Minutes of a regular meeting.of the Common Council of the .City.of
Rochester, Minnesota, held in the Council Chambers in the City Hall, in said City,
Oil July 2, 19560
President Bach called the meeting to order at 2:00 o'clock p, m., the
following members being present: President Bach, Aldermen Anderson, Moody,
Schroeder, Ti:ng3e.y Whiting, 'V4lderman Schwanke arrived at 300 P. m.
Upon motion by Moody, second by Tingley, the minutes of the meetings of
June -1Sth, June '21st, June 22nd and June 28th, 1956 were approved.
Mr. Christy Obrecht, representing Olmsted County Agricultural Society
and the Olmsted 'County Fair Board, was present and requested permission to play a
°calliopell on the streets on July 2,3, and.4 for advertising a circus. A motion
was made by Alderman Schroeder that permission be granted for 16 hours each after-
noon and 1 hour in the evening on July 2, 3, and 4 and that they stay within a
reasonable distance. from the Hospitals and that this be a temporary permit and if
it becomes objectionable the City can immediately stop it. Alderman Anderson
seconded the motion and all voted in favor thereof, except Alderman Tingley,.wha
voted "no".
A representative of the Methodist Kahler School of Nursing was present
and requested permission to block off part of 2nd Street S.W. from the alley West
of the Damon Hot',,el to the Kehler corner during a proposed benefit carnival to be
held on October 6, 1956. A motion was made by Alderman Whiting that permission be
granted to block; off the North * of 2nd Street S. W. from the alley west of the
Damon Hotel to the Kahler correr. Alderman Schroeder seconded the motion and all
voted in favor thereof.
A petition to have a stop sign erected on llth Avenue Northeast at the
corner of 7th Street Northeast signed by 42 residents in that area was read. Mr.
C. V..McKinney of 1101 - 7th Street Northeast was present and urged that the Counci
act on this as soon as possible. A motion was made by Alderman Schroeder that the
matter be nferred to the Police Committee and the Chief of Police and they give
special consideration to some other device than stationery type of stop sign.
Alderman Anderson seconded the motion and.all voted in favor thereof..
The recommendation of the Board of .Zoning that the petition to have the
following property changed from a multiple dwelling zone to a commercial zone be
rejected was read: Joe Cozik, 1000 2nd St. S.W.; Walter 0. Paine, 849-2nd St. S.W.;
Mary L. Crofoot,', $92142nd St. S.W.; A. J. Hall-723-2nd St. S. W. ;. Mrs. Esther
Spring, 713-2nd Street S.W.; Mrs. J.E.Domke, 907-2nd Street S.W.;.Grant and Irene
Culver, 913-2nd Street S.W.; Charles Drubs, 813-2nd Street S.W.; Theodore F. Franke,
913-2nd Street S.W.; Mary Butler, 903-2nd Street S.W. and W. H. Ziehms,empty lot.
A motion was made by Alderman Schroeder, second by Alderman Tingley, that the
report of the Board of Zoning be accepted and a public hearing was ordered to be

held at 7:30 P. m. on Monday, July 16, 1956. All voted in favor of the motion.
Alderman Schwanke arrived at 3:20 p. m.
The following letter from the Planning and Zoning Commission was read:
"Hon. Claude H. McQuillan, Mayor
and the Common Council of Rochester
Gentlemen:
Mr. Ed Rundell appeared before this Commission last_ evening
in regard to his Plat at loth Ave. S. W.
• . After discussion, it was the opinion -of this Commission;
that.they do not feel that they can honestly accept or recommend
the acceptance, of this plat, feeling it would be unwise to ignore
the provisions for a culdesac. The Commission also is reluctant
to recommend plats with street widths less than 60 'feet. We also
feel that any plat should provide the space for sidewalks. But,
if the Common Council should see fit to vary from this procedure
in this peculiar instance, this Commission would liki to recommend
that the Council make provisions for an egress into the alley, in
place of a culdesac; that Mr. Rundell stipulate in deeds to the
property, that each dwelling would be required to have a two car
wide drive way (19 feet); and that also some provision be .established
for some type of sidewalks in the area.

