of the City of Rochester, Minn., October 4, 1954
Minutes of a regular meeting of the Common Council of the City, of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City,
on October 4, 1954.
President Bach called the meeting to order at 2:00 o'clock P. M. , the
following members being present: President Bach, Aldermen Ackerman, Anderson,
Moody, Morris, Schroeder and Whiting. Absent: None.
Upon motion by Moody, second by Ackerman, the minutes of the meeting•of
September 20, 1954 were approved.
President Bach stated this as being the time and place set for the
following hearings:

Hearing on the levying of special assessments for the construction of
a curb and gutter on 2nd Avenue Northwest from 6th to Sth Street Northwest. There
was no one present wishing to be heard.
Hearing on the levying of special assessments for the construction of a
curb and gutter and resurfacing of 4th Avenue Southwest from 3rd to 4th Street
Southwest. There was no one present wishing to be heard.
Hearing on the levying of special assessments for the construction of
a sanitary sewer and water main in Graham Court Southeast, east of 15th Avenue
Southeast. There was no one present wishing to be heard.
Hearing on the levying of special assessments for the construction of a
sanitary sewer and water main in Bielenberg & Giese's Second Addition. There was
no one present wishing to be heard.
Hearing on the levying of special assessments for the construction of a
sanitary sewer and water main on 19th Avenue Northeast from 9th to loth Street
Northeast; loth Street Northeast from 19th Avenue Northeast to the east line of
Miner's Third Addition and 9th Street Northeast from 19th Avenue Northeast to the
east line of Miners Third Addition. There was no one present wishing to be
heard.
Hearing on the levying of special assessments for the construction of a

water main in 131 Street Northwest from 2nd Avenue Northwest to Broadway. There
was no one present wishing to be heard.
Hearing on the levying of special assessments for the grading and
surfacing of 19th Avenue Northeast from 9th to loth Street Northeast and 9th and
loth Street Northeast from 19th Avenue Northeast to the east line of Miner's
Third Addition. There was no one present wishing to be heard•
Hearing on the levying of special assessments for the grading and
surfacing of Graham Court Southeast east of 15th Avenue Southeast. There was no
ohe present wishing to be heard.
The following recommendation of the Street & Alley, Sewer and Water
Committees was read and upon motion by Anderson, second by Moody, and all voting

in favor thereof, the recommendation was approved;

Gentlemen:
We, the undersigned, recommend that the assessments for
grading, surfacing, sanitary sewer and water main construction on 3
and 5 Street Southwest from 18'J Avenue Southwest to 20 Avenue
Southwest, on 19 Avenue•Southwest from 3 Street to•5 Street
Southwest and on 20 Avenue from 3 Street to 5 Street Southwest
be based on the front footage only of each lot. The front of a
corner lot being the narrow side of the lot abutting the street
or avenue.
We, further recommend that this basis of assessment be
incorporated in the resolution ordering this work.

Second hearing on the grading, surfacing, sanitary sewer and water main

from 3rd to 5th Street S. W. and•on 20th Avenue S.W. from 3rd to 5th Street S.W.
There was no one present wishing to be heard.
President Bach stated this as being the time and place set for receiv
and opening bids for the following projects:
Bids for grading and surfacing on 5th Street S.W. from 18'J Ave. S.W. to
20th Avenue S.W.; on 3rd Street S.W. from 181 Avenue S.W. to 20th Avenue S.W.; on
19th Avenue S.W. from 3rd to 5th Street S.W. and on 20th Avenue S.4. from 3rd to
5th Street S.W. The bid of Leon Joyce in the amount of $29,468.00 was received
and opened and upon motion by Schroeder, second by Moody, the'same was referred
to the Street & Alley Committee and the City Engineer.
Bids for the construction of a sanitary sewer and water main on 5th
Street S.W. from 18J Avenue to 20th Avenue S.W.; on 3rd Street S.W. from 18'J
Avenue to 20th Avenue B.W.; on 19th Avenue S.W. from 3rd to 5th Street S.W. and
on 20th Avenue S.W. from 3rd to 5th Street S.W. The bids of Carlisle G. Fraser
In the amount of $40,992.70 and Barbarossa & Sons in thit amount of $44, 519.00
were each received and opened and upon motion by Schroeder, second by Moody, the
same were referred to the Sewer and Water Committees and the City Engineer.
Bids "for Christmas Street Lighting for 1954. The bid of Naegele Sign
Company in the amount of $3,944.40 was received and opened and upon motion by
Ackerman, second by Moody, the same was referred to the Lighting Committee and t
City Engineer.
The recommendation of the Street & Alley Committee and the City Enginee
that the bid of Leon Joyce for grading and surfacing on 5 Street Southwest from
18* Avenue Southwest to 20th Avenue Southwest and on 3rd Street Southwest from 1

