A motion was made by Schwanke, second by Whiting, that Alderman Schroeder act as .President pro tem. All present voted in favor of the motion, President -pro tem Schroeder called the meeting to order at 2:00 p. m., the following.members being present: President pro tem Schroeder, Aldermen Schwanke, Tingley, Whiting. Absent: President Bach, Aldermen Anderson and Moody. Upon motion by Schwanke, second by Tingley, the minutes of the meetings of July 16th and July 23rd, 1956 were approved. President pro tem Schroeder stated this as being the time and place set for the following hearings: First hearing on the concrete paving of the north and south -alley in Block 21, Northern Addition: There was no one present wishing to be heard. First hearing on the construction of a sanitary sewer in 5th Avenue N.W. from llth Street N. W. to a point 176 feet south of the center line of 14th Street U.. W. and a section of the NW -SW trunk line relief sewer from 14th Street N. W. to loth Street N. W. There was no on present wishing to be heard. First hearing on construction of sanitary sewer and trunk line sewer in the following locations: (1) Block 2, Dresbach's Addition. (2) East side of 15th Avenue S. W. from the south line of Dresbach's Addition north to a point 110 feet north of the north line of 7th Street S. W. (3) 14th Avenue S. W. from 7th to 9th Street S. W. (4) 8th Street S. W. from loth Avenue S, W. to the east line of Parkin's Sub -Division (5) Trunk Line sewer along the east side of U. S. Highway No. 52 from 114 Street S. W. to 15th Avenue S. W. Mr. G. H. Glinke of 907 -14th Avenue Southwest was again present and stated that he would like to connect to the City sewer when same is constructed and that he was also interested in annexing to the City. Mr. Ralph Hayes, Mr. Frank Evangelist, Mr. Ralph Schultz and Mrs. Florence Jameson, residents of Collegeville Addition, were present and stated that they were against annexing their property to the City. President pro tem Schroeder told them that this hearing was only for the construction of a sewer and had nothing to do with annexation. Second -hearing on construction of a curb and gutter on the south side of Graham Court Southeast, east of 15th Avenue Southeast. There was no one present wishing to be heard. Second hearing on construction of a curb and. gutter on Sth Avenue N. W. from 14th Street N. W. to the south line of Washington Sub -Division. There was no one present wishing.to.be heard. President pro tem Schroeder stated this as being the time and place set for receiving and opening bids for the following projects: Bids for construction of a sanitary sewer in 3rd Avenue Northwest from a po$nt 76 feet north of the south line of Outiot 4, Northern Addition, to the s north line of Outlot 4, Northern Addition. The bid of Carlisle G. Fraser in the amount of $2,947.25 was received and opened and upon motion by Whiting, second by Schwanke, tl%e same was referred to the Sewer Committee and the City Engineer for tabulation and report. Bids for construction of a curb and gutter on 6th Street Southeast from the bridge to 10th Avenue Southeast. The bids of C. M. Boutelle & Sons in the amount of $1, 4612.,45, Doyle Conner Company in the amount of $1; 46-2—,45 and H. T. Earle Sr. in th'e amount of $1, 542.30 were each received and opened and upon motion by Whiting, second by Schwanke, the same were referred to the Street & Alley Committee and the City Engineer for tabulation and report. Bids for construction of a curb and gutter on 6th Street Southwest fronting Lots 1, 2, 3 and 4 of. grofchalk's First Addition. The bids of. Doyle Conner in the amount of $1, 211.96 and C. M. .Boutelle & Sorts in the amount of $1,223.75 were each received and opened and upon nation by Whiting, -second by Schwanke, the same were referred to the Street & Alley Committee and the City Engineer for tabulation and report. Bids for construction of a curb and gutter on Sth Avenue No W. from 14tb Street Northwest to the south line of fashington Sub -Division. The bids of C. No Boutelle & Sons in the amount of $2,617.50 and Doyle Conner.Company in the amount of $2,675.92 were each received and opened and upon motion by Whiting, second by Tingley, the same were referred to the Street & Alley Committee and the City Engineer for tabulation and report. Bids'for construction of a curb'a.nd gutter on the south side of Graham Court Southeast, oast of 15th Avenue Southeast. The bids of H. T. Earle Sr. in the amount of $1,710.88, C. M. Boutelle & Sons in the amount of $1,716.63 and Doyle Conner Company in the amount of $1,715.43 were each received and opened and upon motion by Whitib:g, second by Schwanke, the same were referred to the Street & Alley Committee and the City Engineer for tabulation and report, A letter from the Minnesota Organization of Blind,` Inca requesting per- mission to conduct their annual White Cane Drive on Thursday a.nd Friday, August 0 18Record of Official Proceedings of the Common Council of the City of Rochester, Minn., Augus t 6. 