Minutes of a regular meeting of the Common Council of the City of
Rochester, Minnesota, held in the Council Chambers, in the City Hall, in said
City, on August 2, 1954•
President Bach called the meeting to order at 2:00 o'clock P. M., the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Moody, Morris, Schroeder, and Whiting. Absent: None.
Upon -motion by Morris, second by Ackerman, the minutes ofthe'meeting
of July 19, 1954 were approved.
President Bach stated this as being the time and place set for the
following hearings:

Second hearing on the grading, surfacing 'and construction of a water
main in 131 Street Northwest from Broadway to Second Avenue Northwest. C. A.
Armstrong, City Engineer, read a letter from Mr. George Henke stating that he
was unable to be represented today,,either personally or by counsel, and
requested that the hearing be continued until the next meeting. Mrs. Arthur L.
Bailey and Carlos Ellis were present and inquired if the property on the north
side of 13th Street Northwest would be included in the assessment, they were
informed that it would not.
Hearing on the establishement of one-way t raffic on 3rd and 4th Avenues
from Second Street Northwest to Sixth Street South west. There was no one present
wishing to be heard.
The following veto message of the Mayor was read together with the
resolution providing for the fluoridation of the Rochester Water Sijpply adopted
by the Common Council on July 6, 1954 and vetoed by the Mayor on July 9, 1954:
."Honorable Members of the'Common Council
City of Rochester
Gentlemen:
I have this day vetoed the resolution passed by your
honorable body, which authorized the Rochester Board of
Health and Welfare to. add Fluorine to our public watersupply.
I do not believe that public officials may determine
that food or medicine or any other thing which effects the
health of people shall be forced upon thee.
I do not wish to become involved in the Fluoridation
Controversy beyond my position that people must have the
right to decide matters of this nature for themselves.

A motion was made by Whiting, second by Ackerman, that the resolution
providing for the fluoridation of the Rochester Water Supply be adopted as read,
and upon roll call, Aldermen Ackerman, Anderson, Schroeder and Whiting voted in
favor of the motion and Aldermen Moody, and Morris voted "no". President Bach
declared the motion lost.
A motion was then made by Alderman Schroeder, second by Alderman

Ackerman, returning the resolution to the Board of Public Health & Welfare. All
voted in favor of the motion.
Mr. Orville Mertz, of the Rochester Fire Department, was present and
asked if anything was going to be done on the recommendations of the Fact Finding
•
Committee on salaries. A motion was made by Schroeder, second by Moody, that the
Council meet informally with representatives of the panels at 7:30 o'clock P. M.
on Wednesday, August 4, 1954 in the Council Chambers.
Mayor McQuillan requested the Council to offer a $500,00 reward to
anyone giving information that will lead to the apprehension and conviction of
the person or persons connected with the bombing of the E. L. Whiting residence
at 616 - llth Street Southwest on July 27th. Mr. Robert Petersdorf, Business Agent
of the Building and Construction Trades Council and Mr. Max Durand, Business Agent
of the General Driver's Union, were presented and stated that they did not object
to the reward as suggested but also felt the Council should offer a reward for
the people slandering and libeling the unions. A motion was made by Anderson,
second by Morris, that if in the opinion of the City Attorney the Council have
the authority that this reward be given. All voted in favor of the motion. After
further discussion on the matter Alderman Anderson moved that the above motion be
rescinded, Alderman Whiting seconded the motion and all voted in favor thereof.
Mayor McQuillan submitted the following five proposed amendments to the
City Charter as presented to him by the Members of the Board of Freeholders of the
City of Rochester, Minnesota:
AMENDMENT OF THE CHARTER OF THE
CITY OF ROCHESTER

The Charter of the City of Rochester, adopted pursuant to Minnesota
Constitution Article 4, Section 36, and Minnesota Laws, 1903, Chapter 239,
and ratified August 22, 1904, as amended is hereby amended by the amendment
of Section 94 thereof so that said section shall henceforth read in its
entiretys
"Section 94. The President or, in his absence, the President
Pro Tem, shall preside at meetings of the Common Council. Each
Alderman, including the presiding officer, shall have one vote on
all matters. a
The foregoing proposed amendment to the Charter of the City of Rochester
is hereby proposed to the people of said City by the Board of Freeholders
thereof, pursuant to Minnesota Constitution, Article 4, Section 36, and
Minnesota Statutes, 1953, Chapter 410, and is hereby delivered to the Mayor
of said City in order that it may be submitted to the voters in accordance
with the provisions of -said Constitution and statutes.

