health and property and to promote the public welfare, it is
suggested that the building inspector in your city be given
proper authority to require compliance with the provisions
of the registration law in issuing building permits.
Upon motion by Fryer, second by Kjerner, the above recommendations were
referred to the Street & Alley Committee, the City Engineer and the City Attorney
f o r further study.
A copy of a. summary of working policies developed by the Board of Park
Commissioners was read and the same was ordered placed on file.
The request of F. J. Magnusrnn, City Engineer, for the transfer to .his
department of Walter C. Hoganson, Civil Engineer, now working in the Public
Utility Department at a salary of $1.55 per hour was read and upon motion by
Kennedy, second by Yaeger, the same was approved.
The certificate of the County Board of Classification of forfeited land;
as provided by Chapter 396 Laws 1935 as emended, in which they certify as non -
conservation lands the following description, °Com. at a pt 135ft N of W line
6th Ave. NW & N line S th St. NW, th N15f t, th E50f t, th S15f t, th W50f t to beg
Lands in the City",was read and the City Clerk was instructed to return to the
County Auditor one copy signed by the members of.the Common Council.
The following copies of resolutions adopted by the Sinking Fund
Commission were each read and upon motion by Kennedy, second by Fryer, the same
were approved and ordered placed on file:

of the City of Rochester, Minnesota:
That the sum of $17,167.35 be and the said sum is hereby
appropriated from the Sinking Fund and ordered paid to the
First National Bank of Rochester, Minnesota, for the purchase
of $17, 000. 00 12% U. S. Treasury bonds, ' ma. tuning December 15,
1950 and premium in the amount of $167.35, the said bonds
being purchased for the City Warehouse investment account."
"Be it resolved by the Commissioners of the Sinking Fund
of the City of Rochester, Minnesota:
That the sum of $119.17 be and the said sum is hereby II

appropriated from the Sinking Fund (Electric Light Depreciation
Account) and ordered paid to the Sinking Fund (Investments for
Light Bond Retirement Account), for the purchase of investments
now carried in the Sinking Fund for the retirement of Electric
Light Bonds.
The said bonds being sold the Electric Light Depreciation
Reserve for the purpose of making funds available for the
retirement of Electric Light 5% bonds, maturing on January 1st,

A letter from the Hawthorne Menus Club asking the Countil for their
opinion as to the advisability of having the Chicago Great Western place a safety
signal on the railroad crossing at 92 Street Southeast and also inquiring into th
posdbility of having sidewalks built on the North side of 92 Street Southeast
to connect with the sidewalk in front of the Rochester Bottling Company and the
walk which is already built East of the Rochester Bottling Company, was read and
upon motion by Yaeger, second by �arveson, the same was referred to the Street &
Alley Committee.
The report of the City Weighmaster for the month of November, 1946
showing 495 loads weighed and receipts.of $49.50 was read and President Lemmon
referred the same to the Finance Committee.
The City Engineer's trial balance for the month of November, 1946 was
read and President Lemmon ordered that the same be placed on -file.
The statement of receipts and disbursements in the Park Improvement Funi
for the month- of November, 1946 was read and the same was ordered placed on file.
The City Treasurer's report for the month of November, 1946 was read
and the same was ordered placed on file.
The reports of the Clerk of the Municipal Court for the week ended
December 7, 1946 showing total criminal fines and costs collected $261.00,, civil
fees received, $2.00 and conciliation court fees $4.00 and for the week ended
December 14, 1946 showing total criminal fines and costs collected $472.50, civil
fees received $4.35, and conciliation court fees, $4.50, were each read and havinj
been previously approved by the City Attorney, President Lemmon ordered that the
same be placed on file. "
The applications of Floyd Schriever and Erwin E. Greenwaldt for license
to sell cigarettes were each read and upon_ motion by Kjerner, second by McQuillan,
the licenses were granted.
The application of Foster Electric Company for Electrical Contractors
License was read and upon motion by Narveson, second by Yaeger, the license was
granted.
The application of Lyle W. Edgerton for a Master Electricians License
was read and upon motion by Yaeger, second.by Narveson, the license was granted.
The application. of John R. Kiefer for Journeyman's Electricians'License
was read and upon motion by McQuillan, second by Kjerner, the license was granted.
The application of Howard McGoon for a taxicab license was read and
upon motion by McQuillan, second by Fryer, the license was granted subject to
change in the ordinance .setting the fees for taxicab licenses other than the

The surety bonds of Lyle W. Edgerton in the amount of $1,000.00 with this
''Fidelity and Casualty Company as surety and Nelson Tire Service in the amount of
$895.00 with the Western Surety Company as surety, were each read and upon motionlj
,:by Fryer, second by Narveson, the bonds were approved, the surety thereon accepted,
,and it was ordered that the same be placed on file.

