HomeMy WebLinkAbout05-19-1947256 May 19. 194 Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on May 19, 1947. • President Lemmon called the meeting to order at 7:30 o'clock P.M., the following members being present: President Lemmon, Aldermen Akenhead, Fox, Fryer, Kennedy, Kjerner,•and Yaeger." Absent: None. i Upon motion by Kjerner, second by Fox, the minutes of the meeting of • May 5,- 1947 were -approved. President Lemmon stated this as being the time and place set f•or receiving and opening bids for the - furnishing of one Bulldozer attachment for front end of Caterpillar- Motor Patrol or Galion Motor Patrol, for use in the Ci-ty Engineer's Department. The bid-s of Geo. T. Ryan Company in the amount of $535.00 and the Wm. H•. Ziegler Company in the amount of $737.36 were each received -and opened. President Lemmon stated this as being the time an-d place set for receiving and openeing bids for Improving -the parking lot east of the alley east of Broadway Street and between Second Street Southeast and Fourth Street Southeast. The bids of Gordon -Winslow Company in the amount of $5050.50 and O'Laughlin & and C. M. Boutelle in the amount of $5,740.30 Hansen in the amount of $5,460.60% were each received and opened. President Lemmon stated this -as being the time and place set for receiving and opening bid-s for salvaging any and all materials deposited at the City Dump on Nor-th Broadway Street. The bid" of Bemel Bros. in the sum of $300.00 per month was received and opened. President Lemmon stated this as being the time and place set for the second hearing on the •con-struc tion of a sanitary sewer and watermain in loth Avenue Northeast from Fifth Street Northeast to 183 feet South. There was no one present wishing to be FBard. President Lemmon stated this as being the time and place set for the first hearing on the construction of a sanitary sewer, watermain and the grading on Fourth Street Northeast to service Lots 5, 6, 7 and 8, Block 2, Boutelle's Addition. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the • first hearing on the grading and graveling of 6th Avenue Northwest from loth to 14th Street Northwest; 7th Avenue Northwest from loth to 14th Street Northwest; Sth Avenue Northwest from llth to 14th Street Northwest; 9th Avenue Northwest from loth to 14th Street Northwest; llth Street Northwest from 5th to 9th Avenue • Northwest; and 12th Street Northwest from 5th to 9th Avenue Northwest. Air. Norman Hoover appeared at the meeting and opposed the improvement. President Lemmon stated this as being the time and place set for the second hearing on the construction of a curb and gutter in 2nd Street Northeast from llth to 13th Avenue Northeast. There was no one present wishing to be heard.) 257 • • 1 1 • May 19 1947 President Lemmon stated this as being the time and place set for the second hearing on the construction of a curb and gutter on the east side of 5th Lvenue Northwest from Center Street to First Street Northwest. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the second hearing on the construction of a curb and gutter in 5th Avenue Southeast 'rom loth to llth Street Southeast. There was no one present wishing to be heard. President Lemmon stated this as being the time and place set for the first hearing on the construction of a curb and gutter on 7th Avenue Southeast petween 9th and loth Street Southeast. There was no one present wishing to be Leard. The members of the Park Board, with the exception of Mr. Nachreiner, President of the Board, were present at.the meeting. Mr. Koehnen stated that their Board had not met on the matter of the Mayo Memorial to be constructed in Mayo Memorial Park. Action on the matter was deferred until the meeting of June it 1947, and upon motion by Fryer, second by Akenhead, the City Clerk was .instructed II to notify the Public Utility Department, the Park Department, and the Mayo Memorial Committee that there would be an informal meeting held at 7:30 o'clock P. M. on May 26, 1947 in the Council Chambers to study the matter before action is taken by the Council or Boards. Donald and Harold Witzke.presented plans of the proposed "On Sale" intoxicating liquor store to be located at 17 Second Street Southeast. Mr. Wm. Murphy was also present at the meeting and requested that action on the issuance of an "On Sale" intoxicating. liquor license be deferred until he could also present preliminary plans. A motion was made by Yaeger, second by Kennedy, that the plans as presented by Messrs. Witzke be accepted and that an "On Sale"" intoxicating liquor license be granted to them subject to the Attorney's opinion as to whether or not their plans would meet all legal requirements for an "On Se.1e1" liquor establishment. All voted in favor thereof except Alderman Fox whop voted "no ". Air. Bernie Lusk, Commander of the Queen City Post of the American Legion asked permission for their post to use two rooms in the basement of the old Libra building as club rooms. Upon motion by Yaeger, second by Fryer, the Queen City Post was given permission to use the basement of the old library building as club ooms. The recommendation of the City Engineer that bids be called for on June 2, 1947, for the furnishing to the City of Rochester, 100 Catch Basin Inlets for replacements and for new installations on curb and gutter jobs was read and upon motion by Fryer, second by