AMENDMENT OF THE CHARTER OF THE
CITY OF ROCHESTER
Rochester, Minnesota
The Charter of the City of Rochester, adopted pursuant to Minnesota
Constitution, Article 4, Section 36, and Minnesota Laws, 1903, Chapter 238,
and ratified August 22, 1904, as amended, is hereby amended by the amendment
of Sections 110 and 111 thereof so that said sections shall henceforth read
in their entirety:
"Section 110. The City Clerk shall have power to :administer oaths,
and affirmations and take the acknowledgment of deeds and other writings.
He shall keep a record of all his acts and doings,. which record shall be
ht all times open.to the inspection of all parties interested. He shall
retain in his possession all records, files, books and papers incident
to his office, and shall not allow them to pass from his possession, except
under the direction of the Common Council. He shall receive for his
services such sum as the Common Council shall deem proper.
"A Deputy City Clerk shall be appointed by and serve at the
pleasure of the City Clerk. Such appointment shall be effective from
and after confirmation by the Common Council. In the event the position
of Deputy City Clerk remains vacant for a period of 30 days or more,
the Common Council may appoint a suitable person to fill such position.
When appointed by the Common Council, the Deputy City Clerk may be
removed by the City Clerk with the consent of the Common Council. The
salary of the Deputy City Clerk shall be fixed by -the Common Council
and shall be paid from City funds. The Deputy City Clerk shall perform
such duties as may be assigned to him by the City Clerk and, subject to -
the direction and control of the City Clerk, shall exercise all the
powers and authorities of the City Clerk."
"Section 111, All fees received by the City Clerk from private
individuals for filing and recording papers and for other services
shall be paid over to the City Treasurer and be the property of -the
City."
The foregoing proposed amendment to the Charter of the City of Rochester
is hereby proposed to the people of said City by the Board of Freeholders,
thereof, pursuant to Minnesota Constitution, Article 4, Section 36, and
Minnesota Statutes., 1953, Chapter 410, and is hereby delivered to.the Mayor
of said City in order that it may be submitted to the voters in accordance
with the provisions of said Constitution and statutes.

AMENDMENT OF THE CHARTER OF THE
CITY OF ROCHESTER
Rochester,.Minuesota
The Charter of the City of Rochester, adopted pursuant to Minnesota
Constitution, Article 4, Section 36, and Minnesota Laws, 1903, Chapter 238,
and ratified August 22, 1904, as amended, is hereby.amended by the amendment
of. Sections 156, 275, and 276 thereof, as follows:
"Section 156. All supplies for public utilities shall be contracted
for and purchased by said Board in the name of the City; but every
appropriation for the amount of Fifteen Hundred Dollars 01500.00) or
more to be paid to any one person, firm or corporation, and the letting
of any job or work, or the authorizing of any contract or purchase
involving the expenditure from the City Treasury of Fifteen Hundred
Dollars ($1500.00) or more, ' and the fixing of any officer= s salary or