prices bid was read and upon motion by'Ackerman, second by Moody, the recommendation
was approved.
The recommendation of the Sewer and Water Committee and the City Engineer
that the bid of Carlisle G. Fraser for construction of a sanitary sewer and water
main in 5 Street S.W. from 18* to 20 Avenue S.W. and in 3 Street S.W. from 18} to
20 Avenue S.W., in 19 Avenue S.W. from 3 to 5 Street S.W. and in 20 Avenue S.W.
from 3 to 5 Street S.W. be accepted at the unit prices bid and checks returned to
the unsuccessful bidd.ers.was read and upon motion by Anderson, second by
Schroeder, the. recommendation was approved.
The recommendation of the Sewer and Water Committees that sanitary
sewer and water service connections be installed in 13 Avenue Northeast in
Jefferson Slopes was read and upon motion by Schroeder, second by Moody, the
recommendation was approved.
The following recommendation of the Street & Alley Committee was read
and upon motion by Whiting, second by Schroeder, the.same was approved:
"Honorable Mayor and Common Council
City of Rochester, Minnesota
Gentlemen:
We, the undersig ned-i having considered the interests of all
parties, recommend that the order to construct sidewalks on the
North side -of 14 Street Northeast from 1 Avenue Northeast to 3
Avenue Northeast; and on the south side of 14 Street Northeast from
Broadway to Silver Lake Drive, except where sidewalk•is-now in place,
be deferred while the matter of grading and surfacing with curb and
gutter on 14 Street Northeast from Broadway to 3 Avenue*Northeast
is considered.
•We,.f urther recommend, that a first hearing be ordered for the
construction of grading, surfacing, curb and gutter and sidewllks on
14 Street Northeast from Broadway to Silver Lake Drive N.E.

Mayor McQuillan read a letter from Mrs. Basil A. ginner commending the
Council and City Engineer for the stand taken on the construct -Lan of a sidewalk
on 14th Street Northeast and the same was ordered placed on,file.
The recommendation of the Street & Alley Committee that the following
list of sidewalks.be installed, after June 1, 1955. was read and upon motion by
Anderson, second by Ackerman, the recommendation was approved:
On the south side of 4 Street Southeast from 11 Avenue
to 13 Avenue Southeast wherever the walk is not now in
place.
.At 925 - llth Street S.E.(Lot 11, Block 1, Benedict's Addition).
On the East side of 142T East Center Street (Lot 12, Block 3,
Stebbins Addition).
At 812 - 17th Avenue Northeast (Lot 1, Block 3, Meredith°s
2nd Subdivision).
At 820 - ljth Avenue Northeast (Lot 3, Block 3, Meredith's
2nd Subdivision).
On the east and north sides of 1608 - 2nd Street Southwest
(Lot 1, Block 2, Westlawn Addition).

The recommendation of the Steering Committee on Parking and Traffic that

parallel parking on the East side of First Ave. S.W. from West Center Street to
First Street S.W. be instituted was read and upon.motion by.Schroeder,•second by
Morris, the recommendation was approved and the City Clerk was instructed to
draw -the resolution making the said change.
The recommendation of the Steering Committee on Parking and Traffic
that the decision. of the Department of Highways of the State of Minnesota
concerning the resurfacing of Highway $63(Broadway)be not accepted as final at
this time and that a committee be appointed by the City Council f rom.its member-
ship and the membership of the Steering Committee on Parking and Traffic and the
Mayor to negotiate further with the Highway Department for the resurfacing of
Broadway with the retention of angle parking at this time was . read. Alderman
Ackerman and Alderman Schroeder were appointed to act on the committee with the
Mayor and members of the Steering Committee on Parking and Traffic.
The following recommendation of the Sewer Committee was read and upon
motion by Ackerman, second by Morris, and all voting.in favor thereof, the said
recommendation was approved:
"Honorable Mayor and Members

