Motion by 'Case' second by Witzke carried that the*minutes .of the meetings held on October 4th, 1920, October 6th;:1920 and October llth, 19209 be each approved: Austin A. Kennedy and J. 'E* McGovern, as members of ,the Civic and Commerce Association Committee on Agriculture and Good Roads, both -talked before the Common Council in regard to including the sum of Five Thousand Dollars in the 1920 tax levy to be used on the mai3&tenan,ce of'the maid approaches to the City. r H. A. JobYson, as a member of the Park Band Committee, requested t that the 1920 tax levy include a one -quarter or one --fifth mill tax on the taxable valuation to be used for furnishing musical entertainment within -said City. W. T. Churchill, as a director of the Public Library, requested that Five Thousand Dollars be included in the 1920..tax levy for the purpose " of creating a fund for the construction of an addition to the Public Library building and that an additional Six Hundred Dollare'should be added to the 1920 tax levy for the'Library Funds Doctor We F: Bleifuss, as Acting Health Officer, stated that as the basement of the Co F. Massey Company's store is not now available for use as a Public Comfort Station, as it has been taken over for other purposes I that the Civic and Commerce Association Committee on said matter have held L�* T another meeting and now suggest that a Public Comfort Station be built as an addition to the City Hall, as it would be possible to use one of the walls, r� and heat could be furnished from the City Hall plant; it being estimated rr that the proper sort of a building and equipment could be secured for about $5000600, and requested that that amount be included in the 1920 tax levy S - for that purposes 5't Paul H. J. Kruse, another member of the said Committee, estimated that the cost of this building and equipment -would be in the neighborhood of $160, 000:00a A salesman for the King Motor Auxiliary Fuel Mixer, requested that he be granted a license authorizing the demonstration and sale of his appliance upon the streets of said.City, and because of the opposition of members of the Common Council to the granting of such.a permit, he wastinstrueted to rent a building or a vacant lot for .such' pVpose, in which ;case he. would not be required to take out a license. Motion by Miner second by Witzke carried that the Chief of Police be in- structed to cause the, automobile which is- parked -at the intersection of Broadway Street South and First, Street Southeast, and used for the purpose of demonstrating spark plug intensifiers,;- to be moved from that location at once. Motion by -Miner. -second by Olson carried that taxi licenses Nos..20, 21 and 22 for -the currec-t license, -year,' -'heretofore transferred from Domaille and Garrison to J. Garrison be now transferred to Charles E. Postiers President Pro tem,,Schrbeder-stated that this was the time and place set for a hearing on the proposed construction of a sanitary sewer in Tenth Avenue Southeast from'the.center-of;Fourth Street Southeast to the center of Sixth Street Southeast, and asked'if there was - any one present who wished to be heard in regard to the said sanitary sewer. Co E. Thomas' stated, 'because of the fact that water mains are only laid between Fourth Street Southeast and Fifth Street Southeast, that he thought it would be satisfactory to'the`property owners concerned that this sanitary sewer be con- structed only between Fourth Street Southeast and Fifth Street Southeast, at which he was advised that the'specifications for this sewer will include a 14 inch galvan- iied water"pipe to be laid betwden Fifth Street Southeast and Sixth Street Southeast: There was no other person present who wished to be heard in regard to the +said sanitary sewer: " President Pro tem Schroeder stated that this was the time and Place set for a hearing on the proposed -opening of a. public street which is described as follows, and asked aif there was` any one present who wished to be heard in regard to the same: Beginning "at`the`Southeast corner of Lot Ten (10) in Block Nine (9) in East, Rochester `Addition to the' City off' Rochester, Olmsted 'County, Minnesota, for place of beginning and running ,thence north along the east line of Lots Ten (I:0) and Eleven (11)`in said block to the northeast corner"of said Lot Eleven (11) and running thence west along the north 11Ae of said Lot Eleven (11), a distance of thirty (30) feet, running thence'in a straight. line Southeasterly to place of beginning. President Pro tem Schroeder r declared the said resolution passed and adopted® The City Engineer submitted plans, specifications and estimate of cost for t the construction of a sanitary sewer on Tenth Avenue Southeast from the center of Fourth Street Southeast to the center of Sixth Street Southeast, which were considered by the Common Councils AldermanOls6n introduced the following resolution -which was read: 9 Whereas, the Common Council of the City of Rochester, at a meeting thereof, duly held on October 18th, 1920, after due notice given and hearing had as provided by law, did duly pass and adopt a resolution ordering that the following sewer be con- structed in the following named avenue in the City of Rochester; That a sanitary sewer be constructed in Tenth'Avenue Southeast from the center of Fourth Street Southeast to the,center of Sixth Street Southeast; and in said resolution directed the City-L'ngineer of said city to prepare and file in the a ' office of the City Clerk. of said city detailed plans, profiles and specifications for said improvements and�to'report to said Common Council an estimate of the costs and expense of said improvements; -and said City Engineer, pursuant to said directions, did; on the 18th day of 0etob4r, "1920, duly 'fil:e in the office of said City Clerk s:7 A 292 M . rt �r s v Y 1b y� T - / t detailed plans, profiles and -specifications-for-the said improvements and did report to the said , Common Council- an estimate ,.of.. the cost -and expense of said improvements; r Therefore, Be it and it is hereby resolved by the said Common Council of said City of Rophoster:. _ That the plans, profiles and specifications for the improvements above described so filed in the office of the City Clerk by the City engineer as pfores&id, be and the same are hereby adopted as the placid, profiles and t specifications for the said improvements and.each of them; and that the estimate of the cost and expense of each said improvement reported to said z, Common Council.be and the same is hereby accepted and ordered filed in the office pf the City Clerk. Be it further resolved by said Common Council: That the whole cost and expense of constructing of said sewer in said part of said avenue, above mentioned, in the,manner above mentioned, according to the plans, profiles and specifications for the same on file in the office of the City Clerk, shall be assessed against each lot, piece and parcel of land benefited by each said_improvement,.respect ively, to -wit: Against each lot, piece and parcel of land abutting upon each said-improve- ent, without regard to the cash valuation of said lands, ratably_and•in ropottinn to the special benefits conferred upon each said lot, piece and excel of land by the said improvements Be it further resolved by said Common Council: That a meeting of said Common Council will be held at 2 o'clock P.Ma on November 1st, 1920, at the Council Chambers in the City Hall in said City, at which meeting all persons interested in said improvements above lescribed may appear and be heard before said Common Council in relation to the said improvements, or to the mode of the assessment for the cost and v, �xpense thereof, or any other matter or objection relating to said improve- r ents, or any of them,,. upon which they may desire to be heard6 TheCityClerk is hereby directed to prepare lists which shall contain a description of each and all of the properties abutting upon each f the said improvements and the named' of owners of said properties so far s the same are known., which lists, together with a notice of the time and lace of the meeting -and, hearing, above mentioned, he shall cause to be pub- ished once in the official paper of said City, at least ten. days• prior to he date of the said meeting and hearing: Be it further resolved by said Common Council:- . ..
