M., the following members being present: President Bach, Aldermen Brumm, Davis, Morris, Schroeder, Thiem and Whiting. Absent: None. i; Upon motion by Davis, second by Morris, the minutes of the meeting of February 2, 1953 were approved. I Mr. Leonard Ekstrand, Chairman of the Parking Commission, was present and asked permission of the Council for the Parking Commission to go ahead and try, to obtain enabling legislation to include .the following; suggestions: 1. Clarification of the City's power to provide funds for the acquisition of off-street parking facilities by ta.x levies, special assessments, -cr -,pledge of revenues, or an"y combin- ation thereof so that the costs may be equitably 'apportioned, and to borrow money repayable from any of these sources.' 2. The granting of express power to the City to use marking meter revenues in the acquisition and development of off- !! street facilities. 3. Th-e granting of express authority to the City to development-,of 'to private interests for management and operation any off-street facilities that may be acquired and developed by the City, and, in particular,, to enter long term leases of unimproved lands owned b the City to y private interests to improve and operate � as off-street parking facilities. 4. An express grant of power to the City to devote lands now held i i; for park purposes (except where under a grant conditioned upon their being perpetually used for park purposes) to the II provision of off-street parking facilities. 5. An express grant of authority," in levying special assessments against benefited land for the cost of acquiring and improving a narking facility, to give consideration to the present use of the benefited land in determining the extent to which it is ; benefited and should. be assessed. Air. Ekstrand also 'resented the folloeing recommendations on matters previously ij referred to the 1?ArkiAg_;Commission: 1. The matter of prohibiting the parking of cars in the South side of lst St. S. W. between 7th and llth Avenues has been referred to our Commission for consideration. It is the opinion of the Commission that this be tabled for the present time', and considered at a later date in connection with other streets where a similar �. problem exists. 2. The matter of stop signs at the intersection of Center Street and 7th Avenue East for the control of East and West traffic was referred to our commission for study. It is the opinion of the commission that a real problem exists in this location, However, it is the opinion of the commission that we ,arb not--qua:lif.ied„ to.Ire'command. U- ic,_ . what type of traffic control should be placed -at this corner, but that the police department should perhaps experiment with various controls to find a solution. 3. The commission would also like to suggest that another entrance i. be provided on 2nd Street to the city parking lot known as the old "Mill Property". We feel that this would cause.this'lot to be used to greater advantage. 4. The commission would also like to suggest that meters be put in use on 1st Avenue S. E. between 2nd Street and Cater St. Most of this space is now being used by "All Day Parkers". After hearing the recommendations a motion was made by Davis, second by Thiem, that the CityCouncil g Parking y go on record as authorizing theCommission to sake l i; whatever steps are necessary to try to get the enabling legislation as recommended., :fir. Don Swenson, Manager of the Rochester Airport, was before the Councif r and invited the members of the Council to be at the Rochester Airport at 10:30 jl A. M. on February 17, 1953, at which time representatives from the Civil Aeronautics 308 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., February 16, 19 5 3 Administration and Minnesota Department of Aeronautics would be present and make the final inspection to the Lighting Extension Project. Air. Claude H. McQuillan was present at the Council meeting and stated that he*had been requested by owners of property in the area 'Test of town which is` now under consideration for annexation, to represent them at this meeting. He stated that a great number of people living in West Zumbro Addition, Terryville Addition and Highland'Addition had not had not had an opportunity to state their -views. He further requested that the Council withhold action on holding an election until a later date when those interested had studied the matter further. He also cited figures on the cost of watermain• a.nd sewer which had been estimated and suggested that the Council study the cost of improvements. in this area before taking action to annex same. Mr. George Pougi&les, Attorney and Mr. M. L. Blee were also present. After hearing those present a motion was made by Thiem, second by Morris, that th-e matter be tabled temporarily. All voted in favor of the motion except Alderman Daitis,' i.rho voted "no". The following recommendation of the Survey Committee was read: "The matter of the area 'Test of the city limits has been referred to the Survey Committee and we of the Survey