There was no oni-' iesent•rwho wished to be heards President Smith stated'that this was the time and place set for a hearing on the proposed construction'of the following sanitary sewers: 1n Vinth Avenue Northwest from the north line of Center Street West to the center'of Second Street Northwest; In Ninth Street Northwest from Broadway Street. Ndrth and running west to the west line of the west alley in Block 23 in Northern Addition to the City of Rochester; In Second Avenue Northwest from Fifth Street'Northwest to the center of Sixth Street Northwest;. In Ninth Street Northeast from Second Avenue Northeast to the alley first east of Broadway; In Eighth Street Northwest from Broadway Street to a point 90 feet east of the east line of Second Avenue Northwest; In Second Street Southeast from Fifteenth Avenue Southeast to a point 100 feet east of the east line of Eleventh Avenue Southeast; .In Second Avenue Southeast from Fourth Street Southeast to a point 60 feet south of the south line of Alley running east and west through Block 85; In Eighth Avenue Northwest from the center of Third Street Northwest to a point 66 feet north of the north line of Second Street Northwests and asked if there was,any one present who wished to be heard in regard to either or any of them. c c c Herman Kruse`, F: W: Brown and Charles Alexander opposed the construction of a sanitary' sewer in Second Avenue Southeast, while Frank Chute and Mrs: Oscar H. Be it further resolved: That the City`Eagiaeer of said City be and he is hereby directed to prepare and file in the office of rthe City Clerk of said City detailed plans, profiles and specifications.for said improvement as herein set forth and to make and report to said Common Council an estimate of the cost and expense of said improvement: Motion by Schroeder second by Witzke that said resolution be adopted as read: Roll Call: Ayes:,Case, Schroeder, Rommel, Miner, Olson, Witzke. Nays: Nonei President Smith declared said resolution passed and adopted. Henry 0. Christensen was before the Common Council as an attorney.for the :parties concerned in the'matter of a settlement of the compensation due, under state laws, to the minor children of the late Nels Madsen, and motion by Case second by Olson carried that the`matter be referred to the City Attorney. H. E-. Swanson; Superintendent of the Electric Light Plant, stated -the con- ' ditions under which Nels Madsen was supposed to have received the injury which caused his death; he explaining that it must have been caused by static current set up in the telephone line to'the hydroelectric power station by the break in the transmis- sion lines occasioned by a squirrel climbing onto them and forming a short circuit which burned them off. i Mr: Swanson further stated that when the body of Nels Madsen was found there f was no evidence that death had been caused by electric shock conveyed through metall- ic contacts as that would have left burns upon the body and that such could not have i been the cause as he himself used the telephone to the hydro -electric plant within i ten minutes after the body was found; and that upon those conditions the supposition !� was formed that Nels Madsen came 'tot hi-s death by the effects, upon a weak heart, of i the static current, above mentioned•-' The City Attorney, reporting .fin -the matter of the compensation above men- tioned, stated that the City is liable under state law, assuming that the employee died from injury received while on duty, and motion by Case second by Olson carried _ r that the said report be adoepted: • ' rP u .y"; t i . Colburn of Jarretts, Minnesota; submitted a claim for $2887aOO which he considered as being due him'• as the result of being,unable to operate his mill on the • Zumbro River:;during the'morit$s •of- December, 19199 January, 1920, February,,1920 and fifteen days in-March,,-1920, which.he claimed was owing -to a 'condition inhis reservoir 'and''flume brought about by the operation -of the .Hydro -Electric Plant,of= the;,City of Rochester, Minn- esota, and in connection wit4 the same.made-an offer -that the: City ,of Roch- ester purchase all his rights and property consisting•of.a mill, equipment for -same, fifteen acres .of land .and a_ residence for,.the sum of Ten Thousand Dollars, or to deduct, Two Thousand Dollars. from said -amount providing ,the residence was not taken. Motion by Case second by Miner ;carried that the Colburn matter be referred to the City Attorney and the City Engineer for further investiga- tion ` Alderman Schroeder, as Chairman of the License Committee, recom- mended that M. E. McClay be granted•a driver's license and that A. O. Ensrud be granted a taxi license, and motion by Miner second'by Case carried that the said recommendations be decepted`and that the said licenses be granted, by all voting in favor thereof, except Alderman Vitzke who voted, "Nay". State .Board of ..HeI :j' ,shows conditions to .be satisfactory from a sanit- ary point of view: Evidences'of contamination were not founds The Division of Sanitation was also requested to make an investigation of the 'river below 'the' ,city,t with 'reference -to .sewage contemination6 This was done Aug. 4,, - and the report just 'received, MIndicates that, the river Prater between a point just below the State-Hospitaf sewer outlet an& a point 5 miles below the sewer outlets was -found to be "approaching.an;•unsatiAfaetory condition": At the City Poorer Dam the river again is normal, indicating that the sewage grossly contaminates the river as far d,awn,'as'-& point''about"-6•miles`ibelow'-the sewer 'outlets, but beyond that conditions quickly become normal# ` This analysis-•was,made,F,,during very low stage of the river& It- ,is. the," opinion. of- the State Board of Health' that "the growing population of Rochester will tend to aggravate conditions which will reach a critical stage in the future, and wily require•corrective measuress" In other words, the contamination just below the city"during low water is very great and might constitute a nuisance: W.