Alderman Fryer in_trodtuced a resolution appropriating $275.00 from the
Street & Alley Fund. -and ordering payment made to the Rochester State Hospital
,;for 220 yards crushed rock, which was read.
Upon motion by Yaeger, second by Fryer, that the said resolution be
,adopted as read, and all voting in favor thereof, President Lemmon declared the
;'said resolution duly passed and adopted.
Alderman Fryer introduced a resolution appropriating $421.115 from the

General Fund, $141.75 from the Sewer Fund and $960.07 from the Street & Alley
Fund and ordering payment made to the Street & Alley Fund for use of equipment
during November, 1946, which was read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be

-Alderman Fryer introduced a resolution appropriating $303.15 from the

adopted as read, and all voting in favor thereof, President Lemmon declared the

Alderman Fryer introduced a resolution appropriating $5, 185. 38 from the
Street & Alley Fund and ordering payment made to the St. Paul Front End Material
Spreader Company for purchase of one front end material spreader, which was read.
Upon motion by Yaeger, second by Narveson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
'said resolution duly passed and adopted.

Alderman Kennedy introduced a resolution levying assessments for
sidewalks for 1946, which was read.
Upon motion by Kennedy, second by Narveson, that the said resolution be
adopted as read, and all voting in favor thereof,. President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kennedy in a resolution appropriating $259.78'from the
Street & Alley Fund and ordering payment made to The George T. 'Ryan Company for
mower to f i t case tractors, which was read.
Upon motion by Narveson, second by "cQuillan, that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared th!
said resolution duly passed and adopted.
Alderman Kennedy introduced a resolution appropriating $439.97 from the
Lighting Fund and ordering payment made to the City of Rochester, Public
Utilities, which was read.

Alderman Kjerner introduced a resolution appropriating $6,000.00 from
the P. I. R.. Fund and ordering payment made to First National Bank for-matuAty of
P.I.R. Bonds, which was read.
Upon motion by Narveson, second by McQuillan, that the said resolution
be adopted as read, and all voting in favor thereof, President Lemmon declared t

Alderman Kjerner introduced a resolution appropriating $750.00 from
the Interest Fund and ordering payment made to the First National Bank for intere
on Light Bonds, which was read.
Upon motion by Kennedy, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Kjerner introduced a resolution appropriating $237.00 from the
Park Improvement Fund and ordering payment made to Midland Popcorn Company for
popcorn and popping oil, which was read.

Alderman McQuillan introduced a resolution appropriating $5249.95 from

for admission taxes collected at the Mayo Civic :'Auditor ium, which ,was read.

Alderman Yaeger introduced a resolution accepting the bid of -Ellis

The matter of children from the housing project at the fair grounds

,attending schools in the City of Rochester was discussed and upon motion by
I'Kennedy, second by -McQuillan, the same was referred to the School Committee to
:;determine if some arrangement could be. made for them to attend ci-ty schools
l wi thout paying the $54.00 per year tuition.

Alderman Fryer again brought to the attention of the Common Council
the dangerous condition for school children crossing 12th Street Southeast and
!upon motion -by Narveson, second by Fryer, the City Engineer was instructed to
i
'prepare a plan showing proposed safety islands and submit same to the Common
Council, they in turn to make an appointment with the State Commissioner of
Highways to urge- that. some action be taken at once to improve the now dangerous
crossings.
Upon motion by Narveson, second by Kennedy, -and all voting in favor
!thereof, the unapproved part of the contract awarded to L. M. Feller by the Public
;Utility Board for the construction of a sewer line —was —approved.
It was brought to the attention of the Common Council that the
'regulations covering the operation 'of an "on sale" non -intoxicating malt liquor
!license issued to Edward Petty at the Avalon Hotel had not been followed and upon'
;motion by Yaeger, second by Kennedy, the said license was revoked and the City
Clerk was instructed to -notify Edward Petty of the action taken by the Common Council.

The application of William Moriarty for an "OnSale" intoxicating liquor!
'license was read and upon motion by 4arveson, second by McQuillan, and all voting'
An favor thereof, the license was granted.
Upon motion by Fryer, second by Narveson, the meeting was adjourned. •
