HomeMy WebLinkAbout03-19-1956�a + 70 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 19, 19 56 • Minutes of an adjourned regular meeting of the Common Council of the City of Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City, on March 19, 1956. President Bach called the meeting to order at 7:30 o I clock P. M. , the following members being present: 'President Bach,'Aldermen Anderson, Moody, Schroeder, Schwanke, Tingley, Whiting. Upon motion by Moody, second by Schroeder, the minutes of the meetings of March 5 and March 14, 1956 were approved* President Bach stated this as being the time and place set for the following hearings: Continued hearing on the construction of a sanitary sewer in: 3rd Avenue Northwest from 14th Street Northwest to a voint 76 feet north of the south line of Outlot 4. Northern Addition. The following recommendation of the Sewer Committee was read: "Honorable Mayor & Common Council City of Rochester., Minnesota Gentlemen: We, the undersigned, recommend that the proposed Sanitary Seiner in 3rd Avenue Northwest from 14 Street Northwest to a point 76 ft. Northof the south line of Outlot 4 - Northern Addition be assessed to the abutting property as follows: (a.) $2600 to the Crenlo Co. for its entire ownership in Outlot s 2 3 and 14. (b.) At the actual cost per foot, but not to exceed $5.35 per front foot, against all the other property abutting on 3rd Avenue that will be served and benefited by the sewer. (c.) The property owned by C. Thompson on the east side of 3rd Avenue Northwest in Ou'tlot #3 (.Appro,x.4.601) be assessed at the same rate per front foot as others, but because of the questionable use by this property of this sewer, the assessment be deferred and collected as connection charges on'a front -foot basis when, and if any part of this property connects to the sewer. This r.ecommendation• is consistant with the previous recommend- ation submitted and approved on October 3, 1955• The purpose of this recommendation being to clarify the assessment to the Crenlo property and to establish a maximum assessment of $5.35 per front fagot to other abutting property. Mr. Fred Wacker was present and stated that he was in favor of having the sewer constructed at this time. After hearing those present and discussing the matter A motion was made by Alderman Schwanke, that the recommendation of the Sewer Committee be accepted. Alderman Whiting seconded the motion'and all voted in favor thereof. Hearing on the proposed annexation of 16 parcels of land which are surrounded by the City. Dr. Gershom J. Thompson of 801 - 12th Avenue Southwest, was present and spoke in behalf of himself, Mr. w Mrs. Donald Barrett, Dr. & Mrs. J. Pratt, Dr. & Mrs. J. M. Berkman and Dr. & Mrs. H. R. Hartman, stating that they did not feel that their property* was completely surrounded by the city and therefore could not legally be made to come into the City. Dr. Hartman and Mr. Barrett also each spoke against the annexation. After hearing those present a motion was made by Alderman Moody that this hearing be continued until the meeting on April 2, 1956, at 7:30 Ia. M., ao the Council could be further advised by the City Engineer and City Attorney, and a survey could be made if same is necessary. Alderman Tingley seconded the motion and all voted in favor thereof. Second hearing on construction of a curb and gutter on 152 Avenue N. W. from loth to .16th Street N. V% and on the north side of loth Street N. W. and sout side of 16th Street N. If. from z block west of 152 Avenue N. W. in Bielenberg & Giese 3rd Addition. There was no one present wishing to be heard. Second hearing on construction of a curb and gutter on Sth Avenue S. W. from Memorial Parkway to lla Street S. W. There was no one present wishing to be heard. Second hearing on.construction of a curb and gutter on 9th Avenue N. E. and 17th Street N. E. in Pegk's 4th Addition. There was no one present wishing to be board. Second hearing on construction of a curb and gutter on llth Aver -tie and 15th Street Northeast in Peck's Fifth Addition. There was no one present wishing to be heard. Second hearing on construction of a curb and gutter on 13th Avenue N. W. from loth to loth Street Northwest. There was no one present wishing to be heard. Second hearing on,construction of a sanitary sewer and sanitary sewer and water service connections in 14th Avenue N. E. and 15th Street N. E. in Jefferson Slopes Second Addition. There was no one present wishing to be heard. Second hearing on,grading, base construction and bituminous surfacing on 14th Avenue N. E. and-15th Street N. E. in Jefferson Slopes Second Addition. There was no one present wishing to be heard. Nearing on change .of zoning from residential to a commercial zone of the property owned by the Rochester Dairy Cooperative, said property abutting on 3rd Avenue Southeast. There was no one present wishing to be heard and upon motion by Schroeder, second by -Moody, the City Attorney was instructed to, prepare an amend- ment to the Zoning Ordinance on the requested change. All