employee's wages, at the aggregate sum of Fifteen Hundred Dollars
($1500.00) or more a year, and every provision for the sale of any
real or personal estate pertaining to said plant, of the value of
Fifteen Hundred Dollars ($1500.00) or more; and every determination
to make any improvement pertaining to publications of the City, shall
first be authorized by a resolution dully passed by the Mayor and
Common Council, before the said Public Utility Board shall have any
right or authority to act thereon."
"Section 275.. All contracts for commodities or service to be
furnished or performed for the City, or any department thereof in-
volving an expenditure of more than Fifteen Hundred Dollars ($1500.00)
shall be made as in this chapter provided, and not:otherwise. The
words "commodities" and "service" as used in this chapter, shall be
construed to include all work, labor, materials, supplies or other
property and all lighting and other service, and all local.or public
improvements, but shall not include the employment of City officers
and employees and the setting of their salaries, the employment of
independent professional services, and the purchase of real estate.
The word "contract" as used in this chapter, shall be construed to
include every agreement, in writing or otherwise, executed or executory,
by which any commodities, work, or service are to be furnished to or
done for the City, and every transaction whereby an expenditure is
made or incurred on the part of the City or any department or any
officer thereof,. except contracts for the employment of City officers
and .employees and the setting of their salaries, contracts for the
employment of independent professional services, and contracts for the
purchase of real estate.
"All action in this chapter required or authorized to be taken by
the Common Council shall be by resolution or ordinance. If the proposed
contract be in the hands of a Board, under this Charter, this Board
shall take the same proceeding as herein provided for the Common Council,
and the Clerk or Secretary of such Board shall do those acts in re:lKt.i_bn*:.
to such contract as are provided by this chapter to be done by the City
Clerk if the letting of the contract were in the hands of the Common
Council.
"Section 276. The first step toward making such a contract, shall be
for the Common Council or Board charged with the duty of making such
contract, to have the cost of the proposed commodity, work or service
to be estimated and determined by such officer, employee, or other
person or persons as it shall deem best.
"If such estimated cost does not exceed Fifteen Hundred Dollars
($1500.00) bhe Common Council or Board, in whose hands the matter may
be, may direct that the commodities, work or service be procured by or
through the proper department or officer, without advertisement and
public bids."
The foregoing proposed amendments to the Charter of the City of Rochester
are hereby proposed to the people of said City by the Board of Freeholders
thereof, pursuant to Minnesota Constitution, Article 4, Section 36, and
Minnesota Statutes 1953, Chapter 410 and is hereby delivered to the Mayor of
said City in order that it may be submitted to the voters in accordance with
the provisions of said'Constitution and statutes..

AMENDMENT OF THE CHARTER OF THE
CITY OF ROCHESTER

The Charter of the City of•Rochester, adopted pursuant to Minnesota
Constitution, Article 4, Section 36, and Minnesota Laws, 1903, Chapter 239,
and ratified August 22, 1904, as a mended, is -hereby amended by the amendment
of Section 163 and 164 thereof, as follows:
I.
Section 163 is amended by the addition, immediately following sub-
division #"Fifteenth" thereof, of a new paragraph to be numbered sub-
division."Sixteenth" and to read as follows:
"Sixteenth. A Police Fund; into which shall be paid all taxes
levied by the Common Council for the purpose of providing police
protection and services for the City."

II.
Section 164 is amended by the addition at the end thereof of a new
paragraph to read as follows:
"For the Police Fund, so much as may be necessary to provide
adequate police protection and services for the City."
The foregoing proposed amendment to the Charter of the City of Rochester
is hereby proposed to the people of said City by the Board of Freeholders
thereof, pursuant to Minnesota Constitution, Article 4, Section 36, and
Minnesota Statutes, 1953, Chapter 410, and is hereby delivered to the Mayor
of said City in order that it may be submitted to' the voters in accordance
with the provisions of said Constitution and statutes.