Mr. E. A. Rundell was present and discussed with the Council the matter of requiring
an 18 foot drive into each driveway, dedicating a turnaround or dedicating a rite -
of -way for the purpose of egress and ingress. After discussing the matter a motion
was made by Alderman Schroeder that the report of the Planning and Zoning
Commission be tabled. Alderman Whiting seconded the motion and upon roll call all
voted in favor thereof, except President Bach who voted Uno".
A notice of appeal in, the matter of the petition for change of zoning
real estate described as lots Nos. 1 and 2 in Block No. 25 of the Northern Addition
to the town, now City, of Rochester, Minnesota, was read. Mir. George Kerr, Attorney
representing E. J. Hand, Trust Officer of the Olmsted County Bank and. Trust Company,
guardian of the estate of Maggie Phillips, incompetent, was present and urged that
the Council reconsider their action in rejecting the requested zoning changes.,
Alderman Whiting then moved to rescind the action of the Common Council taken on
June 19, 1956 denying the petition of E. J. Hand, as guardian of the estate of
Maggie.'Phillips, Incompetent, to rezone Lots 1 and 2, Block 25, Northern Addition.
Alderman Tingley seconded the motion and upon roll call Aldermen Anderson,
Schroeder, Tingley and Whiting voted in favor of the motion and President Bach
and Aldermen Moody and Schwanke voted "no".
Aldermen Schroeder then moved that a hearing be set for: 7:30 P. m. on
July 16, 1956,on the request for the change of zoning of Lots-1 and-2, Block-25,
Northern Addition. -.Alderman Anderson seconded the -motion and all voted in favor
thereof.
President Bach. stated. this as being the time and place set for the
ollowing hearings:

Plummer's Lane in Belmont Slopes Second Addition. There was no one present
wishing to be heard.
First hearing on. the grading, base construction and bituminous surfacing
on Plummer°s Lane' in Belmont Slopes Second Addition. There was no one present
wishing to be heard.
First hearing on the construction of a sanitary sewer in 3rd Avenue
Northwest from a 'point 761 North of the South line of Outiot 14 Northern Addition
to the north line of Outlot 4, Northern Addition. The following letter from
L. A. Kopp was re' 'ad:
uTo the Common Council of the City of.Rochester, Minnesota:
Thel undersigned, as owner of property affected thereby, as you
know, on several occasions appeared before your body and protested
the matter of the proposed special assessments for the sewer project
adjacent to the Crenlo Plant in the City of Rochester. While there
is no objection to the installation of the sewer and no desire to
cause any inconvenience or trouble. to the. Crenlo Plant or anyone
benefited by the installation of the sewer, some of us feel that
the manner of assessment is contrary to the city charter and the
law, arbitrary and unreasonable.
We,think there can be no question that the sewer is being
installed primarily to eliminate a health hazard created by the
Crenlo Plant andthat it will be the chief beneficiary thereof.
What we object to, as the owners of the abutting lots adjacent
to the .Crenlo Plant, is the .manner in which the Crenlo proportion of
the cost', is being distributed; that is over the entire project. We
feel that it should be distributed over that part of the sewer in
front of and adjacent to the Crenlo Plant. If this is not done.
it places a burden upon the adjoining property entirely out of
proportion to the benefit received. It is well known that the
topography of premises effected and the presence of rock formation
make this a very expensive project at that particular section of
the sewer. It Mould seem that any sum paid by Crenlo for this
improvement should be applied in the construction costs at that
place.