voted in favor thereof. President Bach stated this as being the time and place set for receiving and opening bids for the following: Bids for the purchase of one pulverizer mixer fcr use in the City Enginee� Department. The bids: of Phillipi Egtiipme.nt Company in the amount of $3, 507.00; of Borchert Ingersoll Iric. in the 'amount' of '$4,610.00 were each received and opened and upon motion by Schroeder, second by Moody, the same were referred to the Street & Alley Committee and the City Engineer for t,abulati.on and report. A motion was made by Alderman Schroeder, second by Alderman Schwanke that the action on tr.e above bids be deferred until the meeting on March 26, 1956 at 7:30 P. m. All voted in favor of the action. Bids for furnishing one servi-car motorcylle for use in the Police Department. The bid of Leo N. Herrick & Sons in the amount of $1,883.80 was received and opened and upon motion by Schroeder, second by Schwanke, the same was referred to .the Police Committee -and the Chief of Police for tabulation_ and report. Mr. Emrold Thiem was present and stated that the Charter Commission was going to start meeting again and requested permission to use the committee room in the City Clerk's office for these meetings. Upon motion by Schroeder, second by Whiting, the Charter.Commission was given permission to meet in the committee room in the City Clerk's office. Upon motion by Schwanke, second by Tingley, a recess was declared at 9:30 P. M. The meeting was called to order again at 9: 50 P. m. An Ordinance annexing to the City of Rochester, Minnesota, part of the Southeast Quarter of Section Twenty -Two, Township One Hundred Seven North, Range Fourteen West, in Olmsted County, Minnesota (request by Elford), was given its first reading. A motion was made by Schroeder, second by Anderson, that the rules be suspended and the ordinance be given its second reading and upon roll call and alli voting in favor thereof, the rules were suspended and the ordinance was given its second reading. A motion was made by Schroeder, second by Moody, that the rules be sus- pended and the ordinance be given its third and final reading and upon roll call and all voting in favor thereof, the rules were suspended and the ordinance was given its third and final reading. 674 Record of Official Proceedings of the Common Council of the City -of Rochester, Minn., March 19, 1956 A motion was then made by Schwa.nke, second -by Whiting, that the ordinance be adopted as read, and all voting in favor thereof, President Bach declared the said ordinance .duly, passed and adopted. The plat of Elton Hills First Sub -Division was again presented by Mr. Stanley Guth. A letter from C. A. Armstrong, City Engineer, stating that he had examined the proposed plat of Elton Hills -First Sub -Division and that it meets all the. requirements of Ordinance 'No. 704 regarding submission of .plats was read together with a •letter from G. E. Mare'_, General Manager of Utilities, stating that he had drawn in easements which would allow adequate utility service to each lot. A motion v)as then made by Anderson, second by Whiting, that the plat of • Elton Hills First Sub -Division be approved and accepted. Leitzen, that the motion continuing the hearing on the annexation of certain parcels of land completely surrounded by the City until April 2, 1955, be amended by excepting therefrom the property owned by Bert & Ellen E. Leitzen so that the same may be annexed pursuant to law. Alderman Schroeder seconded the motion and all voted in favor thereof. An Ordinance annexing to the City of Rochester, Minnesota, a part of Section Twenty five, Township 107 North, Range 14 West, in Olmsted County, Minnesota (Leitzen.'s) was given its first reading. -Alderman Schroeder then moved to amend the above ordinance by renumbering the present Section 2 as Section 3 and inserting as Section 2'the following: Section 2. That present and future owners of the area annexed by this ordinance are hereby notified that it is the intention of the Common Council to assess against benefited property all or a portion of the cost of any storm sewer construction hereinfater undertaker_ in the area annexed. A motion -was then made by Schroeder, second by Anderson, that the • ordinance as amended by given its second reading and upon roll call and all voting in favor thereof, the ordinance was giver_ its second reading. A motion was then made by Tingley, second by Whiting, that the ordinance be given its third and final reading and upon toll call and all voting in favor thereof, the rules were suspended and the ordinance was giver. its third and final reading. A motion was made by Anderson, second by 'Moody, that the ordinance be adopted as read, and all voting in favor thereof, President Bach declared the said ordinance duly passed and adopted. R. V. Ehrick, City Attorney, then read an easement for street dedication between Bert and Ellen E. R. V. Ehrick, City Attorney, then read an 'agreement between Bert & Ellenl E. Leitzen and the City of Rochester that the first