Minutes of a regular meeting of the Common Council of the City of

President Lemmon called the meeting to order at 2:00 o'clock P.M., the
following members being present: President Lemmon, Aldermen Fryer, Kennedy,
Kjerner, McQuillan, Narveson, and Yaeger. Absent: None.
Upon motion by Fryer, second by Yaeger, the minutes of the meeting of •
;December 16, 1946 were approved.
President Lemmon stated this as being the time and place set for
receiving and opening bids for the purchase of $75,000.00 City of Rochester,
;Minnesota 11% Permanent Improvement Revolving Fund Bonds. The following bids were
;received and upon motion by Yaeger, second by Kennedy, the same were referred to

'the Finance Committee for tabulation and recommendation:

The First National Bank of Rochester, Minnesota $75,000.00
plus a premium of $1102.50, subject to the approval of their
legal counsel.
George K. Baum & Company, Inc. $75,000.00plus a premium
I; of $797. 25, subject to the opinion of their legal counsel.
The Milwaukee Company, $75,000.00 plus a premium of
$1020.00 subject to the approval of their legal counsel.
Braun, Bosworth & Company, $75,000.00 plus a premium of
$967.00, subject to the approval of their legal counsel.
Juran & Moody., $75,000.00 plus a premium of $310.00,
not subject to the opinion of their legal counsel.
President Lemmon stated this as being the time and place set for a hearing

on the vacation of _a strip of land running easterly and westerly between Lots 4,
�i5,-6 and 7, Block 1, Homestead Addition. There was no one present wishing to be
heard.
A notice from the State of Minnesota, Department of Highways, of the
approval by the Public Roads Administration in Washington of P. W. S., Item 1312,

,was read and the same was ordered placed on file.
A copy of a letter from Toltz, King & Day, Inc. addressed to the State ii
Board of Health, Division of Sanitation, transmitting plans and specifications for
the trunk line sewer from the existing trunk line sewer to the proposed sewage
treatment plant for the approval of the said Board was read and the same was
;ordered placed on file.

A letter from the Department of Public Examiner, transmitting copies off'
reports on the financial affairs of the City of Rochester and the Rochester Fire
'Department Relief Association was read and the reports were ordered placed on file.
A notice by Irving L. Eckholdt, Judge of Municipal Court, of the
appointment of Miss Glennis Keehn to fill the vacancy caused by the resignation
of Mrs. Gladys Mitchell, Deputy Clerk of the Municipal Court, was read and upon

The request of Irving L. Eckholdt, Judge of Municipal Court, for ten
days sick leave was read and upon motion by Yaeger, second by Fryer, the same wash.

The petition of Floyd R. Sibley for a permit to operate a barber shop
at 607 - llth Avenue Southeast was read and upon motion by Kennedy, second by
Kjerner, Mr. Sibley was granted a temporary permit to operate a barber shop in
his residence.
A report by the City Engineer for the calendar years of 1945 and 1946,
being in part as follows, was read and the same was ordered placed on file:

The report of the Building Inspector for the year 1946 showing the
number of permits issued, the estimated cost of construction, and the fees
collected for the various types of construction was read and the same was ordered
placed on file.
The recommendation of the Public Grounds Committee that the City Engine,
be directed to make preliminary surveys and plans and report for a parking lot
to be located between 1st Avenue Southeast and 2nd Avenue Southeast and north of
2nd Street Southeast and also that he investigate and report on the feasibility
of rearranging and enlarging the present parking area around the Mayo Civic
Auditorium, was read and upon motion by Kjerner, second by i°icOuillan, the City
Engineer was instructed to make the said survey and recommendations.
The following resolution adopted by the Public Utility Board was read
nd the same was ordered placed on file;
"Be it and it is hereby resolved by the Public Utility
Board of the City of Rochester, Minnesota that the Mayor and
the Common Council of the said City be and are hereby requested
to purchase from A. C. GOODING, in behalf of the City Water
Department, Lots One and Two in Block Three of Cascade Sub-
division in the City of Rochester, Minnesota, the price of said'
lots to be Eight Hundred Dollars ($800.00) each, and said parcel
of land to be used for a new Well location for the' said City
Water Department. s
The resignation of Claude H. Mcquillan as Alderman of the Third Ward
effective January 6, 1947 was read and upon motion by Yaeger, second by Fryer, Mr.
Mcquillan's resignation was accepted.