Kennedy, the same was accepted and ordered placed on file. 258 4 The recommendation of the Street and Alley Committee that the contract for the purchase of -a Bulldozer Attachment for Motor Patrol be awarded to the Geo. T. Ryan Company for the sum of $535.00 was. read and upon motion by Yaeger, • second by Kjerner, the same was accepted and ordered placed on file. The recommendation of the Public Grounds Committee that the contract for the improvement of the proposed parking lost East of the Alley ;ast of Broadway Street and between 2nd Street Southeast and 4th Street Southeast be • awarded to Gordon Winslow Company for the sum of $5050.50 was read and upon motion by Kjerner, second by Akemhead, the same was accepted and ordered placed on file. The recommendation of the Public Grounds Committee that the contract for, salvage privileges at the City Dump Grounds be awarded to Bemel Bros. for the, sum of $300.00 per month was read and upon motion by Yaeger, second by Akenhead, the same was accepted and ordered.placed on file. The recommendation of the Street & Alley Committee that the alley west of Broadway between lath and 132 Street Northwest and that 132 Street Northwest from North Broadway to 2nd Avenue Northwest be graded and graveled was read and upon motion by Akenhead, second by Kennedy, the same was approved and ordered 'placed on file. The recommendation of the Street & Alley Committee for the installation of a curb and gutter in 7th Avenue Southeast from 9th to loth Street Southeast was read and the same was ordered placed on file. The recommendation of the Sewer Committee for the installation of a sanitary sewer in 4th Street Northeast from 16th Avenue Northeast to 194 feet West was read and the same was ordered placed on file. The recommendation of the Water Committee for the installation of a watermain in 4th Street Northeast from 16th Avenue Northeast to 194 feet West was read and upon motion by Fryer, second by Kennedy, the same was accepted and ordered placed on file. The recommendation of the Street & Alley Committee that 4th Street Northeast from 16th Avenue Northeast to 194 feet West be graded and graveled and the same be assessed against the benifited property owners was read and upon motion • by Yaeger, second by Kjerner, the same was accepted and ordered placed on file. The recommendation of the Sewer and Water Committees that the City Engineer be directed and authorized to omit the northerly 132 feet of water and sanitary sewer installation in 14th Avenue Northeast between 9th and loth • Street Northeast was read and upon motion by Kjerner, second by Akenhead, the same was accepted and ordered placed on file. The following copy of a resolution adopted by the Public Utility Board was read and President Lemmon ordered that the same be placed on file: z 5 9 • • 1 • • 1 May 19 1947 "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Common Council of the said City of Rochester be and is hereby requested to authorize the said Board to enter into a contract with the General Electric Supply Corporation for the furnishing of 60 Class 5, 35' Western Red Cedar Poles and 60 Class 3, 351 Western Red Cedar Poles at prices of $21.56 and $24.66, each respectively, the total amount of the said contract to be Two Thousand Seven Hundred Seventy -Three Dollars and Twenty Cents ( $2, 773. 20). If The following resolution adopted by the Sinking Fund Commission was read and upon motion by Fryer, second by Kennedy, the same was approved and order placed on file:' "Be it resolved by the Commissioners of the Sinking Fund of the City of Rochester, Minnesota: That the sum of $100,000.00 be and the said sum is hereby appropriated from the Sinking Fund and ordered. paid to the First National Bank of Rochester, Minnesota, for the purchase of $100,000.00 United States Treasury Notes, Series C, dated May 1, 1947 and maturing May 1, 1950, the same being purchased for the reserve for building and repairing bridges.0 A communication from the State of Minnesota, Division of Public Institutions, stating that the Legislature at its 1947 session had appropriated $731,000.00 t-o be used in providing adequate and approved sewage disposal facilities at �sttate. institutions was read and the same -was referred to the City Engineer to take the matter up with Toltz, King & Day, in regard to treatment of sewage from the Rochester State Hospital.. An invitiation from W. H. Ziegler Co., Inc. to inspect the new Ziegler Company plant at 2929 University Ave. S. E., Minneapolis, was read and the same was ordered placed on file. Rulings from the Attorney General as to whether or not a mechanical device which is similar in appearance to an upright slot machine except that instead of bells, fruit and so on, on the wheels, there are numbers an,d'a, bingo bo: with slots covers, is legal, and as' to whether or not an ordinance or franchise can be introduced for its first reading or all three readings at a special meeting of the Common Council of the City of Rochester, and as to whether or not income from the Williams Estate can be used to purchase playgrounds outside of the -City limits for use of children under the age of 15 years, were each read and President emmon ordered that the same be placed on file. A .letter from the Minnesota Department of Health transmitting a copy of letter to architects and engineers relating to Regulation 277, and