parties do hereby agree with second party that they drill, not later than March 1, 1959, discontinue and remove from their land the business presently conducted thereon by them and known as Leitzen Concrete Products Company. Upon motion by Schroeder, second by Anderson, the agreement was accepted and the Ida.yor and City Clerk were authorized and directed to execute the same, A plat of Leitzen's Fourth Addition was then presented and upon motion by Tingley, second by Schroeder, the plat was approved. A letter Addressed to Mayor McQuillan thanking him for his ]ester dated I -larch S on behalf of the City Council urging that hearings be held on the bills S. 2290 and S. 2713, to permit national banks to underwrite and deal. in state and local government revenue bonds was read and President Bach ordered the same placed on file. A letter from National Rivers & Harbors Congress addressed to Mayor Mc(,uillan stating that the 43rd National Convention of the, said Congress would be held in Washington D. C. on May 11 and 12, 1956 was read and. President Bach ordered the same placed on file. The request of the Veterans of Foreign Wars Post 1215 and the Ladies Auxiliary and the American Legion Post and Ladies Auxiliary forpermission,to sell poppies on the streets of Rochester on Saturday, May 26 was read and upon motion by Schwanke, second by Tingley, their request was granted. The request of the Board of Public Health & Welfare for approval of the employment of Mrs. Mary LaPlante as secretary in the sanitation program, effective March 19, 1956 at $220.00 per month was read and Upon motion by Schroeder, second by Schwanke, their request was approved. The following resolution adopted by the Public Utility Board was read and President Bach ordered the same placed on file: "Be it and it is hereby resolved by the Public Utility Board of the City of Rochester, Minnesota that the Common Council of the said City be and is hereby requested to authorize the said Board to enter into a contract with the SOUTHERN MINiYESOTA SUPPLY COMPANY for the furnishing, in accordance with specifications on file, of ONE 100 H. P. 2300 Volt rotor mo.zor., the totel amount of the said contract to be TWENTY FIVE HUNDRED SEVENTY EIGHT DOLLARS AND NINETY FIVE CENTS ( $2-, 57g.95) and the said Southern Minnesota Supply Company being the lowest responsible bidder. 1t A letter from Mr. & Mrs. Ernest M. W., was read nd upon motion by Schroeder, second by Schwanke, the same was referred to the oard of Public Health & Welfare and the Public Utility Board. A letter from the Board of Park Commissioners requesting an additional' ppropriating in the amount of•$1,048.00 for air conditioning the .South Hall of the ayo Civic Auditorium was read and upon motion by Schroeder, second by Tingley, the same was referred to the Public Grounds Committee. A request from Edwin A. Tervo and James Isaacson for an off -sale liquor icense was read and the same was ordered placed on file. A petition signed by Dale D. J. Arbuckle to have Lots 21 and 22, Block 15 Northern Addition (203-10th•Street N. W.)-changed From a residential to a commercial zone was read together with a statement of acquiescence signed by 26 residents in that area. Upon motion by Anderson, second by Schroeder, the same was referred to the Board of Zoning. A petition signed by Herman Dornack and Goo. H. Ayshford to have Lots 140 15 and 16, Block Northern Addition changed from a residential to a commercial zone was read together with a statement of acquiescence signed by 14 residents An that area were each read. Upon motion by Schroeder, second by Moody, the same was eferred to the Board of Zoning. A petition signed by Ambrose P. Barry to -Have Lots 1 and 2, Block 1 Dashow's Sub -Division changed from a residential to a commercial zone and Lot 3, (Block 1, Dashow's Sub -Division changed from a residential to a multiple dwelling zone'was read together with a statement of gcquiescer_ce signed by Henry Younge. Upon motion by Sch-roeder, second by Anderson,- the same was referred to the Board of Zoning. A petition signed by Henry Younge , R. H. McDermott and 'A. P. Barry to !lave a 30 ft. alley located just north of Lots 1, 2, and 3, 'Block 1, Dashow's ub-Division vacated was read and upon motion by Schwanke, second by Schroeder, the same was referred to the Street & Alley Committee and the City Engineer. A letter from the State of Minnesota, Department of Highways, submitting copy of the plans of the paving on 4th Street in Rochester between Broadway and th Avenue Southeast, together with one plan for each bridge widening, was read and rdered placed on file. A letter from C,. A. Armstrong, City Engineer, requesting permission for imself, Mr. Moore and Mr. Eaton to attend the Public Works' Institute at the iversity of Minnesota Continuation Center for 2 days, March 26, 27, 1956 was read nd upon motion by Whiting, second by Moody, his request -was granted. The recommendation of the Street & Alley Committee that Mrs. Harden's reliminary plan of her Replat of Outlot 1, Stebbins Addition