M. , the i following members being present: President Bach, Aldermen Ackerman, Anderson, Morris, Schroeder, Thiem and Whiting. Absent: None. �i Upon motion by Schroeder, second by Ackerman, the minutes of the meeting; I of July 6, 1953 were.approved. • I; President Bach stated this as being the time and place set.for a hearing i on the petiti-on for the vacation of that portion of 4th Street Southwest, west of 15th Avenue Southwest. There was no one present wishing to be heard. President' Bach stated this as being the time and place set for the second hearing on the construction of a sanitary sewer and watermain in Hillside I' Addition. Fraser in the amount of- $3,901.20 was received and opened and upon motion by Thiem, second by I. Bids for Sealed Bituminous Surface Apron at - the Rochester Airport. Upon motion by Schroeder, second by Whiting, the City Clerk was instructed to open the bids received. The bids of Komatz Construction Company in the amount of $46,925.05 and Hector Construction Co.,•Inc. in the amount of $59,729.40 were each received and opened and upon motion by Ackerman, second -by Schroeder, the same were referred to the Airport Commission for tabulation and report. Mr. A. Ray Kubly was present at the meeting and inquired as to when the area in Highland Addition under consideration for annexation might be taken into the City. After hearing Mr. Kubly and discussion on the matter the following report by the City Engineer on the proposed annexation of lands adjoining the west boundary of the City of Rochester was read and upon motion by Schroeder, second by Thiem, the report was ordered placed on file: City Engineer's Report on Petition for Annexation of East a of Block 6, Block 7 and Block S, Highland Addition Scope of Report: This report covers the items of Sanitary Sewer, Storm Sewer, Street Grading, Street Surfacing, and Water Main in the above area if annexed to the City of Rochester. General: The area is platted into lots and blocks in an acceptable pattern of streets and lots. The lot•sizes are satisfactory, except that corner lots are 61 less than required now on new plats. It is adjacent t,o the present City limits along its entire east boundary. The principal problem from the street construction standpoint is that only one- half of the width of the streets on its north, south and west boundaries would be in the City. Such marginal streets as these present problems both in the design and costs of street and sewer construction. Street Grading and Surfacing: The present roadways are graded to a country road section with side ditches carrying the surface water. Houses and driveways have been built at varying elevations without established street grades. Some of these differ as much as three feet although adjacent to, or directly, across from each other. When these streets are regraded to a City section which provides for sidewalk, and eliminates the side ditch, many of the existing buildings will be either above or below the sidewalk grade. It is impossible to plan an acceptable '.street grade that will meet the elevation of front yards and driveways which vary as much as these do. Street grading will also require the construction of a cut or a fill slope beyond the right-of-way of the street in many cases. The City should acquire easements for this purpose, prior, to annexation, or as a condition of annexation to obviate the necessity of purchasing easements later or paying damages when the work is done. I recommend that the street -grades be established at once after annexation and the street grading be done as soon as storm sewer construction permits. The purpos4 of establishing streets grades is to control future building and lot improvement elevations. The estimated cost of street grading and road -mix bituminous surfacing with a 61, crushed rock base is $3.00 per front foot, if assessed against both sides of the street© On marginal streets which are half -in and half -out of the City, the costs of the' ent'ire width must hither be assessed to the side within the City, or borne by City funds for which no provision is made at present. Sanitary Sewers: The area can be served by reasonable extension of the sanitary sewer system. The costs assessable to the.property abutting sewer mains, if both sides of the street were assessed, is estimated at $5.00 to $6.00 per 1•inear foot frontage. This unit cost includes a proportionate share ($0.65 per foot) of the highway crossing built in 1952. On marginal streets, the same problem of assessing construction costs is present as in grading. Water Mains: Water Mains can be extended to serve the area, although an addition well will soon be needed in this area. Further consideration of this utility must • 1 0 455` Record of Official. The estimated cost of water main construction if $4.0011 to $5.00 per front foot, if assessed to both sides of the street. House Connections: Zhe costs stated above -for sewer and water construction `refer only to the mains in the sheets, and do not include the cost of service connections from the mains -to the building. This work is. usually contracted for privately by the property owner. The estimated cost of sewer and water service connection is $4.00 per foot for the distance from the center of the street to the building �{ served. i Storm Sewers: Surface water which is handled inexpensively by side ditches in rural areas demands storm sewer construction -when areas are built =up and streets are graded to a city section. It is certain that when streets are graded in this area that it.will be necessary to construct a storm