Rochester, Minnesota
Gentlemen:
The undersigned members of the Sewer Committee, hereby, recommend
to the Mayor and Common Council that the Common Council accept the
offer of Owen C. Brause and Naidine A. Brause to sell to the City of
Rochester for the sum of $149000.00, the following described land:
'The North One-half of the Northwest quarter(.) -of Section
No. 23 in Township No. 107 North of Range No.' 14 West,
less that part bounded by a line described as follows:
Beginning at the Northeast (NE) corner of said Northeast
one-auart.er (NEJ) of the Northwest one -quarter (NWJ) of
Section Twenty-three(23) Township one Hundred Seven (107)
North Range Fourteen (14) West, thence south along the
center of Section Twenty-three (23) a distance of 1220.0
feet; thence deflecting to the right an angle of 1390431
a distance of 1627.26 feet northwesterly to the north line

This recommendation is made on the basis of the.contract
executed by the City of Rochester and John Fred Weih'�and Roxy
Luetta Weih on October 2nd, 1945 concerning the above described land
and on the basis of the need. of .the City to acquire -the above des-
cribed land which adjoins the present lands owned by the City on
which the Sewage Disposal.Plant is located.

Notice of personal injury by Laura Miller of 1.61 -.Third Street S.W.
and claim for damages in the amount of $50,000.00 was read'and the same was
referred to the City Attorney,
Mayor McQuillan brought up the matter of personal injury claimed by
she claims
Mrs. Joseph Newberger of California, which/occurred while she was crossing 2nd

Street Southwest on the west side of Broadway. During a recess the members of

the Council viewed the location where she claimed the accident had happened. No
action was taken on the matter.
Mr. George Leiferman was present in regard to the sale of the City Hog
Farm. He stated that the farm could be disposed of in three ways, (1) all in one
piece, (2) divided into five different parcels of land and (3) development of
property into platted area. The matter was discussed at length but no action was
taken at this meeting.
President Bach called a recess at 3:40 P. M. The meeting was called to
order again at 4:20 P. Mo
The preliminary estimates of the City Engineer in the amounts of
$28,651.90 for grading and in the amount of $40,916.15 for sanitary sewer and
water main in 5 Street Southwest from 18i Avenue to 20 Avenue S.W.; in 3 Street
Southwest from 10 Avenue to 20 Avenue S.W.; in 19th Avenue S. W. f rom 3 to 5 Street
S.W. .Pnd in 20 Avenue S.W. from 3 to 5 Street S,V. were each read and the same
were ordered placed on file.
A letter from the Minnesota Department of Health transmitting a copy
of a report by their Municipal Water Supply Section covering an examination of
1plans on water main extensions in the City of Rochester was read and President
j Bach ordered the same placed on file.
The three following resolutions adopted by the Public Utility Board
were each read and President Bach ordered the same placed on file:
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Common.Council of said
City be and is hereby requested to authorize the said Board to enter
Into a contract with the SOUTHERN MINNESOTA SUPPLY COMPANY for the
furnishing, in accordance with specifications, of-
4 - 37$ KVA Distribution Transformers
20 - 25 KVA Distribution Transformers
6 - 15 KVA Distribution Transformers
6 - 10 KVA Distribution Transformers,
the total amount of the contract to. be NINE THOUSAND EIGHT HUNDRED
FIFTH EIGHT DOLLARS ($9, 858.00) and the said Southern Minnesota
Supply Company being the lowest responsible bidder."
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota, that the Common Council of the
said City be and is hereby requested to authorize the said Board to
enter into a contract with the GENERAL CABLE CORPORATION for the
furnishing, in accordance with specifications on file, of
1,000 feet - 400 MOM 3 conductor cable,
the total amount of. the said contract to be FOUR THOUSAND EIGHT
hundred thirty one Dollars ($4,831.00) plus a deposit of $200,00 for
reel, the said General Cable Corporation being one of five low
bidders."
"Be it and it is hereby resolved by the Public Utility Board
of the City of Rochester, Minnesota that the Common Council of the
said City be and is hereby requested to authorize the said Board to
enter into a contract with the GENERAL ELECTRIC SUPPLY COMPANY for
the furnishing; in accordance with specifications, of
TWO (2) STEP VOLTAGE REGULATORS,
the total amount of the said contract to be TWENTY TWO HUNDRED FIFTY
EIGHT DOLLARS ($2,258.00) and the said General Electric Supply Company
being one of. three low bidders."

