That the water is backed up in the said brook to great depth and great width and where the said road first crosses said brook going north said highway is flooded for ,over eighty rods at depths varying up to fifteen feet of water; That one of said bridges was flooded and the other -*as washed out by reason of the ,acts of said defendant hereinafter more specifically set out. That the said defendant proceeded to place an old bridge over the said Trout Brook and at.a great height to be above the flowage of their back water one hundred fifty feet long, which bridge material was from old bridge which had been in existence and use over thirty years, when tore down and placed at this point?