AMENDMENT. OF THE CHARTER OF THE
CITY OF ROCHESTER
Rochester, Minnesota
The Charter of the City of Rochester, adopted pursuant to Minnesota
Constitution, Article 4, Section 36, and Minnesota Laws, 1903, Chapter 239
and ratified August 22, 1904, as amended, is hereby amended by the
amendment of Section 293 thereof, as follows:
°Section 293. The following officers of the City shall
receive each year salaries as follows:
"The Mayor One Thousand Dollars ($1,000.00), Alderman,
each, Seven Hundred Fifty Dollars ($750.00).
"In addition to his salary the Mayor shall in any and all
events have the exclusive control _of a contingency fund in the
amount of One Thousand Dollars (.$1,000.00) each year, or in such
greater amount as the Common Council may be resolution provide.
Expenditures made from this fund shall be subject to such post -
audit as the Common Council may provide."
The. foregoing proposed amendment. to the Charter of the City of Rochester
is hereby proposed to the people of said City by the Board of Freeholders
thereof, pursuant to Minnesota Consitution, Article 4, Section 36, and
Minnesota Statutes, 1953, Chapter 410, and is hereby delivered to the Mayor
of said City in order that it may be submitted to the voters in accordance
with the provisions of said Constitution and statutes.

Members of the Board of Freeholders
Mr. Albert Paine, representing furniture dealers of Southeastern
Minnesota, was present and asked if any more had been done about an ordinance
governing going out of business sales. He further stated that he felt there
should be.some control over the length of time the sale continues. A motion was
made by Whiting, second by Schroeder, that the chair appoint two members of the
Council to work with the City Attorney and representatives of the furniture
dealers in studying the matter of the said Ordinance. President Bach appointed
Alderman Ackerman and Alderman Schroeder.
President Bach called a recess at 3:1 5 P. M. The meeting was called to
order at 3:40 P. M.

President Bach stated this as being the time and place set for receiving
and opening bids for the following projects:
Bids for finish base and bituminous surfacing of 3rd Avenue
grading,
Northeast and 17th Street Northeast in Huey & Reynolds Addition. No bids were
received.
Bids for repaving First Avenue Southwest from West Center Street to 2nd
Street Southwest. The bids of Woodrich Construction Company in the amount of
$37, 7i4.70 and Komat z Construction- Company in the amount of $39, l95. 60- were each
received and opened and upon motion by Ackerman, second by Morris, the same were
referred to the Street &.Alley Committee and the City Engineer.

Bids for furnishing_five traffic signals to be installed on 3rd Avenue
Southwest at 4th Street Southwest and West Center Street and on 4th Avenue
Southwest at 4th Street Southwest, 2nd Street Southwest and West Center Street.
The bid of H & H Electric Company in the amount of $20,020.00 was received and
opened and upon motion_ by Schroeder, second by Ackerman, the same, was referred
to the Police Committee, the Street & Alley Committee and the Chief of Police.
Bids for furnishing two patrol cars for use in the Police Department.
The bid of Universal Mot ors,- Inc-. in the amount of $2,126. 67 less trade in
allowance on one 1952 Ford Four Door in the amount of $1,000.00 making a net
cash difference on delivery $1,126.67 and one in the .amount of $2,126.67 less
trade in allowance on one -1951 Ford Your Door in the amount of $900,00 making
a net cash difference on delivery $1,2 26.67. Upon motion by Ackerman, second
by Schroeder, the same was referred.to the Police Committee and the Chief of
Police.
Bids for furnishing school crossing signals to be installed at Sth
Street Southeast and 3rd Avenue and at West Center Street and 5th Avenue. No
bids were received.
The City Engineers preliminary estimate for construction of a 6"
water main on 13* Street Northwest from North Broadway to 2nd Avenue Northwest

in the amount of $4,269,00 was read and President Bach ordered the same placed
on file.
The City Engineer's preliminary estimate for grading and surfacing on
1319 Street Northwest from North Broadway to 2nd Avenue Northwest in the amount
of $4,659.50 was read and President Bach ordered the same placed on file.
A communication from the State of Minnesota, Tax Study Commission
notifying those interested of the date and place where recommendations from the
large Cities Special Revenue Committee of the League of Minnesota Municipalities
may be heard was read and President Bach ordered the same placed on file.
President Bach called a recess at 4:20 P. M. The meeting was called to
order at 4:50 P. M.