Committee 'recommend that the election be held as soon as possible. This refers to the entire area as indicated in the petition now on file. (A. G. WHITING, Chairman SURVEY 001IMITTEE (WAYNE DAVIS, Member (GEORGE BRUT-I11, Member" A motion was made by Whiting, second by Davis, that the recommendation of the Survey Committee be adopted as read. Upon roll call, Aldermen Brumm and Davis voted "yes" and Aldermen. Morris, Schroeder, Thiem and Whiting voted "no". President Bach stated this as being the time and place set for the following hearings: First hearing on the construction of a sanitary sewer in 2nd Avenue Southwest from let Street to Center Street and in West Center Street from 2nd Avenue to Broadway. There was no one present wishing to be heard. Second hearing on the construction of a curb and gutter on both sides of 9th Avenue Southeast from 4t•h to 5th Street Southeast. There was no one 'present wishing to be heard. Second hearing on the construction of a curb and gutter on Sth Avenue Southeast between 9th-and loth Streets Southeast. There was no one present wishing to be heard. Second hearing on the construction of a curb and gutter on 14th Avenue Northeast from 9th to loth Street Northeast. Hearing on the proposed changes in zoning of certain real estate in r Gooding's Addition described as follows: ."Lot 3 in Block 3 and Lot 2 in Block 5, Gooding's Addition from residential to multiple'dwelling zone. Lots 4 and 5, Block 3 and Lots 3 and 4, Block 5, p,nd Lot 11 in Block 9, in Gooding"s Addition, now paatially commercial and partially residential to multiple dwelling zone. Lots 9 and 19 in Block 4 and Lots 1 and 2 in Block 10, Gooding's Addition from commercial 'to indilstrial zone." There was no one present wishing to be heard. The following resolutions adopted by the Public,Utility Board were each read and President Bach ordered that the same be placed on file: "Be it and it is hereby resolved by tae Public Utility Board of the City of Rochester, Minnesota, that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the Anaconda Wire and Cable Company for the furnishing in accordance with specifications, of 7,500 feet 400 MOM, 310 and 1,000feet #2/0 cable and 15 splicing kits, the total amount of the said contract to be TWENTY FIVE THOUSAND SEVEN THIRTY SEVEN DOLLARS AND NINETY TWO CENTS($259737•92§ and -the said Anaconda Wire and Cable Company being the lowest responsible bidder.", "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester,.Minnesota that the Common 'Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the WOODRUFF COMPANY of this City for the furnishing, in accordance with specifications, of 12,000 feet of 3/411 and 1,000 feet' of 1" Type 'KI Copper Tubing, the .total amount of the said contract to be FORTY FIVE HUNDRED TEN DOLLARS (.$4,510.00)and the said Woodruff Company being the lowest bidder basing his proposal on specifications." "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota, that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the SOUTHERN MINNESOTA SUPPLY COMPANY for the furnishing, in accordance with specifications, of 30,000 pounds -r2/0 Weatherproof Wire, the total amount of the said contract to be TEN THOUSAND NINE HUNDRED FIFTY DOLLARS ($10,950.00) and the said Southern Minnesota Supply Company being the lowest responsible bidder." "Be it and it is hereby resolved by the Public.Utility Board Of the City of Rochester, Minnesota, that the Common Council of the said City be and is hereby requested to authorize the said. Board to enter into a contract with the GENERAL ELECTRIC SUPPLY CORPORATION for the furnishing, in accordance with specifications, of 4 - 167 RVA Distribution Transformers - 100 KVA - 372 EVA 10 - 25 KVA 50 KVA I+ 10 KVA " it the total amount of the said contract to be SIXTEEN THOUSAND TWENTY DOLLARS AND SIX CENTS ($16,020.06).11 The Mayor's appointment of Mr. Cedric Grossbach to serve as special policeman at the Rochester Armory for the ensuing fiscal year was read and upon motion by Davis', second by Morris, the Mayor's appointment was approved. Notice of hearing before the Railroad and Warehouse Commission in the •matter of the Jefferson Transportation Company for authority to increase Interstate passenger fares in the State of Minnesota, was read and President Bach ordered the same placed on file. A notice from the League of MinnesotaMunicipalities of -municipal short .courses to be held at the center for various municipal officers and employees in March was read and President Bach ordered same placed on file. A,letter from the Public Examiner transmitting a. copy of report on examination of the financial affairs of the City of Rochester, covering the year ,ended March 31, 195?, was read and the report was filed in the office of the City i Clerk. The request of Lincoln, School P. T. A. for berm.ssion to conduct a bingo game at their Indoor Carnival to be held March 13, 1953 was read and the same was ordered placed on file. The petition of Louis Golod to have the following described property changed from a residential zone to