be approved with 1st treet Northeast entering onto llth Avenue Northeast as well as 13 Avenue Northeast 1 CJ 1 • 1 11 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 19, 19 56 6771 and that the seven (7) lots replatted in Cutlot 1, Stebbins Addition bear the entire cost of the improvements on 1st Street Northeast between llth Avenue Northeast and 13th Avenue Northeast was read and- upon motion by Schroeder, second by Anderson, the recommendation was approved. The recommendation of the Street & Alley Committee that the cost of all Improvements constructed in Jefferson.Slopes Second Addition be assessed in such a manner that each lot .shall bear an equal share of the total cost was read and upon motion by Anderson, second by Schroeder, the recommendation was approved. The following recommendation of the Street & Alley Committee was read • and upon motion by Schroeder, second by Tingley, the same was approved: 1111onorable Mayor & Common Council City of Rochester, Minnesota Gentlemen: We, the undersigned, recommend that the -proposed Service Drive on the east side of the Southwest Belt line between 5th Street Southwest and 6th Street Southwest be not constructed and that the Minnesota Highway Department be regizested to. delete .said construction from their construction plans for Sta.te Project 5502-15 (T.H.14) Ve further recommend that 5th Street Southwest from the west line of 16th Avenue Southwest to U.S. #52 be closed to traffic and the City Engineer be authorized to construct the necessary barricades to accomplisIr this purpose when the proposed highway construction is done. Respectfully, Street & Alley ( A. G. Whiting Committee ( Raymond C. Schroeder ( Albert J. Tingley" The recommendation of the Police Committee and Chief of Police that the bid of Leo N. Herrick & Sons in the amount of $1,993.90 be accepted for furnishing one Servi-Car Motorcylce for use in the Police Department was read and upon motion by Tingley, second by Schroeder, the recommendation was approved. The recommendation of the Public Grounds Committee that the bid of Runderll Lumber Company in the amount of $592.00 for acoustical work in the basement of the City Hall be accepted was read and upon motion by Schroeder, second by Tingley, the recommendation was approved. The recommendation of the Steering Committee on Parking and Traffic designating lst Street N. W. and 2nd Street N. 11. as a.one-way .mast and West pair - for movement of traffic was read and the same was tabled until the next meeting of the Council. The recommendation of the Street & Alley Committee and the City Engineer that the services of Mr. Gilbert H. MacMillan, co.nsul.tir_g engineer for the 7tr Street N. E. bridge, be continued in accordance with the contract, commencing. February 27, 1956 was read and upon motion by Whiting, second by Anderson, the recommendation was approved. The following recommendation of the Sewer Committee was read together with the City Engineer's report on costs and acreages of -proposed trunk line • 678 Record of Official Proceedings of the Common Council of the City of Rochester, Minn., March 19, 1996 sewer for I.B.M. Factory site. "Honorable Mayor & Common Council City of Rochester, Minnesota Gentlemen: In the matter of Trunk Line Sanitary Set•rer for the I.B.M. factory site, this committee has reviewed the drainage areas involved and estimated the costs of the two trunk lines under consideration. Ife recommend that the I.B.M. factory property be assessed as its share of a trunk line sewer brought to its boundary, an amount of $39,450• That the assessment be the same, whether the site is served by the so-called Fullerton Area Trunk Line or by a new trunk line constructed in the next drainage district in the north 2 of Sections 22 and 23. Schroeder moved that the recommendation of the Sewer Committee concerning the sanitary sewer connection with the proposed I.B.M. site be approved and that the City Engineer advise the proper engineering personnel employed by I.B.M. that the City prefers and recommends the construction of a, trunk line sanitary sewer over the Forth route and that the City will join in the cost of constructing the said trunk line sanitary sewer gver the North route and that I.B.M. be further advised that an assessment -in the approximate amount of $39,450.00 will be made %,Yhether the North route is used o-'a connection is made with the present Fullerton sewer as substantiated by computations of the City Engineer. Alderman Tingley seconded the motion and all voted in favor thereof, The report of the City rTreasurer for the month of Fobruary; 1956 -as read and the same was ordered placed on file. -The reports of the Clerk of Municipal Court for the week ending March 2, 1956 showing total criminal fines and costs collected $1,537.15 and civil fees received $5.10 and for the week ending March 9, 1956 showing total criminal fines and costs collected $919.55 and civil fees received $6.50 were each read and having been approved by the City Attorney, President Bach ordered the same placed on file.