also a copy the Minnesota Plumbing Code as amended on January 14, 1947 was read and the same as ordered placed on file. A notice from Richard A. Golling, State Public Examiner, that the new er diem rates will range from $12.00 to $16.00 per day instead of $10.00 a day s had been previously charged was read and the same was ordered placed on file. A communication from Knu.te Olson, Assessor and a' letter from James T. Ld ird 260 Spillane, Attorney for Mayo Priebe, stating that he had moved his place of business known as Mayo L. Priebe or National Scale Company outside of the City limits which would make a difference in the assessment of personal property • belonging to Mr. Priebe or the National Scale Company, was read and the same was ,ordered placed on file. ; A copy of a notice to Vets Cabs &/or Individual Operators at 328 First Avenue Southwest cancelling policy No. DH-8683 covering bodily injury and property • damage effective May 24, 1947 by the Casualty Reciprocal Exchange was read and the .same was ordered placed on file. r An invitation to the Mayor, the members of the Common Council and the members of the County Board to be guests at the regular monthly meeting of the Safety Council on Wednesday noon, May 21, 1947, was read and the same was ordered, placed on file. A copy of a communication from Mrs. Desmond J. Tulare addressed to Mayor,' Claude H. McQuillanasking that the government of the City of Rochester give consideration to the problem of the supervision of children of working mothers, was read and the same was referred to the Recreation Committee. The'City Engineer's trial balance for the month of April, 1947 was read and the same was ordered placed on file. . The City Treasurer's report for the month of April, 1947 was read and the, same was ordered placed on file. The reports of the Clerk of the Municipal Court for the week ended May 10, 1947 showing total criminal fines and costs collected $601.00, civil fees received $7.40 and conciliation court fees $4.00 and for the week ended May 17, 1947 showing total criminal fines and costs collected $518.50 and conciliation court fees $3.50, , were each read and having been previously approved by -the City Attorney, President Lemmon ordered that the same be placed onfile. The surety bonds of Hankee Heating Company in the amount of $1,000.00 with the St. Paul Indemnity Company as surety; Clifford Aarness and Ralph Fischer in the amount of $1,000.00 with the Western Surety Company as surety; Vincent Huyber!. and J. P. Huyber each in the amoun t. of $1,000.00 with the Aetna Casualty and Surety • Company as surety; and Francis Christopherson in the amount of $1,000.00 with then Fidelity and Casualty Company as surety, were each read, and upon motion by Yaeger', second by Kennedy, the bonds were approved, the surety thereon accepted and it was ordered that the same be placed on file. i I The applications of George B. Tauer and•Henry Chapiewski and Lloyd Williamson for 'off Sale" non -intoxicating malt liquor license were each read and j I; upon motion by Fryer, second by Kennedy, the licenses were granted. The applications of George B. Tauer, J. C. Eppard, Park Board (2), Albert R. Hafner and James Miller for license to sell cigarettes were each read and upon May 19, 1941 motion by Kjerner, second by Akenhead, the licenses were granted. The applications of Vernon G. King, Dale C. Patterson and Alden • Fuerstneau for Journeyman Electricians license were each read and upon motion by Fryer, second by Kennedy, the licenses were granted. The application of Emil J. Nietz for a Master Electricians license was read and upon motion by Yaeger, second by Kjerner, the license was granted. • The application of Emil J. Nie tz for Electrical Contractor's license was read and upon motion by Kennedy, second by Akenhead, 'the license was granted. The applications of Clifford A. Aaby and Henry T. Maass for Journeymai Heating Worker's and Steam Fitter's license were each read and upon motion by Kjerner, second by Yaeger, the licenses were granted. The application of Henry T. Maass for Journeyman Plumber's license was read and upon motion by Kennedy, second by Akenhead, the license was granted. •The application of Francis Christopherson for license to connect with sewer and -drains was read and upon motion by Kennedy, second by Kjerner, the license was granted. The applications of Claire Rooney, J. C. Eppard, Williams &McNiff, George Tauer, Orville -Rowland, Albert R. Hafner and James Miller for license to sell soft drinks were each read and upon motion by Fryer, second by Kennedy, the licenses were granted. -The application of the Rochester Yellow Cab Company for a license to operate one sight seeing bus was read and upon motion by Kjerner, second by Kennedy, the- license was granted. Alderman Fryer introduced a resolution appropriating $433,05 from the General Fund and ordering payment made to Rochester Post:: Bulletin, which was read. Upon motion by Kennedy, second by Kjerner-, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $623.35 from the General Fund and ordering payment made to Schmidt Printing Co., which was: • Upon motion by Yaeger, second by Akenhead, that the said resolution bf adopted as read, andall voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. . Alderman Fryer introduced a resolution appropriating $970.00, from the • General Fund, $49.50 from the Sewer Fund and $994.26 from the Street & Alley Fund and ordering payment made to the Street & Alley Fund for use of equipment, which was read. Upon motion by Fryer,- second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President 'Lemmon declared the said resolution duly passed and adopted. 