a commercial zone was read and upon motion by Brumm, second by Davis, the same was referred to the Board of Zoning; "Commencing at the Northeast corner of Lot 33, Auditor's Plat "A", thence South 200 feet, thence Southwesterly 723.9 feet, thence Northerly 410 feet to the north line of said Lot 33, thence East 94o.3 feet to beginning, and also Lot 3, Bilmar Addition, Rochester, Mimnesota." A communication'from John J. Kerr submitting a sketch of a roposed ,plat of property abutting the city limits at the corner of llth Avenue and 14th Street N. The recommendation of the Street & Alley Committee that a curb and gutter be constructed on 13th Avenue Southeast from East Center to 2nd Street r Southeast was read and upon motion by Morris, second by Brumm, the recommendation!, was approved. The recommendation of the Street & Alley Committee that a curb and gutter be constructed on 4th Avenue Southwest from 3rd to 4th Street Southwest jf was read and upon motion by Davis, second by Brumm, the recommendation was approves, The recommendation of the Street & Alley Committee that a curb and gutter be constructed on 2nd Avenue Northwest from 5th to 6th. The City Engineer's preliminary estimate of cost for construction of the following curb and gutter jobs, were each read and ordered pladed on file: Curb and gutter on loth Street S.E. from 4th to 5th Avenue Southeast - Contract Items, $1,930.50; Non -Contract Items, $1.768.00; and estimated cost of typical 45 ft. lotwith 9 ft. driveway, $159.90. Curb and gutter on Sth Avenue S.E. from 9th to loth Street Southeast - Contract Itesm, $3,475.90; Non-Contract°Items, $3,063.00; and estimated cost of typical 45 ft. lot with 9 ft. driveway, $136.75. Curb and gutter on 9th Avenue Southeast from 4th to 5th Street Southeast - Contract Items, $2, 339.10; Non -Contract Items, $949.25; and estimated cost of 49.97 lot with 9 ft. driveway, $157: 77• Curb and gutter on 1041 Street S. Haglin & Sons Company for a thirty day extension to the permit issued Jan. 20, 1953 granting the use of the alley from 2nd Street S. W. and South Broadway and 1st Avenue Southwest from a point of the North edge of Lyman's Store window to a. point. 10 ft. south of the north' edge of I,ymants store was read and upon motion by Davis, second by Brumm, the same was referred to the Street & Alley Committee. The application of Roy E. Wallenberg for license to sell cigarettes was read and upon motion by Morris, second by Davis, the license was granted. The application of Norman J. Kuyath for a Real Estate Brokers license was read and upon motion by Morris, second by Thiem, the license was granted. The application of Joe Daly, Sr. and Joseph R. Daly for transfer of their "Off Sale" Intoxicating liquor license from 116 South Broadway to 24 - 17th Avenue.Northwest for the period from March 1, 1953 to April 1, 1953 was read -and upon motion by Thiern, second by Morris, the transfer was granted. The surety bonds of Pennsylvania Salt Manufacturing Company in the amount of $1,522.00 with the Indemnity Insurance Company of North America as surety and Norman J. Kuyath in the amount of $2,500.00 with the General Casualty Company of America as surety, were each read and upon motion by Thiem, second by Brumm,-the bonds were approved, the surety thereon accepted and the same were ordered placed on f ile. The report of the Clerk of Municipal Court -for the week ending February 7, 1953 showing total criminal fines and costs collected $1,361.00 and civil fees received $.95 and for the week ending February 14, 1953 showing total criminal fines 'and costs collected $991.00 and civil fees received $10.37, were each read and having been approved by the City --Attorney, President -Bach ordered that the same be placed on file. The reports for the month of January, 1953 of the Building Inspector showing fees collected for building permits -issued $1,480.00; of the Electrical ';Inspector showing fees collected for electrical permits issued $223.25; of the :Plumbing Inspector showing fees collected for plumbing permits issued $100.50; ,of the Heating Inspector showing fees collected•for heating permits issued $455.25; and fees collected for sign -permits in the amount of $20.94, were each read and President Bach referred the same to the Finance Committee: The report. of the City Engineer for the month of January, 1953 was ,presented and President Bach ordered that the same be placed on'file. No recommendation has been filed in the off.ice.of the City Clerk and upon inquiry it was learned that the Secretary of the Planning do Zoning Commission had written no- letter to the Council as of this date.. A motion was made by Thiem, second by Whiting, instructing the City Attorney to draw an agreement between the State of Minnesota and the City of Rochester for the treatment of seiiage from the Rochester State Hospital, 'he fee for same to be $750.00 per month instead of $1,000.00 as previously agreed on and subject to adjustment after a meter has been installed to measure the flow of secaabe treated at the new Sewage Disposal Plant.