19 56 • 23rd and 24th and also permission for use of a small area in the basement of the City Hall for head -.quarters was read. Upon motion by Tingley, second by Whiting, their request was granted. A letter from Ralph Ellingwood requesting that the Council consider selecting him to do the work if the Council decides to publish an annual City report -was read. A motion was made by Whiting, second by Tingley, that a committee of two (consisting of the Mayor and Alderman Schroeder) be appointed to explore I the feasibility of such:a report and present 'their. findings to the Council. All present voted in favor of the motion, A letter from Bert Alexander, Jr. requesting that he be considered for the granting of •an off -sale liquor license in the event the City grant more licenses was read and the same was ordered placed on'file and the City Clerk was instructed to notify him that his application had been placed on file. A letter from C. C. Ludwig, Executive Secretory of the League of Minnesota Municipalities, addressed to Mayor McQuillan and requesting that the City of Rochester be host to one of the League's regional meetings this fall (on October is, I1956) was read. A motion was made by Whiting, second by Tingley,. that the Mayor land City Clerk be instructed to emend a formal invitiation to the League to hold ithe said regional meeting in Rochester. All, present voted in favor thereof. A letter, from Libby, McNeill and Libby requesting permission to attach their private sanitary sewer line to the City sewer in the fairgraound property was read and upon motion by ,Schwanke, second by Whiting, the same w.a.s referred to the Sewer Committee and the City Engineer. A letter from Gilbert H. MacMillan certifying that he had made a personal final inspection of the 7tr Street Northeast bridge and that the work is acceptable was read and President pro tem Schroeder ordered the same placed on file. The.following letter from the Planning and Zoning Commission was read and upon motion by Whiting, second by Tingley, the same was referred to the Survey Committee: OTI�e Survey Committee of The Common Council of Rochester Gentlemen: t In the last several weeks, there has been much discussion about the Art Center locating in Mayo Park. It has been brought up in our meetings, and by Tom Moore, that it would be very well for the City to consider a'cultural center, one that is within walking distance to. the downtown area, but yet far enough out so that it would not interfere with each other, Mayo -Park, over the years, has been gradually changing and at this time, probably offers the best opportunity for a cultural center. I should probably emphasize that I am talking about the Mayo Park and vicinity, and not about the Mayo Park as it exists at this time, I believe that the first decision in this matter should come from the Council, If you believe that Mayo Park or some other area close to the center of town, should be developed into a cultural center, then you could indicate your wish to the Park Department that you would be interested in the development of the area as a cultural civic center (music, art, stage and historical), and that you delegate to the Park 1 1 • • 1 1 0 Record of Official Proceedings of the Common Council • of the City of Rochester, Minn., Augus t 6, 1956 1 • • 1 Department, or some other group, recommendations as to the nature and extent of these activities to be considered. This group would then report back to the council and the council could then either adopt, revise or reject the recommendations. If you adopt the recommendations you should authorize the planning of the area so that the Art Center, which appears to be ready to build a building, know in which location they are to place their particular building. Otherwise groups should, as for example the Historical group, then go ahead and over a period.of time, develope and raise the money necessary for their structure. The Planning Commission is.always willing to help in any manner possible, any of these projects of a civic nature. We are very interested in any situation such as a cultural center from the standpoint of traffic flow and parking problems. Very sincerely, Donald L, Grue, President Planning and Zoning Commission" A letter from the Rochester Central Area Improvement Association request- ing that the Council instruct the City Aotorney to draw an amendment to the ordinance in question so that benches and possibly trees could be placed on the boulevards in certain locations and. again offering to furnish benches .to be placed in strategic locations in the Downtown Area for the comfort and use of indigent and aged people -and/or the general public was read. A motion was made by Whiting, second by Tingley, that the same be referred to the Council as a Committee of the Whole. All present voted in favor -thereof, except Alderman Schwanke, who voted 'In,0. A letter from the League of Minnesota Municipalities calling the a.ttenti'n of the