A letter from the State of Minnesota, Department of Highways, to the Ij •

;City Engineer transmitting a lay -out or general plan of the safety islands which
'the State proposes be built with the remainder of the proposed improvement of
Twelfth Street Southeast from Third Avenue to Eleventh Avenue, inclusive was read'[
and the same was ordered placed . on file.
A petition for the construction of a curb and gutter on 3rd Street

Southeast from 6th Avenue .to llth Avenue Southeast was read and President Lemmon
referred the same to the Street & Alley Committee and the City Engineer.
A notice of a public hearing before the Railroad & Warehouse Commission,
:to be held in the City Hall in the City of Rochester, on February 4, 1947 in the

(matter of the application of Virginia C. Wilson d/b/a Wilson Trucking Company forll
a certificate of public convenience and necessity as an auto transportation company
,was read and the same was ordered placed on file.
A petition for a change of zoning of all that part of Outlot 14 lying
north of 14th Street Northeast and all of Outlot 21 in Northern Addition to the
;City of Rochester was read and upon motion by Narveson, second by Kennedy, the j
same was referred to the Board of Zoning.
The report of the City Weighmaster for the month of December, 1946
showing 414 loads wieghed and receipts in the amount of $41.40 was read and
President Lemmon referred the same to the Finance Committee.
The reports of the Clerk of Municipal Court for the week ended December

21, 1946 showing total criminal fines and costs collected $466.00, civil fees
received $.35, and conciliation court fees $1.50; for the week ended December 29,
1946 showing total criminal fines and costs collected $422.00, civil fees received'
$1.70 and conciliation court fees $3.50; and for the week ended January 4, 1947
showing total criminal fines and costs collected $194.00 and conciliation court �.

President Lemmon ordered that the same be placed on file.

The reports of the Building Inspector for the month of December, 1946

showing fees received for building permits issued in the amount of $102.00; of the!

Electrical Inspector for the month of December, 1946 showing fees received for
electrical permits issued in the amount of $32.25; of the Plumbing Inspector for
the month of December, 1946 showing fees received for plumbing permits issued in

Lemmon referred the same to the Finance Committee.

The applications of Wm. J. Moriarty, George Webb and William J. Ranfrani
for license to sell cigarettes were each read and upon motion by Kjerner, second
by Narveson; the licenses were granted.
The application of Dale C. Patterson for Journeyman Electricians LicensE
was read and upon motion by Fryer, second by Kennedy, the license was granted.
The applications for permits to place and maintain a sign of Peoples
Cooperative Power Assn., RochesterPoster Advertising Co., C. J. Price and VirginiF
Thiem, were each read and upon motion by Narveson, second by Kjerner, the'termitsi
were granted.
The applications of Wm. J. Moriarty, George Webb and Wm. J. Ranfranz
for license to sell soft drinks were each read and upon motion by Narveson, s'eco
by Kjerner, the licenses were granted.
The surety bonds of Frank Mengedoth and Arthur Mengedoth in the amount
$1, 000.00, J. A. Daly in the amount of $1,'000.00 and L. F. Milostan in the amount
of $1,000.00 each with the National Surety Corporation as surety, Ellis Motor
Company in the amount of $1875.00 with Fireman's Fund Indemnity Company as surety,
and the bond of Donald Kersten for $12.00 covering lost check with Charles K.
Kersten and Chas. W. Tannert as surety, were each read, and upon motion by
Kennedy, second by Fryer, the bonds were approved, the surety thereon accepted and
it was ordered that the same beplaced on file.
Alderman Kennedy introduced a resolution accepting the bid of Juran &
oody for the purchase of $75,000.000ity of Rochester Permanent Improvement
evolving Fund Bonds 1-gl%, which was read.
Upon motion by Kennedy, -second by taeger, that the said resolution be
adopted as read, and all voting in favor thereof, §resident Lemmon declared the
said resolution duly passed and adopted.
Alderman Fryer introduced a resolution approving a resolution adopted
by the Public Utility Board for purchase of Lots 1 and 2, Block 3, Cascade 'Sub -
Division to be used for a new well location, which was read.
Upon motion by Kjerner, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, rresident Lemmon declared the
aid resolution duly passed and adopted.
Alderman Fryer introduced a resolution vacating'a strip of land
pproximately 12 ft. in width running in an easterly and westerly direction betwee
ots 4. 5, 6 and 7, Block 1, Homestead Addition, which was read.
Upon motion by Kennedy, second by Yaeger, that the said resolution be
dopted as read, and all voting in favor thereof,'President Lemmon declared the
aid resolution duly passed and adopted.
Alderman Kennedy introduced a resolution granting four public dance
ermits to Archie W. Dieter, which was read.