Upon motion by Whiting, second by Schroeder, the matter was referred to the:.Sewer
Committee and the,. City Engineer for study and recommendation. All voted in favor
of the motion.
The following resolution adopted by the Public Utility Board was read
and President Bach ordered the same placed on file:
uBa it and it is hereby resolved by the PUBLIC UTILITY
BOARD - of,!: the CITY OF ROCHESTER, MINNESOTA, that the COMMON COUNCIL
of the said City be and is hereby requested to authorize the said
Board to,enter into a contract with the WOODRUFF COMPANY for the
f urnishing,.in accordance with specifications;
1,1400 feet 101 Class 150 Cast Iron Pipe
the total amount of the said contract to be FIVE THOUSAND FOUR HUNDRED -
FORTY -SIX DOLLARS ($5,14146.00); the said WOODRUFF COMPANY being the.lowest
responsible bidders
A letter, from the Planning and Zoning Commission recommending that the City
adopt as a matter,of policy, that provisions be made for future public sidewalks
within the street right-of-way on all new plats was read and President Bach ordered
the same placed on file.
A letter from the State of Minnesota, Department of Health, transmitting
copies of the report of the Municipal Water Supply Section covering an examination
)
of plans on watermain extensions in the City was read and President Bach ordered
the same placed on file.

A letter from the State of Minnesota, Department of Highways, acknowledg-
receipt of the Council's resolution of May 21, 1956, requesting a crossing at 5th
Street Southwest, and stating that same had been referred to their District
Engineer for review and recommendation and the Council would be notified as to
their decision, was read and President Bach ordered the same placed on file.
A letter from the 'United States Conference of Mayors inquiring if Mayor
McQuillan would be attending the Canadian Conference of Mayors to be held at
Hamilton, Ontario from August 20 to 23rd was read. A motion was made by Schwanke,
second by Tingley, that the Mayor be authorized to attend the Conferance of
Mayors to be held in Hamilton, Ontario from August 20 to 23rd and that $199.99 be

be appropriated from the General Fund for expenses. All voted in favor of the
motion except Alderman Schroeder, who voted "noel.
A letter from Howard H. Smith, Secretary and Business Representative of
The Rochester Building and Construction Traaes Council, stating that it was the
feeling of the organization that the approaches to the bridge and streets be filled
and graded at once so that the bridge will be in use this fall and winter, if
possible, was read and upon motion by Whiting, second,By Schroeder, the same was
referred to the Street & Alley Committee and the City Engineer. All voted in
favor of the motion.
A petition to have the South 60 feet of North, 276 of Lot 22 and the West
82 feet of Lot 25, Auditor's Plat "An (420 - llth Avenue S. E.) signed by William
M. Pan Hook was read and upon motion by Schwanke, second by Moody, the same was
referred to the Board of Zonih:g. A11 voted in favor of the motion.
The petition that a sanitary sewer be constructed to servo Block 2,
Dresbach's Addition; that a sanitary sewer be constructed in 15th Avenue Southwest
from the South line of Dresbach's Addition to 160 ft. north of 7th Street Southwest;
that a.sanitary sewer be constructed in 14th Avenue Southwest from 7th Street
Southwest to 9th Street Southwest; that a sanitary sewer be constructed in 9th
Street Southwest from 14th Avenue Southwest to 13th Avenue Southwest; that a
sanitary sewer be constructed in 14th Avenue Southwest from U. S. i�52-14 to 9th

Street Southwest and that a trunk line sanitary sewer be constructed from the.West
and of lli Street Southwest in Baihlyls First Addition to the Southend of 15th
Avenue Southwest in Dresbach's Addition were each read. 'Upon motion.by Moody,
second by Schroeder, the said petitions were referred to the Sewer Committee and
the City Engineer.
The preliminary estimate submitted by the City Engineer for the construct-
ion of a storm sewer from 14th Street Northeast to Silver Lake along the West line
of Leitzen's Second Addition was read and President Bach ordered the same placed on
file.