sewer system of undergr..ound mains and i catch -basin inlets. The problem is complicated in this case because a consider- able area above the land in question drains thru it and in turn, discharges at its lower side on to land that will not be in the City. The costs of storm sewer construction have not been assessed to abutting property in the past but have been paid out of the Sewer Funds from the General II Tax Levy. The tax -levy has not been sufficient to provide adequate storm sewer construction within the City for many yegrsl past. Within the present city limits, there is a backlog of several hund-red thousand dollars of badly needed storm �! sewer construction. In annexing this, or any other area to the City,- provision must be made for financing the necessary storm sewer construction. I' The -cost of storm sewers in the subject area cannot be properly estimated without surveys and plans. The extent ofthe project, however,, is indicated by the fact that to serve the area properly, it would be necessary to construct an I' Outf all Duct from 3 Street Southwest, north, more than a mile to Cascade Creek thru property which is not in the City and some of which is not platted into roadways or streets. The Storm Sewer within the area would also amount tD approximately a mile of piping. Storm Sewer demands of this area and the recently annexed Replat of Thurberst Third Addition are in the neighborhood of $100,000. �r Summary: Annexation to the City would make sanitary sewer serviceavailable to the area. Street Grading is necessary in.order to -control 1oty4improvements, building i elevations and to conform to sanitary sewer structures, but graded streets could not be drained without storm sewer construction. Street grades should be established at once, and slope easements acquired where indicated. I Estimated assessed costs to property are: grading $3..00" per front foot, sanitary sewer $5.00 to $6.00 per front foot, water main $4.00 to $5.00 per front:' foot. House service connections: $4.00 per foot of distance from house to center of street. Storm sewer construction is necessary for satisfactory street.drainage, and provision for financing it should be made immediately upon annexation. This construction has not been assessed to the property in the past as have other ' improvements, nor have sufficient amounts been levied for it in the tax levy. Yours respectfully, C. A. The recommendation of the Finance Committee that the City Treasurer be instructed to set-up and manage a procedure for the control and accounting of tickets and receipts at the Mill Parking Lot was read and upon motion by Thiem, 11 second by Schroeder, the recommendation was approved. The recommendation of the Street & Alley Committee that a curb and gutter be constructed on 4th Avenue Southwest from 3rd to 4th Street Southwest was read and upon motion by Anderson, second by Schroeder, the, recommendation was approved. The recommendation of the Street & Alley Committee that the City Council advertise for bids on grading and surfacing of loth Street Southeast in Willoyd's Subdivision was read and upon motion by Thiem, second by Schroeder, the recommendation was approved. The recommendation of the Street & Alley Committee recommending the annexation to the City of Rochester of a tract petitioned by A.E. The recommendation of the Sewer and Water Committees that the cost of the sanitary sewer and water main construction for -Gooding Addition and Bielenberg & Giese Addition be assessed to the frontage of the lots, without assessment for the sides of corner lots or the back of lots abutting two streets was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved. The recommendation of the Sewer Committee that Russel D. Sawyer be employed as Laboratory Technician at the Sewage Treatment Plant at the base rate • of $4020.00 per year, actual salary for the first 18th months to be 'as specified in the City Employment Policy, was read and upon motion by Schroeder, second by Ackerman, the recommendation was approved. The recommendation of. the Finance Committee that the two voting machines loaned to the City by the Automatic Voting Machine Corporation be purchased at the price of $1,217.00 each and that 1/10 of the cost of the said machines be included in the budget for the next fiscal year, no payment being due on these machines until April 15, 1354, was read .and upon motion by Anderson, second by Ackerman, the recommendation was approved. The recommendation of the Public Grounds Committee that bids be taken for the construction of a Quonset type steel building for the City Painterts Shop on the former Disposal Plant property was read and upon motion by Ackerman, second by Schroeder, the recommendation was approved. The recommendation of the Street & Alley Committee that when the Central Improvement Association erects signs on the main highways at the outskirts of the City advertising the public parking lots, the City post signs along the streets leading to the public parking lots, was read and upon motion by Ackerman; second by Whiting, the recommendation was approved. McGhie, Consulting Engineer, that the low • bid of Komatz Construction Company in the amount of $46,925.05, for sealed bituminous surface apron, be accepted, subject to the approval of the Minnesota Department of Aeronautics, was read and upon motion by Anderson, second by Thiem, the recommendation was approved. An -agreement between the State of Minnesota-, Department of Highways, and the City of Rochester granting permission for the installation of master push 'button crossing signals