"Be it resolved by the Commissioners of - the Sinking Fund of the
City of Rochester, Minnesota:
That the sum.of $75,000#00 be and the said sum is hereby appro-
priated from the Sinking Fund of the City of Rochester, Minnesota,
and ordered paid to the First National Bank of Rochester, Minnesota,
for the purchase of $75,000.00 1 519% Percent Treasury Notes of
Series B-1957 dated October 4, 1954 and maturing on May 15, 19 57•
Be it further resolved: That the said bonds be purchased for the
following investment accounts:
Steam Depreciation Reserve . . . . . . . . . $70,000.00
Employees Compensation Reserve . . . . . 5• 000.00"
"Be it resolved by the Commissioners of the Sinking Fund of the
City of Rochester, Minnesota:
That the sum of $40,000.00be and the said sum is hereby appro-
priated from the Sinking Fund of the City of Rochester, Minnesota,.
and ordered paid to the First National Bank of Rochester, Minnesota
for the purchase of. $40,000.00 1 5 8% Percent Treasury Notes of
Series B-1957, dated October 4, 1954 and maturing on May 15. 1957-
Be-it further resolved: That the said bonds be purchased for
the Bridge Fund Reserve Investment Account."
The following veto message from the Mayor was read together with a veto
of a resolution levying special assessments for the widening, paving and constr-
uction of a curb and gutter on 4th Street Southeast from 6th Avenue Southeast to
the Rochester State Hospital:
"Honorable Members - Common Council
City of Rochester
Gentlemen:
I am returning, with my veto inscribed thereon, the resolution
setting up the assessments against the lots and parcels of lands
adjoining 4th St. S.E. from 6th Avenue S. E. to the State Hospital
for the curb and gutter and widening and paving of the 4th St. S.L.
Notwithstanding, the fact that the State of Minnesota has con-
tracted with the City of Rochester to pay 70% of the expense of
the improvement, I feel that any widening of 4th St. from 6th Ave.
S.E. to llth Ave. S.E. was strictly for the benefit of the general
public and should therefore be paid for by general taxation.
There are some .unusual features in the advantages and proceedures
which led to the improvement and I want to call the attention of
the Council to the fact that I promised the people that I would
veto any resolution ordering assessments against properties which
already had paving on the street in front of those properties.
Because of my promise, further delay which could have jeopardized
State participation was avoided - and I feel the members of the
Council should back me up on this stand.

Alderman.Ackerman moved that pursuant to the Charter this resolution again be put
up for passage. Alderman Whiting seconded the motion and upon roll and all voting
in favor thereof, President Bach declared the resolution passed and adopted.
The following veto message from the Mayor was read together with his
veto of a resolution authorizing and directing the Mayor and City Clerk to execute
the commercial garbage contract between the City of Rochester and Donald Kruger:
"Honorable Members of Common Council
City of Rochester
Gentlemen:
I am returning the resolution ordering the execution of the
commercial garbage contract, which bears notice of my vetG
I believe the action by resolution is improper and therefore

must request that the action be reconsidered and handled as a
franchise contract.