given to the City of Rochester by the Rochester Baseball Association covering
the advertising sign acrosss 2nd Street Southwest was read and President Bach
ordered the same'! placed on files
A letter from Rs B. Milam, Secretary of the. First Presbyterian Church
asking for clarification of the status of the -alley leading from Sixth Avenue
Southwest east to the church parking lot was read and President Bach ordered
same placed on file,, and the City Attorney was instructed to check with the
Register of Deeds.
The recommendation of the Street & Alley Committee that the procedure
be started for the vacating of the alleys in Blocks 18, 19, 22 and 23, Cummings
Addition and that the petitioners for said vacating be required to submit satis-
factory replat of these blocks before final vacating action is taken was read.
Upon motion by Whiting, second -by Schwanke the same was referred to the City
Attorney to check with the Register of, Deeds as to whether or not.the alleys are
vacated and if same are not vacated, then upon submission of a satisfactory replat
the City Attorney is instructed to prepare a resolution to commence proceedings
to, vacat3 All noted in favor thereof except Alderman Tingley, who voted nno°.
The recommendation of -the Street & Alley Committee that the concrete
paving of the North and South alley in Block 21 Northern Addition be done and
that the first hearing be held and if the construction is approved that the same
be programmed for 1957, was read.- Upon motion by Whiting, second by Tingley, the
recommendation was approved.
The recommendation of the Street & Alley Committee that a curb and gutter
be constructed on Sth Avenue Northwest from 14th Street Northwest to the South
line of Washington Sub -Division was read. 'Upon motion by Tingley, second by Moody;
the recommendation was approved.
The recommendation of the Street & Alley -Committee that a curb and gutter
be constructed on the south side of Graham Court Southeast, East of 15th Avenue
Southeast was read. Upon,motion by Tingley, second by Whiting, the recommendation
was approved.
The recommendation of the Street & Alley Committee that a curb and gutter
be,constructed on 16th Avenue Northwest from 14th Street -to 16th Street Northwest
and on the Nw th side of 14th Street Northwest; and the South side of 16th Street
Northwest from a, block east of 16th Avenue Northwest to 3* block west of 16th
Avenue Northwest, all in Bielenberg & Giese Third Addition was read. Upon motion
by Whiting, second by Anderson, the recommendation was approved.
The recommendation of the Street & Alley Committee that a curb and gutter
be constructed on the North side of 6th Street Southwest fronting Dots 1, 2, 3 and
4 of grofchalk's First Addition, was read. Upon motion by Moody, second,by Tingley

the recommendation was approved.
The recommendation of the Street & Alley and the Sewer & Water Committees
that the request of Bert & Ellen Leitzen, owners of Leitzen's Fourth Addition to
do their own grading, base construction and bituminous surfacing and construction
of sanitary sewer, watermain, storm sewer and sanitary sewer and dater service
connections -under the supervision of the City Engineer on 14th, 15th, and 16th,
Street Northeast and 4th Avenue Northeast be granted was read.• Upon motion by
Anderson, second by Moody, the recommendation was approved.
The recommendation of the Street & Alley Committee that Tony Herold be
granted permission to construct curb and gutter, at his own expense, on the north
•
side of his property at 1302 14th Street Northwest (Lot 1,.Block 8, Gooding's
Addition), said construction to be done by a licensed concrete contractor and.,
under the supervision of the City Engineer was read. Upon ,motion by Moody, second
by Whiting, the recommendation was approved.
The recommendation of the Police Committee and the Chief of Police. that
Andrew J. McCrudden be appointed to the position of Meter Maintenance Man to_ fill
a new position created by the Common Council was read. Upon motion by Schwanke,
second by Whiting, the -recommendation was approved,
The recommendation -of the Board of Zoning that the petition of Lloyd
Paszek to have Lot 1, Block 33, Northern Addition (904 North Broadway) changed
from a residential to a .commercial zone was read.. Upon motion by Tingley, second
by Whiting the recommendation of the Board of Zoning was accepted and a hearing
is set on the said change of zoning for July 16th, 1956.
The Mayor's appointment of Mr. E. H. EApp to the Board of Health &
Welfaro, term to, expire the second Monday. of April, 1959 was reed and upon motion
by Whiting, second by Schroeder, the appointment was approved.
A letter from Mr. -A. J. Haas, Secretary of the Firemen's Civil Service
Commission submitting the following names for appointment for the vacancies for
firemen was read together with a recommendation from the Fire Committee approving
the appointments of the said firemen and also the appointment of Orville Mertz
•
and Robert Laack as Captains which had been previously submitted by the Firemen's
Civil Service Commission. A motion was made by Schwanks, second by Anderson that
the certification of the eligible by the Civil Service Commission be approved and
that the men therein be appointed to the positions indicated. All voted in favor