262 May 19, 194 Alderman Fryer introduced a resolution appropriating $360.93 from the General Fund, $617- 95 from the Street & Alley Fund, and $1. 49 from the Sewer Fund and ordering payment made to the City of Rochester, Minnesota, for gasoline, which was read. Upon motion by Kjerner, second by Akenhead, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $491.75 from the Street & Alley Fund and ordering payment made to Quarve & Anderson for 281 cu. yds. Crushed Rock, which was read. Upon motion by Kennedy, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $1,834.98 from the P.I.R. Fund and ordering payment made to Gordon Winslow for estimate No. 1 for installation of curb and gutter in 6th Avenue Southwest from 7th to 9th Street • 1 Southwest, which was read. Upon motion by Yaeger, second by Akenhead, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Fryer introduced a resolution appropriating $3,208.77 from the P.I.R. Fund and ordering payment made to Carlisle G. Fraser for estimate No. 1 for construction of a sanitary sewer and watermain in 14th Avenue N.E. from 9th to' loth St. N. E. , which was read. Upon motion by Akenhead, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. i Alderman Kennedy introduced a resolution appropriating $561.38 from the Park Improvement Fund and ordering payment made to Reynolds Wholesale, which was read. Alderman Kennedy introduced a resolution appropriating $6,028.22 from the Park Improvement Fund and ordering payment made to Mayo Civic Auditorium Revolving,, • Fund, which was read. Alderman Akenhead introduced a resolution appropriating $10,695.99 from v Sewage Disposal Plant Fund and ordering -payment made to Toltz, King and Day, nc. for partial payment on plans and specifications for Sewage Treatment Plant, ,hi ch was read. Upon motion. by Akenhead, second by Fryer, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. • Alderman Akenhead introduced a resolution ordering the first hearing on grading and graveling of 132 Street Northwest from North Broadway to 2nd Avenue Northwest and the alley west of Broadway between 13 and 131 Street Northwest, which was read. Upon motion by Kennedy, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Akenhead introduced a resolution ordering plans, specifications, profile and estimate of cost and 2nd hearing on construction of a curb and gutter on 7th Avenue Southeast between 9th and loth Street Southeast, which was read. Upon motion by Akenhead, second by Kjerner, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the ,said resolution duly passed and adopted. Alderman Akenhead introduced a resolution ordering plans, specifications, profile and estimate of cost and 2nd hearing on. grading and graveling of 6th Avenue N. W. from loth to 14th St. N. Alderman Akenhead introduced a resolution ordering plans, specifications, profile and estimate of cost and 2nd hearing on construction of a sanitary sewer • and watermain and the grading on 4th Street Northeast to service Lots 5, 6, 7, and 8, Block 2, Boutelle's Addition, which was read. Upon motion by Fryer, second by Yaeger, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the • said resolution duly passed and adopted. Alderman Kjerner introduced a resolution accepting the bid of Gordon Winslow' Company for improvement of proposed parking -lot East of the Alley East of Broadway' Street and between 2nd and 4th Street Southeast, which was read. Alderman Kjerner introduced a resolution accepting the bid of Be'mel 0 • (I Bros. for salvaging privileges at the City Dump Grounds, which was read. Upon motion by Fryer, second by Kennedy, that the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. • Alderman Kjerner introduced a resolution accepting the bid of The George T. Ryan Company for furnishing one Bulldozer Attachment for Motor 'Patrol; which was read. Upon motion by Yaeger, second by Akenhead; that the said resolution'be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted. Alderman Kjerner introduced a resolution authorizing the Public Utility Board to enter into contract with the. General Electric Supply Corporation, which was• read. Upon motion by Kennedy, second by Akenhead, that the said resolution be adopted as read, and all voting in favor thereof, President Lenimon declared the said resolution duly passed•and adopted. Alderman Kjerner introduced a resolution ordering bids for the purchase of 100 Catch Basin Inlets, which was read. Upon motion by Yaeger, second by Fryer, that 'the said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said res•olu•tion duly passed and adopted. Alderman Yaeger introduced a resolution appropriating $24.00 from the Street- & Alley Fund and $282. 70 from the Fire Protection Fund and ordering paymen made to Hayes Lucas Lumber Company, which was read. Upon motion by Kennedy, second by Kjerner, that the'said resolution be adopted as read, and all voting in favor thereof, President Lemmon declared the said resolution duly passed and adopted*. Alderman Yaeger introduced a resolution granting a public dance permit t • Civil Air Patrol, which was read.