on North Broadway at 9th Street and on 12th Street ' Southeast at Sth Avenue Southeast was read and upon motion by Schroeder, second by Anderson, the Mayor was authorized to execute the said agreement. The following resolution adopted by the. Public Utility Board was read and the same was ordered placed on file: "Be itand it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to purchase Lot 11, Block 2 of Gregg's Addition from George Leifernan at a price of SIXTEEN HUNDRED DOLLARS ($l, 600. a0) , said property to be used as a new well site for the Water, Department of the City of Rochester." The request of the Board of Public Health & Welfare' for permission to employ Mrs. Edith Martin as a public health nurse, effective July 16, 1953 at a �I i salary of $295.00 per month, to replace hiss Robah Kellogg who resigned, was readi; I� and upon motion by Schroeder, second by Ackerman, their request was granted. The following communication from the State of Minnesota, Department of II Highways was read and upon motion by Ackerman, second by Anderson, the conclusions; reached at the Jul 1 (I. H. #296) J' Rochester, Minnesota In Rochester- Dear Mr. McQuillan: This is to summarize the conclusions reached at the July'g, li 1953 conference with Commissioner Hoffmann at which the construction of Trunk Highway 44296 was discussed. l.'The City will make such revisions in the plans as is necessary to let a separate contract for the storm !i sewer work. 2. The City -will, as soon as possible, let a contract for the storm sewer with the expectation that the construction will be completed not later than early in 1954. 3. The City will give consideration to widening Fourth Street l Southeast to provide a roadway width of 5.6 feet between llth Avenue Southeast and 13th Avenue Southeast. If this is to be done, the City will make the necessary plan revision. The cost of the additional Right -of -Way will be shared 50-50 by the State and the City. !' 4. The following actions will have to be taken to implement this program. Item 1. Transparent prints of the plans will be delivered to Mr. Armstrong by District Engineer C.A. Swanson. -These two men should determine the extent to which catch basin, castings and pipe to catch basins can be indluded in the City contract. Item 2. Before the City, advertises for bids the plans and specifications must be approved by this Department. Before the City awards a. contract, the cooperative a.gr,eement between the State and the City must be executed -and the State must concur in the award. Item 4. Previous to the award of the State'-, contract for surfacing etc, the State "and the City will enter into a second cooperative agreement. Item 5. Previous to the starting of work on the bridge widening plans it is neeessary to execute an agreement similar to the one under which the surfacing and storm sewer plans were prepared. If Mr. Armstrong will confer with Mr. T. S. Thompson -of this Department 'in regard -to the terms of the agreement, it will be prepared and presented to the Council and the Commissioner for execution. The Mayor's appointment of Mr. T. A. Heimer, 1235 - eth Avenue Southeast as .a member of the Board of Zoning, to hold office until the second Monday of ,April, 1959 was read and upon motion by Thiem, second by Morris, the appointment was approved. A request by the Governing Body of the City for an examination by the Public Examiner of accounts and affairs of the City of Rochester for the period beginning April 1, 1953 and ending March 31, 1954 was read and upon motion by Morris, second by Anderson, the said audit was authorized. A petition for construction of a curb and gutter on 9th Street N. E. from 1st to 2.nd Avenue Northeast was read and upon motion by Morris, second by Anderson, the same was referred to the Street & Alley Committee and the City Engineer. a - A petition for the vacation of the public property, formerly a part of Sth Street N. W. and presently a part of 3rd Street N. Utility Board was instructed to .ins.tall a. street light on .9th Avenue Northeast, north of the Chicago Northwestern. tracks on 2nd Street Northeast•. Discussion was held on the Liatter of a ground sign located at the corner of 9th Avenue and 12th Street Southeast which is 'now leased by the Naegele Poster Service Company. This sign was located at its present - location prior to • the date of the ordinance regulating the placing of signs. The.Matter was left with the Building Inspector -to confer with Mr. Chas. Bemel, who owns the property on which the sign is located. It was brought. to the attention of the Council that certain repairs on the house at the dog kennels and also on the dog kennel building should be made and upon motion by Whiting, second by Thiem, the matter was referred to the Public Grounds Committee to have the necessary repairs completed. It was again brought to the attention of the Council that the ruins of the Rommel Hotel building at the corner of Broadway and 4th Street Southwest had not been taken care of. The City Attorney explained the proceedure which would have to be follow6•d to make the owner clean up the area in question. A motion was made.by Schroeder, second by Whiting, instructing the City Attorney to serve the proper notice. All voted in favor of the motion. The City Attorney brought to the attention of the Council that if the City wished to proceed with assessments projects under the regulations of the present Charter it would be:necessary to take action indicating that assessment projects would be handled under charter provisions and not under the new State Law.