Council to their eligibility for direct city membership in the American Municipal Association, with an annual fee of $100.00, was read and upon motion by Whiting, second by Tingley, the same was referred to the Budget Committee. The four following preliminary estimates presented by the City Engineer were each read and President pro tem Schroeder ordered the same placed on file; Construction of a curb and gutter on 6th Street Southeast from the bridge, to 10th Avenue Southeast in the amount of $1,371.95; Construction of a curb and gutter on the south side of Graham Court Southeast, east of 15th Avenue Southeast in the amount of $1, 551,07; Corstraction of a curb and gutter on Sth Avenue Northwest from 14th Street Northwest to the south line of Washington Subdivision in the amount of $2,417,90 and Construction of a curb and gutter on the north side of 6th Street Southwest fronting on Lots 1, 2, 3 and 4 of Krofchalkts First Addition in the amount of $1,043,85, A letter from the State of Minnesota, Department of Highways, forwarding an approved copy of the Cooperative Agreement covering the work on T. H. 63 was read and President pro tem Schroeder ordered the same placed. on file. A letter from the Rochester Fire Department Relief Association asking permission to grant a loan to Haven Fritsche on his property at 530 - 3rd Avenue �T. W. in the amount of $6, 500.00 which had been approved by their Board was read and upon motion'Iby Tingley, second by Whiting, the same was approved. A letter from the State of Minnesota, Water Pollution Control Commission, transmitting approved plans for sewera.ge'fa.cilities in Bielenberg & Giese Third Addition and on,lst Street Northeast from.13th Avenue Northeast west 512 feet was read and President pro tem Schroeder ordered the same placed on file, 0 r 186 Record of Official Proceedings of the Common Council Augus t 6 19 55 of the City of Rochester, Minn., , • A petition for construction of•a curb and gutter on.12th Avenue Southeast from Sth to 9th Street Southeast was reed and upon motion by Whiting, second by Schwanke, the same was referred to the Street & Alley Committee and the City Engineer. A petition signed by Henry J. Giese, John Bielenberg and William Bielenberg to have Lot 2, Block 2; Lot 25, Block 2; Lot 2, Block 3; Lot 25, Block 3 and the blaance of Block 4 that is not already zoned commercial all in Bielenberg & Giese Third Addition changed from a residential to a multiple dwelling zone was read and upon motion by Whiting, second by Tingley, the same was referred to the Board of Zoning. • A claim in the amount of $25.50 of Walter R, Pates for damage to his trousers torn on a trash can in front of Huey's Cigar Store was read and upon motion by Schwanke, second by Whiting, the same was referred to the City Attorney. Mr. Dave Bach, representing the Rochester Central Area Improvement Association, was present and stated that their organization was in favor of the assessment program as set up b.,-the Council. Also a letter from K. J. Ladner, Chairman of the Steering Committee on Parking and Traffic, recommending that the assessment policy be supported as the first step in a permanent street improvement program was read and President pro tem Schroeder ordered the same placed on file. A letter from R. V. Ehrick, City Attorney, stating that he had contacted Mr. Tom Moore, Register of Deeds -in and for Olmsted County, concerning the status of the East -lest alley in Block. 15 of Head & McMahon's Addition and the alleys in Blocks 19, 19., 22 and 23 in Cumming's Addition and that the Register of Deeds had advised him that there is nothing in the records of his office .to indicate that any of.the aforesaid alleys have been vacated was read. Upon motion by Whiting, second by Schwanke, the City Clerk was instructed to notify the Presbyterian Church of the findings, The following letter from R. V. Ehrick, City Attorney, was read and upon motion by Schwanke,' second by Whiting, the same was referred to the Police Committee, • all present voted in favor thereof, except Alderman Tingley, who voted "no". '"Honorable Common Council of the City & Rochester City Hall Rochester, Minnesota Gentlemen: Pursuant to your request, the undersigned has checked certain matters concerning the Rochester Yellow Cab Corporation and its operation in the.City under general taxi cab franchise and under a certificate issued by the Railroad and Warehouse Commission to transport passengers to the Rochester Airport over an established route. . The Railroad and Warehouse Commission has granted the Rochester .Yellow Cab Corporation a Certificate to operate as an auto trans- portation company in the transportation of passengers between Lobb Field, the Rochester Rirport, and points in downtown Rochester over the following described route, with service to be limited to hotels and hospitals and the Clinic along its route, and the airport: From the Airport'on 4th Avenue to 12th Street, on 12th Street to South Broadway, on South Broadway to