The request of the City'Health Officer for permission to employ Mrs.
Mary Alexander as clinic clerk in the Health Department effective Monday, July 26
1954 at a salary of $195.00 per month was read and upon motion by Schroeder,
second by Ackerman, the appointment was approved.
A communication from Irving L. Eckholdt, Judge of Municipal Court,
requesting that in making a study of salaries, wages and work classifications that
the Municipal Court be carefully considered was read and President Bach ordered
the same placed on file.
An opinion by R. V. Ehrick, City Attorney, that.the abstract for the
land purchased from Edward J. Foster, Ray J. Arend and J. 0. Dalsbo had bean
examined by him and found to be up to date was read and President Bach ordered
the same placed on f ile.
A notice of hearing in the matter of the application of the Rochester
Bus Line, Inc. for an increase in fares before the Railroad and Warehouse
Commission was read and President Bach ordered the same placed on file.
The report of activities in the Office .of Civil Defense, Stanley F.
Drips. Director, for the period of April 1, 1954 to August 1, 1954 was read and
President Bach ordered same placed on file.
The reports for the week ending July 24, 1954,,�of.,-the Clerk of Munici
Court, showing total criminal fines and costs collected $1,491.00 and civil :#es
received $.70 and for the week ending July 30, 1954 showing total criminal fines
and costs collected $1, 502.40 and civil fees received $4.80, were each read and
having been approved by the City Attorney, President Bach ordered the same placed
on file.
The license bond of Yale Engineers, Inc. in the amount of- $1,000.00
with the Continental Casualty Company as surety was read and upon motion by
Whiting, second by Schroeder, the bond was approved, the surety thereon accepted,
and the same was ordered placed on file.
The contract bond of Leon Joyce in the amount of $594.70 with the
Seaboard Surety Company as surety was read and the same was referred to the Mayor
for his approval.
Upon motion by Whiting, second by Schroeder, action on the matter of
accepting the bid for paving 1st Avenue Southwest from West Center Street to 2nd
Street Southwest was deferred until the meeting to be held at`4:30 olclock P. M.
on August 9, 1954•
President Bach called a recess at 5:50 P. M. The meeting was called to
order at 5:00 P. M.
The recommendation of the Street & Alley Committee that as no bids were
received for finish grading, base and bituminous -surfacing on 3rd Avenue Northeast
and 17th Street Northeast in Huey Reynolds Addition, that the job be readvertised.

was read and upon motion by Schroeder, second by Morris, the same was approved.
The recommendation of the Police Committee and the Chief of Police
that the bid of H & H Electric Company for furnishing five traffic signals to
be installed on 3rd Avenue Southwest at 4th Street Southwest and West Center
Street and on 4th Avenue Southwest at 4th Street Southwest, 2nd Street Southwest
and West Center Street be accepted at the price of $20,020.00 was read and upon
motion by Schroeder, second by Ackerman, the recommendation was approved.
The recommendation of the Street & Alley, Sewer and Water Committees
that a sanitary sewer, water main and sewer and water.service connections be
constructed and grading, base construction and bituminous surfacing be done on

9th Avenue Northeast and 17th Street Northeast in Peck's Fourth Addition was
read and upon motion by Whiting, second by Schroeder, the recommendation was
approved.
The recommendation of the Street & Alley, Sewer and Water Committees
that a sanitary sewer, water main and sewer and water service connections be
constructed and finish grading, base construction and bituminous surfacing be
done in Sauer's First Subdivision was read and upon motion by Whiting, second by
Schroeder, the recommendation was approved.
The recommendation of the Street & Alley Committee that 16th Avenue
Southeast in Willoyd's Subdivision be vacated was read and upon motion by .Whiting,
second by Schroeder, therecommendation was approved.
The recommendation of the Police Committee .that. the bid of Universal
Motors, Inc. be accepted for furnishing two patrol cars for the Police Department
was read and upon motion by Schroeder, second by Ackerman, the recommendation
was approved.
The matter of purchasing school crossing signals to be installed at
Sth Street Southeast and 3rd, Avenue and at West Center Street and 5th Avenue
was again discussed and the same was referred back to the Street & Alley
Committee and the Police Committee.