Alderman Whiting moved that pursuant to the Charter this resolution again be
put up for passage. Alderman Ackerman seconded the motion and upon roll call and
all voting "no", President Bach declared the resolution not adopted.
A communication from the Fireman's Civil Service Commission signed by
J. C.,Haas, Secretary, recommending that the following individuals from the
eligibility register be appointed as fireman, pending the outcome of their
physical examinations was read: Richard Toogood, Marvin McGowan, Harvey Miller,
James Nelson, Paul Powe, Emery Walters, Robert Johnson, Francis Pulford,
Arleigh Schroeder, Donald Leonard, Daniel Hovers and Robert Mariotti. Upon
motion by Ackerman, second by Anderson, the appointments were approved, subject
to the physical status. All voted in favor of the motion.
A letter signed by Mr. 0. W. Haling stating that during the past week
he had submitted three proposals to the Aldermen on the Weih-Brause deal'.for
consideration and that he now wished to withdraw these offers until a later date
was read and President Bach ordered the same placed on file.
A recess was called -at 5:30 P. M. President Bach called the meeting to
order at 7:45 P.-M.
A letter from the Minnesota Society of Professional Engineers contain-
ing the following resolution adopted by the Members of the Southeast Chapter was
read and President Bach ordered the same placed on file:
"Resolved: The Southeast Chapter of the Minnesota Society of
Professional Engineers recommends that in order to assure the
citizens of Rochester a proper and adequate engineering serviee
that professional engineers be employed in all cases where job
qualifications call for engineering services.
And be it further resolved that the salary ranges established by
the Minnesota Society of Professional Engineers as outlined in the
Scale of Minimum Fees and Salaries be used as a basis for
establishing salaries for all professional engineers and their
aides."
A letter from the State of Minnesota. Department of Highways, trans-
mitting Cooperative Agreement C-1347 for the improvement of Trunk Highway f296
along 4th Street S. E. from Broadway to 6th Avenue Southeast was read and
President Bach ordered same placed on file.
A petition to have Lots 11, 10. 7, 6, 3 and 2 of Leiferman-8oehnen
Addition changed from a commercial to a residential zone, signed by 21 residents
in that area, was read. Mr. James Pfeffer and Mr. Charles Passe were heard on
the matter. no action.was taken.
Mrs. Bertha Weichman, Mrs. James Mahoney and Mr. George Lemke were
again before the Council and heard on the matter of the construction'of a san-

An easement for -highway and utility provisions given to the City of
Rochester by School District No. 59 of .Olmsted County was read and upon motion
by Ackerman, second by Morris, the same was accepted and the City Clerk was
instructed to record same with the Register of_Deeds.
The request of Mr. Amos Seymour that an easement given .to the City by
him, granting the right for the City to use certain parts of his land located at
the corner of 4th Street and 13th Avenue Southeast for street purposes, be Alease
was read and upon motion by Whiting, second by Morris, the same was referred to t
City Engineer and the City Attorney.
A notice addressed to the City of Rochester from the office of the
State Fire Marshall that the offices of the Army Recruiting Officer and the Air
Force Recruiting Officer be removed from corridorp in the City,Hall and that all
corridors are to be kept unobstructed at all times was read. A motion was made
by Schroeder, second by Whiting, that the use of the City Hall be confined to the
Municipality of the City of Rochester offices and that the Public Grounds Committe
be empowered to enforce this resolution.of the Council. All voted in favor of the
motion.
The request of Gertrude Toomey that an exception be made by the City of
Rochester to a provision of the Building Code wherein it is required that a house
Should be built on not less than 5,000 square feet was read and -gpon motion by
Schroeder, second by Whiting, the same was referred to the Building Inspector for
report at the next meeting.
A petition to vacate a part of 3rd Street Southwest lying between the
west line of Sth Avenue Southwest and the east line of 9th Avenue Southwest was
read and upon motion by Anderson, second by Ackerman, the same was referred to the
Street & Alley Committee,. the City Engineer and the City Attorney_.
The report, of the City Weighmaster for the month of September, 19.54
showing fees collected f-or loads weighed in the amount of $132 05 was read and
the same was referred to the Finance, Committee.
The reports for the month of September,. 1954 of.-t-he._;Building. Inspector
showing fees_ collected for building permits issued in the amount of $1,959,.00; of
the -Electrical Inspector showing fees collected for electrical permits: issued .ia
the amount of $213.00; of the Plumbing Inspector showing fees collected. for
plumbing Permits issued in the amount. $246.75; of the Heating Inspector, showing
fees collected for heating permits issued in the amount of $153.75; and fees
collected for sign permits issued in the amount of $35.20 were each read and the
same were referred to the Finance Committee.
The reports of the Clerk of. Municipal Court. for the week ending _Septem-
ber 25, 1954 showing total criminal fines and costs collected $1,293.00 and civil
fees received $7.60 and for the week. ending October 2, 1954 showing total criminal