Alderman Kennedy introduced a resolution appropriating $65.04 from the
;General Fund, $2.88 from the S & A Fund, $26.17 from the Fire Protection Fund,
and $4,162.20 from the Lighting Fund and ordering payment made to City of Rochester,

Alderman Kjerner introduced a resolution appropriating $270.00 from the
General Fund and ordering payment made to the City of Rochester, Public Utilities,,
for steam heat for the city hall, which was read.

Alderman Kjerner introduced a resolution appropriating $2,826.00 from
the P.I.R. Fund and ordering payment made, to Carlisle G. Fraser for estimate No.
• 2 for construction of a storm sewer in Sth St. S. E. from Bear Creek to lath Ave.
S. E. , which was read.
Upon motion by Fryer, second by i'arveson, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
• Alderman McQuillan introduced a resolution appropriating $1,060.05 from
the Street & Alley Fund and ordering payment made to Carlisle G. Fraser for final
estimate for construction of a watermain in 3rd Ave. S.W. and in 4th Ave. S.W.
from 12th St. to 16th St. S.W. and in service drive along 12th to 16th St°s. S.W.
and from 3rd to 4th Avenue S. W., which was read.
Upon motion by Narveson, second by Yaeger, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman McQuillan introduced a resolution appropriating $477.73 from
the Street & Alley Fund and ordering payment made to Carlisle G. Fraser for final
estimate for construction of a watermain in 3rd Ave. S. E. from 16th St. S. E. to
262 feet North and in 16th Ave. S.E. and S. W. from 3rd Ave. S.-E. to 4th Ave.
S. W. , which was read.
Upon motion by Narveson, second by Kjerner, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
Alderman Requillan introduced a resolution appropriating $1, 734. lS from
the Street & Alley Fund and ordering payment made to Carlisle G. Fraser for
estimate No. 5 for construction of a sanitary -sewer through Soldiers Field, which
was read.
Upon motion by McQuillan, second by Kennedy, that the said resolution be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said resolution duly passed and adopted.
• Alderman Narveson introduced a resolution appropriating $444.02,from
the Firemen's Relief Fund and ordering payment made to the Rochester Firemen's
Relief Association for tax settlement of October 31, 1946, which was read.

An Ordinance annexing to the City of Rochester, Minnesot'a,.a part of
the Northeast Quarter- (NE4) . of Section Thirty -Four. (34), Township One Hundred.
Seven (107) North, Range Fourteen (14) West, in Olmsted County, Minnesota, was
given its first reading.
Upon motion by Fryer, second by Kennedy, and.upon roll call and all
voting in favor thereof,.`the rules were suspended and the ordinance was given its
second -reading..
Upon motion by McQuillan, second.by Kjerner, and upon roll calland all
voting in favor thereof, the rules were suspended and the ordinance was given its
third ,and final reading.
Upon mot`ion.by Fryer,. second by Kennedy, that the said Ordinance be
adopted as read, and all voting in favor thereof, President Lemmon declared the
said Ordinance duly passed and adopted.
An Ordinance authorizing and regulating the issuance of permits,by the
Common Council of the City�of Rochester, Minnesota, for the drilling of wells
within the limits of .the City of Rochester .for the purpose of protecting the
general health and welfare of . the public and for . the protection of the water
supply of the City of Rochester, Minnesota, was given its first reading.
.The following claims were read and upon motion by Yaeger, second by
Fryer, the bills were approved and the Mayor and City Clerk were authorized and

President Lemmon stated that the City and County had been informally

notified of a gift in the amount of $150,000.00 by the Mayo Association for the
!establishment of a health center and upon motion by Fryer, second by Kjerner,
President Lemmon .and Alderman Yaeger were appointed as a committee to .work with
the .committee .from the County and the Public Health and Welf.are Board on the
future plans for health facilities in the City of Rochester.