The application of Vet8s Cab Company for the transfer of a 1953 Chevro-
let 4 door to a'19.56 Ford 4 door was reado Upon motion by Anderson, second by
Whiting, the transfer was granted.
The application of Theatre Management Company (Rochester Outdoor Theatre)
f.or a theatre license was read. Upon motion by Anderson, second by Whiting, the
license was granted.
The application of Lysne Construction Company for a permit to move a
building 208 x 428 from 1520 Sth Avenue Northwest out of the City Limits was
read. Upon motion by Whiting, second by Moody, the permit was granted upon report
from the Building Inspector and the Chief of Police as to the feasibility of the
'route.
The official bonds of Harold R. Wiesener and Merlin Mewhor-ter, Jr. in
the amount of $500,00 with the Fidelity and Casualty Company of New York as surety
and the license- -'bo-ad -of Velie-Ryan, Inc. in the -amount of $1,'000.00 with the
Vestex•n Surety Company as surety were each read and upon motion by Whiting, second
by -Tingley, the bonds were approved, the surety thereon accepted and the same were
ordered pla-ced on file.
Th,e .contract bonds of Leon Joyce (2) in the amounts of $3,100.66 and -
$22,123.0,0 with ;the Seaboard .Surety Company as surety; -and Carlisle G. Fraser (5)
in the amounts of $9,391.40, $9,258.60, $2.223.10, $1,766.60 and $27,669.00- with
the Federal Insurance Company as.surety were each read and the same were referred
to' the Mayor fore, his approval.
The reports of the Clerk of Municipal Court for the week ending June 22,
1956 showing total criminal fines and costs collected $1,963,40 and civil fees
received $7.45; and for the week ending June 29, 1956 showing total criminal
fines and costs collected $1,874.67 and civil fees received $6,25 were each read
and having been approved by the City Attorney, President Bach ordered the same
placed on file.
The reports fok the month of June of the Building Inspector showing fees
collected for building permits issued $411.00; of .the Electrical Inspector showing
fees collected for electrical permits issued $146,25; of the Plumbing Inspector
showing fees collected for plumbing permits issued $45.00; of the Heating Inspector
showing fees collected for heating permits issued $239,25 and fees collected for
sign permits $6311 were each read and President Bach ordered the same placed on
file.
The following resolutions were each introduced and read:. and President
Bach declared the same duly passed and adopted:
Resolution ordering bids for the installation of sirens in seven (7)
,riven locations in the City of Rochester. Minnesota. Upon motion by Anderson,
second by Moody, !,resolution adopted.

y Q lan called the Council s attention to newly enacted federal
legislation for',,highway and water pollution.control programs and recommended that
a 6^tudy be made as to whether the City can obtain financial aid under.these
measures and the procedures involved in obtaining same. A motion was made by
Schwanke, second by Whiting., that the Mayor and City Attorney be instructed to
investigate and report on the possibility of attaining such assistance. All voted
in favor of the motion.
Mayor'124cauillan asked the Coun-cil to consider a high school area
arrangement ia'=which students from District 58, which is 1.4 miles from the City,
attend school at Byron. He stated parents in District 58 had asked for help in
this problem and he recommended that the matter be studied. The matter was dis-
cussed but no action was taken.
Alderman Schwanke moved that the City Attorney be instructed to purchase
the latest Minnesota Statutes, published by the State of Minnesota, and that a
cabinet with a lock be constructed in the Council Chambers for same and the key be
given to the City Attorney. Alderman Tingley seconded the motion and all voted
In favor thereof. -
President Bach declared a recess at 6:00 p. m.
A motion was made by Alderman Whiting, second by Alderman Moody, that
Alderman Schroeder act as President pro ten and upon roll call all voted in favor
thereof.