fines and costs collected $1,197,05 and civil fees received $3.30., were each read
and having been approved by the City Attorney, President.Bach ordered the same
placed on file.
The applications of H. R. Dormady and Clarence Wharton for license to
sell cigarettes at retail were each read and upon motion by Anderson, second by
Morris, the licenses were granted.
The application .of Clarence Wharton for license to sell soft drinks
was read and upon motion by. Whiting, second. by Morris, the license was granted.
The applications of A. D. Mills for -an Electrical Contractors License
and a Master Electrician's License were each read and upon motion by Moody,
second by Ackerman, the licenses were granted.
The license bond of A. D. Mills in the amount of $1,000.00 with the
Fidelity and Casulaty•Company of New York as surety was read and upon motion
by Moody, second by Whiting, the bond was approved, the surety thereon accepted
and the same was ordered placed on file.
The contract bonds of Carlisle G. Fraser (4) in the amounts of $6,993.00.
$49623.90. $1.237.50 and $22,958.70 with the Federal Insurance Company as surety
and Leon Joyce (2) in the amounts of $9,905.10 and $1,980.59 with the Seaboard
Surety Company as surety were each read and the same were referred.to the Mayor
for his approval.
The following claims were read and upon motion by Morris, second by
Moody, the same were approved and the Mayor and City Clerk were authorized and
directed to draw warrants upon the City Treasurer and make payments accordinglys

An Ordinance amending an Ordinance entitled; "An Ordinance- for the pur-
pose of promotion health, safety, order, convenience and general welfare by regul-
ating the use of land, the location, size, use and heighth of buildings and the
arrangement of buildings on lots and the density of population within the -City of
Rochester, Minnesota, all in accordance with a comprehensive plan°, was given its
first reading.
Upon motion by Morris, second by Moody, and upon roll call and all presenj
voting in favor thereof, the rules were suspended and the ordinance was given its
second reading.
Upon motion by Morris, second by Whiting, and upon roll call and all
present voting in favor thereof, the rules were suspended and the oriinance was
given its third and final reading.
Upon motion by Morris, second by Ackerman, that the said ordinance be
adopted as read, and all present voting in favor thereof, President Bach declared
the said ordinance duly passed and adopted.
An Ordinance relating to the licensing of Peddlers, Canvassers and
Transient Merchants and providing penalties for the violation thereof, wqs given
its second reading.
Upon motion by Whiting, second by Ackerman, and upon roll call and all
present voting in favor thereof, the rules were suspended and the ordinance was
given its third and final reading.
Upon motion by Whiting, second by Anderson, that the said ordinance be

An Ordinance amending an Ordinance entitled, "An Ordinance establishing
charges and rates for the use and service of the Sewage Works of theCity of
Rochester, Minnesota", was given its third and final reading.
Upon motion by Whiting, second by Morris, that the said ordinance be
adopted as read and upon roll call, Aldermen Ackerman, Moody, Morris and Whiting
voted "no", and President Bach declared the ordinance not adopted. (Alderman
Anderson and Schroeder were absent at the time the vote was taken).
Alderman Whiting stated that Mrs. Otto Clare who lives directly North
of 011ie's Food Store on lot Street Southwest had complained that cars were parked
bumper to bumper in front of her residence and at times made it difficult.' for her
to enter a taxicab in front of her residence. Upon motion by Morris, second by
Ackerman, the same was referred to the Police Committee and the Chief of Police.
Mr. James J. Macken, Jr., Chief of Police, requested permission to attend
a F.B.I. Conference to be held in Minneapolis on October 7, S and 9, 1954. Upon
motion by Morris, second by Ackerman, he was authorized to attend the said Conferenc
at city expense.

C. A. Armstrong, City Engineer, presented a request by the Public
Health & Welfare Department for permission to move their garage for trucks from
the old hog farm to the city grounds at the old Sewage Treatment Plant on North
Broadway. Upon motion by Morris, second by Ackerman, the request was granted.
Upon motion by Ackerman, second by Moody, the meeting was adjourned
until 7: 30 o'clock P. M. on October 11, 1954.