S.W. 3rd I - • Record of Official Proceedings of the Common Council • of the City of Rochester, Minn., August 6, 1956 I �� 1 1 CJ • 1 Street, west along S. E. to',.2nd Street S, W., thence along the river to 3rd Street S.W. and west along 3rd Street S.W. to South Broadway, north on South Broadway to 2nd Street S. W. and return. A one-way fare of 60 cents per passenger is authorized for .all passengers picked up and transported over the authorized route. All passengers picked up by taxi cabs of the Rochester Yellow Cab Corporation either off the established route or at.points on the established route where stops are not authorized and transported to the.Airport should be charged according to the taxi cab rate scheduled established in the franchise ordinance and not according to thelrate authorized in the Commission's order, With respect to the question of whether vehicles of the Rochester Yellow,Cab Corporation can carry both a Railroad and Warehouse Commission permit and also a City taxi cab license, I can find nothing in the law which prohibits this. 'With respect to the question of whether the Common Council has authority to designate cab stands on the public streets for the exclusive use of either the Vets Cab Company or the Rochester Yellow Cab Corporation, it is still the opinion of the undersigned that the Common Council has such authority. The following letter addressed to Mayor McQuillan was read and upon motion by Schwanke, second by Whiting, the same was referred to the Mayor, the Police Committee and the Fire Committee: "Mayor' Claude H. The reports of the Cierk of Municipal' Court for the week ending July 20, 1956 showing total criminal fines and costs collected $1,076.00 and civil fees received $7.15; for the week ending July 27, 1956 showing total criminal fines and costs collected $950.00 and civil fees received $9.75; and for the week ending August 3, 1956 showing total criminal fines and costs collected $1,503.00 and civil fees received $5.10 were each read, and having been approved by the City Attorney, President pro tem Schrodde.riordered the same placed o.n file. The recommendation of the Street & Alley Committee that in the matter of the petition by the Kruse Company to vacate a portion of 2nd Avenue X. E. (formerly Cresent St.) that the committee recommends that the petition be granted provided that the provisions of Section 212 of the Charter be invoked was read and upon motion by Schwanke, second by Whiting, the recommendation was approved. The recommendation of the Street & Alley Committee and the City Engineer that the offer of C. H. Boutelle to dedicate to the City 16th Avenue Northeast from 'nth Street Northeast to 5th.Street Northeast be accepted, upon the condition that Mr. Boutelle petition for the grading, base and bituminous surfacing of said street or contract with the City to construct the street at his expense, was read and upon motion by Tingley, second by Whiting, the recommendation was approved. The recommendation of the Street & Alley Committee and the City Engineer that the Edwin A. Rundell, Jr. parcel petitioned on July 23rd be annexed to the City with the understanding that the City cannot serve said parcel with sanitary sewer from existing mains was read and upon motion by Whiting, second by. Schwanke, the recommendation was a;�proved. The recommendation of the -Street. & Alley Committee that on the proposed Iconstruction on the extension of Plummer's Lane in Belmont Slopes 2nd Addition, that the assessments for the local improvements be levied as follows, was read and upon motion by Schwanke, second by Whiting, the recommendation was approved: Sanitary Sewer: The entire cost of the sanitary sewer extension to be borne by Lots 2,3, and 4 on a front footage basis. Watermain Extension: The costs of i,ratermain installation to be borne by Lots 1, 2, 3 and 4 on a front footage basis. Street Grading & Surfacing: The entire costs of street grading and surfacing to be borne by Lots 1, 2, 3 and 4 on a front footage basis. The applications of - John L, Loftgaarden for a Master Electricians License nd an Electrical Contractors License were each read and upon motion by Schwanke; econd by Tingley, the licenses were granted, The application of Elvin E. Benike for a license to construct sidewalks, urb and gutter and driveway was read and upon motion by Whiting, second by Schwanke, he license was granted. The license bonds of John L. This construction is defined as 112 inches of intermediate bituminous surfacing". Alderman Tingley moved that the Game Haven Area Scouts be permitted to se the Mayo Civic Auditorium,at City expense, for their annual appreciation anquet on a date to be agreed upon by the Manager of the Auditorium and a represent- tive of the scouts. Alderman Whiting seconded the motion and all present voted in avor thereof. Upon motion by Anderson, second by Tingley, $199.99 was appropriated from he General Fund and ordered paid to Mayor McQuillan, to reimburse the Mayor's ontingent fund..