Upon motion by Anderson, second by -Tingley, and upon roll call and all voting
in favor thereof, the rules were suspended and the ordinance was given its second
reading.
Upon motion by Moody, second- by Schwanke, and upon roll 'cal"1 and all voting
in favor thereof, the rules were suspended and the ordinance was given it's third
and final reading.
Upon motion by Schwanke, second by Tingley, that the said ordinance be adopted
as read, and all voting in favor thereof, President pro tem'Schroeder, declared the
said ordinance duly passed and adopted.
A petition signed by J. J. Thornton, Plant Coat roller Rochester International
Business Machines Corproation, to have their property changed from a residential to
an industrial zone was read and upon motion by Tingley, second by Whiting, the same
was referred to the Board of Zoning.
Upon motion by Schwanke, second by Tingley, the Board of Zoning was requested
to have a meeting this week .and when their recommendation has been submitted, the
Mayor is requested to call a special meeting of the Common Council. A11'voted in

The request of Henry J. Giese and John Bielenberg to constructtheir own
curb and gutter on both sides of 16th Avenue Northwest from 14th to 16th Street
Northwest, on thie north side of loth Street Northwest extended to Lot 26, Block 3,
Bielenberg & Giese Third Addition and on the south side of 16th Street Northwest
extended to Lot'14,. Block, 3, Bielenberg & Giese Third Addition was read. Aldermax
Whiting, Chairman of the Street & Alley Committee, verbally reported that it was
the recommendation of the Street & Alley Committee that they be allowed to do their
own work under the supervision of the City Engineer. Upon motion by Whiting,
second by Moody,, the verbal recommendation was approved and the City Attorney was
instructed to prepare a.contract for Bielenberg & Giese to do their own work and
the Mayor and City Clerk were authorized to execute same. All voted in favor of
the motion.
A resolution authorizing and directing the Mayor and City Clerk to
execute a contract between the City of Rochester and Charles R. Hutchinson for the
construction of certain improvements in Northgate Addition was read. Upon motion
by Tingley, second by Anderson, resolution adopted.
A claim in the amount of $3. 50 from Don Kepp for oil sprayed on his car
was read and upon motion by Moody, second by Schwanke, the same was referred to the
City Attorney.
An Ordinance amending an ordinance entitled, "An Ordinance of the purpose
of promoting health, safety, order, convenience and general welfare by regulating
the use of land,' the location, size, use and height of buildings, and the
arrangement of buildings on lots, and the density of population, within the City
of Rochester, .Minnesota, all in accordance with a comprehensive plan(changing
Lot 3, Dashow's Sub -Division to multiple dwelling district and changing Lot 3,
Bilmar Addition and Lots 1 and 2, Dashow's Subdivision to commercial district)"was
given its first reading.
A resolution declaring Council intention to annex certain lands presently
surrounded by City land and owned by Ethel G. Kennedy and Mary E. Rinke was read.
Upon motion by Anderson, second by Whiting, resolution adopted.
Mayor McQuillan stated that exchange students from 21 different count@s
were going to arrive .in Rochester on Tuesday, July 3rd and that he was going to
meet them at about 9:15 a. m.. on the outskirts of the City together with a police
escort and anyone who wished to go along could do so,
Alderman Tingley brought up the matter of the condition of the retaining
south wall across the Zumbro river behind the Norton Hotel. President pro tem
Schroeder referred the same to the Street & Alley Committee.
Mr. Catl F. Petersen, owner of Vets Cab Company, was present and inquired
what was going to be done about taxi stands and if it is legal for the City to
designate what streets can be used and by'whom. He also questioned if a vehicle

that is operating with a city taxi license should not comply to the city taxi rates.
President pro tem Schroeder referred these questions to the City Attorney for an
(opinion,
Mayor McQuillan stated that the employees of International Business
Machines Corporation at 11 - 4th Street Southeast had•no,place to park their cars
and would like to have approximately six parking spaces. He was inforeded-that no
parking spaces in the lot behind their store were being rented on a monthly basis
but the City Attorney was instructed to check the lease on the said parking lot
behind the store.
Upon motion by Anderson, second by Moody, the meeting was adjourned until
7 : 30 p, m. on Monday, July. 16, 1956.