The following resolutions were each introduced and read and President
Bach declared the same duly passed and adopted:
Resolution accepting the bid of H & H Electric Company for furnishing
five traffic signals to be installed on 3rd Avenue Southwest and 4th Avenue
Southwest. Upon motion by Ackerman, second by Anderson, resolution adopted.
Resolution accepting bid of Universal Motors, Inc. for furnishing two
patrol cars for use in the. Police Department. Upon motion by Anderson, second
by Moody, resolution adopted.
Resolution accepting plans and specifications and ordering bids for
construction of sanitary sewer, water main and grading and surfacing on 13th
Avenue Northeast and 15th Street Northeast in Jefferson Slopes. -Upon motion by

to a point 491.73 feet west of the Southeast corner of Block 29, Northern
Addition. Upon motion by Moody, second by Anderson, resolution adopted.
Resolution accepting plans and specifications and ordering bids for the
construction cf a sanitary sewer, water main, sewer and water service connections,
finish grading and bituminous surfacing on 721 Avenue Northeast, Sth Avenue
Northeast and Northwood Drive in Northwood Addition. Upon motion by Morris,
second by Schroeder, resolution adopted.
Resolution ordering first hearing on the finish grading, base'constr-
uction, bituminous surfacing and the construction of a sanitary sewer, water main
and sewer and water service connections in Sauer's First Sub -Division. Upon
motion by Schroeder, second by Whiting, resolution adopted.
Resolution ordering first hearing on the grading, base construction,
bituminous surfacing and construction of a sanitary sewer, water main and sewer
and water service connections in 9th Avenue Northeast and 17th Street Northeast

An Ordinance regulating the parking of vehicles on the public street
and alleys,.providing for the installation, maintenance and use of.parking meters,
creating a parking.meter fund, . and providing penalties for the violation thereof,
-was given -its second reading.
Alderman Schroeder moved that Section 1. (m), of the above ordinance be
amended so as to read in its entirety.as follows:
Section 1.
(m) PARS OR PARKING. The stopping, standing or parking of a
vehicle upon a street or alley whether accompanied or unaccompanied
by the operator thereof, except temporary stops for the purpose of
loading and unloading passengers.
Alderman Ackerman seconded the motion and all voted in favor thereof: •
'Alderman Whiting moved that Section 13 (b), of the above ordinance, be
,amended so that said section reb.ds in'its entirety as follows:
Section' 13.
(b)•The Common Council shall have the authority to make exceptions
to the parking restrictions and prohibitions set forth in paragraph (a)
above in justifiable cases where. the safety and convenience of the
traveling public will not be substantially impaired.
Alderman Schroeder seconded the motion and all voted in favor thereof.
A communication from Daniel M. Robbins, Architect for Fire House No. 2
submitting copies of.Change Order No. 1 on the Electrical Contract and also a
sketch ' of ' a "Dedicat ion. Plaque" was read. Alderman Whiting moved that change
order No. 1 under the Electrical Contract be approved, Alderman Ackerman
seconded the motion and all voted in favor thereof. Alderman Whiting then moved
that the City Clerk be instructed to advise Mr. Daniel M. Robbins., Architect for
Fire House No. 2, to revise the planned plaque so that the same will contain
only the following information: "Rochester Fire House No. 2" and "195411. Alderman
Ackerman seconded the motion and all voted in favor thereof.
Alderman Moody stated that there was quite a traffic hazard at the
corner of 2nd Street and 13th Avenue Northwest and recommended that stop signs be
placed on this corner. Upon motion by Whiting, second by Morris, the matter was
ref erred to the Police Committee and the Chief of Police. •
Upon motion -by Anderson, second by Morris; the meeting was adjourned
until 4:30 o'clock P. M. on'August 9, 1954•
